Abstract

Research in connection with the theme is “ Implementation of Good Corporate Governance (GCG) in Procurement at PLN Bali”. The problems are researched the translation of good corporate governace forms in the procurement of goods and services at PLN Bali and the form of the procurement of goods and services at PLN Bali. This research includes the category of empirical legal research, legal research is a empirical means reviewing the practical reality in daily life - today. The nature of the research is descriptive research that has a goal to paint a picture of something in the area and at a certain moment. Furthermore, the technique used is to study documents, interviews, Non-Probability Sampling, purposive sampling. Procurement of goods or services in PLN involves many parties, the employees who were appointed to take care of such procurement and future providers of goods and services. In this relationship unfair business competition or the price is too high or low in supply. However, the existence of e-procurement and the correct procedures in the procurement of goods and services as well as the concept of GCG which also animates the principles of procurement of goods and services. Procedures in the procurement of goods and services as well as the principles of GCG, the procurement in PLN can be carried out transparently, responsibly, independently, fairly and equitably.

Abstract

The purpose of this research is to discover the existence of autonomy of Desa Pakraman in legal pluralism perspective. Related with that purpose, there are two issues that will be discussed, first, how does the existence of the autonomy of Desa Pakraman in Indonesia’s legal system?,Second, how does the existence of the autonomy of Desa Pakraman in legal pluralism perspective?. The research method is normative legal research using statue approach, concept approach and analytical approach and law analysis by using legal interpretation. Based on the problems, the results of discussion are : first, the existence of the autonomy of Desa Pakraman within the Indonesia’s legal system has regulated in the 1945 Constitution of the Republic of Indonesia, national and local Regulations. In the Constitution, specifically Article 18 B of paragraph (2), declare that the states recognizes Desa Pakraman and their traditional rights. In regulation of Law No.5 of 1960 concerning basic Agrarian Law (UUPA), regulation of Human Rights, and regulation of Desa (Village) are clearly recognize Desa Pakraman as traditional institution has traditional rights, one of it is the autonomy of Desa Pakraman. At the local regulation, autonomy Desa Pakraman has regulated in Local Regulation about Desa Pakraman. Second, that existence of autonomy Desa Pakraman in perspective legal pluralism is that the existence autonomy Desa Pakraman is a weak legal pluralism. In perspective weak legal pluralism the state law as a superior and the customary law as an inferior, its position in the hierarchy under State law. As a theory, the semi-autonomous social field from Sally Falk Moore perspectives that Desa Pakraman is semi-autonomous. Desa Pakraman has capacity to hold their village based on the customary law and outomaticly Desa Pakraman to be in framework of state law.

Abstract

Area Immigration is an area that is in every Immigration Check Point (TPI) in which the functions of immigration especially related to the people’s traffic inspection which coming in and out of a country and there are a restricted and a sterile  area that can only be traversed by parties concerned like the passengers or crew whom will exit or entry Indonesian territory or official and authorized personnel. Arrangements regarding to the area of ??immigration set in Part Five, Article 22 paragraph (1) of Immigration Law determined that: In every Immigration Checkpoints assigned a specific area to immigration inspection is the area of ??immigration. The existence of the immigration area reflects the immigration service quality standards in a country. As an international area marked by yellow line (yellow line), the area of ??immigration has a position that is as important as the sovereignty of a country. Normatively, immigration area which available in each Immigration Check Point is the place and area that was authorized by the Ministry  and has a legal status (legal standing) and legitimate in law. So that the existence of the immigration area is a representation of authority and sovereignty. But immigration area is less effective because of the legal instruments governing inadequate and also people have not been aware of law so that there are many violations happens in the immigration area.

Abstract

The guidance and development of military law are needed and intended to guarantee the respect for human rights, rule of law and justice in the military environment, which among others are manifested through a system of law and order in the law number 25 of 2014 on the law of military discipline. Under the provisions of article 6 paragraph (1) of law number 25 0f 2014, then the law of military discipline should be imposed on any person  who under the law equated with the military, including the citizens who are mobilized for their expertise in time of war. The enforcement is considered to be too early, given the sentencing of military discipline for offenders who have violated the law of military discipline must be performed by the Authorized adjudge (Ankum), but on the other hand, the law of number 25 of 2014 on the law military discipline does not provide any explicit and complete arrangements or provisions about the Ankum’s authority in enforcing discipline  against citizen who are mobilized in time of war. Through the method of the normative legal research with an approach to the concept and approach to legislation, it can be concluded that assesment  of vagueness  of these arrangements is quite essential, considering that the vaqueness of these arrangements may result in legal uncertainty, therefore, it is needed more complete arrangement in order to implement the provisions of the law of military discipline against citizens who mobilized in time of war. Pembinaan dan pengembangan hukum militer diperlukan dan ditujukan untuk menjamin terciptanya penghormatan terhadap hak asasi manusia, kepastian hukum dan keadilan di lingkungan militer, yang diantaranya diwujudkan melalui suatu sistem dan tatanan hukum dalam Undang-Undang Nomor 25 Tahun 2014 tentang Hukum Disiplin Militer. Berdasarkan ketentuan Pasal 6 ayat (1) Undang-Undang Nomor 25 Tahun 2014, maka Hukum Disiplin Militer juga diberlakukan kepada setiap orang yang berdasarkan undang-undang dipersamakan dengan militer, diantaranya adalah warga negara yang dimobilisasi karena keahliannya pada waktu perang. Pemberlakuan ini dianggap terlampau dini, mengingat penjatuhan hukuman disiplin militer bagi pelaku yang melakukan pelanggaran hukum disiplin militer harus dilakukan oleh seorang Atasan Yang Berhak Menghukum (Ankum), namun di sisi lain, Undang-Undang Nomor 25 Tahun 2014 tentang Hukum Disiplin Militer tidak memberikan pengaturan secara tegas dan lengkap tentang kewenangan Ankum dalam menegakkan hukum disiplin terhadap warga negara yang dimobilisasi pada waktu perang. Melalui penelitian hukum normatif dengan pendekatan konsep hukum dan pendekatan perundangan-undangan, maka dapat disimpulkan bahwa pembahasan tentang kekaburan pengaturan ini merupakan hal yang cukup penting, mengingat kekaburan tersebut dapat menimbulkan ketidakpastian hukum, dan oleh karenanya diperlukan pengaturan lanjutan yang lebih lengkap dalam upaya menerapkan ketentuan hukum disiplin militer terhadap warga negara yang dimobilisasi pada waktu perang.

Abstract

This study aims to analyze the need to establish a special election court which has the authority to solve various election law cases in order to realize elections with integrity; and analyzing the formulation of election special justice in order to realize the integrity of the election. The research method used is the method of normative legal research and the implementation of this research collects data from various sources in order to get an answer to the issues that have been formulated. The results of the study shows that the purpose of the need for the formation of special judicial elections; First, to meet the growing demands of increasingly complex justice in society and more election law enforcement so as to realize the integrity of the elections; Second, To handle the election law cases quickly and simply so as to obey the integrity of the election. Formulation; First, the election special justice to be able to work quickly and simply in handling election law cases, domiciled at the central and provincial level, then entering the District Court or the High Court; Secondly, the Guidelines for the election special judicial law shall be based on Supreme Court Regulation Number 4 Year 2017 on Procedures for the Settlement of Administrative Offenses of the General Elections in the Supreme Court. Penelitian ini bertujuan untuk menganalisis perlunya membentuk peradilan khusus pemilu yang mempunyai kewenangan menyelesaikan berbagai perkara hukum pemilu agar terwujud pemilu yang berintegritas; dan menganalisis formulasi pembentukan peradilan khusus pemilu dalam rangka mewujudkan integritas pemilu. Metode penelitian yang digunakan ialah metode penelitian hukum normatif dan pelaksanaan dari penelitian ini mengumpulkan bahan hukum dari berbagai sumber guna mendapatkan suatu jawaban atas pokok-pokok permasalahan yang telah dirumuskan. Hasil penelitian menunjukkan bahwa tujuan perlunya pembentukan peradilan khusus pemilu; Pertama, Untuk memenuhi tuntutan perkembangan akan keadilan yang semakin kompleks dalam masyarakat dan lebih penegakan hukum pemilu sehingga mewujudkan integritas pemilu; Kedua, Untuk menangani perkara hukum pemilu dengan cepat dan sederhana sehingga mewudkan integritas pemilu. Formulasi; Pertama, Peradilan khusus pemilu agar bisa bekerja cepat dan sederhana dalam menangani perkara hukum pemilu, berkedudukan di tingkat pusat dan provinsi, selanjutnya masuk pada Pengadilan Negeri atau Pengadilan Tinggi; Kedua, Pedoman beracara pada peradilan khusus pemilu berdasarkan pada Peraturan Mahkamah Agung Nomor 4 Tahun 2017 tentang Tata Cara Penyelesaian Pelanggaran Administratif Pemilihan Umum Di Mahkamah Agung.

Abstract

One of the implications of information technology to which attention is currently paid is its impact on the existence of Intellectual Property Right. One of the crimes committed to the right of intellectual property is the illegal imitation of presentation on web page of sites belonging to others popularly known as Offense against Intellectual Property. Based on the background above, the problems discussed in this study are the formulation of criminal act and the policy of formulation in the future system of sanction imposed upon the imitation of presentation of website in Indonesia. Normative method based on the regulations of laws related to the crime of the imitation of presentation of website in Indonesia was used in the present study. The results of the study showed that the elements of the formulation of criminal act of the imitation of presentation of website in Indonesia are subjective and objective ones. The policy of the formulation of the system of criminal sanction imposed upon the limitation of presentation of website in Indonesia applies the type of cumulative criminal threaten which includes two types of punishment. The formulation is a 2 (two) year imprisonment and/or a maximum spesific fine of Rp. 150.000.000,00 (one hundred fifty thousand rupiahs), based on Article 72 Clause (6) jo Article 24 of the Criminal Law.

Abstract

This article was written based by result of normative legal research about the regulation of padagelahang marriage on customary law that created by customary law society of desa pakraman inBali. That research was aimed to identify legal norms in awig-awig desa pakraman that regulateabout pada gelahang marriage.From that research’s result, it was known that aspect of matrimonial law has been regulated inawig-awig, whic is on certain chapter that regulate family law. That chapter titled Sukerta TataPawongan, that regulate the legal aspects about marriage, divorce, lineage, and inheritance.Although, the research result aslo shown that on nine awig-awig desa pakraman researched, onlyone that regulate about pada gelahang marriage, which is Awig-Wig Desa Pakraman Gadungan(Tabanan). The regulation is rather ambigious, only regulate about recognition of pada gelahangmarriage existance, without any further regulation about requirements, procedure or it’s legalconsequences.

Abstract

Licensing is a process with the State unilaterally approving the community do to legally perform a deed or activity. In a sense, a process has the essence of a portion of a governing instrument of the State against citizens for the conduct of the follow-up activities that do not allow by the law and harming the others. One of the important infrastructures and almost always necessary and there are related activities all over the utilization of the environment building. The function of the building is good for the individual as a residential dwelling to the building for Office business activities, as well as supporting business activities in the field of natural resources become the main elements as supporting infrastructure. Research is conducted with normative legal research methods. The analysis is conducted thorough research on the principles and rules of law which are guidelines in the conduct of the related science. Policy settings set up buildings in the future to support ease of Trying Towards an independent Nation, advancing a prosperous, fair, and we recommend that you do not break the law, the technical aspects must remain referenced with continued development of science-supported technologies and human resources adequate to the abundance and quality of technical considerations override as in the OSS with conception of the permit that requires commitment and without commitment regarding the IMB must reconsideration. Perizinan merupakan sebuah proses dengan negara secara sepihak memberikan persetujuan kepada masyarakat melakukan untuk secara legal melakukan perbuatan atau kegiatan. Dalam arti sebuah proses memiliki esensi sebagian sebuah instrument pengendali Negara terhadap tindak laku warga negaranya dalam kegiatan yang dilakukan tidak melanggar hukum serta merugikan orang lain. Salah satu prasarana yang penting dan hampir selalu diperlukan dan ada terkait seluruh kegiatan pemanfaatan lingkungan adalah bangunan. Fungsi bangunan baik bagi individu sebagai tempat tinggal perumahan hingga bangunan untuk kegiatan usaha, perkantoran serta pendukung kegiatan usaha pada bidang pengelolaan sumber daya alam menjadi unsur yang utama sebagai prasarana pendukung. Kebutuhan pengaturan yang diindikasikan tumpang tindih mengenai bangunan gedung perlu dilakukan pengkajian mengingat fungsi bangunan gedung serta wujudnya yang semakin berkembang seiiring perkembangan ilmu pengetahuan dan teknologi. Penelitian dilakukan dengan metode penelitian hukum normatif. Analisis dilakukan melalui penelitian terhadap asas dan kaidah hukum yang merupakan pedoman dalam berperilaku dengan bersumber dari ilmu pengetahuan terkait. Arah Kebijakan pengaturan mendirikan bangunan ke depan untuk Mendukung Kemudahan Berusaha Menuju Bangsa Yang Mandiri, Maju, Adil dan Makmur sebaiknya dilakukan dengan tidak melanggar hukum, aspek teknis harus tetap diacu dengan terus pengembangan ilmu pengetahuan yang didukung sumberdaya yang memadai dan berkualitas Banyaknya pertimbangan teknis yang di kesampingkan seperti dalam OSS dengan konsepsi izin yang memerlukan komitmen dan tanpa komitmen berkenaan dengan IMB tentunya harus dipertimbangkan kembali. Berkaca pada penerapan perizinan terpadu satu pintu, banyak isu permasalahan yang sejak awal belum dapat diselesaikan khususnya kualitas sumber daya manusia khususnya di daerah.

Abstract

Act Number 15 Year 2001 regarding  Trademark has set the provisional charges. Provisional charges may be filed by the plaintiff while the investigation process of trademark infringement lawsuit in court of commerce is still ongoing. In a civil proceeding, the provisional charge must not be the primary charge, however the provisional charge that is set out in the Trademark Act has already concerned the primary charge. Actions that can be requested in the provisional charge according to Article 78 paragraph (1) in the  Trademark Act include cessation of production, cessation of circulation of goods and / or services using Plaintiff's trademark illegally. Using literature study that utilizes primary legal materials and secondary legal materials as the research object, the results of the discussion are expected to be based on sufficient arguments to provide benefits for those who are interested to learn the trademark law enforcement.

Abstract

This research aim to analyze how far the competency test implication on press legal awareness of print journalists in Denpasar. The research method used is sociology approach on print journalists in Denpasar that pass competency test. To collect data from print journalists in Denpasar on how the implication of competency test affect press legal awareness, method of law as it is in society is used with quantified non-doctrinal approach. Based on the press laws in Indonesia, there no rules that sternly or specifically made regarding competency test. The competency test conducted base on Regulation of Press Council No. 1 of 2010 about Journalists Competency Standard. The enactment of regulation is part of function implementation of Press Council according to Article 15 of Law No. 40 of 1999 on the Press journalists. Press legal awareness of print journalists in Denpasar basically affected by own awareness to know and learn about press legal regulations and opportunity that given by print media company to attend training on law and ethic, both internal or external, and taking competency test. In conclusion, competency test has implication on the press legal awareness of print journalists.
