Abstract

Problems of neutrality of civil servants will always occur when the meaning of neutrality  is not in sync with the norms. In order to evaluate governance, the meaning of neutrality should be broader and more functional towards the legal relationship in the context of public official relation in the field of civil servants law. Substantially, the focus of Law Number 5 Year 2014 concerning Civil State Apparatus just make civil servants as an object of neutrality, regardless of the dynamic activity of practical politic intervention. It should be underlined that the role of civil servants in government always correlate with many interested parties. If neutrality is not matched by standard criteria and restrictions, it is very possible neutrality principle only be a slogan with minimum implementation.

Abstract

AbstrakPenelitian tentang kebijakan netralitas politik Pegawai Negeri Sipil (PNS) dalam pemilukada ini dimaksudkan untuk mengevaluasi kebijakan dalam rangka mengantisipasi keterlibatan PNS dalam aktivitas politik praktis maupun menunjang aktivitas politik praktis, khususnya dalam pelaksanaan pemilukada di wilayah Jawa Tengah. Pendekatan yang digunakan dalam penelitian ini bukan hanya pendekatan doctrinal, tetapi juga penelitian terhadap hukum sebagai law in action yang non-doktrinal. Subyek penelitiannya adalah KPU Provinsi Jawa Tengah, Bawaslu Provinsi Jawa Tengah, Panwalsu, KPUD, dan BKD di Kabupaten Banyumas, Purbalingga, Semarang, Solo, dan Karanganyar. Berdasarkan hasil penelitian, diketahui bahwa sumber masalah dalam penerapan netralitas PNS adalah lemahnya fungsi koordinasi dan penerapan sanksi. Hal ini didasarkan pada permasalahan substansi yang bias dalam menempatkan netralitas PNS sebagai objek hukum. Hasilnya, terciptalah kebijakan yang sifatnya sektoral yang tidak dapat menuntaskan permasalahan, baik dari unsur kelembagaan, ketatalaksanaan, maupun penegakan hukumnya.Kata kunci: netralitas politik, Pegawai Negeri Sipil (PNS), pemilukada, partai politik, politik praktis.  Policy on Political Neutrality of Civil Servants in Regional ElectionAbstractThis research on the political neutrality policy for civil servants in the regional election has the intention to evaluate the policy in order to anticipate the involvement of civil servants in political activities, especially in the Regional Election of Central Java. In this regard, the approach used by this study is not only doctrinal, but also the study of law in action as non-doctrinal. The subjects of this research are KPU of Central Java Province, Bawaslu of Central Java Province, Election Supervisory Committee, the Election Commission and BKD in Banyumas, Purbalingga, Semarang, Solo, and Karanganyar. The research found that the identified source of problem is the weak function of coordination and implementation of sanctions. The problem is due to the biased legal substance which confines the neutrality of civil servants as an object of law. Abstract

The legal system which is adopted and applied in Indonesia was based on the formation from the founding fathers which is adjusted to the condition and the spirit of Indonesia as a nation known for its legal system as Pancasila. Ideally, Pancasila serves as the philosophy for the nation of Indonesia, as state's ideology and as the basis of the state. However, in reality, vertical conflicts (government and society) and horizontal conflict (inter-society) have created a variety of concerns, in which the sense of nationalism and diversity has diminished. The trigger is because Pancasila can only be understood as the ideology and the basis of the state, without saturating the meaning contained therein. The paradigm development of Pancasila based on legal state should demand the development of a democratic constitutional state, which juxtaposes the principles of a rule-of-law (nomocracy) with harmonious and complementary principles of the sovereignty of the people (democracy). This role can be solved by the Constitutional Court to harmonize the ideology of Pancasila in the Indonesia legal substance. When the legal development is integrated into meaning, the legal development which characterized by Pancasila can be realized to resolve the variety of community conflicts.

Abstract

Badan Penyelenggara Jaminan Sosial (BPJS) berlaku pada tahun 2014, namun sampai saat ini masih banyak pemberi kerja dan pekerja yang kurang paham dengan program yang diselenggarakan BPJS Kesehatan, dan penerapannya masih belum dikategorikan optimal. Hal yang menarik dianalisis adalah Pertama, bentuk perlindungan pekerja dalam program Jaminan Kesehatan Nasional (JKN) dan Kedua, persoalan dalam penerapannya. Tulisan ini menggunakan jenis penelitian Yuridis Normatif dengan pendekatan perundang-undangan dan pendekatan analisis serta dianalisis secara normatif kualitatif. Dalam tulisan ini diketahui terdapat perubahan dari program Jaminan Sosial Tenaga Kerja (Jamsostek) ke BPJS kesehatan yang berimplikasi penerapan jaminan dan pelayanan kesehatan bagi pekerja. BPJS membuat prosedur yang dapat meningkatkan keterjangkauan peserta pekerja terhadap pelayanan kesehatan secara berjenjang dari fasilitas pelayanan Kesehatan (fasyankes) tingkat pertama ke  tingkat lanjut. Terlepas dari hal tersebut, terdapat beberapa persoalan hukum dalam penerapan program JKN meliputi persoalan dari aspek kepesertaan, penggunaan kartu kesehatan dan jaminan pelayanan kesehatan. Social Security Administrative Bodies (referred as BPJS) established in 2014, but until now there are still many employers and workers who are not aware of the programs held by BPJS Kesehatan, moreover the implementation was still not optimal. The problems studied were first, the form of worker protection in the National Health Insurance program and second, legal issues in its implementation. This manuscript used Normative Juridical research with statute approach, analytical approach and qualitative analysis method. In this manuscript, it known that there is a change from the Workers’ Social Security program to BPJS Kesehatan which has implications for the implementation of health insurance and services for workers. After the enactment of the BPJS Law, there are protection scheme for health insurance for both formal and informal workers. In addition, the BPJS provides a mechanism that can increase the affordability of workers to tiered health services from the first level to the advanced level. Meanwhile, there are several obstacles in the implementation of the Social Security program which include constraints on the aspects of participation, use of health cards and health service guarantees.

Abstract

 At this time, the implementation of neutrality for government employees are still use the legalistic approach. It doesn’t mean that this approach is problematic, but its not relevan when this approach is a self-implementing. That's why the policy is required by casuistry and situational approach, which means that the rule become the basis of law enforcement, while the case resolved by the consideration of the situation and the real reason that occur in the field. In this regard, the government should set standards, procedures and clear criteria against violations of neutrality as a basis for the imposition of penalties that are scalable and doesn’t have a double standard. Thats why its necessary to have institution that independent, objective and transparent. Keywords: Legal Policy, Neutrality, Law enforcement.

Abstract

In this reformation era, there were discourses on the recovery of the right to vote for members of the Indonesian National Army (TNI) and Indonesian National Police (Polri) in the General Election. The willingness of those recovery based on the development of democratization and human rights, that places the right to vote as a fundamental right that cannot be infringed by the state. The problem that arises are how the arrangement of the right to vote for the TNI and Polri in the Indonesian General Election when it viewed from the perspective of the political history and how the legal synchronization between the right to vote for TNI and Polri when it viewed from the conception of human rights in the context of a democratic society in Indonesia. Based on the results, it known that there are setback in the arrangement of the right to vote for armed forces and police in three periods. In old order, armed forces and police were given the right to vote in the election. In the new order, the Armed Forces were not entitled to vote, but the presence of armed forces in the realm of regulated political sphere in particular through the lifting mechanism in the legislature. While in reformation era, the right to vote and vote for members of the military and police were removed, so the military and police only carry out the state tasks without any political rights inherent in that institution. This indicates that the legal arrangements concerning the right to vote according to the perspective of human rights in the context of a democratic society is not yet in sync with each other.

Abstract

The legal protection to health care, especially for the poor directed to apply the principles of holistic, unity, evenly, acceptable and achievable. Therefore, this article is useful to explain the rules, policies and barriers that occur in its implementation. Based on the classification, there are 3 part in implementing legal protection and health services include arrangement of the essence of health development, funding and health service delivery. Policies that have been implemented in Banyumas includes a health card namelly jamkesmas, jamkesda, and jampersal. Abstract

The pattern of the authority relation between head of local government and Secretary of local government in the promotion of Civil Servants lead into two pattern which are sub-ordination and coordination. Normatively, the position of Secretary is subordinate from Head of local government. Meanwhile, the pattern of coordination is a tiered pattern that puts Secretary as officials who provide recommendations of official candidate to Head of local government as the Trustees of the Local Employment Officer.Both of these relation creates superior position of Head of local government in the terms of promotion of civil servants. To create a proportional authority relation, it necessary pre-requisite form of commitment, orientation of human resources and the use of technology. On that basis, a mechanism must be created to limit the authority of the Head of local government by strengthening the system of merit-based technology.Keywords : position, authority, promotion of civil servants
