Abstract

Education is meant to nurture man to make of nature what can enable him make the society much better for him and for all. At every stage of this grooming process, however, examination still remains the major benchmark of cognitive competence and intellectual prowess right from the kindergarten to the university. Though, the application of the learning to solving real-life situation challenges in the society is what the world craves today. In several nations, examination is still skewed towards the test of retention ability than the appreciation of expertise in skills. This preference makes the process less vital than the product in the minds of the learners: the end justifies the means. Therefore, a number of learners in the society wouldn’t mind going to any length to have good results that will boost their employment opportunity or enhance their status in the society. Ideally, the importance of process in determining the value of the product should never be overlooked.  Though, things are changing for the better and several employers now value academic qualifications with adequate skills, a number of the learners are still of the opinion that good academic results only are synonymous to employability skills that open all doors to success. With the rapid technological advancement in the world today, examination malpractice has assumed more complex forms as it appears in different colours that often mesmerise those who advocate its demise. Using the examinee’s flesh as reference sheets and making the apparel as equally susceptible to manipulative innovation as any electronic device or bodily sign are just a tip of the iceberg. Hence, the war against examination malpractice often seems to be several paces behind in matching the sophistication of the perpetrators of the menace. Yet, it is a must-win war and efforts must continue towards making it a reality as soon as possible. The study employs primary and secondary sources of information, and they both reflect a great mismatch of efforts and resources in the war against examination malpractice in Nigeria. It was found out that lack of adequate knowledge of the nature and mechanism of the menace often leaves loopholes for the perpetrators to carry out their plans. Another finding is that the perpetrators are close to being in abreast with technology while the army against them is more analogous than technological. Inconsistency in implementing the deterrent policies also encourages the perpetrators. The study therefore recommends strict compliance with Islamic teachings and stiffer measures against offenders amongst others.

Abstract

The term "cryptocurrency" refers to a form of digital or virtual currency that does not exist in tangible form like paper money. That cryptocurrency can only be used with internet-connected PCs, laptops, smartphones, and other devices. Cryptosystems that make use of the blockchain system have a number of advantages, including the speed, convenience, and security of transactions, as well as the ability to be used in all nations and continents. However, there is still room for improvement in the circulating cryptocurrency, including the absence of supervisory authorities. Experts, including Islamic scholars, are constantly debating the advantages and disadvantages of using cryptocurrencies. The Koran, al-Hadith, Qiyas, and Sad-Adzariyah are the sources used in this study to examine the dynamics of cryptocurrency use from the perspective of ushul fiqh. Increasingly, cryptocurrency transactions are used for speculation, which violates Islamic principles. According to Surah Al-Qur'an An-Nisa verse 29, the elements of superiority are gharar and maysir, so the use of cryptocurrencies is permitted subject to certain conditions. Additionally, a country's legality must be clear for cryptocurrency to be used safely.

Abstract

The sovereignty of the Nigerian 1999 Constitution as amended over its citizens which include Muslims and non-Muslims is absolute and binding. In this regard and despite the absolute power ascribed to this Constitution, Nigerian Muslims like other Muslims are also expected to adhere strictly to all Islamic precepts as enjoined in the Qur’ān and Sunnah amidst the imposition of British-inclined legal system on which the 1999 Constitution was codified. Though, the present Constitution was enthroned on the Country’s nascent democracy by a Military Junta, its constitutionality and appropriateness to Nigerian religious and cultural diversities has become a lingering debate for over two decades.  To this end, this paper examines some of the principles of the 1999 Constitution such as Sharī‘ah application and classification in Nigeria and the syndrome of secularism in the context of Islamic law as they affect Nigerian Muslims. It was then revealed that despite the recognition of Sharī‘ah as a source of law by the Constitution, its applicability and enforcement has been demeaned as a mere customary law for decades. The paper then suggested that to overturn this incongruity, Nigerian Muslims should renew their concerted agitations for total application of Sharī‘ah and enforcement of its jurisdictions from lower to apex courts in Nigeria through constitutional review since the current Constitution was not people-centric.

Abstract

This study examines the problems and prospects of Aliya Madrasa education in Bangladesh. Education is the opportunity to enhance oneself and to develop society and the nation at large. To examine the problems and prospects of Aliya Madrasa in Bangladesh, this study employs a qualitative approach with library research and data sources from books, articles, research papers, reports of newspapers and magazines, education commissions, and government education policies. Madrasah education in Bangladesh is found to be associated with some problems from inside and outside. Through the study, some problems have been identified linked to the curriculum, management, poor funding, lack of quality teachers, shortage of instructional equipment for science subjects, and limited teacher training institutes. Furthermore, Madrasa graduates face many problems, such as university admissions examinations, government service interviews, and joining cultural activities. This paper advises that the government should consider madrasa education carefully as an important education system since it is a unique system in Bangladesh. It further suggests that the management committee, head teacher, staff, and students altogether must have to work to attain the goals of Madrasa education. Moreover, madrasa education must be restructured according to the current needs. The current curriculum approach needs to be modified and developed in accordance with the modern education system by providing all the necessary tools. Madrasas should also motivate their students to play a role in politics and take part in cultural and national activities in Bangladesh.

As social beings, humans depend on each other to meet their needs and interests. For this reason, a definite regulatory structure (institutionalization) is needed to minimize and overcome various problems that arise. Al-Mawardi is one of the most interesting Islamic political thinkers to discuss. The basic concept of al-Mawardi's political thought is the origin of the social contract theory. Through qualitative research methods through literature studies, this article will discuss al-Mawardi's social contract theory based on his political thoughts. The discussion in this article starts from a discussion of al-Mawardi's biography, al-Mawardi's main thoughts regarding the state and leadership, as well as the relationship between the ruler and the people which later became the social contract theory.

Abstract

This article intends to examine the concept of rational theological concepts in Islam with a focus on the thoughts of Harun Nasution. Harun Nasution is a controversial Islamic reformer. His idea was born as a response to and against the traditional ideas that developed at that time; even Harun Nasution dared to go against the flow of traditional ethics that according to him had long been rusty and difficult to remove. The emphasis of this paper is on the presentation of Harun Nasution's progressive thinking in the Islamic theological concept and tts importance in advancing Indonesian Islamic civilization. Thus, the qualitative method will be employed in this work, along with a historical study approach gleaned from books, journals, and related publications. The essence of Harun Nasution’s theory is the realization that Islam is a universal rational religion, and that via rational theology, people can fully comprehend the meaning of revelation in both the Qur'an and the Hadith. To build the Islamic Ummah such that it always exists exclusively through forming a rational society, a renewal movement through education is required.
