Abstract

Dibentuknya Otoritas Jasa Keuangan (OJK) guna mengantisipasi kompleksitas sistem keuangan global dari ancaman krisis. Pembentukan OJK dilandasi motivasi yang baik yaitu untuk meningkatkan kualitas pengawasan lembaga Keuangan secara terintegrasi, antara lain : Lembaga Perbankan, Pasar Modal, Dana Pensiun dan Lembaga Keuangan Non Bank. Kehadiran OJK dalam perkembangan sektor keuangan di Indonesia diharapkan dapat membantu lancarnya kegiatan lembaga-lembaga jasa keuangan, sehingga pengaturan terhadap kegiatan jasa keuangan dapat terlaksana dengan baik, dan pada akhirnya memberikan dampak yang positif bagi perkembangan perekonomian di Indonesia pada umumnya. Sementara Bank Indonesia sebagai Bank Sentral hanya berperan sebagai regulator kebijakan moneter untuk menjaga stabilitas moneter.Permasalahan dalam penelitian ini adalah : Bagaimanakah hubungan hukum antara Otoritas Jasa Keuangan (OJK) dengan Bank Indonesia sebagai Bank Sentral di Indonesia?. Pendekatan penelitian yang digunakan dengan menggunakan pendekatan yuridis normatif dan pendekatan empiris. Selanjutnya data yang digunakan Data Sekunder dan Data Primer, kemudian data tersebut diolah dan dianalisis secara yuridis kualitatif yaitu mendeskripsikan permasalahan berdasarkan penelitian dan pembahasan dalam bentuk penjelasan atau uraian kalimat demi kalimat yang disusun secara sistematis, selanjutnya ditarik kesimpulan secara deduktif untuk menjawab permasalahan penelitian.Kesimpulan penelitian ini adalah berdasarkan ketentuan Pasal 69 ayat (1) huruf (a) UU No. 21 Tahun 2011 menegaskan bahwa tugas Bank Indonesia dalam mengatur dan mengawasi bank yang dialihkan ke OJK adalah tugas pengaturan dan pengawasan yang berkaitan dengan microprudential, sedangkan Bank Indonesia tetap memiliki tugas pengaturan perbankan terkait macroprudential.  Berkaitan dengan hal tersebut, tugas pengaturan perbankan tidak sepenuhnya dilaksanakan secara independen oleh OJK, karena pengaturan microprudential dan macroprudential akan sangat berkaitan.  Kata Kunci : Hubungan Hukum; Bank Indonesia dan Otoritas Jasa Keuangan

Abstract

Direction of criminal justice in Indonesia is currently experiencing a shift from retributive to restorative-rehabilitative or daad-dader-strafrecht or model of balance of interests. This is confirmed by Laws No. 11 of 2012 on Juvenile Justice System, which states in Article 6 to Article 8 that emphasizes the concept of restorative justice through diversion. Both of these concepts allow the settlement of children out of the criminal justice. However, not all criminal offenses committed by children can be settled out of court (diversion) unless two conditions are met: imprisonment for a criminal offense under seven years and is not a repetition of criminal offenses (recidivism). The essences of restorative justice are: First, in the settlement of children, it is necessary that the offenders and their families and victims and their families can sit together to discuss the settlement of issues including reparations to victims (restitution in integrum). Second, the essence of restorative justice is to give punishment to the offenders but the punishment is didactic, in order to benefit to both of the perpetrator and the victims.  This is in line with an adagio “delinquens per iram provocatus puniri debet mitius”. Third, regulation of a quo using two approaches: i.e. victims and offenders mediation approaches as implemented in North America as well as approach that emphasizes restitution and reparation (court based restitutive and reparative measure), as practiced in the United Kingdom

Abstract

This study was aimed  to  reform some of  regulations of  the commercial code  in  shipping which are no  longer adequate  in  the  present development.  The main  issues  of  the  study  are:  (1)  How  is  the  development  of commercial  code  in  regulating  shipping matter  in  Indonesia?;  (2) Which  regulations of  the commercial  code are  necessarily  to  be  reviewed  to  guarantee  the  legal  protection  of  consumers?;  (3) How  is  the practice  of commercial code in Malaysia as a comparison in regulating the port in Indonesia?. The study uses the traditions of  normative  legal  research.  Legal materials  are  collected  by  studying  document  both  the  primary  legalmaterials and secondary  legal materials. Legal materials are analyzed by both of  themes  and content analysis. The analysis of  the  theme  is focused on  topics of commercial code  that needs  to be  reviewed. On the other hand,  the content analysis  is aimed  to  the contents of the  legal provisions of  the commercial code which are no longer appropriate , and it needs to be replaced by the new ones. The results of the study shows that there are some commercial code  regulations that need  to be reviewed namely: (1)  It relates to  the definition of the contract and  the parties  involved in  the making of  the contract;  (2)  It  is necessary to determine  the  limits of liability and responsibility of the carrier, and the protection of shippers (customers); (3) From the results of the comparative  studies  at  the  Port  Klang Malaysia demonstrate  that  normatively  Indonesia  is not  left behind  in terms of regulating commercial Code. It demonstrates that in practice Indonesia has imposed the Hage Visby Rules  1968,  although  Indonesia has  not  yet  ratified  it. On  the other hand, Malaysia  still  imposes  the Hague Rule 1924. The facts prove  that PortKlang  in Malaysia  is more advanced  than the ports  in  Indonesia  in terms of infrastructure availability. Portklang engagesin 13th rank among ports in the world, while the ports in Indonesia are not  included  in  the world rank.

Abstract

Information delivered by the medical professionals to the patients in their initial communication is crucial in establishing the therapeutic contract (transaction). Based on that information, the patient will decide whether to accept or to refuse the proposed medical treatment. This paper discusses the philosophical basis of the Informed Consent, Informed Refusal and the documentation of medical information into Medical Record. This normative legal research is carried out by library-based study on primary and secondary legal materials. Besides descriptive-analytical approach, the study also employs comparative approach. The comparison is made between continental legal system, common law system, and the Islamic legal system. It is found that philosophical basis of informed consent, informed refusal and documentation of medical information into medical record is basically to protect the patients’ dignity and to maintain their trust and cooperation. Furthermore, from the Islamic perspective the establishment of informed consent is to respect the privacy to blood, property, and family. In addition, the documentation of medical information into the medical record is to give legal protection in the form of strong evidence both for the health providers and health receivers in the event of a medical dispute.

Abstract

The study examines the political response to the crime of fisheries law, where criminal offenses prevention fishery does not operate effectively so that the results can only be overcome small fishermen. The research method uses juridical normative and empirical research sites in Lampung Province. The results showed that the politics of law including the formulation of policy or legislation making, policy application and execution or implementation of the legislation and enforcement of criminal law. Legislation on fisheries contained in the Fisheries Act has adequate set of law enforcement against criminal acts fishery, but there are obstacles in the application and execution stages, such as barriers in terms of law enforcement, infrastructure and public awareness.

Abstract

Correctional facility has duty and strategic function in implementing the imprisonment and nurturing the inmates. The existing regulations are unble to solve the problems within the correctional system. The purpose of this study is to find out better solution with regard to the nurturing process of the inmates. This study employs doctrinal or normative approach. It is found that many inmates involve in criminal activities during the nurturing process. Furthermore, the inmates often become recidivists either by repeating the previous crime or conducting the new one. These facts show that the application of the existing regulations fail to change the inmates’ behavior. Self-conscience of the inmates is a determinant factor and therefore, psychological approach needs to be incorporated in the nurturing process. This can be done especially by providing psychotherapy for the inmates

Abstract

This research aimed to analyze about Interpretation Forms village-owned enterprises According to Law No. 6 of 2014 About the Village. To answer the legal issues mentioned above, the type of research conducted by the researchers are using a normative juridical research, by using the approach the statute approach and conceptual approach. From the analysis of Law No. 6 of 2014 About the village and its implementing regulations, it was concluded that the establishment of village-owned enterprises, the Government does not impose the form of a particular enterprise, this is an effort to grow the rural economy naturally through a form of business entity characterized by village, Rule further that in terms of business activities can run and well developed, it was possible at the time village-owned enterprises follow legal entities established in the provisions of the legislation, here the researchers interpret of legislation, that the legal entity in question is Village Public Company. Additionally village-owned enterprises can consist of business units that are legal entities which may be institutions whose business is derived from its ownership village-owned enterprises and communities.

Abstract

Unlike traditional sports that relies on traditional television broadcasting, esports usually adopts live streaming on internet platforms, such as YouTube, as its medium.  Through a delicate design of profit sharing, live esports streaming and media have greatly changed the video game industry from sheer family entertainment machine makers into a new frontier of money making sport, and therefore the game players into a profession that may make billion dollars annually. This paper intends to introduce the current situation of esports in Indonesia, asserting the potential to collect tax from live game streamers (Content Creators) and YouTube (Platform), and players from this newly developed sports industry to broaden the tax base in Indonesia.  This research is a normative legal research. Data collected from books, journals, relevant laws and regulations. The results show that the government should either revise the current tax law and legal design that are obvious out-of-dated and dysfunctional or follow developed countries to have law specifically designed for taxing esports industry and e-economy.

Abstract

The existence of a lawsuit in court against the certificate is not a new thing anymore , given stelsel adopted in the system of land registration in Indonesia is negative stelsel positive tendency . If on the certificate that was sued earlier , based on court decisions that have permanent legal force ( inkracht van gewisjde ) should be revoked and canceled by the National Land Agency, but de facto the decision can not be implemented by the National Land Agency with some particular reason , then this is where the role of National Pertanahann Agency to be able to realize the judgment which can not be implemented as Non - Executable decision. In this study will answer perrmasalahan , namely : Why is the National Land Agency wants the Indonesian Supreme Court Decision 158 / PK / TUN / 2011 on Cancellation of Certificate Broking No. 132 on behalf of PT . TOP As the verdict of Non - Executable ?, How the National Land Agency Role In Delivering the Indonesian Supreme Court Decision 158 / PK / TUN / 2011 As a verdict of Non - Executable ? How Legal Certainty The winner of the Indonesian Supreme Court Decision 158 / PK / TUN / 2011 and the Justice and Legal Protection against the owner of Certificate Broking No. 132 Certificate of derivatives and their owners ? To address this problem used approach Legislation , Case Approach , Conceptual Approach , Approach Sociology of Law and Political Law. Based on the survey results revealed that : First , there are two main reasons why the National Land Agency wants the Supreme Court Decision No. 158 / PK / TUN / 2011 as Non - Executable ruling that reasons are normative juridical considerations and Juridical Technical . Pertimbangann normative juridical reason is that the decision of cancellation of the Certificate Broking No. 132 on behalf of PT . TOP is overdue / expired / verjaring , Ultra Petita and filed by the plaintiffs who do not have other interests and there is a decision in the administrative court ruling that the criminal verdict. While consideration juridical reason partly because the decision concerning civil rights and legal justice for the hundreds of people or communities certificate owner derivative or fragment of a Certificate of Right to Building No. 132 certificate as a parent, but it also relates to issues of Local Government Assets and Money State. Second, the role of the National Land Agency in realizing the Supreme Court Decision No. 158 / PK / TUN / 2001 to a decision of Non-Executable is a way to initiate a peace between the parties that the winning parties and the ruling party Certificate holder Broking No. 132 as a party that has been lost. The essence of peace is how the BPN role in creating the conditions that the parties who won the verdict, his rights can still be given, while for the owner of Certificate Broking No. 132 does not need to be canceled. Then after a peace between the parties earlier, the peace agreement must be drawn up in an authentic deed in this case the notarial deed, then a notary deed are then registered to Class I Palembang District Court to get the verdict determination of Non-Executable. Third, the Rule of Law which can be given to the winner of the verdict is that they can still get their rights as they are demanded in the lawsuit, while the owner of Certificate Broking No. 132 does not need to be done for cancellation as a command decision, so that the legal protection and legal justice for the hundreds of citizens derivative of the certificate holder Certificate nno Broking. 132 can still be given. In this study is recommended in order to be reviewed and revised the regulatory legislation has tended to impose to government officials to have to melaksanaka command decision that has ikracht, while there has not yet been set on the criteria that can be used as a benchmark as the ruling Non -Executable as well as an alternative solution, so there will be a legal umbrella for state administration officials were not able to carry out a court decision that has inkracht due to constraints of both factors normative juridical and technical factors. Especially for the internal BPN, it is recommended that in the Minister Substitute Regulation of the National Land Agency No. 3 of 2011 which is currently being created in the Ministry of Agricultural and Spatial / BPN RI put special rules regarding the decision of non-executable and its completion, resulting in the implementation later, this rule can be used as a benchmark by all officials BPN RI in the face of problematic decision of non-executable.

Abstract

The existence of the Geographical Indication (GI) was estabilished at the same time as the TRIPs Agreement in 1994. In the TRIPs Agreement, GI is Intellectual Property Rights (hereafter IPR) regime that is typical of sui generis due to its distinctive features. It is reflected in the elements that are in the definition of GI. Basically, GI has set the use of Geographical names to recognise an object. Previously, the IPR regime had also set them, namely: Indication of Source (IS) and Apellation of Origin (AO), that were set in the Paris Convention in 1883, Madrid Agreement in 1891, and the Lisbon Agreement in 1958. Instead, the geographical names are also used as brands. The paper is a theoretical study towards two problems. First, the elements that become the characteristics of GI so that it is typical of sui generis. Second, the similiarities and the differences amongst GI and IS, AO and other trademarks. The findings of the study reveal that GI is typical of sui generis, reflected in the elements that are in the GI definition as it has already been agreed upon in the TRIPs Agreement. There are similiarities amongst GI and AS, AO and other trademarks, namely they can use the geographical names as a label on objects. Meanwhile, the differences are in the elements themselves. IS has the simplest element, followed by GI and the trademark is in ownership system that is individual in the trademark and communal in GI.
