Abstract

At the end of March 2018, there was an accident in the sea of Kalimantan-Balikpapan where a Panamanian-flagged vessel caused a leak over the oil pipeline. The pipeline connects the Crude Lawe-lawe Terminal to Pertamina's Balikpapan Plant. As a result, spilled oil is estimated at 40,000 barrels and resulted in five deaths. The aim of this study is to examine the regulation on environmental protection, especially on the oil and gas natural resources and what form the accountability of the oil spill on the shore. This paper is structured using a normative juridical approach to seek solutions to legal issues arising from such environmental cases. The study shows that the use of natural resources, which produce metals, coal, and minerals as a source of energy, oil and geothermal, should be based on the principles of environmental management, namely: equity, balances, democracy (democracy), and sustainability (sustainable) between generations. In terms of accountability both in civil liability, criminal, and an environment in accordance with the principle of direct liability (strict liability) with the occurrence of environmental pollution caused by the oil spill so legally PT Pertamina Regional East Kalimantan may be subject to the principle.

Abstract

The high flow of globalization and the easiness of obtaining visas for foreign citizens can increase the income of a country engaged in tourism. This phenomenon does not always have a positive impact for the country of Indonesia because many foreigners were found residing in the territory of Indonesia without having a valid and legal immigration stay permit. Many of these foreign citizens were convicted legal cases in Indonesia, it is therefore necessary to study the legal consequences of the free judgment for the foreign citizens. This study was conducted to examine the legal basis for the imposition of free judgment against foreign citizens and the implementation of the Denpasar District Court Decision Number 748/Pid.Sus/2016/PN DPS on the free judgment against a foreign citizen. This study is an empirical juridical study that examines the legal consequences caused after the abolition of free judgment on foreigner (Case study of Denpasar District Court No. 748/ Pid.Sus / 2016 / PN DPS). Based on the result of this study, was found that according to Law Number 8 Year 1981 regarding Criminal Procedure Law and law of the republic of Indonesia Number 6 Year 2011 on Immigration, foreigners who live in the territory of the Republic of Indonesia who do not have a valid and legal immigration stay permit can be given immigration administrative action in the form of detention. Whereas foreign citizens who are secured and still hold immigration stay permit until the completion of the judicial process and given free judgment, the foreigners may remain in the territory of the Republic of Indonesia until the validity period of their stay permit expires. Meanwhile, for foreign citizens who have been subjected to free judgment and still hold immigration permit, the Public Prosecutor may request the Immigration Civil Service Investigator to perform the act of detention to those foreign citizens. Tingginya arus globalisasi dan kemudahan memperoleh visa bagi warga negara asing dapat meningkatkan pendapatan suatu negara yang bergerak dalam bidang kepariwisataan. Fenomena ini tidak selalu berdampak positif bagi negara Indonesia karena banyak ditemukan orang asing yang berada di wilayah Indonesia tidak memiliki izin tinggal keimigrasian yang sah dan masih berlaku. Banyak diantara warga negara asing tersebut tersandung kasus hukum di Negara Indonesia, sehingga perlu dikaji akibat hukum yang ditimbulkan atas Putusan Bebas bagi warga negara asing tersebut. Penelitian ini dilakukan untuk mengkaji dasar hukum penjatuhan putusan bebas terhadap warga negara asing dan pelaksanaan Putusan Pengadilan Negeri Denpasar Nomor 748/Pid.Sus/2016/PN DPS atas putusan bebas terhadap seorang warganegara asing. Penelitian ini merupakan penelitian yuridis empiris yang mengkaji akibat hukum yang ditimbulkan setelah dijatuhkannya Putusan Bebas terhadap orang asing (Studi kasus terhadap Pengadilan Negeri Denpasar Nomor 748/Pid.Sus/2016/PN DPS). Berdasarkan hasil penelitian ini ditemukan bahwa menurut Undang-Undang Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana dan Undang-Undang Republik Indonesia Nomor 6 Tahun 2011 Tentang Keimigrasian, orang asing yang tinggal di wilayah Negara Republik Indonesia yang tidak memiliki izin tinggal keimigrasian yang sah dan berlaku dapat dilakukan Tindakan Administratif Keimigrasian berupa pendetensian. Sedangkan warga negara asing yang saat diamankan dan hingga proses peradilan selesai masih memiliki izin tinggal keimigrasian dan dijatuhi putusan bebas, maka orang asing tersebut dapat tetap tinggal di wilayah Negara Republik Indonesia hingga masa berlaku izin tinggalnya habis. Sementara bagi orang warga negara asing yang telah dijatuhi putusan bebas dan masih memiliki izin tinggal keimigrasian namun oleh Penuntut Umum dilakukan upaya hukum kasasi, Penuntut Umum dapat meminta kepada Penyidik Pegawai Negeri Sipil Keimigrasian untuk melakukan tindakan pendetensian atas warga negara asing tersebut.

Abstract

Delegation means delegation of authority to make Law and Regulations. Article 246 paragraph (1) of Act No. 23 of 2014 on Regional Government stipulates that “to implement the Regional Regulation or over the power of Law and Regulations, the Head of Region shall pass the Head of Region Regulation.” The words "implement" and "over the power" which contains ambiguity of command cause philosophical problem related to the validity value. It becomes a sociological problem if such delegation cannot predict the dynamics of society. Furthermore, it becomes a juridical problem due to the existence of vague norm which creates multi interpretation which could potentially miss the aim of delegation of regulation. Specifically, this article has specific aims to examine philosophically concerning the need for delegations of authority to regulate, examine and find the direction of regulation in the delegation of regulation to governor regulation in ensuring utility and justice. This is a normative legal research with literature study which employs statute, philosophy, theories, conceptual and contextual approaches. The study so that with regard to the philosophical basis, delegation of regulation to Governor Regulation is needed to formulate technical and detail norms, the urgent factor contained herein as well as brief discussion and The direction of regulation to the Governor Regulation in the Regional Government Act to implement Regional Regulation or over the power of law and regulations. Such direction is based on command from the higher law and regulations, or established based on delegation.

Abstract

International trade in higher education belongs to the more complex reality in the international trade in services, become global trends and reform in system of higher education all over the world. This research is aimed at finding out both modes of supply and principles of GATS regarding international trade in services. The main objective of the GATS is creating a credible and reliable system of international trade rules; ensuring fair and equitable treatment of all members; stimulating economic activity through guaranteed policy bindings and promoting trade and development through progressive liberalization. This study used normative research. The method used for collecting data was the statute approach. Primary legal sources derived from WTO Trade in Services Division regarding GATS obligations and the principles of the international trade in services. The result of this study, it was found that, there were four modes of supply trade in education under GATS (article 1:2) such as: cross-border supply; consumption abroad; commercial presence and delivery abroad; and the principles of GATS divided into two categories; Firstly, unconditionally obligations, such as the Most-Favoured Nation (article II GATS) and Transparency (article III GATS) apply directly and automatically to all WTO members and services sector regardless of whether WTO member schedule commitment or not; Secondly, conditionally obligations such as: National Treatment (article XVII) and Market Access (article XVI)  and only applies to commitment listed in national schedules.Perdagangan internasional dalam pendidikan tinggi milik realitas yang lebih kompleks dalam perdagangan internasional di bidang jasa, menjadi tren global dan reformasi dalam sistem pendidikan tinggi di seluruh dunia. Penelitian ini bertujuan untuk mengetahui model-model pasokan dan prinsip-prinsip GATS mengenai perdagangan internasional di bidang jasa. Tujuan utama dari GATS adalah menciptakan sistem yang kredibel dan terpercaya aturan perdagangan internasional; memastikan perlakuan yang adil dan merata dari seluruh anggota; merangsang kegiatan ekonomi melalui binding kebijakan dijamin dan mempromosikan perdagangan dan pembangunan melalui liberalisasi yang progresif. Penelitian ini menggunakan penelitian normatif. Metode yang digunakan untuk mengumpulkan data adalah pendekatan undang-undang. Sumber hukum primer berasal dari WTO/GATS Divisi Perdagangan Jasa mengenai kewajiban dan prinsip-prinsip perdagangan internasional di bidang jasa. Hasil penelitian ini, ditemukan bahwa, ada empat model perdagangan pasokan dalam pendidikan di bawah GATS (pasal 1: 2) seperti: pasokan lintas batas; Konsumsi di luar negeri; Kehadiran komersial dan pengiriman luar negeri; dan prinsip-prinsip GATS dibagi menjadi dua kategori; Pertama, kategori kewajiban tanpa syarat, yaitu: Most-Favoured Nation (pasal II GATS) dan Transparansi (pasal III GATS) berlaku secara langsung dan secara otomatis kepada semua anggota WTO dan sektor jasa terlepas dari apakah anggota WTO membuat jadwal  komitmen atau tidak; Kedua, kewajiban dengan persyaratan seperti: Perlakuan Nasional (pasal XVII) dan Akses Pasar (pasal XVI) dan hanya diaplikasikan terhadap daftar komitmen yang tercantum dalam jadwal nasional.

Abstract

This study aims to analyze the nature of political party recall rights to the membership of the House of Representatives; recall rights of members of the People's Legislative Assembly by political parties whether they are in accordance with the principles of a democratic state based on law; Juridical consequences of recall rights if they remain in the hands of political parties. This type of research is normative law research. The results of the study indicate that the nature of the right of Recall by political parties to the membership of the People's Legislative Assembly is that political party members who sit in parliamentary seats remain supervised by political parties as political organizations that carry on the democratic stage in order to be submissive and obedient to party policies even if they are against the spirit struggle of the people's representatives. The right of a political party's recall is not in accordance with the principles of a democratic state, if the reason for recalling the membership of the House of Representatives is only limited to members of the House of Representatives who violate the Articles of Association and Household Budget. Penelitian ini bertujuan untuk menganalisis Hakikat hak recall partai politik terhadap keanggotaan Dewan Perwakilan Rakyat; hak recall terhadap anggota Dewan Perwakilan Rakyat oleh partai politik apakah telah sesuai dengan prinsip-prinsip negara demokrasi yang berdasarkan hukum; konsekuensi yuridis hak recall apabila tetap berada di tangan partai politik. Tipe penelitian ini adalah penelitian hukum normatf. Hasil penelitian menunjukkan bahwa hakikat Hak Recall oleh partai politik terhadap keanggotaan Dewan Perwakilan Rakyat adalah agar anggota partai politik yang duduk di kursi parlemen tetap diawasi oleh partai politik sebagai organisasi politik yang mengusung dalam pentas demokrasi agar tunduk dan patuh terhadap kebijakan partai sekalipun bertentangan dengan semangat perjuangan wakil rakyat. Hak Recall Partai Politik tidak sesuai dengan prinsip-prinsip negara demokrasi, apabila alasan merecall keanggotaan Dewan Perwakilan Rakyat hanyalah sebatas anggota Dewan Perwakilan Rakyat melakukan pelanggaran terhadap Anggaran Dasar dan Anggaran Rumah Tangga Partai politik.

Abstract

The WTO – TRIPs Agreement regulates the principle of non- discrimination which must be complied by its member countries. There are two principle of non discriminationnamely the principle of National Treatment ( NT ) and Most Favoured Nations principle (MFN).  This study focus to the adoption of MFN and NT principles into IntellectualProperty Rights  laws of Indonesia whether it harmony with the legal system in Indonesia.   This study uses the normative legal research methods by using  conceptual approachand statute approach . The  legal materials that studies in this research  consists of thePrimary Legal Materials : Act No.  19 of  2002 , Act No. No. . 15 of 2001, Act No. 14 of2001,  as well as the TRIPs Agreement.  Secondary legal materials studied in this research are  legal text books and law journals related to NT and MFN principle in the field of IntellectualProperty Rights.                                  .The results showed that the Principle of Non Discrimination System in the form of theprinciple of National Treatment (NT) expressly governed through  Article 3 TRIPsAgreement and the principle of Most Favoured Nations (MFN) regulated  through  Article 4TRIPS Agreement.  As a member of WTO-TRIPs Agreement, Indonesia should comply andadopt the MFN and NT principles into IPR laws. Currently those principles exist implicitlyand explicitly such as in the Act No. 19 of 2002, the Act No. 14 of 2001, and the Act No. 15of 2001.  Although the MFN and NT principles has already adopted, it is still need moreeffort to implement the principle of non Discrimination, especially in the relationshipbetween Indonesia and other unequal size countries, between developing and developedcountries.

Abstract

This study aim to describe and analyze in debt about the basic authority in resolving Main Assembly of Pakraman Village or Majelis Utama Desa Pakraman (MUDP) Bali Province speech by justice and how to talk through the judicial settlement process by MUDP Bali Province. This research used normative legal research based legal document research and library research. The conclusion in this study, that authority obtained MUDP Bali to finish the speech obtained a mandate by Council Decision No. 050 Main Pakraman / Kep / Psm-1 / MDP Bali / III / 2006 concerning the results of the Great Pasamuhan I MDP Bali and Completion of speech through the courts by MUDP Bali has been arranged by the Decision of the MDP Bali Number: 002 / Skep / MDP Bali / IX / 2011 on the Implementation Guidelines and Technical Guidelines Speech by Assembly Resolution Pakraman (MDP) Bali as a form of autonomy that is owned by Pakraman.

Abstract

This study aimed to know and understand about the legal culture of community on the phenomenon of different caste nyentana marriage. This research was empirical legal research legal research with behavioral approaches. The data source consisted of primary data sourced directly at the site of research and secondary data that included legislation, traditional laws, law books, magazines, dictionaries and newspapers. This study used qualitative data analysis which then produced descriptive data.Based on the national legal perspective, there are no differences in the position of husband and wife in different caste nyentana marriage. But in Balinese customary law, it resulted in the wife having a position that is more important than the husband in the family. As in the context of social life, especially in the capacity as krama in the sub-village, then the husband remains responsible for his obligations as krama muani while the wife still serves as krama luh. Related to the legal culture of indigenous people in Tabanan over different caste nyentana marriage, the fact that people are still of the view that marriage is an inter-caste marriage. Thus the legal culture of indigenous people in Tabanan tends to be static. This is motivated by many factors, one of which is either ignorance factor of traditional leaders or traditional krama of Decree of the Parliament No. 11 of 1951 which expressly has abolished inter-caste marriages that often lead to discrimination. Penelitian ini bertujuan untuk mengetahui dan memahami tentang budaya hukum masyarakat terhadap fenomena hukum perkawinan nyentana beda wangsa. Penelitian ini ialah penelitian hukum penelitian hukum empiris dengan pendekatan pendekatan prilaku (behavioral approach). Data primer bersumber langsung dari lokasi penelitian, sedangkan data sekunder berupa peraturan perundang-undangan, awig-awig­, literature hukum, majalah, kamus dan surat kabar. Pada penelitian ini data dianalisis secara kualitatif yang kemudian menghasilkan data deskriptif. Berdasarkan perspektif hukum secara nasional, tidak terdapat perbedaan kedudukan suami-isteri dalam perkawinan nyentana beda wangsa. Namun dalam Hukum adat Bali, justru mengakibatkan istri memiliki kedudukan yang lebih penting dibanding suami di dalam keluarga. Adapun dalam konteks kehidupan bermasyarakat, khususnya dalam kapasitas sebagai krama di banjar, maka si suami tetap bertanggung jawab pada kewajibannya sebagai krama muani sedangkan si istri tetap berkedudukan sebagai krama luh. Terkait dengan budaya hukum masyarakat hukum adat di Tabanan terhadap perkawinan nyentana beda wangsa, faktanya masyarakat tetap berpandangan bahwa perkawinan tersebut merupakan perkawinan antar kasta. Dengan demikian budaya hukum masyarakat hukum adat di Tabanan cenderung bersifat statis. Hal ini dilatarbelakangi oleh banyak faktor, salah satu diantaranya ialah faktor ketidaktahuan baik dari pemuka adat maupun krama adat tentang Keputusan DPRD  No. 11 Tahun 1951 yang secara tegas telah menghapus perkawinan antar kasta yang kerap menimbulkan diskriminasi.

Abstract

One part of the judicial process is verifying evidence for searching the material truth of case to assist judges in making decisions. One aid that can be used in verification the evidence during the trial is the Information Technology in the form of Circuit Closed Television (CCTV) footage because it is not regulated in the positive Law in Indonesia. Because of that, in this research are used a normative method to answer the problem with the approach of legislation and approach to the concept. The legal arrangement of CCTV footage as evidence in Act No. 8 of 1981 on the Law of Criminal Procedure Code is not exist, because the Criminal Procedure Code are setting a limited valid evidence under the Act, but for the interest of seeking the material truth, then there makes Act No. 11 of 2008 on Information and Electronic Transaction which govern the other evidence in the form of Electronic Information and/or Electronic Records. The strength of evidence from CCTV footage has not been expressly provided in Act No. 11 of 2008 on ITE, so that the strength of evidence is still exempt, which means that the strength of evidence is still based on the judge’s conviction. Salah satu bagian dalam proses peradilan yakni adanya proses pembuktian guna mencari kebenaran materiil dari suatu perkara guna membantu hakim dalam mengambil keputusan. Salah satu bantuan yang dapat digunakan dalam pembuktian di persidangan adalah teknologi informasi yang berbentuk rekaman CCTV, tetapi dalam persidangan dipertanyakan akan kekuatan pembuktian dari rekaman CCTV tersebut, karena tidak diatur dalam hukum positif di Indonesia. Penelitian ini mempergunakan metode penelitian normatif untuk menjawab permasalahan tersebut dengan pendekatan perundang-undangan dan pendekatan konsep. Pengaturan rekaman CCTV sebagai alat bukti ini dalam Undang-Undang Nomor 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana (selanjutnya disebut KUHAP) tidak ditemukan pengaturannya, karena KUHAP mengatur secara limitatif alat bukti yang sah menurut Undang-Undang. Demi kepentingan mencari kebenaran materiil maka dibentuklah Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik yang mengatur tentang alat bukti lain berupa informasi elektronik dan/atau dokumen elektronik. Kekuatan pembuktian dari rekaman CCTV belum diatur dalam Undang-Undang Nomor 11 Tahun 2008 tentang ITE, sehingga pembuktiannya masih bersifat bebas, yang artinya kekuatan pembuktian dari alat bukti tersebut masih berdasarkan atas keyakinan hakim.

Abstract

Supervision of regional regulations is a new authority possessed by the Regional Representative Council. The purpose of writing this article is to examine the implications of regional regulation oversight arrangements by the Regional Representative Council. This article uses a normative legal research method with a statue approach, a legal concept analysis approach, and a historical approach. The results of the study show that the implications of regional regulation oversight by the Regional Representative Council as Article 249 paragraph (1), letter j, Law number 2 of 2018, namely: cause legal uncertainty due to unclear regulation; raises legal problems if related to article 31 of Law number 3 of 2009, article 245 of Law number 9 of 2015, articles 15 and 16 of Law number 6 of 2014; and raises the problem of constitutionality. Pengawasan terhadap peraturan daerah merupakan wewenang baru yang dimiliki oleh Dewan Perwakilan Daerah. Artikel ini bertujuan untuk mengkaji implikasi pengaturan pengawasan peraturan daerah oleh Dewan Perwakilan Daerah. Artikel ini memakai metode penelitian hukum normative sebagai jenis penelitian, yang dikaji melalui pendekatan perundang-undangan, analisis konsep hukum, dan juga sejarah. Hasil studi menunjukkan bahwa Implikasi pengaturan pengawasan peraturan daerah oleh Dewan Perwakilan Daerah sebagaimana tertuang pada Pasal 249 ayat (1), huruf j, Undang-Undang nomor 2 tahun 2018, yakni: menimbulkan ketidakpastian hukum karena pengaturannya yang tidak jelas; menimbulkan masalah hukum apabila dikaitkan dengan pasal 31 Undang-Undang nomor 3 tahun 2009, pasal 245 Undang-Undang nomor 9 tahun2015, pasal 15 dan 16 undang-undang no. 6 tahun 2014; serta menimbulkan problem konstitusionalitas.
