Abstract

In conflict mediation understanding the concept and mastering the skill of neutrality is perceived as essential. Despite as a fundamental and core principle in mediation, it has been a debate among mediators upon the outcome of the mediation itself. This principle puts mediator as facilitator who would not influence or be partial over the parties. Indeed, mediators highly respect on aspirations and demands of the parties by creating an acceptable procedural framework which enables disputants to achieve their goals fairly. Nevertheless it is practically an arduous principle and inapplicable. In addition, neutrality is not a stipulation for a successful mediation; rather, mediators need to and should be partial and biased in some cases. This article, therefore, is aimed to examine the problems revolve around the issues of neutrality in mediation process.

Indonesia and Pakistan have a trade history that can be said to be potentially and beneficial for both parties. One of the potential sectors and mainstay of Indonesia in Pakistan is the palm oil sector. Abstract

This article discusses the reason behind the decision from The Ministry of Tourism, Republic of Indonesia to release the Halal Tourism policy by using constructivist perspective. The Ministry has made the religious norm as the principle for the 2013 Halal Tourism Program as a response to the significant number of tourists visiting Indonesia- both domestic and foreign visitors. The Halal Tourism Program was established to fulfill the need of Muslim tourists so that they can still travel around without violating their beliefs or norms- Islamic teaching. The Ministry of Tourism has found a fact that religion is an important consideration for the tourists to make decisions on their travel destination. Using the constructivism approach and after undergoing a social process, the policy of the Halal Tourism based on Islamic norms shaped Indonesia’s identity as a country that is friendly to the needs of Muslim tourists in the international arena

Abstract

The Syrian conflict brings warfare to a new level where jihadists have evolved from small terrorist cells into large armed groups. The Islamic State of Iraq and Sham (ISIS) seem to be the most outstanding and eye-catching of all, as they seem to be the strongest and most brutal among them. They have allegedly committed numerous breaches of international humanitarian law(IHL). especially in the treatment of War Captives. This includes summary execution, torture, and even acts of crucifixion. While ISIS claims to follow only Islamic law and dismisses other laws, does this mean that Islamic laws of war are inconsistent with IHL? This article will first examine relevant rules of IHL and Islamic laws of war with a focus on the treatment of war captives, finding that the two laws are generally consistent except for a few points. Then the practice of ISIS regarding the treatment of war captives will be observed, and it will be found that there are numerous evidence of violations towards both IHL and Islamic law.

Abstract

The existence of refugees in Indonesia in the past decade is gradually increasing. Some countries such as  Afghanistan,  Myanmar,  Sudan,  Sri Lanka, Somalia and Ethiopia make Indonesia as one of the transit areas as well as a destination for those who come out of their country to look for another place to live due to the ongoing conflict and war. But unfortunately Indonesia does not have the right and authority to accept asylum seekers because it is not yet a state party which ratified the 1976 refugee Protocol and the 1951. Convention. However, the government continues to provide assistance on a humanitarian basis. UHNCR and IOM became the first organizations to address the existence of refugees  in Indonesia. Both are government organizations that have the authority to regulate the existence of asylum seekers in various countries. Given this, it is necessary to know the existence and role of non-governmental organizations in overcoming the existence of refugees in Indonesia. This study uses a qualitative descriptive method where data is obtained through observation and interviews with one non-governmental organization. This research results in an internationally accredited journal publication and will contribute to academics in the social humanities field.
