Purpose of this research is identify the construction norms about security and safety standard of tourist in the supply of tourism services by Tour Operator and the readiness Tour Operator in implementing tourists protection regulations in the supply of tourism services by Tour Operator. The research method used is a empirical legal research. Data and sources of data used are primary data, which derives from Tour Operator located around Denpasar and Badung, while secondary data used consisted of primary legal materials, secondary, and tertiary. Data collection techniques used are Study Documents Techniques and Interview Techniques, with the sampling technique used on the population is Non-Probability Sampling Techniques. The analysis used in this research is the Qualitative Data Analysis. As from April 11, 2014, the Government has set rules on Standards Service of Business Travel through Regulation of the Minister of Tourism and Creative Economy Number 4 of 2014. This allows for Tour Operator standardization problem as provided in the ministerial regulations, and constraints experienced by the Tour Operator to fulfill that standardization. In this regard, it is necessary to study more about the implementation of the protection of the law by a Tour Operator, after the ministerial regulation.

The local government of Bali Province issued a policy that was formulated in The Local Regulation of Bali Province Number 9 of 2009. In appendix of The Local Regulation Number 9 of 2009 is described a 12-year compulsory education. This study discusses the effectiveness of The Local Regulation of Bali Province Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province and the factors that influence the effectiveness of the implementation of The Local Regulation Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province. This research is empirical legal research. The nature of research is descriptive. The data in this study include primary data that was collected through interview techniques and secondary data that was collected through the study of literature. The research location is in Bali Province with sample in Denpasar and Bangli regency. The data collected was analyzed qualitatively and descriptively presented analytically. Effectiveness of The Local Regulation of Bali Province Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province is not optimal in some areas. The factors that influence the effectiveness of the implementation of The Local Regulation Number 9 of 2009 related to the implementation of 12-years compulsory education in Bali Province are legal factors, law enforcement factor, means and facilities in law enforcement factor, community factors and cultural factors

Penelitian ini adalah penelitian hukum normatif yang bertujuan untuk mengidentifikasi aspek-aspek hukum keluarga dalam peraturan-peraturan hukum yang dibuat oleh kesatuan masyarakat hukum adat desa pakraman di Bali. Peraturan-peraturan tersebut lazim disebut awig-awig desa pakraman. Penelitian dilakukan terhadap sembilan awig-awig desa pakraman yang mewakili seluruh kabupaten/kota yang ada di Provinsi Bali. Hasil penelitian menunjukkan bahwa aspek-aspek hukum keluarga diatur dalam awig-awig desa pakraman dalam satu bab khusus yang berjudul: Sukerta Tata Pawongan. Bab ini mengatur hubungan antara sesama manusia khususnya kehidupan bersama dalam keluarga. Aspek-aspek hukum yang diatur dalam bab ini meliputi: (1) prihal perkawinan (indik pawiwahan), (2) prihal perceraian (indik nyapian), (3) prihal anak keturunan (indik sentana), dan (prihal pewarisan (indik warisan).

Oil and Natural Gas as a vital commodity which is controlled by the state have an important role in providing fuel as well as for transport and energy, oil and gas must be managed professionally and optimally. PT Pertamina (Persero) as the holder of authority in the management and Trading of Oil and Gas in the distribution of fuel to the community, providing opportunities presence of third parties as partners that Petrol Station. The complexity of the arrangements regarding subsidized fuel raises the scarcity of oil supplies Solar (product of fuel subsidies) and the difficulty of Solar oil purchases at the pump. The problem that then arises is how the legal arrangements concerning Letters of Recommendation Purchases of fuel oil (BBM) subsidy and Institutions Which are authorized to issue Permit / Certificate Purchase Recommendations subsidized fuel at the pump. This research is a Normative legal research in the discussion of the problem using the approach of legislation (The Statute Approach) and Approach Analysis of Legal Concepts (Conceptual Analytical Approach). The source of legal materials in this study is the legal material Primary, Secondary and Tertiary. The results of this study indicate that the legal arrangements of the Letter of recommendation purchase subsidized fuel is regulated in the Regulation of Downstream Regulatory Agency for Oil and Gas in Number 5 of 2012 on Guidelines for the issuance of Letters of Recommendation Local Government to Purchase Fuel Type Specific. Besides the Presidential Regulation in Number 15 of 2012 on the Retail Price and Consumer User Specific Fuel type mentioned also the consumers who are entitled to use a certain type of fuel that can be used as the basis for verification of manufacture Letter of Recommendation by the regional work units. Institutions authorized to issue Letters of Recommendation purchase of fuel type is Local Government. Minyak dan Gas bumi sebagai komoditas vital yang dikuasai oleh negara memegang peranan penting dalam penyediaan bahan bakar baik untuk transportasi dan energi, Minyak dan gas bumi tentunya haruslah dikelola secara profesional dan seoptimal mungkin. PT Pertamina (Persero) sebagai pemegang kewenangan dalam pengelolaan dan Niaga Migas dalam pendistribusian BBM ke masyarakat, tentunya memberikan kesempatan hadirnya pihak ketiga sebagai mitra kerja yaitu SPBU (Stasiun Pengisian Bahan Bakar Umum). Kompleksnya pengaturan mengenai BBM subsidi ini menimbulkan adanya kelangkaan pasokan minyak Solar (produk BBM Subsidi) serta sulitnya masyarakat melakukan pembelian minyak Solar di SPBU. Permasalahan yang kemudian muncul adalah Bagaimanakah pengaturan hukum tentang Surat Rekomendasi Pembelian Bahan Bakar Minyak (BBM) bersubsidi dan Lembaga- Lembaga mana sajakah yang berwenang mengeluarkan Surat Ijin/ Surat Rekomendasi Pembelian BBM Bersubsidi di SPBU. Jenis penelitian ini adalah penelitian hukum normatif dalam pembahasan permasalahannya menggunakan pendekatan Perundang- undangan (The Statute Approach) dan Pendekatan Analisis Konsep Hukum (Analitical Conseptual Approach). Adapun sumber bahan hukum dalam penelitian ini adalah bahan hukum Primer, Sekunder dan Tersier. Hasil penelitian ini menunjukkan bahwa Pengaturan hukum tentang Surat Rekomendasi pembelian BBM Bersubsidi adalah diatur dalam Peraturan Badan Pengatur Hilir Minyak dan Gas Bumi Nomor 5 Tahun 2012 tentang Pedoman penerbitan Surat Rekomendasi Satuan Kerja Perangkat Daerah untuk Pembelian Bahan Bakar Minyak Jenis Tertentu. Selain itu dalam Peraturan Presiden Nomor 15 Tahun 2012 tentang Harga Jual Eceran dan Konsumen Pengguna Jenis Bahan Bakar Minyak Tertentu disebutkan juga mengenai konsumen yang berhak menggunakan BBM jenis tertentu sehingga dapat dijadikan sebagai dasar verifikasi pembuatan Surat Rekomendasi oleh Satuan Kerja Perangkat Daerah. Lembaga yang berwenang dalam mengeluarkan Surat Rekomendasi pembelian BBM Jenis Tertentu adalah keseluruhan Satuan Kerja Perangkat Daerah yang selanjutnya disingkat SKPD.

This study aims to identify and elaborate the Non-Discrimination Principles of the GATS related to the use of foreign workers in the provisions of tourism. The main non-discriminatory principle used in this study is the principle of Most Favoured Nation (MFN) and National Treatment. Indonesia agreed to be bound on GATS by promulgating law Number 7 the year 1994 regarding the Ratification of Agreement on Establishing the World Trade Organisation, that ensures Indonesia to obedient non-discrimination principle on Indonesia’s regulations. As a member of GATS, Indonesia must submit a schedule of commitments that explain the types of services that are ready to apply the principle of non-discrimination. This research is a normative legal research by examining norms, principles, and related legal aspect of foreign labor in Indonesia. The authors found that there was a conflict of norms in the application of the GATS non-discrimination principle in Indonesian labor law in the trade of foreign labor services. Indonesia actually has its own sovereignty that can not be imposed by any party and in the application of GATS non-discrimination principle not by contradicting Pancasila and the 1945 Constitution of the Republic of Indonesia as the basis of the development of employment. Tulisan ini bertujuan untuk mengidentifikasi dan mengelaborasi Prinsip Non Diskriminasi GATs terkait penggunaan Tenaga Kerja Asing dalam ketentuan kepariwisataan. Prinsip non diskrimininasi yang utama digunakan dalam penelitian ini adalah prinsip Most Favoured Nation (MFN) dan National Treatment. Indonesia setuju untuk terikat pada GATS dengan meratifikasi Undang-Undang Nomor 7 tahun 1994 tentang Pengesahan Agreement Establishing The World Trade Organization yang mengikat Indonesia untuk mematuhi prinsip-prinsip non diskriminasi dalam pengaturan perdagangan jasa di Indonesia. Sebagai anggota GATS, Indonesia harus menyerahkan komitmen yang berisikan jenis perdagangan jasa yang siap menerapkan prinsip non diskriminasi. Penelitian ini merupakan penelitian hukum normatif dengan meneliti norma, asas, dan bahan-bahan hukum penunjang terkait tenaga kerja asing di Indonesia. Hasil studi menunjukkan bahwa ada konflik norma dalam penerapan prinsip non-diskriminasi GATS dalam hukum ketenagakerjaan Indonesia, khususnya dalam penggunaan tenaga kerja asing. Indonesia sebenarnya memiliki kedaulatan tersendiri yang tidak dapat dipaksakan oleh pihak manapun dan dalam penerapan prinsip non-diskriminasi GATS tidak boleh bertentangan dengan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sebagai dasar pengembangan ketenagakerjaan.

Factualapproach, analytical approach to the legal concept of a comparative approach in thecriminal judicial oversight of Children in Conflict with the Law in the criminal sistem inIndonesia.In formulating criminal law criminal policy oversight of Children in Conflict withthe Law in the guidance sistem of positive law in Indonesia, consists of 3 major topics:First, the substance of Children in Conflict with the Law into law in Indonesia, Second,Determination of sanctions / penalties against Children in Conflict with the Law inIndonesia's criminal law policy, Third, criminal oversight of Children in Conflict with theLaw and its relevance to the theory of punishment in modern criminal law in Indonesia.Criminal oversight of Children in Conflict with the Law as the integrative goals ofpunishment in accordance with the ideas and correctional sistem discussed 3 subjectsnamely: First, criminal oversight of anal naughty review of aspects of the integrativetheory of punishment, Second, Criminal oversight of Children in Conflict with the Lawreview of aspects of correctional sistem, Third, Criminal oversight of Children in Conflictwith the Law in terms of aspects of legal protection and benefit of the criminal lawrequirement for social welfare (children). And its application by all law enforcementcomponents and related institutions involved in handling cases of children in conflict withthe law in coaching children in prison.

Recommendation of the Local House of Representative (DPRD) is a common administrativeinstitution employed in the local government decision making process. However, thisinstitution does not recognized by the law. Hence, its presence dan used in the processof decision of public license contains various problem, such as: (1) its status under theadministrative law; (2) its implication to the validity of the license; (3) and the positionof the head of the local government, the degree of the local government responsibility asthe recommendation receiver and the DPRD as the recommendation giver to the negativeimpact of the license. These facts resulted in needs for conducting research for clarifyingthe status, measuring the implication of the recommendation over the validity of the license,and the range of responsibility head of the local government and the DPRD to the impact ofthe license.This research is focused into two issues, namely: (1) how is the position and function ofthe DPRD in the process of issuing of license; and (2) how would be the implication ofthe DPRD’s recommendation over the range of responsibility of the head of the localgovernment and DPRD in the issuing of license. This research is limited to the practice ofissuing of recommendation in the Local Government Province of Bali.This research shallemploy normative approach and uses both primary and secondary legal resources.The research resulted in two inventions: firstly, recommendation of DPRD is not recognizedby the law in the level of province local government neither it’s the authorithy of the DPRDon supervising the governor. The recommendation recognized by law is the recommendationas an administrative legal instrument in the performance of local government by thegovernor, particularly for performing the function of decision making or the conductingof governmental act. Hence, recommendation of DPRD is a state custom in performingstate governmental function. Secondly, recommendation has two functions, namely: acondition and confirmation. In the function of condition, recommendation is a prerequisitefor adopting public decision. In the function of confirmation, recommendation is a merely anexpression of an agreement provided by a certain instution for adopting a public decision.Recommendation in the function of condition, binds the recommendation giver to bearresponsibility over the result of the implementation of the decision. While, in the functionof confirmation the giver may not necessarily responsible to the result of the performanceof the decision. However, under the principle of good faith, the giver is under obligationto bear responsibility over the result of the implementation of the decision whenever therecommendation is given under a bad faith.

In order to create order and legal certainty to the type and quality of local artsto tourism, the Government of Bali Province issued the Regional Decision of TheGovernor of The Head of Bali Number 394 of 1997 on Regulating Regional Arts onThe Province of Bali. Implementation of the Regional Decision of The Governor ofThe Head of Bali Number 394 of 1997 on Regulating Regional Arts on The Provinceof Bali of the terms, procedures and sanctions do not work effectively. These arecaused because of legal substance, legal structure, legal culture and the means andfacilities. To optimize the decision made by the Governor of the preventive andrepressive efforts. To streamline the implementation of the Regional Decision of TheGovernor of The Head of Bali Number 394 of 1997 will require a synergy betweenthe Department of Culture, sekaa / arts organizations and the service users. RegionalDecision of The Governor of The Head of Bali Number 394 of 1997 should have tobe amended because it does not fit with the times. Bali Provincial Cultural Officeshould be more proactive in doing preventive and repressive efforts in upholding theRegional Decision of The Governor of The Head of Bali Number 394 of 1997.

This thesis of prosecutor function in the implementation of the court decision related to return of financial loss caused by corruption. In addition, this study also aims to determine and assets the constraints in the implementation of court decisions related to the return of financial loss. It is invecitable that at current time, corruption is one of the remarkable (extra ordinary crime) that endanger the stability and security as well as economic development in Indonesia. Corruption in Indonesia has been so severed and widespread in the community and very alarming, its development continues to increase from year to year, both in number of cases and the amonut of state financial losses and in terms of quality. These cirminal offenses commit more systematic and scope into all aspects of life. Starting from lower level of the dominant and state officials or law enforcement. Judge in imposing sanctions not only imprisonment and also fined an additional punishment, including the return of financial loss to the state by state corruption. The method used in this research is the method of normative juridical legal research of the research using primary and secondary data sources by document. This approact to use the statute approach, the analifical and conseptual approach, case approach and comparative approach legal, basic of corruption in the judicial process is ussed act No. 8 of 1981 (KUHAP), Act No. 31 of 1999, Act No. 20 of 2001 and Act No. 16 of 2004 The constraints in the implementation of the court decision related to the return of states losses, is convicted assets and property that has been transfered, multiple population administration and duration of the judicial proceses of implementation is not effective.

Penelitian ini menggunakan metoda penelitian hukum normatif, yang bertujuan untuk mengetahui dan memahami siapa yang dimaksud degan penyelenggara jalan dan juga untuk mengetahui dan memahami bagaimana pertanggung jawaban penyelenggara jalan sebagai subyek hukum.
