Abstract

One of the Islamic fiscal instrument is waqf that have been played a significant role in economics. Cash waqf is a new instrument in the field of waqf and Islamic economics as a facility for the purpose of worship and to achieve social welfare. The development of the waqf field through cash waqf, management which is flexible and offers many choices. Cash waqf have the multiplier effect in economic, through this effect cash waqf can be used as instrument to poverty alleviation program through community empowerment program.

Abstract

This article talks about democracy concept and it relationship to religion which is concept and a means value system is extremely important in the human life. The problem is between Islam as the conviction based on divine revelation and democracy that is product of human reason as social creature. Side long, Islam actually is the initiator in political system application that very appreciate humanity and on the other side democracy system appreciated as the most appreciating system about humanity, so that almost entire government in the world include most of Islamic state accept this system. This democracy system is still in process and its fluency dependent on three component within the state, they are political will from the state, strong commitment from the political society, and strong guidance from civil society to bring the democracy system into reality. For the Muslim, this socialization will be more effective when it also done through religion approach, by the translation of that democracy ideas into religiouslanguage, and integration between it and learning of Islamic religious discipline that discuss about constitutional.

Abstract

Dalam pada ini, Barat menilai UDHR sebagai kontruks dari budaya mereka yang egaliter dan toleran sambil memicingkan sebelah mata terhadap penduduk dunia bagian Selatan yang dihuni oleh negara-negara ketiga dan masyarakat Muslim-- sebagai dunia miskin, picik, tidak toleran dan anarkis. Persepsi inilah yang memunculkan pertentangan atau clash civilization antara Barat dan Timur. Meski terkesan apologis, kelahiran IUDHR dan Cairo Declaration on Human Rights in Islam (CDHRI) yang diratifikasi oleh OKI sesungguhnya merupakan upaya penjernihan yang dilakukan oleh negara-negara Muslim atas klaim Barat yang arogan, otoriter dan semena-mena. Respon serupa juga dilakukan oleh beberapa cendekiawan Muslim, semisal An-Naim. Dalam konteks keindonesiaan respon tentang HAM diberikan oleh tokoh-tokoh dan sarjana-sarjana seperti Ali Yafie, Munawir Syazali, Ahmad Basyir dan lain-lain. Mereka berupaya menggali kembali pemahaman yang lebih dinamis, up to date dan universal.

Abstract

The Characteristic of Islamic banking is different with Conventional bank in terms of interest system in which Islamic banking is based on core product in sharing profit such as musy?rakahand mu??rabah. It is therefore the existence of Islamic banking should have a significant impact on real sector development. One of a such real factor that must be established is small and medium Micro Finance (UMKM) where has significant contribution in national economic development for employment recruitment and Domestic Bruto Income (PDB) as well as its stability in encountering economic crisis. The Islamic banking allocation for UMKM in Makassar has flucktuative improvement (2010-2011). Although its contribution for Micro Finance is not yet optimum, it has great prospects with respect to the quality of UMKM that never receives budgets.

Abstract

So far the subjects discussed in Islamic Marriage/Family Law (Munakahat) limited marriage matter only and using the normative approach (halal and haram). In fact the successness of family is not enough by merely understanding marriage matter and the normative approach. To build a happy family as the goal of marriage in Islam is required other knowledges and approaches outside the normative approach. Even with other subjects and using multi approach, it is possible to uncover the secret behind the Quranic texts discuss marriage. This paper attempts to illustrate how science Ethnology, as illustrated Hazairin, can reveal the secret behind the Quranic verse discuss mahram (women are forbidden to marry) as it is described in al-Nisa? (4): 22, 23, and 24. Likewise, this paper tries to offer a number of subjects that should be included in the subject of Islamic marriage in order to be able to achieve the goal of marriage and family breakdown can be avoided. To mention some of which are: (1) the science about sexuality and sciences related thereto, (2) the science of reproduction and reproductive health, (3) knowledge of health and family nutrition, and (4) knowledge about building communication between family members.

Abstract

The  rejection  of  unjustice  exploitation  to  natural environment  is  central  theme  of  green  constitution,  green  economic, and  sharia  economic  law.  The  problems,  how  do  comparison of essence and implementation between one and others. In  this paper is used study method in law normative. There are two important findings. First, the similarity of essence of green constitution, greeneconomic, and sharia economic law is focus on environment justice (eco-justice). The  differences,  environment  justice  under  perspective  of  (a)  green constitution  means  natural  environment  has  to  be  welfare  of  people, (b) green economic means natural environment is part of production, distribution,  and  ethical  consumption,  and  (c)  sharia  economic  law means  give  the  right  for  future  generations  to  enjoy  natural environment. Second, the similarity of implementation challenge faced by  three  concepts  is  inconsistention  of  law.  The  differences, inconsistention of law faced by (a) green constitution isinconsistension of environments Act with 1945 Constitution, (b) green economic is the loss  of  unlawfull  meaning  of  lawful  term  (c)  sharia  economic law  is systemic disobedience by sharia corporation to sharia principles.

Abstract

This article clarifies some gender bias issues which are importantly included into the Islamic political system. In addition, the Islamic political curriculum should take part in the effort to make people aware of the importance of gender equilibirium by establishing cultural perspective which is not discriminative against women. Gender sensitivity in Islam includes three main factors which require comprehensive methodological approach. They are: the fisrt, equilibrium issue related to the difference view of aurat (part of the body should be covered in Islamic law),the second, divorce and inheritance Islamic law, and the third, demand toward equal stance in politics. These three domains are supposedly important issues in Islamic political system.

Abstract

The concept taabbudirelating to matters of worship ma?dah, and taaqqulirelating to the affairs and worship gairu ma?dah. Taabbudiabsolute, static, and its existence is not based on mere outward benefit, while taaqquliis relative, not static, and its existence is based on the benefit to humans so it is rational. However, in each taaqqulidefinitely embodied the values of worship. Instead, at each contained taabbudialso for human benefit. Both of these concepts have great contribution in the development of Islamic law.

Abstract

Dalam Islam mengambil resiko apapun adalah suatu yang dibolehkan bahkan dipuji. Hal ini dikarenakan tindakan yang seperti ini akan mendorong pertumbuhan dan pengembangan ekonomi. Resiko akan menciptakan nilai tambah untuk menciptakan usaha-usaha yang kreatif. Di sisi lain, ketidakpastian adalah suatu hal yang intrinsik dalam semua aktivitas ekonomi. Dalam hal resikoyang dapat dikontrol, hasil yang tidak pasti dari bentuk resiko ini sebenarnya digerakkan oleh sebab-sebab yang pasti yang dapat mempengaruhi atau mengontrol kemungkinan hasilnya. Jika seorang agen ekonomi ingin mendapatkan hasil dari suatu usaha yang bersifat tidak pasti, maka ia harus melakukan usaha-usaha yang nantinya bisa mendatangkan keuntungan. Artinya, hasil dari ketidakpastian tersebut sangat ditentukan oleh usaha yang dilakukan.

Abstract

Blasphemy problems are issues that have emerged in the archipelago long before the republic independence, for example, in the Kraton Kasunanan Surakarta or other kingdoms. The problem up to now always appear in public spaces, and along with that then there are also efforts to resolve the various forms of regulation according to the situation and condition of the development of society, ranging from the shape of legislation to discharge Fatwa Indonesian Ulema Council (MUI). This paper attempts to examine the behavior of blasphemy from the standpoint of legal or political dimension. By using this approach is expected to gain a clearer perspective and basic. In addition, this study tried to find the complex relationships between the dimensions of understanding inherent in the system of belief (belief system) in people with political interests and realities of the developmental needs of society at that time. Perpetrators of blasphemy in the Islamic kingdom in Java kelindan linked with local political structures. Local political structure is very determinant in determining the legal person or group.
