Itis obvious, that the Decentralization that occurred through Law No. 22/1999 granted the political decentralization. However, the substance of Law No. 32/2004 is administrativedecentralization. It is suspected that through Law No.23/2004 re-centralization in local governance has occurred.

Abstract

The focus of this research is on the conformity of head of local government impeachment mechanism regulated in Act No. 32 of 2004 and Act No. 12 of 2008 with direct democracy system and the impeachment mechanism of head of local government in Indonesia after the enactment of Act No. 32 of 2004 and Act No. 12 of 2008.This research used normative juridical approach by focusing on philosophical approach. To complete the research matters, primary, secondary and tertiary legal matters method is used. The legal materials are qualitatively analyzed.The research result concludes that impeachment of kepala daerah in direct democracy era needs to be re-designed because it is not in accordance with concept of regional autonomy and the principles of legislation formation. On top of that it is to avoid centralistic system which is contradicted with the essence of decentralist system and not in line with decentralization values in the context of unitary in impeachment system.

Abstract

The settlement mechanism of credit through re-negotiating credits and restructuring company will achieve efficiency and increase productivity which Is indicated hydecreasing the company's problems, and increasing company's income; thus the company will be able to settle its credits. In this Indonesian crisis era, an effective method of credit settlement is required. The efforts and the methods to settle are discussed in this article.

Abstract

The monetary crisis in Indonesia has shown that the syariah banking proves that it has the significant endurance. For law protection interest for customers, syariah banking need thesupervision authority for two both aspects. The first is banking administrative supervision, and the second is the syariah supervision. This task is actually takenby the institution of authority consent of supervision (Bl or OJK), because the effectiveness of syariah depends greatly on the sanction available. Through single supervision pattern, the dualism of guidance and counseling for banking in Indonesia is deni able. The syariah protection for the customers can as well as be taken by optimalization of the National Syariah Board and Syariah Supervision Board.

Abstract

This study brought up the problems, first, the theoretical foundation of the exchange of regional owned property (BMD) between local government and private parties. Second, the laws and regulations governing the exchange activities of BMD. Third, basic considerations in relation to the exchange of BMD. The type of the research was normative research. The results concluded that, first, theoretically, the government (local government) can do contractualization of governmentaffairs because this has become a practice (habit) in the government. The contractualisation includes exchange agreements with non-governmental parties that involve assets(land)thatare under government control (BMD). Second, juridically, the regulational basis for the exchange agreement serving as the basis for the right to transfer the assets (land) under government control (BMD) can be found in the legislation. In doing such actions, terms and conditions of legislation shall apply as the basis of the validity of the actions which includes the aspects of authority, substance and procedure. Third, another thing that determines the feasibility of government action in exchanging BMD (in the form of land) is the aspect of benefit (doelmatigheid).

Abstract

The special agency in accordance to Banking Law Number 10/1998 is an agency put forward to settle and torecover state funds formerly placed in the banking industries in time of severe economic crisis. The special agency has given a broad power to this agency evensurpass the power or authority that normally become the power of the court. This regulation is one example of how some times Indonesian regulations are notin harmony to each others and become a stumble block in establishing due process of law, giving fair treatment and establishing good system of law. it is also now on derif the effectiveness ofthis special regulation and the functions ofthe specialagency it is created do not meet the requirement insettling government financial problem.The purpose of this paperisto determine whetherthe existing regulations arein harmony each other, to analyze which regulation should putinplace or which one shouldbe remove, which theory orprinciple can be put forward orkept as the basic argumentation in creating harmonious law.To be particularitis recommended that based upon consideration using normative analytical method on dogmatic legal system to create harmoni ous lawin Indonesia, there mustbe a new law in banking namely, 'undang-undang penyelesaian bank bermasalah' which permanently become the guidance ofany agency which its functions is tosettle banking problem.

Abstract

This study examines: first, the tendencies in the type and weight of crime in the judge's decision in the criminal case of violence against women. Second, the application of the theory of criminal prosecution. This is a normative-legal research with the legal materials that were analyzed using a descriptive-qualitative analysis. From the results of research and discussion conducted, it can be concluded, first: judges always choose to impose the type of imprisonment. The trend for choosing such type was caused by two factors, namely the pattern of criminal threatening in legislation and the nature of crimes of violence against women that substantively is relatively serious. Meanwhile, regarding the weight of sentence imposed, the judge's decisions tend to be various but on average are quite heavy, that is the punishment of 3 (three) to 4 (four) years in jail. Such tendency showed the alignment towards women as the victims of violence crime. The second conclusion showed that the most dominant theories used are the theory of retribution. With the use of this theory it means that judges tend to pay attention to the interests of women as victims.

Abstract

The UUPA is a transitional act product which is made to change the characteristic of colonial Law of agrarian field into the agrarian law which is in accordance with the form and idea of Indonesia Republic Unitary State. In practice, during the new order regime,the authorities abused the State Authorization Right and gave the investors the privileges of controlling the agrarian sources. As a consequence, the existency and community role of the custom were getting marginilized and felt ata disadvantage. This reality frequenthy triggered to cause the tenureal disputes between the investors and the custom community which, in general, enabled to threat the integrity of national territory/ unity. In the effort of preventing the recurrence, the UUPA needs reforming the characteristic of agrarian law which not only accomodating but also warranting the interests ofcustom community. Pluralism of agrarian law should reflect more the spirit of Unity in diversity.
