Abstract

In the course of the constitutional state of the Republic of Indonesia specifically related to the patterns and actions carried out by the President and Vice President during his leadership process and the process of their succession certainly experienced its own dynamics. One of the dynamics is related to the election of the president and vice president directly by the people, both President and Vice President will voiced their respective visions and missions to the people. The delivery of the visions and missions of the President and Vice President before and after being elected were still limited to an oral narrative and could not be translated into a juridically intact scope. Therefore the visions and missions of the prospective President and Vice President are deemed necessary to be reviewed in terms of the direction, insight and development planning based on the 1945 Constitution in order to realize the implementation of national development planning system in a sustainable manner and prioritize the interest of the people above all.Keywords : Actualization ; Vision and Mission of the President and Vice President; National Development Planning SystemDalam perjalanan ketatanegaraan negara Republik Indonesia khususnya terkait dengan pola dan tindakan yang dilaksanakan Presiden dan Wakil Presiden selama proses kepemimpinannya dan proses pergantian kepemimpinan tentu mengalami dinamikanya tersendiri. Salah satu dinamika tersebut terkait dengan adanya pemilihan presiden dan wakil presiden secara langsung oleh rakyat, Presiden dan Wakil Presiden akan menyuarakan visi dan misinya kepada rakyat. Penyampaian visi dan misi Presiden dan Wakil Presiden baik saat sebelum dan setelah terpilih masih terbatas pada narasi lisan dan belum dapat diterjemahkan dalam lingkup yang utuh secara yuridis. Abstract

AbstrakIndonesia merupakan negara maritime dengan garis panjang terpanjang di dunia dengan potensi air laut yang baik sebagai dasar pembuatan garam. Namun, ironisnya Indonesia belum mampu memenuhi kebutuhan garam nasionalnya. Ketidakmampuan memproduksi garam nasional untuk memenuhi kebutuhan garam dalam negeri mengakibatkan pemerintah mengeluarkan kebijakan impor garam. Tujuan dari penelitian ini ialah untuk meninjau dampak dari impor garam terutama di Kabupaten Jeneponto dan untuk meninjau efektivitas kebijakan pengendalian impor komuditas pergaraman terhadap kesejahteraan petambak garam di Kabupaten Jeneponto. Penelitian ini menggunakan metode kualitatif. Hasil penelitian menunjukkan bahwa dampak dari kegiatan impor garam sangat dirasakan bagi petambak garam di Jeneponto. Meningkatnya impor garam dari tahun ke tahun mengakibatkan harga garam nasional anjlok dan kurangnya permintaan pasar. Hal ini mengakibatkan menurunnya angka kesejahteraan masyarakat khususnya petambak garam. Pemerintah dalam hal ini telah mengeluarkan berbagai kebijakan untuk mengendalikan impor pergaraman. Namun, hingga saat ini kebijakan tersebut belum berdampak positif bagi kesejahteraan petambak garam, justru kebijakan tersebut menimbulkan kekacauan sector pergaraman.Kata Kunci: Efektivitas kebijakan; Pengendalian Impor Garam; Kesejahteraan Petambak Garam

Abstract

Peraturan Presiden Nomor 122 tahun 2012 tentang Reklamasi di Wilayah Pesisir dan Pulau-Pulau Kecil mengamanatkan penentuan lokasi reklamasi dan lokasi sumber material reklamasi wajib mempertimbangkan aspek teknis, aspek lingkungan hidup, dan aspek sosial ekonomi. Salah satu fenomena yang dihadapi oleh masyarakat di kota Makassar adalah pemerintah daerah dalam melaksanakan kegiatan reklamasi pantai yang bertujuan untuk meningkatkan pendapatan daerah dianggap tidak melibatkan pendapat masyarakat sekitar wilayah reklamasi yang mana sebahagian besar manfaat kegiatan tersebut hanya tertuju untuk kalangan masyarakat menengah ke atas dan kurang memperhatikan akan dampak yang ditimbulkan bagi golongan masyarakat ekonomi menengah ke bawah serta lingkungan. Kata Kunci: Persepsi Masyarakat, Reklamasi Pantai, Makassar

Abstract

Kementerian Kelautan dan Perikanan bertanggung jawab penuh dalam pengelolaan sumber daya perikanan sehingga dapat mengangkat penyidik di lingkungan kementeriannya. Keberadaan penyidik yang lebih dari satu instansi diharapkan mampu mengatasi tindak pidana di bidang perikanan. Kalimat dalam rumusan pasal 73 ayat (1) Undang-undang No. 45 Tahun 2009 tentang Perikanan bersifat kumulatif atau alternatif karena menggunakan kata dan / atau sehingga tidak dapat diterima karena dapat saja diartikan ketiga-tiganya atau salah penyidik. Di sisi lain pihak berwenang dari instansi tersebut berdasarkan fakta atribusi mengingat instansi penyidik berdiri sendiri-sendiri dengan aturannya sendiri. Secara regulasi hal demikian dapat berdampak pada ketidakefektifan dalam penegakan hukum di bidang perikanan.Kata kunci: Penyidikan, P PNS Perikanan, SPP

Abstract

The most serious crimes that occurred in North Aceh left a deep scar for the victims. The birth of impunity causes victims to be naturally forced to survive. However, various fundamental rights that are difficult to access are a significant problem for survivors due to post-conflict trauma, making it difficult for survivors to open up to the local government. Therefore, the Women Volunteer Advocacy Institute for Humanity (RPuK) is here to bridge the fundamental rights needs of survivors with advocacy to local governments. This study aimed to determine the existence of RPuK in accommodating the fundamental rights of survivors. The method used is empirical legal research with interview and observation techniques. The study results reveal that the existence of RPuK for ten years in North Aceh Regency has built a unique advocacy program with the Regional Government in terms of fulfilling integrated service programs and unique service bazaars for survivors of the most serious crimes. Both programs focus on making identity cards, health insurance cards, marriage certificates, service mental health, employment assistance, and other fundamental rights. This success is a form of reparations as part of the fulfillment of transitional justice to the survivors. Interestingly, RPuK made a breakthrough in its food security advocacy program for the survivors during the pandemic. Thus, RPuK sees a new perspective that is far more important, prioritizing the survivors during the pandemic, fulfilling the survivors' economic, social, and cultural rights to fulfill human rights and transitional justice.

Abstract

What are the liabilities of regional government of Riau Province as shareholders in provincially-owned enterprise Bank based on provisions of Law Number 40 of 2007 on Limited Liability Companies? How is Control by regional government of Riau province as a shareholder in a provincially-owned enterprise Bank according to provisions of Law Number 40 of 2007 concerning Limited Liability Companies? Purpose of this study is to explain and analyze the liabilities of regional government of Riau province as shareholders in provincially-owned enterprise bank and to explain Control by the Regional Government of Riau Province as Shareholders in provincially-owned enterprise bank according to provisions of Law Number 40 of 2007 on Limited Liability Companies. Type of this research is sociological legal research. From results of this study, liabilities of shareholders is limited to the capital (shares) invested or owned or in other words, shareholders are not personally responsible for agreements made on behalf of company and are not responsible for the company's losses in excess of shares they owned, shareholders are personally responsible for the losses of a limited liability company, if requirements of limited liability company as a legal entity have not been or are not fulfilled, bad faith to take advantage of company solely for personal interests and, shareholders are involved in unlawful acts using the company's assets which resulted in company can’t pay off company's debt, limited liability company of provincially-owned enterprise bank is a limited liability company which is partially closed. Shares in the Bank can be owned by many parties, in this case provincial government and regency/city governments within the province. With the conclusion that the shareholder is not personally responsible for the action made on behalf of company and is not responsible for the company's losses in excess of the shares owned,.

Abstract

This research focuses on solving problems in the field of law in the Indonesian Navy which regulates the mechanism for the synergy between the Pomal and the National Police regarding the delegation of criminal cases carried out by civil servants within the Navy, the mechanism for carrying out investigations and investigations carried out by investigators and Pomal investigators or Provos Unit against the process of examining civil servants with civilian status, technical rules within the Indonesian Navy that regulate legal settlement if there is a difference of opinion between Pomal and Atkum investigators regarding the settlement of cases carried out by civil servants in military units. The research method used is a legal research method with a descriptive approach. Synergy and cooperation in the use of software and hardware in their respective investigative fields. The process of delegating case files and resolving criminal cases involving civil servants within the Navy can run well and smoothly due to a good cooperative relationship and synergy between Pomal investigators and Polri investigators. The process of resolving disciplinary violations committed by civil servants within the Indonesian Navy is carried out by Pomal investigators starting from examining violations, preparing for administrative completeness of examinations to imposing disciplinary penalties by officials authorized to punish within the Navy.

Abstract

Abstract             The Village Government plays a role in the management and implementation of governance in the Village in order to realize village autonomy. The Village Government is absolutely responsible for what it has done to the community in order to carry out its duties, powers and obligations as regulated in statutory regulations, including in terms of providing a good living environment. The relationship between the role of the village government and the environment in this study is emphasized on efforts to protect the rural environment. The need for environmental regulation in the village is currently considered urgent in order to save the environment and become a guideline for the community and local government. However, due to the absence of this village regulation, the Mattampawalie Village Government issued a policy in the form of a Village Head decision as a form of concern for environmental protection in Mattampawalie Village, however, the material contained in the Village Head's decree has not been systematically compatible with environmental management and protection standards as regulated in Law No.32 of 2009 concerning environmental protection and management.Keywords: Role, Village Government, Environment Abstrak            Pemerintah Desa berperan terhadap pengelolaan dan pelaksanaan pemerintahan di Desa guna mewujudkan otonomi desa. Abstract

Penal mediation is an alternative form of settlement of cases outside the court by prioritizing the principle of resortative justice which aims to achieve justice that is oriented towards improving the relationship between perpetrators and victims. This study aims to examine how the implementation and the obstacles faced by the Makassar City Police in conducting penal mediation in the settlement of minor theft cases. This research is a normative empirical research with a qualitative analysis approach. The result of the research obtained is that the implementation of penal mediation by the Makassar City Police in resolving minor theft cases is carried out based on police discretion as regulated by Law Number 2 of 2002 concerning the State Police of the Republic of Indonesia and Circular No. SE / 8 / VII / 2018 dated 27 July 2018 concerning the Application of Restorative Justice in the Settlement of Criminal Cases. The circular regulates how to apply the concept of restorative justice in solving criminal cases at the level of investigation or investigation in the police, while in its implementation there are still obstacles faced by the Makassar City Police, including emotional factors, namely the existence of selfishness between the perpetrator or victim justifying oneself and blaming the opposing party and financial (economic) factors, namely the inconsistency between the victim and the perpetrator to make peace, especially in matters of compensation.

Abstract

Abstract            The tendency of judges in imposing sanctions against children who commit criminal acts is still dominant in imposing criminal sanctions, especially imprisonment. This is evidenced by the discovery of data on child cases in the jurisdiction of the Sungguminasa District Court and the Makassar District Court, which in their decisions still tend to impose criminal sanctions. 2) Constraints in the application of criminal sanctions as a last resort for children who commit crimes, namely legal factors, community factors, and facilities / facilities.Keywords: implementation, criminal sanctions, the last choice, criminal acts, child.Abstrak                      Kecenderungan Hakim dalam Menjatuhkan Sanksi Terhadap Anak Yang Melakukan Tindak Pidana yaitu masih dominan menjatuhkan sanksi pidana terutama pidana penjara.
