Abstract

This article aims at examining and analyzing contextually and critically the understanding on hadith as a comparison study between orientalism and Occidentalism’s understanding. The hadith understanding both critically and contextually has been existed and will continuously exist doing by whoever included orientalist and occidentalist which is considered fair as long as its has high objectivity and fulfill scientific research standard to avoid bias and personal purpose. The objectivity and scientific standard are such as commitment, can be tested and verified, trusted, objectivity, and can be used in general. Hadith contextualizing or the effort to interpret hadith based on its context and time is important to be done to answer the dynamic and progressive social reality. Abstract

This article describes hadith memorizing tradition in pesantren Al-Fatah, Temboro, Karas Magetan, by studying the motive, purpose, and urgency of hadith memorization (tah}fi>z} al-H{adi>th) in the pesantren. This study employes qualitative research through phenomenology approach to understand the phenomena, especially the attitude and the experience of the pesantren’s community related to research and hadith memorization. In collecting the data, this study uses interview, observation, and documentation. Interview is used to explore data about the process, motive, and the purpose to be achieved in hadith memorizing in the pesantren Al-Fatah Temboro Karangrejo Magetan. Interview is done to teacher, kyai, and students involved in hadith memorizing program. Observation is done by observing directly in the learning process of hadith study included hadith memorizing. Then documentation is used to collect the data and documents related to the result of hadith memorizing. The findings show that the activity of hadith memorizing in the pesantren Al-Fatah has some motives namely to make students have common interaction with the Prophet’s hadith and to strengthen the basic argument with hadith. However, the use of memorization in understanding hadith to solve law problems is not practiced yet. The urgency is more on the strengthen of hadith reference from the main source of hadith based on the memorization. Keywords; the Prophet’s Hadith, tah}fi>z} al-h{adi>th, phenomenology

Abstract

This article is reinterpretation of hadith meaning with integration-interconnection paradigm, focusing on hadith study on thought and religion of women through psychology approach. In the hadith, the Prophet stated that almost people in hell are women; less their thought (na>qis}a>t ‘aql), and also less their religion (na>qis}a>t di>n). Contextually, this speech has gender discrimination. It consists of a meaning that women are not as smart as men, and their religion as well. it Therefore, feminists mention that there is misogyny inside. However, if is studied contextually, based on investigating the asba>b al-wuru>d, women thought psychology study, and their life reality study, it can be concluded that there is no misogyny factor inside. In contrast, there is knowledge direction that is needed to be investigated inside the speech. The findings of this study show that the change of women’s thought is related to some functions of thought that is different with men’s thought including the different of hormonal changes and its adaptation with menstruation cycles that influence some parts of thought function and decrease their roles in spiritual activities Key words: thought, religious, women, psycho-social, hadith

Abstract

Aqiqah is a religious ceremony that is very common in Muslim communities. The ritual is the slaughter of goat in the seventh day of the baby birth. Aqiqah has become a tradition in our communities, but in the practice there are many differences. The main factor of the differences is the different understanding and perception toward hadith about aqiqoh. This article discusses about the understanding of Purworejo community, Sanan Kulon, Blitar district toward aqiqah hadith and the implementation by using sociology-history approach. The research finding shows that Purworejo community conducts aqiqah tradition not only following the previous tradition but also having knowledge that it is a direction of the Prophet. The understanding of Purworejo community toward the hadith is not textually. They understand the aqiqah hadith contextually. Keywords: Aqiqah, hadith, textual, contextual

Abstract

A study on contradictive hadith is popular with terms “ilmu mukhtalaf al-Hadisikh and mansu>kh (elimination), and al-tarji>h} (priority). In a case of murtad person, the majority of riwayah mention the punishment is death execution. However, there is also a riwayat that explains the delay of death execution to give a chance for murtad person to do taubat. The contemporer shoolars (ulama) debate the death punishment for murtad person that is done in hurry. It is done to debate the authority of shahih hadith about death punishment for murtad person, but with the consideration of keeping the life balace in nation and religion. Abstract

Integrating hadith from the past with the contemporary social problem is not always easy. It is because hadith is a fixed text so that it cannot always be suitable with every problem developed outside its time. In a case of religious decision (fatwa) in which hadith is used, MUI has own way to connect between hadith and recent problems so that hadith can give answer on that problems. The haram decision on un-use choosing right in election is the example. In arranging that decision, hadith is placed together with other basis: al- Qur’an, fiqh, and ushul fiqh, then they are mixed together using qiyas as methodology basis of its interpretation. The result is subjective. However, there is no other way, and what has been done by MUI to use hadith in religious decision (fatwa) has been correct. Abstract

In Islamic study especially in Islamic law study, study on hadith has been conducted. However, it is often that the resulted works tend to one of two tendencies namely absolutism and skeptics. The absolutism paradigm is developed in traditional Islamic study; meanwhile, skeptics paradigm is grown among orientalist and Muslim scholars oriented to West. This article discusses the ideas of Fazlur Rahman, one of contemporary Muslim scholars having popular works in Indonesia since the last year of 90. Rahman tried to formulate the basis of history study and hadith methodology that use both traditional Islamic knowledge and some important findings of orientalists. Abstract

He also shows how Muslim should do ideal interaction with sunnah. This research is a literature study namely analyzing data related to the topic by checking the references related to the main study especially Yusuf al-Qaradawi’s thought about hadith. In addition, other books are also used as secondary sources of the research. In analyzing the data, this research employs hermeneutic analysis namely describing the discussion object systematically and then analyzing it by using hermeneutic paradigm. In conclusion, the Qaradawi’s theories are not something new and original since they are related to the thoughts developed previously. However, the important contribution of Qaradawi’s theories is placed in the implementation of the theories on the cases related to the contemporary problems. Abstract

The optimalization of hadith’ roles as guidance in life is not easy since hadith is born form the history in different context and reality. In fact, the reality is always developed and changed. This is always raising big question “can hadith accommodate the contemporary problems?” To answer this question, the scholars (ulama) effort continuously to give guides in understanding hadith correctly to avoid misunderstanding. One of them is by studying asba>b al-wuru>d hadith. This article explains the significance of asba>b al-wuru>d that is called as the background of hadith rising, giving direction for us when the hadith is rising, why , to whom it is given, in what case, and how is the socio history of the hadith. Abstract

The use of hermeneutic as one of approaches in hadith study becomes one of knowledge integration forms which is implemented in the contemporary era. The knowledge integration between hadith and hermeneutic can be found such as from a study conducted by Fatima Mernissi. The Mernissi’s concept toward the issue of gender equality has brought her to study hadith that as if support the views lowering women (misogyny). Based on that argument, this article tries to explore more descriptivelyanalytic about the form of hermeneutic hadith of Fatima Mernissi in her effort in understanding misogyny hadith. The research problems are how is Fatima Mernissi’s thought related to the Prophet’s hadith from the rising and process of its collecting?, how is Mernissi’ hermeneutic hadith form that is showed through double investigation methods? How is the description of the method application in Abu Bakrah’s riwayah about women leadership?. This study is a literature study, and its discussion is more descriptive-analytic. Based on her, method in hadith knowledge that has been shown by the classic scholars (ulama) should be completed by the development of contemporary knowledge that puts scientific aspect as the more important aspect than normative aspect.
