Hukum prismatik merupakan tata nilai hukum yang khas, yakni yang membedakan sistem hukum Indonesia dengan sistem hukum lainnya. Sehingga muncul istilah hukum Pancasila yang, jika dikaitkan dengan literatur tentang kombinasi antara lebih dari satu pilihan nilai sosial disebut sebagai pilihan nilai prismatik yang karenanya dalam konteks hukum dapat disebut sebagai hukum prismatik. Konsep Prismatik merupakan kombinatif atas nilai sosial paguyuban dan nilai sosial patembayan. Dua nilai sosial ini saling mempangaruhi warga masyarakat, yakni kalau nilai sosial paguyuban lebih menekankan pada kepentingan bersama dan nilai sosial patembayan lebih menekankan kepada kepentingan dan kebebasan individu. Nilai prismatik diletakan sebagai dasar untuk membangun hukum yang penjabarannya dapat disesuaikan dengan tahap-tahap perkembangan sosial ekonomi masyarakat yang bersangkutan. Ada empat hal supaya prismtika hukum dapat diwujudkan, pertama, Pancasila memadukan unsur yang baik dari paham Individualisme dan kolektivisme. Kedua, Pancasila mengintegrasikan negara hukum yang menekankan pada civil law dan kepastian hukum serta konsepsi negara hukum the rule of law yang menekankan pada common law dan rasa keadilan. Ketiga, Pancasila menerima hukum sebagai alat pembaharuan masyarakat (law as tool of social enginering) sekaligus hukum sebagai cermin ras keadilan yang hidup dalam masyarakat (living law). Keempat, Pancasila menganut paham relegious nation state, tidak mengendalikan agama tertentu (karena bukan negara agama), tetapi juga bukan hampa agama, Di sini negara harus melindungi semua pemeluk agama tanpa diskriminasi.

Politic, in every episode of history, seems full of intrict that pragmatics, so that politic the same with cruel, dirthy and anomaly. Many of stakeholders appriory by this situation. This is make politic more and more tiranic offcourse. That is way, very important think to advocate ethic and moral politic which base on universal values of prophet, namely prophetic of politic. Core of this models is humanis, liberation and transendental. The implementations of this model take in Islamic nomocration, as main of state management.

Married couples of different religions argue that they have no serious problems in families. They feel that their couple has fulfilled their needs, they do not live under poverty, and they are happy. In relation to the religious life, they feel that their couple gives much attention on freedom of religion and everyone in their family is free to perform their own religious worship. Their couple never asks them to change their belief to his/her religion. This also occurs in the religious social life in Melati village, Sleman, Yogyakarta. They feel very lucky to live among tolerant society, in which people honor religious diversity. Although they live among tolerant people, they feel uncomfortable in communicating with other people, especially in relation with the religious social activities, because they live in interfaith marriage. This makes them reluctant to be active in religious social activities. This article presents happiness and harmony among couples living in interfaith marriage in Mlati village, Sleman Regency, Yogyakarta.

Determining the beginning of Ramadhan and Syawal can do by rukyat, hisab and istikmal. Method of rukyat which done by Prophet Muhammad saw, friends, tabiin until now. Rukyat can do all off people with see the hilal when the sunset in the end of month. Hisab is calculating position and height of hilal at the sunset. If hilal can not seen because of weather so entire numbering of Syakban become 30 days. Determine like this can call with istikmal. Differentiate in determining beginning of Ramadhan and Syawal its happen because method of using is not same with determining height of hilal reputed new month also not same.

Kemiskinan terlahir tak jauh dari masa ketika manusia ada, ia selalu menjadi problem manusia yang membayang-bayangi kehidupannya dari segala zaman, manusia sebagai makhluk yang lemah sepertinya tidak akan pernah bisa menghapuskan secara tuntas 100 persen di muka bumi ini. Ketika al-Quran diturunkan (611-632 M.), masyarakat Makkah dan Madinah serta kawasan sekitarnya juga menghadapi problem kemiskinan. Tidak mengherankan jika kemudian al-Quran menaruh perhatian sangat besar terhadap problem tersebut. Demikian ini karena al-Quran diturunkan selain sebagai mukjizat, juga berfungsi sebagai petunjuk bagi manusia, khususnya bagi mereka yang bertakwa dalam memecahkan persoalan hidup dan kehidupan dengan tujuan tercapainya kesejahteraan di dunia dan akhirat. Dengan demikian dapat dinyatakan bahwa baik dalam bidang teologi, tasawwuf, fikih, maupun tafsir konsep kemiskinan merupakan konsep yang parsial. Keparsialan konsep tersebut dalam bidang teologi, tasawwuf, dan fiqih disebabkan oleh spesialisasi sudut pandang masing-masing, bukan karena soal metodologis. Sedang dalam bidang tafsir keparsialan konsep tersebut disebabkan oleh penggunaan metode tajziziy.

This article discusses about the liberalization of Marriage law in the western countries which occurs in line the liberalization of religious values in the societies. Marriage law reform had begun when the religious reform took a place, namely from Catholic to Protestant (Lutheran). In the Catholic era, marriage is a religious affair which was regulated by Church, but in the Protestant era, marriage was the affair from God to humanity. Therefore, marriage law had developed as the development of the human culture. In the western countries, religious marriage is not regarded but they have the civil marriage which is legal according to the state law; and in several western countries, marriage law has accommodated the same sex marriage.

The establishment of the law should not be in a vacuum but rather cultural particularities of the community with their cultural roots. Because the law in the service of society, the legal system must also trademark the same cultural roots communities it serves. Therefore, it becomes inevitable that the political vision of making the culture of the community and the interests of different political, economic, social, cultural (poleksosbud) is a parallel society. Accordingly, periodically in line with the historical appearance of terms of customary law, then the exposure will be described in periodically. First is the forms of the Dutch government's policy towards the Islamic law and custom. It is important to understand the different kinds of consequences caused by the policies of the colonial legal system. While the second part of the discussion is the relationship between Islamic law and custom in the independence of Indonesia, so that an image between the two legal systems is obvious.

It is generally known that the rights of inmates have been well executed by the Wirogunan penitentiary in Yogyakarta. Some caveats need to be evaluated by the Ministry of Justice and Human Rights especially Directorate General of Corrections, there are medical service, less availability of decent food, the high cost of prison canteen food, unresponsive response to gripe, complicated remission procedure.It also needs to be considered in developing inmates that some inmates never be the member of correctional institution before, upgrading facilities, coaching personality and autonomy theinmates it self.

Massive demonstrations that occurred since 2010 in several Arab countries (Arab Spring) sparked the attention of the UN Security Council to undertake humanitarian intervention, including in Libya which started in February 2011 with the use of armed force undertaken by NATO and some other big countries. Humanitarian intervention is a recommendation of the UN Security Council Resolution 1973 of 2011, under Chapter VII of the UN Charter, 1945. In doing humanitarian intervention, state and international organizations must have the recommendation of the UN Security Council, but the Security Council should also get legitimacy from the international community. Humanitarian intervention is also required to have humanitarian objectives to protect human rights. In this paper discusses the legitimacy given by the international community to the humanitarian intervention of the UN Security Council on Libya.

Pada dasarnya, NU memandang politik sebagai upaya bersama memperbaiki negara dengan berwawasan kebangsaan. Terjun ke dunia politik (bukan politik praktis), pada masa kolonial, merupakan kewajiban agama, sebab, penjajah telah menginjak-injak martabat bangsa Indonesia, dan inilah politik kebangsaan. Akar historis keterlibatan kyai NU dalam kegiatan politik (bisa dilacak) dimulai jauh ke belakang, yakni ke masa-masa penjajahan. Pergeseran kebijakan politik kebangsaan ke politik kekuasaan yang dilakukan kyai NU sangat terkait dengan masalah perebutan kekuasaan, kedudukan, dan posisi di pemerintahan.
