Abstract

The Penal system is conducted by the correctional facility was only oriented towards convicted criminals. The problem was on how to treat death penalty convicts who are in the penitentiary during the execution waiting period. The result research’s on Penal system is only effective for convicts obliged to follow the restoration program, whereas the death penalty convict was not obliged and for him to decide actively or not to follow the restoration program. The restoration program must to be obliged for the death penalty convict, so that the penal system could provide protection for Human Rights

Abstract

Due to pollution and environmental destruction that most feel  is  the victim. Most victims also suffered losses, both material  and  immaterial  losses,  therefore  it  is  natural  that  the  victims  should  receive protection.  The purpose of  this  research  is  to  analyze  about:  1)  the  resolution  of  environmental  cases which  occur  either through the courts or out of court; 2)  the implementation of legal protection for  the victims of pollution and environmental destruction; 3)  formulating  the  ideal model of legal protection for  the victims of pollution and environmental destruction by the corporation is based on the principles of restorative justice in the future. The research method  is used  the  socio-legal  research using primary and  secondary data. The  results  showed  that environmental cases can be  resolved through the court and outside the court. Ideal model of  legal protection for the  victims of pollution and  / or environmental destruction by the  corporation  is based on  the  restorative justice principle in the future.The offender in this case as the corporation will deal with victims of environmental pollution and the state  as a facilitator. The  Facilitator from  the state for this early stage could be  represented by a judge. In an agreement between  the perpetrator and the victim of the most important is the provision of compensation  from  the  offender  to  the  victim. Ideally  in  the  concept  forward  on major  and  compensation mechanism  is  stipulated  in  the  rules of  implementation.

Abstract

The peace agreement resulted from an out of court mediation process can be made in the form of either an authentic deed or underhand deed. This paper discusses the application of the principle of ‘ne bis in idem’ in lawsuit relating to the breach of the notarial deed for peace and the legal strength of notarial deed for peace based on the Civil Code and the Civil Procedure (HIR). Data in the form of primary and secondary legal materials were collected through both library research and field work. It is found that with regards to Article 1917 of the Civil Code and Article 130 paragraph (2) the Civil Procedure (HIR), the principle of ‘ne bis in idem’ is not contained in a lawsuit against the breach of notarial deed for peace. It is also found that the legal strength of the notarial deed for peace is the same as the authentic deed as outlined in Article 1870 of the Civil Code and Article 165 of the Civil Procedure (HIR).

Abstract

Amendments of UUD 1945 Constitution to change the state system of Indonesia, including changes in state institutions, especially institutions MPR. After amendment of 1945 Constitution, MPR position parallel with other state institutions, and the authority of MPR also changed. MPR no longer as the highest state institutions and actors sovereignty of the people so that their authority is very limited. MPR no longer authorized to elect the President and Vice President, and is no longer authorized to establish GBHN. By not competent MPR sets GBHN, then MPR is not authorized to establish to form TAP MPR. It becomes polemic when Law No. 12/2011 2011 places TAP MPR to the kind and hierarchy of Laws and Regulations. Therefore, This research will analize the development of position of TAP MPR related to authority of MPR, then reconstructed to the position of TAP MPR on Indonesia’s constitutional system. The method used to analyze is normative. In the reconstruction of the position of TAP MPR carried by the fifth amendment of the 1945 Constitution to strengthen the MPR institutions and give the highest authority MPR, one of which is to develop a state policy that is poured into legal products MPR.

Abstract

The fundamental issues in the era of industrialization is the protection of patent rights and the enforcement of the patent law. In Indonesia, Intellectual Property Rights (IPR) including patent tend to be violated with regard to foreign investment and transfer of technology issue. Therefore, as a member of the WTO, it is necessary for Indonesia to learn from  other countries such as Japan and the United States of America, especially in terms of regulations. The purpose of this study is to find out the fundamental differences among Indonesia, Japan and America regarding the protection of patent rights and the enforcement of patent law. This research is a normative legal research. Data is collected from books, international journals, relevant laws and government regulations. The results show that the scope of patent protection in Japan, the United States and Indonesia has so far followed TRIPs and WTO provisions. Basically, Indonesia, Japan, and America have the same acquisition system, namely “first to file”. Historically before 2013 America has ever used “first to invent” system. Coverage of protection remains the same in the fields of technology and industry, but Japan extends the scope of patents to cover those produced by the employees and Indonesia also adopts this  model. In term of enforcement, Indonesian patent law also develops  a new appeal commission to settle patent disputes.

Abstract

Criminal acts of sexual abuse under Article 82 of Law Protection of children, also under Article 292 of the Criminal Code, as general criminal law where criminal threats 5 years imprisonment, against the actions of sufficient age, who do obscene acts with other people the same sex, which known or reasonably should be expected, that was not old enough. These acts of abuse against people want castrated using chemicals. This paper provides an alternative in criminal policy for perpetrators of sexual disorder which criminal act of abuse by using medic rehabilitation and social rehabilitation, in Psychiatric Hospital or Psychiatric Therapy, considering the criminal act of abuse committed by perpetrators of sexual disorders like people whose souls disturbed because of illness, so that Article 44 can apply to cases.

Abstract

An outstanding feature of Aceh Special Region is its autonomy relating to the administration of Islamic Criminal justice system. Undoubtedly this power is one of the key features of the devolution of power to the region. It is a tedious process with numerous challenges and obstacles. The research paper aims to examine whether the prolonged development pertaining to the Islamic Criminal justice system's administration is due to the constitutional and administrative arrangements or actually lies in society. Devolution requires well-structured and systematic planning and execution. It involves various mechanisms and touches many issues. To blame the system for protracted progress is not something unexpected. However, the perception of the public or society of Aceh relating to the Shariah Criminal Justice System also has a significant impact. The research shows that despite the general manifestation of the local population's willingness and support for the system, some issues have emerged. The research reveals that the challenges and obstacles in prolonged development come from both the society and the system. Lack of understanding of the society towards Syariah Penal Code, problems faced by members of the People Representative Council (DPR) Aceh in drafting the Code, and the need to ensure strict compliance of the Code with Syariah are among obstacles faced. The issues and their effect on the implementation and enforcement of Aceh's Syariah Penal Code are scrutinized in the research paper.  This is a qualitative study based on library and internet research. It is also legal research whereby the relevant laws are examined.  The devolution in Aceh is more complicated than in other regions because it is coupled with "dualisme hukum" or legal pluralism within the Indonesian legal system.

Abstract

The purpose of this research is to know the reconstruction of dispute resolution institutions of financing agreement with mortgage guarantee interest in Islamic banking practices following the Ruling of the Constitutional Court Number 93 / PUU X / 2012. In addition to this, the importance of this research is to the development of Islamic banking institutions in Indonesia and economic law, particularly the law of Islamic economics. For researchers, the importance of this study is to realize the competence of researchers in developing science insightful of sharia law, especially law of syariah economic.The method in this research, using qualitative tradition, its operation carried out in accordance kostruktivisme paradigm. The relative position (stand point) the authors of the problem in this study at the level epiteme not as a participant but instead as an observer. Strategy Research carried out by the two strategies is the research library (Library Research). This study uses socio-legal rules governing studie.Technic data collection to secondary data obtained through library research and a legal document. The primary legal materials, consisting of Article 55 of Law No. 21/2008 and explanation, Article 39 of Law No. 30 /1999, Law No. 4/1996, Law No. 50/2009 Constitutional Court Decision No. 93/ PUU-X / 2012. Secondary law, consists of book-nail on the agreement (contract), Islamic banking, political law, legal theory, legal research methodology, journals. The primary data obtained as supporting data through research in the field (Field Research) with observations interviews which includes: 1) Law sanction institution: Judges Religion, Arbiter in Basyarnas, Staff Bagia Legal in Islamic Bank, Mediator in Bank Indonesia, Notary; 2) Role Occupant: Management Islamic Bank, Islamic Bank Customers, which is done by hermeneutics, sociology of law and phenomenology. Analisys data using qualitative descriptive analysis that describes the development of dispute resolution institutions guarantee security interest in Islamic banking practices after the Constitutional Court Decision 93/ PUU-X/2012. The Results from this study is the reconstruction of dispute resolution institutions of financing agreement with hak tanggungan guarantee interest in Islamic banking practices following the Ruling of the Constitutional Court Number 93/ PUU X / 2012 is resolving disputes financing agreement with mortgage guarantee through Parate Executie more effectively and efficiently in other words more beneficial for of the parties when compared to the settlement of disputes trough the assurance executorial title. However, for the preventive protection during the pre-contractual agreement prepared sharia Islamic banks needfully the deed of acknowledgement of financing manufacture (APP) agreed debtor. The parties are no longer glued to that in resolving disputes and guarantee rights dependents through judicial institutions and non litigation in the narrow sense, namely non litigation on consultation, banking mediation, arbitration through the National Sharia Board of Arbitration or other arbitration institution, but can also cover non-litigation processes such as consultation, negotiation (negotiation), conciliation, non judge mediation, expert opinion or assessment.

Abstract

The way a legal system works determines how well law enforcement will be. A legal system consists of structure, substance and culture, of each must work in a system. In order that a legal system works properly, the law enforcers must be able to increase their knowledge on law and divinity so that they are able to comprehend law more broadly. In other words, law is not taken merely as a text in a constitution. As a system, the most important aspect is the culture of the law because it functions as the driving force that leads people to abide the law. In addition, in order to establish the integrity of legal enforcers, the implementation of integrated judicial system is also needed. Therefore, the role of supreme court as the highest supervisor of judges is also necessary.

Abstract

Perwujudan hukum yang benar harus saling melengkapi dan tidak saling mengecualikan hakikat dari hukum terletak pada karakteristik dari hukumnya sebagai institusi yang menunjang dan melindungi nilai-nilai, hingga eksistensi hukum harus mampu memberikan perwujudan nilai-nilai menjadi kenyataan dan perwujudan tersebut teraplikasikan dalam proses bekerjanya hukum. Norma hukum yang mengatur dokter yaitu Undang-Undang No.29 tahun 2004 tentang Praktek Kedokteran memberikan suatu pendefinisian secara tegas mengenai standar profesi, yaitu batasan kemampuan (knowledge, sklill and profesional attitude) minimal yang harus dikuasai oleh seorang individu untuk dapat melakukan kegiatan profesionalnya pada masyarakat secara mandiri yang dibuat oleh organisasi profesi. Untuk itu, dalam menjalankan profesi dokter harus berdasarkan pada ketentuan norma tersebut sebab dokter dituntut pertanggungjawaban dalam menjalankan profesinya, bilamana terjadi hal-hal yang disebabkan oleh kelalaian dan kesalahannya dapat menimbulkan pertanggungjawaban hukum sehingga dituntut adanya proses hukum yang dapat berakibat administratif, perdata atau pidana, putusan pengadilan yang dapat menentukan hal ini. Putusan Mahkamah Agung Nomor 365 K/Pid 2012, salah satu bentuk pertanggungjawaban hukum yang harus dibebankan sebagai bentuk perwujudan dokter dalam menjalan profesinya, sekalipun pada akhirnya dengan putusan tersebut dapat berdampak pada kinerja dokter.
