Abstract

Criminal law reform in principle is an attempt to conduct a review and reestablishmentof law in accordance with the common values of socio-political, sociophilosophic,and cultural values of the people of Indonesia. Renewal of the CriminalCode criminal law angle can be done in two ways. First, the partial renewal, byreplacing part after part of the codification of the criminal law. Second, with therenewal of a general nature, thorough renewal by replacing total codification of thecriminal law. underlying purpose of a criminal law reform in Indonesia, including todetermine the political purposes to which a bill is nationally Indonesian State coversall aspects of society with keanegaragaman nation based on Pancasila. Abstract

Research in connection with jurnal writing thesis takes the theme the protection of the law against companies factor in billing accounts receivable factoring transactions. Problems studied involves two things; the first what factors the company’s legal position as a buyer on receivables in factoring and financing institution both what form of legal protection that can be given to companies factor of a possible failure of the trade receivables collection. This includes research conducted legal research categories, namely normative legal research literature or legal research based on secondary data. The approach used is the approach ot the laws and facts approach. Next to for further analysis techniques use the description legal interpretation techniques based argumentative theory, principles, and concepts relevan laws. The results showed that the company,s legal position as a purchaser of  factoring receivables is very weak and vulnerable than risk the possibility of failure of collection of accounts receivable due to non fulfillment of the achievements by the customer. In this context there is no guarantee of  legal protection for the company for the payment or refund factor its receivables in full. The next from legal protection that can be given to the factor as a buyer of receivables is; a) apply the type of recourse factoring in the factoring agreement with the burden of responsibility is on the client in case of failure of collection of accounts receivable, b) implement a system of personal/corporate guarantees, and c) apply the prudential banking principles

Abstract

The development of the current paradigm demonstrate initiative of the citizens to share information in their possession to the public. Citizen who was only a reader, now turned into a citizen journalist, who sends the picture to the press on Instagram account on an event that attracts attention. In this research, there are two issues to be discussed namely 1) How is the protection of moral rights and economic rights over the photos produced by citizen journalist on Instagram? 2) How can the efforts of a citizen journalist to protect the copyrighted works uploaded on Instagram? This research is an empirical juridical study that examines the problem of copyright photography protection in Instagram. Moral rights protection of citizen journalist on Instagram photo is done with the mention of names of the photographer (citizen journalist) and copyright holder (press accounts on Instagram). Protection of economic rights of citizen journalism photo on Instagram as stipulated in the Act of the Republic of Indonesia Number 28 of 2014 on Copyright only applies to photographs with human objects. Efforts that can be done by a citizen journalist to protect copyrighted works uploaded on Instagram are preventive efforts, respresive efforts and pre-emtive efforts. Perkembangan paradigma di era informasi saat ini menunjukkan inisiatif dari warga untuk membagikan informasi yang dimilikinya kepada publik secara cepat dan up to date. Warga yang tadinya hanya seorang pembaca, kini cenderung menjadi citizen journalist yang cenderung berinisiatif dan aktif mengirimkan hasil fotonya kepada akun pers di Instagram mengenai suatu peristiwa yang menarik perhatian. Dalam penelitian ini terdapat dua permasalahan inti yaitu 1) Bagaimanakah perlindungan hak moral dan hak ekonomi atas foto yang dihasilkan oleh seorang citizen journalist di Instagram? 2) Bagaimanakah upaya-upaya yang dapat dilakukan seorang citizen journalist untuk melindungi karya cipta fotonya yang diunggah di Instagram? Penelitian ini merupakan penelitian yuridis empiris yang mengkaji mengenai masalah perlindungan karya cipta fotografi di Instagram. Perlindungan hak moral foto citizen journalist di Instagram dilakukan dengan penyebutan nama pencipta (citizen journalist) dan pemegang hak cipta (akun pers pada Instagram). Perlindungan hak ekonomi foto citizen journalist di Instagram sebagaimana yang diatur dalam Undang-undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta hanya berlaku pada karya foto dengan objek manusia. Upaya-upaya yang dapat dilakukan seorang citizen journalist untuk melindungi karya cipta fotonya yang diunggah di Instagram adalah upaya preventif, upaya respresif serta upaya pre-emtif.

Abstract

The Self-service shop developing into the countryside, however there are those who do not have licenses and violated licensing regulation. Therefore, violations of law were identified and analyzed by supermarkets, and law enforcement by SATPOL PP against these violations. Research uses normative legal research methods; the approach is the legislative approach, concepts, and philosophy. Data sources consist of primary, secondary, and tertiary legal materials and the results of interviews with informants. The arrangement of the Self-service shop’s licenses is performed with Local Regulation, Regent Regulation, Regulation of Mayor, and/or the Mayor's Decision, the Mayor's Instructions and Regent's Circular Letter. Klungkung District does not have a regulation for supermarket yet. The legality of the Self-service shop is in the form of IUTS/IUTM, IUPP, DUTS, and DUPP. Tabanan and Klungkung District use SIUP and TDP. The law infringement of the Self-service shop is: violation of working time, distance of location, not having an IUTS, not applying a new license application in moving the location, and selling liquor. The law enforcement conducted by providing verbal warning, written warning, founding, applying for the licenses, and/or business suspension. The legality of the Self-service shop must use IUTS, and Klungkung District immediately formed regulation for the Self-service shop are. The un-licensed Self-service shop are monitored and evaluated continuously and identified the licenses that have been issued. Law enforcement for unlicensed and illegal Self-service shops that are permitted to be done explicitly and consistently so as not to cause injustice in society. Toko swalayan menjamur hingga ke pedesaan, namun ada yang tidak berizin, dan melanggar ketentuan perizinan. Penelitian dilakukan untuk mengidentifikasi dan menganalisa pelanggaran hukum oleh toko swalayan, dan penegakan hukum oleh SATPOL PP terhadap pelanggaran tersebut. Penelitian menggunakan metode penelitian hukum normatif; pendekatannya yaitu pendekatan perundang-undangan, konsep, dan filsafat. Sumber data terdiri atas bahan hukum primer, sekunder, dan tersier serta hasil wawancara dengan informan. Pengaturan izin toko swalayan dilakukan dengan Perda, Perbup, Perwali, dan/atau Keputusan Walikota, Instruksi Walikota dan Surat Edaran Bupati. Kabupaten Klungkung belum memiliki Perda toko swalayan. Legalitas toko swalayan berbentuk IUTS/IUTM, IUPP, DUTS, dan DUPP. Kabupaten Tabanan dan Klungkung menggunakan SIUP dan TDP. Pelanggaran hukum toko swalayan yaitu: pelanggaran jam kerja, jarak lokasi, tidak memiliki IUTS, tidak mengajukan permohonan izin baru dalam memindahkan lokasi, dan menjual minuman beralkohol. Penegakan hukum dilakukan dengan memberikan peringatan lisan, tertulis, pembinaan, mengajukan izin, dan/atau pembekuan usaha. Legalitas toko swalayan supaya menggunakan IUTS, dan Kabupaten Klungkung segera membentuk Perda toko swalayan. Toko swalayan yang tidak berizin supaya dimonitoring dan dievaluasi secara berkelanjutan serta diidentifikasi izin yang sudah terbit. Penegakan hukum terhadap toko swlayan yang tidak berizin dan yang melanggar izin supaya dilakukan secara tegas dan konsisten agar tidak menimbulkan ketidakadilan dalam masyarakat.

Abstract

This study aims to : 1) determine the translation of Article 33, paragraph 3 of the 1945 Constitution in a variety of legislation on natural resources, 2 ) analyze the synchronization of several provisions in the legislation on the natural resources, espicially related to legal community participation and sanctions, and 3) analyze the implications of insynchroni- zation between the regulations of natural resource. This research is a normative legal research is implemented using the statute approach. The main object of study is the primary legal materials in the form of legislation on natural resources. The results showed that, in principle, the essence of Article 33 paragraph 3 of the 1945 Constitution, about the " earth , water , and space ,and the natural riches contained therein, shall be controlled by the state and used for the greatest welfare of the people . " has been translated into various statutory provisions of natural resources. There is synchronization between the various legislation, among other things : state control of natural resource management authorizes local governments, and the types of sanctions imposed against violations to the various regulations, namely sanction of imprisonment, confinement and fine. However, there is not synchronization related to the delivery of state control of the rights to the indigenous people (legal community)and about magnitude of sanctions, there are countless monthly ,there are countless decades. Likewise, regarding the fine penalties, there is a very lightweight ( Rp 10,000 ) some are up to Rp 15.000.000.000,- The existence of the insynchronization may be implicated on the participation of the legal community (indigeneus people) in managing the local natural resources and lack of legal positiveness (kepastian hukum) in law enforcement for violations of the various regulations on these resources .

Abstract

Pasal 28 H ayat (2) Undang Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 45) yang menyatakan setiap orang berhak mendapat kemudahan dan perlakuan khusus untuk memperoleh kesempatan dan manfaat yang sama guna mencapai persamaan dan keadilan. hak perlakuan khusus bagi tenaga kerja wanita untuk mensejahterakan bayi dengan cara memberikan ASI Eksklusif walaupun sedang bekerja yang dilindungi dan dihormati karena Negara Indonesia adalah Negara Hukum dan menjunjung tinggi HAM. Pengaturan mengenai hak khusus tenaga kerja wanita dalam memberikan ASI Eklusif di Provinsi Bali masih kosong karena belum dilakukan pengkajian dan penyelarasan, padahal angka kematian bayi di Provinsi Bali dari bulan Januari-Mei 2015 tercatat 187 bayi berusia 0-12 bulan. Maka dari itu dirumuskan masalah: Bagaimana tanggung jawab Pemerintahan Daerah Provinsi Bali mengenai hak khusus bagi tenaga kerja wanita dalam memberikan ASI eksklusif? Dan Bagaimana pengaturan dalam menegakan hak khusus bagi tenaga kerja wanita dalam memberikan ASI eksklusif di Provinsi Bali?. Jenis penelitian ini menggunakan metode penelitian normative yang merupakan penelitian mengenai substansi hukum yang terdiri dari norma, kaidah, asas-asas hukum, doktrin dan peraturan perundang-undangan. Dengan jenis pendekatan menggunakan: The Statute Approach and Analitical and Conceptual Approach. Tanggung jawab pemerintahan daerah provinsi Bali sebagai pemegang otoritas dan legitimasi, diwajibkan untuk menyusun dan menjalankan kebijakan baik yuridis maupun nonyuridis dalam pemenuhan Hak anak yang berusia 0-6 bulan dan Hak tenaga kerja wanita dalam perlindungan ASI Ekslusif tersebut dalam penyelenggaraan umum dengan Asas Dekonsentrasi dan Asas Tugas Pembantuan melaksanakan kebijakan nasional dalam rangka program pemberian ASI Eksklusif selaras dengan pengkajian dan penyelarasan hierarki Peraturan Pemerintah Nomor 33 Tahun 2012 Tentang Pemberian Air Susu Ibu Eksklusif.

Abstract

Women in Bali Customary Law have not received legal heir protection. This is because the Hindu community in Bali embraces patrilineal kinship system. In the development of the Assembly Pakraman (MDP) Bali Number III of 2010, they have taken the initiative to give women the right to inherit the extent of the joint property of her parents. As the MDP decree has not been implemented into awig awig Pakraman, women are still in the same position. This condition causes the researcher to study the "Implementation Inheritance Rights of Women into Awig-Awig Pakraman". The issues that will be studied as follows: How do women's inheritance rights in Hindu society in Bali before the issued MDP Bali? How is the implementation of the MDP Bali Decree No.III of 2010 into awig awig Pakraman? This research is an empirical research. Analysis of primary data and secondary data is done using qualitative descriptive method and legal arguments are then provided. Having conducted research on awig awig Pakraman 2014, none have implemented the MDP decree into awig-awig. Continuous socialization is necessary so that the indigenous elders and Hindu community in Bali implement the MDP decree to provide what the rights of women.Perempuan dalam Hukum Adat Bali, belum mendapat perlindungan hukum dalam mewaris. Hal ini disebabkan karena masyarakat Hindu di Bali menganut sistem kekeluargaan patrilineal. Dalam perkembangannya Majelis Desa Pakraman (MDP) Bali Nomor III Tahun 2010 telah mengambil inisiatif untuk memberikan hak  mewaris kepada perempuan sebatas harta bersama dari orang tuanya. Putusan MDP tersebut belum di implementasikan kedalam awig-awig desa pakraman, menyebabkan perempuan masih dalam posisi yang sama. Keadaan inilah yang menyebabkan peneliti ingin mengkaji  “Implementasi Keputusan MDP Bali Nomor III Tahun 2010 Tentang Hak Waris Perempuan Ke Dalam Awig-Awig Desa Pakraman”. Adapun permasalahan yang akan dikaji sebagai berikut: Bagaimanakah hak waris anak perempuan dalam masyarakat Hindu di Bali sebelum keluarnya Keputusan MDP Bali? Bagaimanakah implementasi Keputusan MDP Bali Nomor III Tahun 2010 ke dalam awig-awig desa pakraman ? Penelitian ini termasuk penelitian empiris. Analis data primer dan data sekunder dilakukan dengan cara diskriptif kualitatif serta diberi argumentasi hukum. Setelah mengadakan penelitian terhadap awig-awig desa pakraman tahun 2014, belum ada yang mengimplementasikan keputusan MDP ke dalam awig-awig. Perlu sosialisasi terus menerus agar para bendesa adat dan masyarakat Hindu di Bali melaksanakan keputusan MDP tersebut untuk memberikan apa yang menjadi hak perempuan.

Abstract

The importance of education applies to all children, including children who undergo legal process. It is suitable for the main purpose of Correctional Institution which is to return the prisoners back in the middle of a better society, but in the reality the feedback is not as people expected. The purpose of this study is to find out the objective conditions for the fulfillment of children's rights in the field of education in the prisons IIA of Balikpapan City. The study belongs to empirical legal research that data is collected by some literature books which are related to the material has being studied, and interviews with student prisoners and the officers, then the data is inserted into descriptive qualitative. Analysis is done by legislation approach combined with sociological approach. The results of this study indicate that the fulfillment of the children education rights in prisons IIA of Balikpapan city is weak and less effective, the weakness has found either in juridical normative or empirical/sociological. The weakness includes formal rules where there are no regulations governing education in prisons; there is still lack of facilities factors; third, community factors that have not been aware to assist the fulfillment of education at Penitentiary institution; and cultural factors that the community has which is difficult to re-accept the correctional students into society, while the factors that play a role in the fulfillment of government and penitentiary officers in this case referred to law enforcement. Penting nya pendidikan berlaku bagi semua anak-anak tidak terkecuali bagi anak-anak yang menjalani proses hukum. Hal ini selaras dengan tujuan utama dari lembaga pemasyarakatan yaitu agar dapat kembali nya anak didik pemasyarakatan ketengah kehidupan masyarakat yang lebih baik. Tetapi pada kenyataannya kembalinya warga binaan pemasyarakatan tidak menjadikannya lebih baik. Tujuan studi ini untuk mengetahui kondisi objektif pemenuhan hak anak dibidang pendidikan pada lembaga pemasyarakatan kelas IIA Kota Balikpapan. Penelitian ini termasuk kedalam penelitian hukum empiris. Data penelitian dikumpulkan dengan cara studi pustaka yaitu buku-buku literatur yang berkaitan dengan materi yang diteliti dan wawancara dengan anak didik pemasyarakatan dan petugas lembaga pemasyarakatan, kemudian data tersebut dimasukkan secara deskriptif kualitatif. Analisis dilakukan dengan pendekatan perundang-undangan dipadukan dengan pendekatan sosiologis. Hasil studi ini menunjukkan bahwa pemenuhan hak anak di bidang pendidikan pada lembaga pemasyarakatan kelas IIA kota Balikpapan adalah lemah dan kurang efektif, kelamahan itu baik secara yuridis normatif dan empiris/sosiologis. Kelemahan itu mencakup belum adanya peraturan yang mengatur tentang hak atas pendidikan dilembaga pemasyarakatan; kurang nya faktor sarana atau fasilitas; faktor masyarakat yang belum ada kesadaran untuk membantu dalam pemenuhan pendidikan pada lembaga pemasyarakatan; dan faktor budaya yang dimiliki masyarakat yang sulit untuk menerima kembali anak didik pemasyarakatan ke dalam lingkungan masyarakat; sedangkan faktor-faktor yang berperan dalam pemenuhan yaitu pemerintah dan petugas lembaga pemasyarakatan dalam hal ini disebut sebagai penegak hukum.

Abstract

Health is the most important part of human life that can affect productivity and optimal human activity. When a person's health is compromised, then that person will seek treatment in health care facilities in the hospital one of them in order to get action. Measures of medicine containing the high risk should get written consent from patient/family called Informed Consent. The legal relationship between health professionals with patients occurs because of the agreement that causes the therapeutic relationship inspaningverbintenis law (treaty effort). Similarly in the Bali Provincial Hospital in any medical act especially those containing a high risk, which is done by some health professionals are also using the Informed Consent. But if there is negligence actions that cause harm, who will be responsible for the risks in the suffering patient / family? and how the efforts of patient / family to resolve medical disputes against the risk of Informed Consent? The method used in this research is an empirical law derived from primary data and secondary data. The nature of the study is descriptive, with qualitative data analysis. Overall the results of these analyzes are presented in the description which describes the complete problem under study, along with a critical discussion. Based on the Theory of Legal System of L. M. Friedman, legal systems theory described by Soerjono Soekanto be legal efficacy theory, the theory of Hans Kelsen responsibility, and legislation as well as the results of research in the field, it is known that the liability of health professionals based on Informed Consent Agreement Therapeutic Hospital in Bali province is on the doctor who signed the operator of the informed consent form. However, if the patient / family prosecute acts of negligence committed by health professionals, the hospital will be responsible jointly and severally against such negligence. From the result of  research in the hospital in the province of Bali, demands action against medical negligence are usually resolved by kinship means or mediation

Abstract

The development of military law as part of the national law for the security of order, justice and legal certainty within the military. The divestment development is implemented through the renewal of the law of military discipline stamped in Law Number 25 the Year 2014 on Military Discipline Law. Act No. 25 of 2014, it can be understood that the laws of military discipline other than applied to the military, are also applied to every person who is based on the law equated with the military, while also applied to prisoners of war. The enforcement of military discipline laws against prisoners of war may be too late, given the abolition of military discipline for the perpetrators of legal offenses must be committed by an Excusing Superior (Ankum), but acts, Act No. 25 of 2014 does not provide complete and clear arrangements on the authority of Ankum in upholding disciplinary law against prisoners of war. Based on normative legal research with the approach of legal concept and legislation, it can be obtained a conclusion about the norms and regulation of war tactics in Law Number 25 the Year 2014 is important, because the form of legal vagueness can result to the situation of legal uncertainty, especially the enforcement law against prisoners of war. In the next note, a more complete and clear arrangement is needed to enforce the legal provisions of military discipline against prisoners of war. Pengembangan hukum militer sebagai bagian dari hukum nasional ditujukan untuk menjamin terciptanya ketertiban, keadilan dan kepastian hukum di lingkungan militer. Pengembangan tersebut diantaranya diimplementasikan melalui pembaharuan hukum disiplin militer sebagaimana tertuang dalam UU Nomor 25 Tahun 2014 tentang Hukum Disiplin Militer. Mencermati ketentuan Pasal 6 ayat (1) UU Nomor 25 Tahun 2014, maka dapat diperoleh pemahaman bahwasannya hukum disiplin militer selain diberlakukan kepada militer, juga diberlakukan kepada setiap orang yang berdasarkan undang-undang dipersamakan dengan militer, adapun diantaranya adalah diberlakukan bagi tawanan perang. Pemberlakuan hukum disiplin militer kepada tawanan perang dapat dianggap terlampau dini, mengingat bahwa penjatuhan hukuman disiplin militer bagi pelaku pelanggaran hukum disiplin militer harus dilakukan oleh seorang Atasan Yang Berhak Menghukum (Ankum), namun kenyataannya, UU Nomor 25 Tahun 2014 tidak memberikan pengaturan secara lengkap dan jelas tentang kewenangan Ankum dalam menegakkan hukum disiplin terhadap tawanan perang. Berdasarkan penelitian hukum normatif dengan pendekatan konsep hukum dan perundangan-undangan, dapat diperoleh suatu kesimpulan bahwa kajian tentang kekaburan norma dan pengaturan tawanan perang dalam UU Nomor 25 Tahun 2014 merupakan hal yang penting, oleh karena bentuk kekaburan hukum tersebut dapat berakibat kepada situasi ketidakpastian hukum, khususnya penegakan hukum terhadap tawanan perang. Dalam tinjauan selanjutnya, hendaknya diperlukan pengaturan-pengaturan tertentu yang lebih lengkap dan jelas untuk menerapkan ketentuan hukum disiplin militer terhadap tawanan perang.
