Abstract

sejatinya agama adalah pencarian spiritual manusia tentang hakekat kebenaran dan kedamaian dirinya dengan Tuhan yang terjadi secara evolutif. Dalam proses pencarian dan kebenaran itu maka beragama dipandang sebagai salah satu hak asasi manusia (HAM) yang harus dihormati oleh institusi apa dan manapun. Karena itu dalam konfigurasi ketatanegaraan, HAM beragama mempunyai posisi yang sangat penting. Bagaimanapun juga HAM beragama akan menemukan jantung persoalan yang utama ketika berhadapan dengan entitas negara. Persoalan yang munculkemudian bagaimana posisi agama dalam konteks negara? Atau posisi agama dalam konteks hukum? Tulisan ini ingin mengkaji lebih mendasar bagaimana HAM Beragama dalam perspektif Filsafat Ilmu Hukum.

Abstract

This research is motivated by the low public understanding of the productive waqf and magnitude of potential productive waqf. The purpose of this resesarch is to analyze the condition of BWI and PWS. Results showed that the strategy is the collection of productive waqfperformed by BWI and PWS there are two methods namely: the first method of "waiting for the ball." The second method "pick up the ball. Method" waiting for the ball ", this method starts with opening an account at Financial Institution Shariah waqf Receiver on behalf of BWI. While PWS started by opening kaunter PWS, open an account at Financial Institution Shariah waqf Receiver top name PWS, Skim Infaq (salary), Ejen, and portal e-Mais. And in cooperation with educational institutions. Method " pick up the ball " means that the direct interaction between BWI with prospective wakif by approaching directly to the agency-intansi both public and private. Where as PWS using three models: first, female Moon and waqf, Second, Month selangor waqf, and the third month Masre Industry.

Abstract

This paper compares the substance of Aceh Qanun of Jinayat and Enakmen Jenayah Syaria Selangor Number 9/1995. Aceh Qanun substance and Enakmen Jenayah Syaria Selangor Malaysia have some similarities among criminalize spreader cult, not perform Friday prayers, not respect Ramadan, not Islamic dressing in public places, alcohol or gambling, seclusion, liwath/same-sex relationships, qazaf, prostitution, pimping, adultery/extramarital intercourse. The both rule are applied only to Muslims and applicable in certain region (province/state). Compared with Aceh Qanun, Enakmen Jenayah Syaria Selangor regulates more crimes. Nevertheless, Aceh Qanun threatening criminal sanctions heavier than Enakmen Jenayah Syaria Selangor and opportunities for non-Muslims voluntarily subjecting himself to the by laws. The principle of lex posteriore derogat legi inferiore is not apply to Aceh Qanun. Meanwhile, Enakmen Jenayah Syaria Selangor to enforce the Sharia principle of lex posteriore derogat legi inferiore.

Abstract

Two figures of contemporary moslem scholar, Fazlur Rahman and Muhammad Syahrur, have unique, dynamic conception and comprehension toward Sunnah and Hadits different from other scholars and moslems` comprehension in general. Both Rahman and Syahrur, emphasize more on methodological criticism on Sunnah and Hadits instead of criticism on matan and sanad. According to Rahman, the existence of hadits are historically improvable. Basically, the concept of sunnah have been existing since Islam born. It was merely guidance and protective in its nature. It embraced interpretations fit to situation and condition at the time, often considered as "living Sunnah" . Rahman`s criticism on recent condition is a comprehension toward hadits which tends to be stiff, unchangeable and even moresacred than Al-Qur`an itself, whereas Syahrur`s is method to apply laws in ummul kitab in simple way by breaking no rules settled by Allah. In Syahrur`s, it places custom laws as the determiner for problems still uncovered in law by noticing objective standard covering the context of space and time.

Abstract

Islamic militant group is arguably followed by laymen circle is. Change of movementis condusted by this group. This group tries to gain support from university students as a new agent which is assumed by this group to be able to change movement pattern. Spreading of Islamic radical group in the area of student is not apart from striving for caderization of intllectual group in Islamic fundamentalist circle. This strategy is an indoctrination of ideology which caused student feels difficult to cut his relation to this group. This phenomenon finally forms a new metamorphosis to a new Islamic radical movement in campus.

Abstract

Sejarah pembukuan as-Sunnah memiliki nilai sangat penting dalam kajian sumber-sumber Syariat Islam. Peristiwa ini ada keterkaitan antara tidak hanya sebagai bukti warisan peninggalan dalam sejarah Islam, lebih dari itu pelembagaan (pembukan) as-Sunnah merupakan landasan dalam sumber penetapan kualifikasi as-Sunnah. Melalui kualifikasi as-Sunnah menjadi Sahih, Hasan, dan Dlaif, sangat ditentukan oleh modelmodel periwayatan hadits yang sudah terbukukan dalam kitabkitab induk al-Hadits. Model-model periwayatan dan pengajaran Hadis dari masa ke masa juga menjadi instrumen indikator mardud atau maqbul nya suatu periwayatan hadis, karena alasan bahwa prinsip-prinsip periwayatan hadis oleh para perawi setidaknya diketahui melalui peristiwa aktivitas Pembukuan atau Pelembagaan as-Sunnah. Momentum gerakan Pembukuan as-Sunnah memunculkan petunjuk model pengajaran Syariat Islam seacara kultural, dan memberi penentu tentang periodisasi perjalanan format sumber Syariat Islam. Sehingga dari aspek Syariah bahwa Pelembagaan dan Pembukuan as-Sunnah ada keterkaitan dengan penentuannilainilai otentifikasi sumber-sumber Syariat Islam, setidaknya ada tujuh fase periode dan masing-masing memiliki format unsur karakter sekaligus nilai penting dalam penetapan kedudukanasSunnah, baik berupa Sunah Qauliah, Filiah, dan Taqririah bahkanQaul danAtsar Shahabat. Juga melalui Pelembagaan dan Pembukuan menjadikan tumbuhnya aktivitas keilmuan terutama dibidang Hadits (Ulum al-Hadits) disamping mendorong timbulnya lembaga Ijtihad dari generasi ke genarasi berikut.

Abstract

For a long time, Islamic law have wrestled with reality, and its proved that methodology of Islamic law is always suitable with anything era. Of course, it is caused by role of philosophy Islamic law in which there are two methodology, that is falsafah al-tasyri' and falsafah al-syari'ah. From both of them, we can know any wisdom about enacted the law (hikmah al-tasyri) and intention of law and the secret of law (asrar al-ahkam). With such paradigm, construction of Islamic education theory must be suitable with era growth and hoped in line with both of the Islamic law analysis. As a result, Islamic education theory can be able to growth itself according to moving era and human characteristic as a subject and also object of Islamic education.

Abstract

In the life of the nation which Seara essentially based on the principle of diversity, pluralism happenings become very important idea to be actualized. This, considering the many phenomena of social groups, especially those based on the religious, who plays more the majority of much use repressive means to memaksanakan belief to more minority groups. Inevitably, the consequences of action anarchism became a partial continuation of the way of thinking that the minority must follow the majority. Ironically, about pluralism which can be used as a spirit of togetherness and mutual respect, to be one shot stigma that pluralism is understood that contrary to religious teachings tertentu.Seiring with the stigma, the Indonesian Ulema Council (MUI) had issued a fatwa for pluralism .Implikasinya, this fatwa increasingly confirmed as an excuse to strengthen joints to discredit the majority of minorities, particularly the different streams and ideology with groups such mayoritas.Namun, fortunately lah is a collection of scholars who are members of the Nahdlatul Ulama (NU), which has the attitude and stance Different, which still considers pluralism as values of divinity and the human values that should dilestarikan.Sehingga, many generations NU, especially at lower levels, which fosters mutual respect in tengarah diversity that unfolded in this sphere of life them.And , can not be separated from the elders thought NU clerics such as Gus Dur, Mustafa Ali Jacob, Ali Yafie, and others are introducing religious teachings of the tolerant, moderate, balanced, and berkeadilan.Untuk know more detail and depth about how to construct ideas NU scholars in response to the spirit of pluralism absolute maintained and how the position of NU in the treatment of minority groups, this paper tries to break them down further.

Abstract

Dewasa ini banyak cendikiawan dan ulama modernis maupun tradisionalis- progresif yang kreatif di dalam pengembangan hukum Islam. Mereka melakukan penjelajahan penafsiran nas keagamaan secara liberal tanpa merasa menghianati jalur transmisi intelektual yang selama ini dipegangi kuat oleh kalangan ulama mazhab. Pemikiran yang mencoba mengotak-atik nas, bahkan meninggalkan nas dalam usahaisibat al-hukm ternyata mendapatkan dukungan dari ulamaulama tertentu. Ada kesadaran untuk menerima perubahan dan pembaharuan hukum Islam bidang muamalah seperti hukum keluarga, ekonomi, sosial, politik. Mereka mendorong keharusan ijtihad dan talfiq, dan redefinisi makna qati (tidak terikat makna teks nas), ke dalam bentuk perundang-undangan positif maupun fatwa ulama. Lahirlah beberapa undang-undang maupun fatwa ulama yang mengutamakan maslahah sebagai pertimbangan hukum pertama. Bahkan dari sisi metodologis, pembentukan undang-undang maupun fatwa ulama di Indonesia, seperti U.U. Perkawinan, U.U Wakaf, Kompilasi Hukum Islam dan lain-lainnya dan beberapa Fatwa MUI ada yang tidak memberlakukan nas, kalau tidak dikatakan membatalkan nas sebaliknya mengutamakan pertimbangan rasional, mengutamakan teks fiqh dan sistem pengambilan marajinya bukan sekedar memilih salah satu mazhab 4 tetapi mazhab manapun yang dipandang keputusan hukumnya lebih maslahah seperti mazhab dahiri dan mazhab syiah.

Abstract

For al-Faruqi, Islam is an-all encompassing ideology, the primeryidentity of aworld-wide community of believers and the guiding principle forsociety and culture. This approach, this wholistic Islamic world-view, is embodiedin a life and career in which he wrote extensively, lectured and consulted withIslamic movements and national governements and organized Muslims in bothAmerica, for instance, and internationally. Al-Faruqi, who saw the world throughthe prism of his Islamic faith and commitment, focused on issues of identity,history, belief, culture, social mores and international relations. Al-Faruqi, waspreoccupied with the specific scheme of Urubahor Arabism. He described Arabism as an Arab stream where the Arabness, in fact, animates that stream andgives it momentum and provides them with their language, culture and religion.From this, he light the conceft of ummah as basis of the concept of state inwhich there are peole who has rights and duties. His pax Islamica which stoodon his arm was never conceived as monolithic society in which Islam alone predominates. To enter into the paxIslamica never meant coversion to Islam,but entry into a peacepul relationship where ideas are free to move and men arefree to convince and be convinced. Indeed, the Islamic state put all its resourcesat the disposal of all believers.
