Abstract

Penyelesaian sengketa tidak diselesaikan di pengadilan, tetapi juga dapat diselesaikan melalui pengadilan umum dikenal sebagai penyelesaian sengketa alternatif, salah satunya adalah arbitrase. Hubungan industrial arbitrase untuk menyelesaikan perselisihan kepentingan dan hanya perselisihan antar serikat pekerja atau buruh di satu perusahaan. Undang-Undang Nomor 2 Tahun 2004 tentang Hubungan Industrial, khususnya arbitrase hubungan industrial Indonesia sesuai dengan prinsip lex specialis dan lex generali.The solution of dispute of shouldn’t be resolved in the court, in the court, but also can be resolved through but also can be resolved through the courts of commonly be known as alternative dispute solution, one of which is arbitration. Industrial relations arbitration to resolve disputes only the interest and disputes between union/union workers at one company. Act No. 2 of 2004 about industrial  relations, specifically arrange the particulars of arbitration of industrial relations in Indonesia accord with principle lex specialis derogat lex generali.

Abstract

Konsekuensi logis dari ditetapkannya konsep Negara hukum, bahwa segala penyelenggaraan pemerintahan harus berdasarkan hukum (baik hukum tertulis maupun hukum tidak tertulis). Dalam pelaksanaan penyelenggaraan pemerintahan dikenal bentuk-bentuk instrument hukum dalam bentuk peraturan perundang-undangan, peraturan kebijakan, keputusan tata usaha negara, rencana bahkan bentuk peraturan intern (Interne Regeling). Kepolisian Republik Indonesia, sebagai pengayom, pelindung, dan penjaga ketertiban dan ketentraman masyarakat, dalam menjalankan tugasnya selalu bersinggungan dengan masyarakat (Hak). Dalam konteks polisi sebagai penjaga ketertiban juga wajib melaksanakan tugasnya yang didasarkan pada ketentuan peraturan hukum. Protap sebagai salah satu interne regeling yang secara hirarki peraturan mengikat pada setiap anggota polisi. Disisi lain, Protap tentang Prosedur Penindakan huru-hara, secara substansi bersinggungan dengan undang-undang No. 39 Tahun 1999 tentang HAM. Oleh sebab itu secara substansi materi muatan Protap harus berdasar pada Undang-Undang HAM juga. Hal ini mengingat bahwa kedudukan Protap sebagai peraturan pelaksana dari berbagai undang-undang yang berkaitan dengan bidang tugas anggota Polri dalam menangani huru-hara. Sehingga hirarki protap adalah sebagai verordnung yang tegas-tegas tidak boleh bertentangan dengan segala bentuk peraturan hukum yang ada di atasnya.Logical consequence of the enactment of the concept of rule of law, that all of government must be based on the law (both written law and unwritten law). In the implementation of governance known forms of legal instrument in the form of legislation, regulatory policies, a decision of the State, even plan form of internal regulation (Interne Regeling). Indonesian Police, as guidance as, protective, and maintain order and peace of society, in performing its duties is always tangent to the public (right). In the context of the police in to maintain order also required to carry out their duties based on the provisions of the rule of law. SOP as one of the interne regeling the hierarchical rules binding on every member of the police. On the other hand, standard operating procedure regarding enforcement procedures riot, substantially interfere with the law No. 39 Year 1999 on Human Rights. Therefore, in substance the substance of standard operating procedure should be based on human rights law as well. This is considering that the position of standard operating procedure as the implementing regulations of the various laws relating to field duty police officers in handling the riots. So the hierarchy of standard operating procedure is as verordnung strictly must not conflict with any existing legal regulations on it.

Abstract

Kejahatan di dunia maya adalah persoalan baru dan perbuatan pidana yang berdimensi baru. Undang-Undang Informasi dan Transaksi Elektronik diharapkan bisa memayungi bidang telematika. Namun, Undang-Undang tersebut masih memiliki kendala yuridis dan kendala penanganan tersangka. Banyak ketentuan-ketentuan yang menyangkut perbuatan yang dapat dihukum belum masuk dalam Undang-Undang tersebut.Crime in cyberspace is a new problem and new dimensions of criminal acts. Information Act and Electronic Transaction is expected to be an umbrella for the field of telematics. However, the Act still has the legal obstacles and constraints handling of suspects. Many of the provisions relating to actions that can be punished yet in the Act.

Abstract

Menurut Nr hukum. 28, 2009, setiap pemerintah daerah atau Provience sholud menjadi relay peraturan saja mereka lokal tentang Pajak dan Retribusi. Basis revisi pada dua alasan, pertama, tentang tarif dan waktu; kedua batas untuk mengambil uang dari fiskus. Untuk mencapai target anggaran, pemerintah setempat harus repaidly merevisi semua peraturan daerah. Berdasarkan alasan ini, penelitian ini akan muncul posisi Pajak Daerah dan Retribusi Daerah berurusan dengan Anggaran. Data akan menunjukkan tren pajak dan retribusi form 2007, 2008 dan 2009.According to law Nr. 28, 2009, every local government or provience sholud be a just they local regulation relay on Tax and Retribusi. The revision base on two reason, first, about tariff and the second, time limits to take some money from fiscus. To reach a target of Budgeting, local government should be repaidly revise all the local regulation. Base on this reason, this research will show up the position of Local Tax and Retribusi dealing with Local Budgeting. The data will show the trend of tax and retribusi, fraom 2007, 2008, and 2009.

Abstract

Pajak telah sangat berperan penting bagi Negara. Tapi, tidak bisa disangkal bahwa negara sering mengalami kesulitan untuk mengumpulkan itu karena jumlah besar wajib pajak yang tidak patuh dalam melakukan pembayaran pajak. Para wajib pajak kurang menyadari arti penting pajak, di mana mereka sering dalam tunggakan pajak sampai hutang pajak mereka menjadi akumulasi. Setelah hutang pajak yang dilakukan menekan mengklaim jika belum dibayar maka dilakukan kejang yang salah satunya adalah dibuat beku. Di mana, setelah pembekuan itu adalah membuat pembukaan rekening untuk mengetahui jumlah saldo Wajib Pajak atau Pajak Pembawa. Sementara, perbankan memiliki ketentuan Rahasia Bank mewajibkan pihak bank untuk menjaga informasi nasabah dan deposito mereka rahasia. Perumusan masalah dalam penulisan tugas terakhir adalah Apa adalah tindakan hukum Pelayanan Pajak Point pada pembukaan rekening pembayar pajak orang individu bank dalam rangka penyitaan kekayaan di bank sesuai dengan Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan. Jenis penelitian yang digunakan adalah satu normatif dengan menggunakan pendekatan penelitian yaitu pendekatan Kisah Para Rasul. Data yang digunakan adalah data primer dengan cara wawancara langsung dengan pihak terkait dalam hal ini adalah KPP Pratama (Pelayanan Pajak Point) Sidoarjo Selatan dan data sekunder yang diperoleh dari data literature. Hasil penelitian ini adalah tindakan hukum Pelayanan Pajak Point pada orang pembayar pajak pembukaan rekening bank individu dalam rangka penyitaan kekayaan menurut Kisah Nomor 10 Tahun 1998 tentang Perbankan yaitu dalam pelaksanaan pembukaan rekening di budi dari perpajakan diperbolehkan untuk mengungkapkan rahasia bank, bahwa kasus ini sesuai dengan pasal 40 dan 41 dari Kisah Para Rasul Perbankan.Tax have very important role for State. But, it is undeniable that the state frequently has difficulties to collect it due to the great numbers of tax payers who do not obedient in making the tax payments. The tax payers less aware of the important meaning of tax, in which they are often in delinquent tax until their tax debts become accumulated. Upon the tax debt conducted the pressing a claim if it have not been paid then conducted the seizures that one of those is made the freezing. In which, after the freezing it is made the account opening to know the balance amount of Tax Payer or Tax Bearer. While, the banking have the Bank Secret provision obligating the bank side to keep the information of depositors and their deposits secret. The problems formulation in this last assignment writing were What is the legal act of Tax Service Point upon the opening of individual person tax payer bank account in the framework of wealth seizure in bank according to the Acts No. 10 of 1998 about Banking. The research type used was the normative one using the research approach namely the Acts approach. Data used were the primary data by means direct interview with the related parties in this case was the Pratama KPP (Tax Service Point) ofSouth Sidoarjoand the secondary data obtained from the literature data. Result of this research was the legal act of the Tax Service Point upon the individual person tax payer bank account opening in the framework of wealth seizure according to the Acts No. 10 of 1998 about the Banking namely in the implementation of account opening in the favor of taxing is allowed to reveal the bank secret, that this case is in accordance with articles 40 and 41 of the Banking Acts.

Abstract

Desentralisasi pelayanan publik untuk mewakili upaya pemerintah setempat untuk membuat debirokratisasi. Melalui konsep menemukan kembali pemerintah yang dapat digunakan untuk reformasi birokrasi dalam pengelolaan pelayanan publik. Debirokratisasi publik dan deregulasi bahwa spesifikasi manajemen orientasi umum pelayanan publik dan juga panduan untuk menilai kinerja pelayanan publik. Deregulasi pelayanan perizinan dengan mengorganisir layanan perijinan terpadu di pemerintah daerah.Decentralize the public service to local government represent the effort to do the debureaucracyzation. Through concept of Reinventing Government can be used for the reform of bureaucracy in public service management. Debureaucracyzation and deregulation public service as specifying of common guidance of public service management and also guidance of public service performance assessment. Deregulation to management of licensing service as arranging of inwrought licensing service in local government.
