Abstract

Distribution agreement that contains the agency agreement if the terms of law no.5, the year 1999 concering Prohibition of Monopolistic Practices and Unfair Business Competition can be categorized as a distribution agreement if the basic agreement between the parties is a purchase agreement so that he acts on his own name so that can have     the freedom to set prices of goods or services that have been bought.In practice in Indonesia,distribution agreement have a variety of different shapes and substances in accordance with the will of the parties,so that in determining whether the agreement included an agreement that made the distribution or agency agreement should be seen from the substance of the  agreement

Abstract

Industrial revolution has substantially changed the economy and society. The fusion of technologies and information marked the fourth industrial revolution which brings about new challenges relating to protection of intellectual property, including copyrights. With regard to this, there has been several changes in the law relating to copyrights in Indonesia. The nature of copyright infringement has been changed from ordinary offense to complaint-based offense. This fundamental change undoubtedly affects the enforcement of the copyright law in Indonesia. Thus this paper aims to answer and review the legal reasoning behind the shift in offense in Copyright Law in Indonesia. This normative legal research employed a descriptive-analytic method. The result shows that the complaint-based offense is suitable in copyright protection considering that only the copyright owner knows the details of the object of the creation.

Abstract

Penelitian ini bertujuan untuk mengetahui sejarah lahirnya BUMDes diIndonesia dalam sudut pandang politik hukum. Metode penelitian yang digunakandalam penelitian ini adalah metode penelitian normatif dimana hanya mengkajiperundangan-undangan dan norma-norma lain yang terkait. Hasil penelitian iniadalah BUMDes lahir dengan semangat politik dan konstitusional bahwa negaramelindungi dan memberdayakan desa menjadi kuat, maju, mandiri dalam rangkamenciptakan landasan yang kokoh dalam menciptakan pemerintahan desa denganpembangunan masyarakat menuju adil, makmur dan sejahtera. Adapun untuk mencapaisuatu kesejahteraan masyarakat desa melalui BUMDes, maka pertama-tamaharus dipahami BUMDes harus menghasilkan profits and benefits yang lebih mudahdikembangkan apabila berbentuk badan hukum

Abstract

The current criminal acts of malpractice in the criminal justice system in Indonesia in its enforcement ignores the rights of victims of the crime in the criminal case handling process and the effect to be borne by the victims of the crime because of the legal protection for the victims of the crime does not receive adequate recognition. Based on this understanding the author made two formulations of the problem. First, how is the fulfillment of the rights of victims of doctor malpractice in the criminal justice system in Indonesia? Second, how is the implementation of balance idea in settling disputes of doctor malpractice through penal mediation? This research used normative juridical method. It can be concluded that first, the criminal justice system in Indonesia ignores the rights of victims of doctor malpractice and prioritize more on how to penalize the perpetrators of the malpractice. Second, the principle of balance idea in crime can be applied in resolving malpractice criminal cases through penal mediation where a doctor can be released from criminal penalties, subject to treat and recover the victims. Through the penal mediation the victims’ protection and fulfillment of their rights are preferred and the responsibilities to treat the victims are burdened the doctors. Abstract

The airport is an air transport infrastructures that must be equipped with a variety of facilities, equipment and services in accordance with applicable regulations. One of the facilities available at the land side is the lounge / boarding lounge to accommodate passengers who are leaving / boarding. Passengers at the airport El Tari Kupang each year continues to increase so that the need to adjust the waiting room as needed. The methodology in this study was descriptive qualitative and forecasting. The results of this study stated that the waiting room at the airport El Tari Kupang should be expanded to waiting passengers feel comfortable flying hours.

Abstract

Trade mark not only functions as an identity but also contains economic value so there are many efforts regarding bad-faith trademark registration. This study aimed to find the concept of bad-faith registration and to know the law enforcement in Indonesia. This was a normative legal research, with statute approach, conceptual approach, and case approach. The results of the study showed that: first, the concept of bad-faith has been regulated in Trademark Law Number 19 of 1992, Trademark Law Number 15 of 2001 and Law Number 20 of 2016. The concept of bad-faith is when an applicant is reasonably suspected to register his trade mark improperly and dishonestly to imitate, copy, or follow the trade mark of other parties for the interests of his business, create unfair business competition atmosphere, deceive, or mislead consumers. Second, the law enforcement on bad-faith trade mark registration is carried out by (a) rejecting the trade mark since registration process; (b) removal of trade mark by trade mark owners, government (ministers) or third parties; (c) revocation of trade mark by lawsuit in Commercial Court.

Abstract

AbstrakProses bisnis yang terjadi di dalam perusahaan sangat ditentukan oleh mekanisme penjualan yang dilakukan. Toko Kemuning adalah salah satu home industy dimana mekanisme penjualannya masih dilakukan secara tradisional (pelanggan membeli produk di toko).  Mekanisme penjualan tradisional mengakibatkan jangkauan pemasaran yang sempit. Oleh karena itu diperlukan suatu sistem yang dapat mengelola transaksi penjualan secara elektronik. Sistem yang digunakan dalam penelitian ini adalah E-Commerce. Dimana, sistem akan dianalisa terlebih dahulu untuk mengetahui kebutuhan masing-masing pengguna. Kemudian sistem dirancang menggunakan Data Flow Diagram (DFD). Hasil perancangan, diimplementasikan ke dalam Bahasa Pemrograman PHP dan MySQL. Dan hasil dari pengujian adalah sistem E-Commerce telah berhasil dirancang dan diimplementasikan sehingga dapat meningkatkan penjualan produk di Toko Kemuning. Kata Kunci: E-Commerce, DFD, PHP dan MySQL

Abstract

The objective of this study are: First, to find the reasoning behind changes in offenses in the Copyright Law number 28 /2014. Second, reviewing the impact of offense changes and their influence on the enforcement of copyright in Indonesia. This study uses a normative juridical method. Normative legal research is carried out through qualitative descriptive. While the legal material is collected, sorted and subsequently studied and analyzed for content, to obtain the level of synchronization, the feasibility of norms, and the submission of new normative ideas.The results of this study are that the complaint offense in the 2014 Copyright Law is suitable considering that copyright is something unformed. When a complaint is imposed, the copyright owner must know the details of the object of his creation. The impact of the offense change has become a crucial factor in the enforcement of copyright law in Indonesia. Given that so far the application of normal offenses seems to be running in place because law enforcers become passive and with complaints offense, all stakeholders can protect the copyright of the creator.

Abstract

Telecommunication advancement has become a central part of human life brought tight competition among cellular operators. On June 2016, there was a case of business competition between Telkomsel and Indosat (the big Three Cellular operators in Indonesia) that conduct monopoly practice and predatory pricing. In Indonesia, there are two Institutions that maintain business telecommunication and business competition namely Indonesian Telecommunication Regulatory Body (BRTI) has mandated by Law number 36 of 1999 and Business Competition Supervisory Commission (KPPU) by Law Number 5 of 1999. The research aims to know how the government regulates on competition of cellular operator in Indonesia and to know the role of Indonesian Telecommunication Regulatory Body (BRTI) and Business Competition Supervisory Commission (KPPU) to settle the cases on competition of cellular operator (Telkomsel and Indosat cases). The study is normative legal research with statute and case approach, by using juridical qualitative approach. The results of this research are, firstly the analysis of regulation regarding on competition of cellular operator. Secondly the analysis of the role of Indonesian Telecommunication Regulatory Body (BRTI) and Business Competition Supervisory Commission (KPPU) to settle the cases on competition of cellular operator (Telkomsel and Indosat cases) that conduct monopoly practice and predatory pricing, regarding with Law Number 36 of 1999 on Telecommunication and Law Number 5 of 1999 on the Prohibition of Monopolistic Practice and Unfair Business Competition.
