Abstract

The aspirations fund of the House of Representative to be one hot issue discussed publicly, especially with regard to the right of the House budget. Problems posed, first, how the position of the aspirations funds of the House associated with the function of the House Budget? Second, what the aspirations funds of the House become a necessity in response to House obligation in fulfilling the aspirations of the people? This research is doctrinal, using primary and secondary legal materials, in the form of some legislation, literature and research results which are relevant to the object of research. The approach used in this study is the approach of legislation, comparison, and conceptual. The study concluded, first, the aspiration funds of the House is not the function of budget of the House, because the House should function gives approval and not received an allocation of a specific budget as an executive. Secondly, the aspirations fund of the House is not an answer to the need to meet the aspirations of the people, can even cause negative culture that is pork barrel politics.

Abstract

Basically, the thrust of international credit is the same as domestic thrust credit Their differences are theparties involved more so that the contract they made is more complect, the timeis longer, there is guarantee of credit taking and the difference of countries. The Parties must be criticized carefully although in general the thrust of international credit need a board arbitration on solution for dispute.

Abstract

The main issue in this research is whether the power abuse in Corruption is still an absolute competence of Corruption Justice or is shifted into the administrative justice in post-regulation of Government Administration Act. This is a research on normative law that is analytical prescriptive through conceptual approach, statute approach, and case approach. The results of the research showed that the concept of the power abuse in the Government Administration Act theoretically and practically is equal with the concept of power abuse in Corruption Eradication Law. Therefore, those two justices attributively have the absolute competence to examine and determine the elements of power abuse in corruption. However, based on the principle of “lex posteriori derogate legi priori”, the authority to examine and determine the element of power abuse in corruption comes to be the absolute competence of Justice Administrative.

Abstract

Signature, exchange of instruments or ratification will be binding If the text provides that these actions are to have that effect. A treaty which merely needs signatures from the parties, it will be legally binding to the parties by signing the treaty. However, for a treaty which needs ratification, signatures of the parties will not have a legal effect to the parties. The parties who have signed the treaty is only bound morally. Thus, the treaty will be legally binding to the parties, if the parties have ratified it.

Abstract

Hukum Pidana Indonesia pada dasarnya menganut "asas kesalahan" sebagai asas yang fundamental dalam mempertanggungjawabkan seseorang yang melakukan perbuatan ppidana. Namun, dalam perjalanan sejarah, dengan berkembangnya ilmu pengetahuan dan teknologi yang bedampak pula pada perkembangan kejahatan itu sendiri, asas kesalahan tidak lagi dapt digunakan sebgai satu-satunya asas dalam pertanggungjawaban pidana. untuk mengantisipasi kemajuan tersebut, diperlukan reformasi terhadap sistem pertanggungjawaban pidana. Berkaitan dengan reformasi ini, ada empat tolak ukut untuk menilai pakah relevan untuk diterapkan di Indonesia dalam kerangka pembaharuan hukum pidana nasional. Keempat tolak ukur tersebut adalah relevansi teoritis, relevansi yuridis, relevansi sosiologis, dan relevansi filosofis.

Abstract

The progress of modem technology recently makes the transformation of Information and mode of communication among human beings become easy and direct, especially in the world of trade. In deed, the business facilities which can be obtained easily through e- commerce gives some advantages, but, at the same time, it also gives birth a number of crucial legal problems. First, the substantive problem swhich include problems of data massage authenticity, electronic signature, validity, privacy or confidentiality, security, and availability. Second,the procedural problems which are related to jurisdiction or forum. To solve such problems, weneed to prepare certain instruments which support the establish ment ofsafe, effective and beneficial e-commerce transaction for all parties involved. In addition, we have toper form reformation and uniformity of law by referring to UNCITRAL Model Law as a fundamental guidance.

Abstract

Minimal ada empat belas klausul Restrictive Business Practices (RBP) yang sering terdapat dalam berbagai kontrak alih teknologi melalui lisensi. Hal ini jelas sangat merugikan bagi negara-negara berkembang. Walaupun PBB dalam resolusinya no. 25/65 tanggal 5 Desember 1960 telah memberikan himbauan untuk menghindari klausul semacam Itu, namun banyak negara berkembang berpendapat bahwa resolusi itu kurang diapresiasi oleh negara-negara maju. Maka menurut Ridwah Khairandy. Indonesia harus lebih mengoptimalkan pemberlakuan UU no. 6 1989 sebagai langkah antisipasi hukum nasional terhadap permasalahan di atas.
