Abstract

Strategi penting dalam mengantisipasi hukum pada PJPT II salah satunya adalah dengan merevisi dan mengganti sebagian besar hukum kolonial yang masih berlaku. Hal ini dilakukan bukan hanya karena alasan politik untuk membayar hutang sejarah terhadap cita-cita proklamasi kemerdekaan. Tapi juga karena hukum peninggalan kolonial itu sudah ketinggalan jaman, demikian tulis Salman. Lebih jauh memasuki PJPT II berbagai masalah sosial barupun muncul dan hal itu tentuperlu alternatif.

Abstract

Having regardto the failure ofthe existing complaint system, the Wahid's administration govemment has formed anew institution in an effort to cover the weaknesses of the existing supervisory institutions. The new institution is the National Ombudsman Commission, which was established through the Presidential Decree Number 44 of 2000. Within twoyears ofits operation, the Ombudsman has receivedmore than 1, 723 complaints including those regarding the executive govemment officeras well as the judiciary. This may indicate that people puthigh expectationon this new Commission. How ever,apart from  the impressive number of received complaints, there are some significant problem sfaced by this Commission tha tembrace, legal, politics as well associalim pediments. This article examines those problems and proposes some reforms

Abstract

The independence of the court has been regardedand it has guarantee in constitution, butinaction, especially the action ofcn'minal lawenforcement in Indonesia, the independence of the court is in the lowest rankeven buried. To rebuild the independence of the court, such that, the correlation of the court with other component is unseparable, for instance, structure, regulation,, and personal componentsof the court. With consideration oft hecourt component, the strategy in rebuilding of the independence of the court is donethrough taking reconstnictionofthe court, the reform of regulation and revitalization of the court.

Abstract

Dimungkinannya pegawai negeri sipil menjadi anggota partai Politik dan Golongan karya, karena secara normatif diperkenankan oleh peraturan perundangan-undangan, antar alain UU No. 3 Tahun 1975 yang diubah menjadi UU No. 3 Tahun 1085 tentang Partai Politik dan Golongan Karya. Selanjutnya ketentuan tersebut diatur dengan PP No. 20 Tahun 1976 yang menyebutkan macam-macam jabatan yang tidak boleh diduduki mereka yang menjadi anggota partai politik dan golongan karya (16 macam jabatan). Ketentuan ini sesungguhnya memberi kesempatan kepad apegawai negeri untuk menjadi anggota dan pengurus organisasi sosial politik dan menjadi anggota DPR/DPRD, asal memperoleh persetujuan dari pihak yang berwenang. Muara dari ketentuan ini adalah menjadikan pegawai negeri sebagai alat kekuasaan demi menjagga status quo. Akibat negatifnya mustahil seorang pegawai negeri mempu memberikan teguran dan pengawasan terhadap seoang menteri, gubernur atau bupati yang selama ini menjadi atasannya dan telah memberikan rekomendasi bagi dirinya untuk menjadi anggota dan pengurus orsospol dan pengurus orsospol serta menjadi anggota legislatif.

Abstract

As a correction of local govemmerit regulation according to Law No. 5 1974 which is centralistic in nature, the advent of Law No. 22 1999 isexpected to blow the wind of change In the substance and the paradigm of the real autonomy. That is, the mechanismof decentralization system which guarantees (respects) the existence of local government Independence in regulating and arranging their home affairs and the dispersion ofnational revenue to local government for the even distribution of social justice. Never the less, the problems rises when the content of Law No 22 1999 runs against the amendment ofthe Constitution45, especially concerning article 18, article 18A, and article 18B. Namely, the confusion of decentralization which is placedas "principle/basic" in the (autonorhous)system of local government whereas in the oryitisa "process". The second is related to article 8(2) which gives privileges structurally to local government, while, on the otherhand, it can endanger the integrityof NKRI. To review the substance of Law No 221999 is a wise step in of fering solutions.

Abstract

Commercial space activWes conducted by private company may raise legal problems which relate to state responsibility. State Responsibility can be embodied in the national regulation, national policies and effective control of commercial space activities by the government, such as permit system with specific and private company to participate on the commercial space activities. Therefore, the company is able to fulfil its responsibility and liability if its activities cause disadvantage to the third parties.

Abstract

The issues raised in this study are: The form and legal considerations, the methods and the role of ijtihad as well as the contribution of the judge ijtihad decision of religions courts in the field of inheritance law in Islamic Law Compilation (KHI)aganise the national law from the influence of muslim community life of Indonesia. The research method using a normative approach and the paradigm of constructivism, with the object research of jurisprudence of the high supreme court of Republic Indonesia and the verdict as the primary source of qualitative data analysis.  It is verdicted that: A daughter (as the inheritor) who acts hijab toward the inheritance provider’s biological brother gets all of the inheritance from the inheritance provider. This verdict seemingly confronts article 176 of Islamic Law Compilation which says:”on anly daughter alone gets a half of the inheritence …”. The verdict is the result of Ijtihad in attempt of catching the ruh (soul) or maqashid al-syari’ah in order to promote justice with a legal justification that the provider’s brother is not in responsibility for providing his niece money and other needs. It is also because of the change in social structure in farm of “family structure” which is widely known in modern Indonesian family as “nuclear family” consisting of father, mother, and children excluding relatives. This type of family structure has become more standard and socially accepted. In other words, nuclear family is a more modern model in Indonesian modern society
