Abstract

Metode ilmiah terdiri atas serangkaian kegiatan yang berupa : pengenalan dan perumusan masalah, pengumpulan informasi yang relevan, perumusan hipotesis, pelaksanaan eksperimen dan publikasi atau penyebaran informasi.Revolusi ilmiah merupakan proses peralihan dari paradigma lama keparadignia baru. Dengan perubahan paradigma ini cara pandang ilmuwan dalam menentukan masalah, menetapkan metode dan teknik, dan penarikan kesimpulan terhadap kenyataan alarn akan berbeda dari sebelumnya. Belajar dari kritisisme yang di kembangkan oleh Popper dan revolusi ilmiah dari Thomas Kuhn, sikap positif terhadap penolakan dan belajar sebanyak mungkin dari penolakan, kita selayaknya terutama yang bergerak dalam bidang penelitian, pendidikan, dan akademisi harus siap di kritik dan juga siap mengkritik. Selain itu belajar dari penolakan pun bukan sesuatu yang jelek, tetapi justru akan memacu kita untuk menghasilkan yang lebih baik. Disini kita akan di uji, apabila kita siap untuk berbeda pendapat, perbedaan pendapat bukan sesuatu yang di haramkan, tetapi justru merupakan suatu rahmat. Kata sebuah pepatah, benturan pendapat itu akan memercikkan kebenaran, asalkan tujuannya tidak sekedar berbeda pendapat, melainkan untuk bersama-sama mencari kebenaran.

Abstract

The existence of Nucleic Acid Tests Deoxyribo in determining nasab, this revealed about practical of DNA tests of proving their nasab relationship. Issues as was seen from the perspective of the Positive Law and Islamic Law which will look Existence of Deoxyribo Nucleic Acid Tests to determine nasab both in the perspective of Positive Law and Islamic Law. The purpose of Deoxyribo Nucleic Acid Test was to determine the legal certainty the results of DNA testing as evidence to determine nasab in view of the Positive Law and to analyze Islamic Law Review toward the existence of a DNA testing to determine nasab. DNA testing in the Positive Law could be used as valid evidence that as a subsidiary or additional evidence in addition must be supported by other evidence, as if linked in determining nasab particularly children that born outside of marriage it did not have the force of law and legal certainty. So both in Law No. 1 of 1974 and the Islamic Law Compilation that DNA testing was not regulated either as evidence or not, because basically in the Civil Code, Criminal Code and the Law on Children Protection also had been no the evidence type of DNA testing. Further DNA testing in the context of Islamic law could be used as legal evidence, but needed to be seen from his goal, because DNA testing also could not be separated from Maqasid as-shar 'iah namely giving the benefits while keeping human existence in nature needs of ḍaruriyyât and if the purpose of the DNA testing that deviated from the provisions of Islamic law, the existence prohibited. Proof through DNA testing could be categorized as evidence of qarinah whose authenticity was quite accurate, so no longer in doubt.

Abstract

Al-Qur’an merupakan kitab yang tidak ada keraguan di dalamnya, sebagai sumber pokok kehidupan yang di dalamnya terdapat petunjuk, undangundang serta prinsip-prinsip umum yang menyeluruh. Dalam surat ar-Rum ayat 30 dijelaskan bahwa Islam adalah agama fitrah. Dan juga dalam hadits dinyatakan bahwa semua anak yang lahir dalam keadaan fitrah tergantung kedua orangtuanya yang akan menjadikan Yahudi, Nasrani, atau Majusi. Munculnya beberapa fenomena manusia di masyarakat yang dianggap penulis telah keluar dari fitrahnya seperti kedurhakaan yang terjadi pada umat Nabi Luth, kemusyrikan, transgender dan transeksual, emansipasi wanita, dan korupsi yang merajalela. Fenomena-fenomena tersebut yang melatarbelakangi penelitian ini. Dengan melihat ayat-ayat yang berkaitan dengan fitrah, menemukan macam-macam fitrah, yaitu: Pertama, bahwa fitrah manusia terbagi menjadi tiga, yaitu 1. Fitrah beragama, 2. Fitrah suci, 3. Fitrah intelektual (aqliyah), Kedua, adapun faktor yang menyebabkan manusia berpaling dari fitrahnya adalah: 1. Tidak memahami perjanjiannya dengan Allah SWT, 2. Bermaksiat kepada Allah SWT, 3. Tidak menggunakan akal dengan baik. Ketiga, Cara memelihara fitrah manusia yaitu dengan cara: 1. Kembali kepada agama Allah SWT,  2. Penyucian jiwa (tazkiyah an-nafs), 3. Menggunakan akal dengan baik.

Abstract

Muslim scientists tried to seek scientific the paradigm of Islamic studies in responding to modern science had three perspectives in view of science. First, the group that thought  that modern science was universal and neutral, and all science could be found in the Qur'an; Secondly, the group that  tried to bring science in Islamic countries; Third, the group that wanted to build a new paradigm (epistemology ) of Islam, the knowledge paradigm and the paradigm of behavior, focusing on the principles, concepts and values of Islam concerning search certain fields, and paradigms concerning search specific areas, and the paradigm of behavior decided the limits of ethic where scientists could freely work. This paradigm departed from the Qur'an instead of ending the Qur’an.

Abstract

Kegiatan muamalah adalah kegiatan dalam upaya memudahkan manusia memenuhi kebutuhan hidupnya dengan bekerja maksimal dalam mencari nafkah yang disisi lain tidak melupakan dimensi sosial dari harta yang diperoleh melalui apa yang dikenal dengan Zakat, infaq dan sadakah. Konsep zakat tersebut terwujud pula dalam Undang-Undang Nomor 38 tahun 1999 yang dikenal juga dengan ibadah maliyah ijtima’iyyah, perkembangan pengelolaan kemudian dibangun dengan Keputusan Menteri Agama Republik Indonesia Nomor 118 Tahun 2014 Tentang Pembentukan Badan Amil Zakat Nasional. Berdasarkan hasil studi dapat disimpulkan bahwa: Pertama, manajemen BAZ Kabupaten Musi Banyuasin menggunakan manajemen standar yang berkembang dalam konsep manajemen modern yang cukup representative. Kedua, Faktor pendukung yang menyebabkan  masyarakat Musi Banyuasin mengeluarkan zakat kuatnya sosialisasi dan profesioanlisme pengurus dalam memberikan kepercayaan Ketiga faktor Penghambat  adalah Kabupaten Musi Banyuasin adalah minimnya kesadaran masyarakat karena ketidaktahuan dan pandangan klasik bahwa zakat harus diberikan langsung kepada mustahiq. Ketiga, upaya BAZNAS Muba dalam menyikapi hambatan manajemen yang dihadapi dengan melakukan optimalisasi kerjasama dengan pemerintah, juga kementrian agama wilayah Kabupaten Musi Banyuasin, keikutsertaan para pengurus dalam berbagai kegiatan yangpenguatan atas keorganisasian BAZ baik ditingkat regional, nasional maupun studi banding atas berbagai kajian terhadap kelembagaan zakat, infaq dan sadaqah.

Abstract

One of the issues still being debated today is the women testimony, specially in marriage. Previous study found that in the KHI women are not be able to be a witness. As stated in article 25 of KHI “That may be designated as a witness in the marriage contract is a Islam male, fair, understanding, mature, uninterupted memory and is not deaf or hard of hearing”. By using the normative legal research methode (juridical) with statute approach and using content theory as legal materials analysis techniques. This study found that the KHI has used by the headman as referenced in determining marriage witness, in that found there were many drawbacks,  in addition it was look like a breakdown of The Marriage Law No 1 of 1974, as well as the basics of the article is almost entirely abstracted from Fiqh Syafiiyah books. In fact, the Qur'an and the hadith are not forbid women to be witness. Likewise in the Constitution, women have the equality before the law. For that we need the deconstruction of KHI Article 25 by providing opportunities for women to witness the marriage. Considering that The KHI is part of the rules of law, accordingly for reform it should be made by the president himself as an executive or judicial review to the Constitutional Court.

Abstract

The 19th century to the 20th century is a moment in which Muslims enter a new gate, the gate of renewal. This phase is often referred to as the century of modernism, a century where people are confronted with the fact that the West is far ahead of them. This situation made various responses emerging, various Islamic groups responded in different ways based on their Islamic nature. Some respond with accommodative stance and recognize that the people are indeed doomed and must follow the West in order to rise from the downturn. Others respond by rejecting anything coming from the West because they think it is outside of Islam. These circles believe Islam is the best and the people must return to the foundations of revelation, this circle is often called the revivalists. One of the figures who is an important figure in Islamic reform, Jamaluddin Al-Afghani, a reformer who has its own uniqueness, uniqueness, and mystery. Departing from the division of Islamic features above, Afghani occupies a unique position in responding to Western domination of Islam. On the one hand, Afghani is very moderate by accommodating ideas coming from the West, this is done to improve the decline of the ummah. On the other hand, however, Afghani appeared so loudly when it came to the question of nationality or on matters relating to Islam. As a result, Afghani traces his legs on two different sides, he is a modernist but also a fundamentalist.

Abstract

Research in title “The impact of Sriwijaya Maritime Power toward the Entrance of Muslim Trade in Palembang in VII-IX Century” is based on the power of Sriwijaya maritime that dominated all of the International trade voyage path which was sailed by the foreign merchant including Arabic Muslim traders. The Arabic Muslim traders which sailed and traded to China must go across trade voyage paths of Sriwijaya, thus, the merchants stopped over in the Kingdom center of Sriwijaya located in Palembang. The objective of the study is to analyze the history of development of Sriwijaya’s maritime power, analyzing the sailing and trading path and the relationship of Sriwijaya and the foreign country, and the impact of Sriwijaya’s maritime power toward the entrance of Muslimtraders in Palembang in VII-IX century. This study is in the form of Qualitative research design which is library research., by analyzing thoroughly every single relevant literature. The approach of the research is by using historical method approach which are, heuristic, verification, interpretation, and historiograsion, and politicoligist and economologist scholarship. Moreover, the source of the data were primer and seconder data. Data collection technique as heuristic and verification. To analyze the data, it was used interpretation, then it was conducted the last step that was historyografy or a writing of history. This research concludes that the history of development of Sriwijaya appearing as the ruler of the largest maritime power in Nusantara was supported by their great army and a management of a strong and respected leader.Sriwijaya easily controlled strategic shipping paths, such as the Strait of Malacca, Bangka Strait, Sunda Strait, Karimata Strait, and all shipping lanes in the Nusantara.The condition of the shipping Routes initially frightened Muslim traders, because of the large number of pirates, having successfully controlled by Sriwijaya's maritime power, it became safe and comfortable to go through. And it was required to stop at the harbor or in the center of Sriwijaya Kingdom located in Palembang. In addition, Sriwijaya's relationships with foreign countries, namely Arab, India, China were carried out by Sriwijaya for the recognition of sovereignty and Sriwijaya's power strengthening in the trade shipping paths. Sriwijaya with its maritime power and cooperating with the Sea People to secure the cruise line to the center of Sriwijaya from pirates as well as increasing the confidence of Muslim traders both in trade and security guarantees on the way back from the center of Sriwijaya and access for Muslim traders in the process of Islamization through trade routes in the territory of Sriwijaya kingdom.

Abstract

Muslims in Indonesia are the majority people. This means that most of the people of Indonesia are adherents of Islam or Muslims. According to the Central Bureau of Statistics (Jakarta, 2004) report, Indonesia's population is 224 million, 89% of which 224 million are Muslims. A very large community for a country that also has a large distribution area such as Indonesia. The Muslim community in the archipelago has been decisive for decades in the direction of political development in Indonesia.

Abstract

The Qur'an as the main source of Islamic teachings clearly states that believing in the unseen is a characteristic of a believer. Hamka in Tafsir Al-Azhar states that, faith to the unseen is the basic belief in Islam. Satan as the main enemy of man constantly directs temptations to prevent man from God's straight path with various means of aberrations. Taking into account the interpretation of Hamka in the Al-Azhar Tafsir associated with verses that speak of Satan, is closely related to Satan. Therefore, a special study is needed to examine: The concept of Satan and Satan according to Hamka. And what are the ways of Satan and Satan in seducing men according to Hamka in Tafsir Al-Azhar ?. Because the discussion is the book of interpretation of the approach to the problem is the science of interpretation with a theoretical basis that is: Tafsir type, style of interpretation and methods of interpretation. The method used in this research is maudhu'i method. That is the method of interpretation that seeks to answer the Qur'an about the problem with thematic way. From the research that has been done can be concluded that: According to Hamka Satan is from the group of disobedient Jin to Allah swt. Satan is more than anything that is evil that plunges a person in a danger, both danger in the world and danger in the afterlife. Satan can be a negative passion that stimulates a person to behave evil and deviate from the truth. As for the manner and kind of temptation of Satan or Satan's many and varied tricks, among them, by derailing man, being deceived by far-reaching apostasy, whispering evil thoughts to deviate from the way of Allah swt.
