Abstract

Basically, GAM has the basic right demanding the manifestation of self determination for separating to Indonesia. It is based on the unjustice and suffering of Acehnese during the New Order Regime. However, some determination should be discussed intensively inresponding the Acehnese self determination, such as it must be considered the consequences and the ability of Acehnese on keeping their community survival and interaction to international community if the separation to Indonesia is permissible.

Abstract

Basically, there is no disticntion on classic Figh, on law of the Republic of IndonesiaNumber 1 of the year 1974 on Marriage, and Islamic Law Compilation relate to children care right The distinction is merely on the determination of age limit of mumayyiz. When divorce occurs, children before 12 years old (before mumayyiz) is to be the right of the mother or a close relative to the mother, while the cost of bringing up the children will be the responsibility of the father. In a particular condition, the children care right may move to the father. Even, on Act No. 1/1974 states that the right of one ofthe parents can be with drew if one or both of the parents neglect their duties and perform extremely bad behaviour.

Abstract

The first and foremost issue in this study is the general principles and legal arrangements of tapping into national and international human rights law. Second, as lex specially can tappin be prosecuted to national or international law? Third, why is the wiretapping of Australia against Indonesia not considered as a crime but a violation of the diplomatic code of conduct. This is a normative research. The study reveals that first: legally tapping is prohibited by law and international human rights based on the Universal Declaration of Human Rights (UDHR) in 1948, the International Covenant on Civil and Political Rights (ICCPR) in 1966, the European Convention for the Protection of Human Rights and Fundamental Freedoms (1958) and the 1961 Vienna Convention. While in the national law, the prohibition of tapping is provided in Article 28G paragraph (1) of the 1945 Constitution, Article 32 of law No. 39 of 1999, Article 40 of Law No. 36 of 1999, Article 31 paragraph (1) of Law No. 11 of 2008, and Article 31 paragraph (2) of Law No. 11 Year 2008. Tapping is allowed when the order and security of the country is being threatened as stipulated in the Law on Combating Criminal Acts of Terrorism, Narcotics Law, the Law on the Corruption Eradication Commission, and the Law on State Intelligence. Second, the ban on wiretapping in international criminal law can be excluded for particular crimes as stipulated by Rome Statute of 1998, and Transnational Organized Crime. Thirdly, in the context of the behavior relations between countries, Australia tapping against Indonesia has shifted meaning from a crime  into a violation of the diplomatic code of conduct. Indonesia acted diplomatically towards Australia’s violation by forgiveness.

The Problem of legal security and certaintyis a negative effect of e-commerce development. The efforts togive legal protection to customers canbe done by using The Most Characteristic Connection Theory. Indonesian contract law can only be applied if thesuppliers of internet payment service are in Indonesia. In spite of the fact that Indonesian authentication law has been unfamiliar with digital signatureas written evidence, the emerging controversy can be settled by using conventional ADR or on line ADR agency.

Abstract

Under the article 1338, section 3 of CMI Law Code, it is stated that an agreement shouid be implemented on the basis of goodwill because it is one of the important principles in Contract Law. However, the notion of goodwill is so abstract that it is whether related to a matter of law or moral. This article will propose a description of the goodwill -when and where itiscoming up-, its functions in implementing the agreement, and how the authorities of the judge toget involved towards the contract duties on the strength of the goodwill principles.

Abstract

Indonesia teiah melewati tahap pertama kegiatan menarik investasi asing untuk membantu pembangunan, dan kini berada dalam tahap kedua. Dengan demikian TRIMs menjadi suatu hal yang penting untuk diperhatikan. Abstract

This paper tries to emerge the phenomena of Mining Authority and Land Right in the Basic Principle of Agrarian Law. Argumentatively the Act of Mining No. 11, 1967 does not show any relationship to the considerance of the Principal Act of Agrarian (UUPA). its existence(UUPA) is not expiicitiy stated in the Body Frame, and is mentioned unclearly on Article 2 letter b of the Basic Principle of Agrarian Law (UUPA). The Article states that land rights are rights on the land area located in certain part of the earth based on the IndonesianLaw. This perception seems dear when the Indonesian Law is indefinitely elaborated. However, if it is traced, there is a close relationship between The Basic Principal of MiningAct and the Basic Principle of Agrarian Law.

Abstract

Peralihan tanah yang belum bersertifikat rawan menimbulkan sengketa apabila PPAT tidak menerapkan prinsip kehati-hatian. Penelitian ini menganalisis, pertama, apakah Peraturan Jabatan PPAT telah menerapkan prinsip kehati-hatian? Kedua, bagaimana prinsip hehati-hatian PPAT dalam peralihan tanah yang belum bersertifikat. Metode penelitian yang digunakan adalah penelitian hukum normatif. Dari penelitian ini disimpulkan bahwa: pertama, Peraturan Jabatan PPAT telah menerapkan prinsip kehati-hatian. Kedua, prinsip kehati-hatian PPAT dalam peralihan tanah yang belum bersertifikat direfleksikan dalam kewajiban PPAT menolak membuat akta apabila tidak disertai data formil.
