Children are a mandate from God Almighty which in them laid a dignity as human beings. Children need protection against negative effects of a fast-growing developmnet. This essay is trying to discuss about how’s the implementation of the law of SPPA and the Government of Indonesia’s efforts in protecting children especially those who are conflicted with the law in accordance to The Law number 11 Year 2012. The method applied in this essay is qualitative socio-legal approach, based on the library data. In the investigation process, prosecution until the proceedings, there still be diversion process Is ultimately enforced considering the children’s age and the penalties are not over than 7 years. If this diversion process is not applicable then the judicial process is becoming ultimum remedium, putting the children in LPAS, LPAK and LPKS. Those institutions are expected to give new hopes to children who’s dealing with the legal matters. Through the approching system in Juvenile Criminal Court Process from investigators, prosecutors, judges, advocates to the public counselor, both the Ministry of Law and Human Rights and the Social Ministry, it is necessary to establish a clear coordination and role in implementing the Juvenile Criminal Court System.

Industrial revolution has substantially changed the economy and society. The fusion of technologies and information marked the fourth industrial revolution which brings about new challenges relating to protection of intellectual property, including copyrights. With regard to this, there has been several changes in the law relating to copyrights in Indonesia. The nature of copyright infringement has been changed from ordinary offense to complaint-based offense. This fundamental change undoubtedly affects the enforcement of the copyright law in Indonesia. Thus this paper aims to answer and review the legal reasoning behind the shift in offense in Copyright Law in Indonesia. This normative legal research employed a descriptive-analytic method. The result shows that the complaint-based offense is suitable in copyright protection considering that only the copyright owner knows the details of the object of the creation.

Case of domestic violence had increased every year, this is caused by people have a paradigm that domestic violence is privat domain. Even though, domestic violence be regulated by domestic violence elimination Act number 23 in 2004, but the victim often don’t recognize justice. Customary law community or Masyarakat Hukum Adat (MHA) in Indonesia has their own uniqueness and peculiarity in establishing relationships with the people and the surrounding environment. Along with the development of the era, the MHA experienced the complexity of the conflict of interest on the land tenure for business purposes or Hak Guna Usaha in the civil sphere, as well as conflicts within the scope of criminal law. The research analyzes legal indigenous communities’ position in the protection of normative law. The method used is normative or doctrinal law research that leans to a qualitative (non-numeric) based on secondary data which is analyzed qualitatively. Recognition and protection of the MHA in Indonesia is experiencing an uneasy phase. Since the independence of Indonesia the existence of MHA has only received adequate portions in the era of reformation with the Amendment of the Constitution 1945, enshrined in the Article 18b Paragraph 2 and Article 28i Paragraph 3, eight laws, and at least 22 (twenty two) regulations of the region either in the province, or regency/city, or decree of the local head of the area that recognizes the existence of the Communities. Nevertheless, the upper position of the MHA is felt not to provide maximum assurance and protection forthe Communities. The Indonesian House of Representatives (DPR) through the right of initiative encourages the draft law on MHA which currently becomes a national legislation program and become a priority in 2020 in providing recognition, protection, and empowerment of MHA. With the initiatives of the Bill, it is expected that the problems experienced by indigenous peoples are reduced drastically.

The study aims at knowing the judicial power in legal reform perspective. In principle the rule of law, all public policy and election of public officials must be based on the rule of law. To realize the principle of supremacy of law, then one major factor is the presence of the judiciary is the embodiment of judicial power is independent, and authoritative. Law enforcement can not be regarded merely as a process of applying the law, however, has a broader dimension especially with regard to the dimensions of human behavior. The legal problems that will always stand out is the problem of “law in action” and not “law in the books”. The judge is not only a spokesman for the law, but even further is the spokesman for law and justice. This means that the judiciaryfunction as an institution that is able to translate the law in concrete when dealing with written legal norms/laws, and even be able to find the law, when a legal vacuum. In this perspective the judiciary can function as a locomotive of legal reform, if the judiciary can run freely and independently, and adhering to the principlesof justice and expediency.

Carl Schmitt was an anti-liberal conservative jurist during the Weimar Republic in Germany whose position on emergency powers sponsors a hardline form of ‘realism’. To restore peace and order qua the homogeneity of the people in times of crises, he sponsors the role of the sovereign in deciding on an extreme emergency even by transgressing the wordings of a written constitution. However, this article seeks to use the case of the Thai government’s response to Covid-19 through the invocation of emergency powers to expose deficiencies pertaining to the Schmittian model. Rather than calling for the politics of exclusion, the present outbreak of Covid-19 in Thailand reiterates the essence of legality and communitarian and social solidarity.

Problems of neutrality of civil servants will always occur when the meaning of neutrality is not in sync with the norms. In order to evaluate governance, the meaning of neutrality should be broader and more functional towards the legal relationship in the context of public official relation in the field of civil servants law. Substantially, the focus of Law Number 5 Year 2014 concerning Civil State Apparatus just make civil servants as an object of neutrality, regardless of the dynamic activity of practical politic intervention. It should be underlined that the role of civil servants in government always correlate with many interested parties. If neutrality is not matched by standard criteria and restrictions, it is very possible neutrality principle only be a slogan with minimum implementation.

Tujuan penelitian ini adalah untuk mengidentifikasi dan mengevaluasi berbagai bentuk kebijakan pemerintah daerah serta mengevaluasi kondisi eksisting berbagai program TJSP di DIY dan Provinsi Jawa Tengah yang telah dilaksanakan. Untuk menjawab tujuan tersebut, maka metode yang digunakan adalah Pada tahun pertama, penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan pendekatan perundang undangan (statute approach) (Marzuki, 2005: 137-139); dan penelitian yuridis empiris (sosiologis). yaitu mengkaji dan mengevaluasiberbagai bentuk kebijakan daerah serta program pelaksanaan TJSP di Daerah Istimewa Yogyakarta dan Provinsi Jawa Tengah. Berdasarkan hasil dan pembahasan dapat disimpulkan bahwa: Pertama, Kebijakan TJSP oleh pemerintah daerah terutama di DIY dan Jatenag secara umum masih sangat lemah, dimana untuk DIY dalam bentuk Peraturan Gubernur sedangkan Jawa Tengah menggunakan Surat Keputusan Gubernur. Kedua, untuk Program TJSP yang dilakukan oleh perusahaan selama ini belum mengetahui kalau pemerintah telah mengeluarkan kebijakan TJSP. Sehingga perusahaan dalam melakukan TJSP selama ini hanya sebatas inisiatif sendiri dan walapun secara tidak langsung sudah bekerjasama dengan pemerintah dalam melaksanakan TJSP. Perusahaan secara umum akan mendukung kebijakan Daerah mengenai TJSP dalam bentuk Perda. Namun ketentuannya harus mempertimbangkan kepentingan situasi dan kondisi yang dihadapai perusahaan.

This research aims to investigate and identify the empowerment of consumer rights on drug information. Research questions focused on how the role of the Food and Drug Supervisory Agency (BPOM) and pharmacists in the empowering consumers on drug information. Research indicates very important information for consumers in taking the medication. Basic settings need to be protected and fulfilled people the right to information is the Constitution of the Republic of Indonesia in 1945 under Article 28F, Articles 7 and 8 of Law No. 36 of 2009 on, and Article 4 of Law No. 8 of 1999 on Consumer Protection Act. Implementing rules and derivatives can be found in the Decree of the Minister of Health No. 1197 / Minister of Health / SK / X / 2004 on Standards of Pharmaceutical Services in Hospitals and Organizational Rules Number 004 / PP.IAI / 1418 / VII / 2014 about the Organization Regulations Concerning Guidelines for Discipline Pharmacist Indonesia Chapter IV. The right to information is also related to the basic rights of Human Rights.The conclusions showed that the agency’s role in empowering consumers POM top right drug information is by monitoring the promotion / advertising and labeling of drugs, Communication, Information, Education and Communication (IEC) and formed a Consumer Complaints Service Unit. While the pharmacist’s role on the self medication drug at the pharmacy and hospital pharmacists, by providing information, counseling, promotion and education.

Issue of dismissal is closely related to human rights and economics. The regulating must consider both aspects. This paper explores how the economics perspective and human rights perspective on the issue. On the economics perspective, although the neoclassical economics theory and the theory of new institutional economics have a difference in perspective on the issue, whether or not it stipulated by legislation, but both have a common view that the dismissal should not affect the company's productivity and efficiency. Meanwhile, on the human rights perspective, the worker is entitled to a fair dismissal.
