Abstract

The implementation of administrative sanctions in Government Regulation No. 101 of 2014 on the Management of Hazardous and Toxic Waste (B3) has emerged a polemic in the form of inconsistency in the sanction enforcement under Act No. 32 of 2009 on the Protection and Management of the Environment (Law PPLH). Under the provisions concerning with the management of B3 waste as regulated in the Act of PPLH, criminal sanction is enforced as premium-remedium without any first enforcement of administrative sanctions. This study observed two issues: first, the urgency and the strategy of sharpening the existence of the administrative sanctions in the Regulation No. 101 of 2014 of the Law No. 32 of 2009. Second, it concerns with the effectiveness of the administrative sanctions in the management and supervision of B3 waste. This is a normative juridical law research. The study concluded that: first, although based on the law of PPLH criminal law is enforced in medium premium, but the role and presence of the administrative sanctions in the B3 waste management is necessary especially to develop any preventive measures against environmental pollution caused by the B3 waste. Second, although the Act of PPLH has applied the criminal sanctions in premium remedium, but the implementation of administrative sanctions is more effective and provides a protection against the threat of environmental pollution from waste B3.

Abstract

The internasional criminal justice has a relevance to human rights protection inasmuch as it protects the international community from the practice of crimes such as genocide crimes, humanity crime and aggression and war crime. Additionally, various cases of serious human rights violation occurring in several countries such as Bosnia, Croatia, Kosovo, and East Timor which were earnedoutbyauthoritarian regime lead the existence of the international justice to be more relevant Even though the existence of this justice isrelevant in this manner, its implementation provides us with the barrier like institutional weaknesses, authentication difficulties, political power, economy, and military among the UN members. Thus, the effectiveness of the international criminal justice will be examined by time.

Land-ownership conflicts concerning estate rops are classical problems faced by the government (colonial or national). However, it has indicated an increase in the post-reformation era.According toits typology, thereare 5 aspects involved namely: subject, object, causalfactor, claim effort, and settlementef fort. Abstract

This research is designed to study the model of alternative resolution of crime suit in accordance with the Islamic law that can be used as the model of resolving the crime suit of ordinary assassin in Indonesia. The method of this research was juridical normative method. The result of this research showed that the model of resolution of diyat and apology in Islamic concept are highly relevant and acceptable by Indonesia people. The noble values as a culture of forgiveness and resolving the issue by more emphasizing on deliberation have been highly maintained and developed since a long time age among the ancestors. The ordinary assassin could be solved by forgiving in this case by paying the Tepung Tawar (Malay Custom) as long as the assassin is not related to the public interest..

Abstract

The first and foremost problem in this study is testing the urgency of the legislation that is integrated in the Constitutional Court. Secondly, it deals with the relevance of the integration testing of the legislation to the development of law in Indonesia. This is a juridical normative research whose legal materials were analyzed descriptively and qualitatively. The study reveals that first, the idea of unification of judicial review of legislation in the Constitutional Court is very essential to do, in order to harmonize the legislation, to maximize the protection of constitutional rights of citizens, and to realize the supremacy of the constitution. Second, the unification of legislation testing can fix elements of the legal system that is particularly an instrument or substance of the law, which highly affect law-making and institutional capacity building, namely the Supreme Court, the Constitutional Court and the executive in Indonesia.

Abstract

In a welfare state, the administration of non-governing functions requires that there have been an equal relation between the legal subjects. The relations probably arise from various legal civil actions taken by the government bodies, particularly those bodies withstatus of legal entity. The civil legal between the govemment with civil of legal entity are directed at achieving the highest welfare of the community. The pattern of cooperation contract based on the mining exploitation in juncture of foreign investment according tothe meaning and substance of the rights of the state control shall be production sharing contract.

Abstract

Dalam reformasi hukum pidana politik hendaknya diingat bahwa kejahatan politik tidak hanya dilakukan oleh individu atau organsiasi melawan pemerintah, terutama yang mencoba merubah sistem politik yang dilakukan pemerintah melawan rakyat dan melanggar kemanusiaan. Secara yuridis ketentuan hukum pidana yang mengatur tentang tindak pidana bidang politik di Indonesia secara historis dapat mempergunakan UU Subversi dan beberapa pasal-pasal KUHP, khususnya tentang makar. Perumusan Undang-Undang Subversi ternyata terlalu luas sehingga perlu direformasi dengan term-term hukum, bukan term-term politik sehingga tidak merugikan tersangka, karena pasti dapat terjerat dan dihukum. Berikut ini penulis mencoba mengemukakan ide dan gagasannya seputar reformasi hukum pidana politik. Lalu, apa sebenarnya yang ditawarkan penulis tentang reformasi hukum pidana politik itu sendiri.
