Abstract

A good and healthy environment is a human right for every Indonesian citizen as mandated in Article 28H of the 1945 Constitution of Indonesia. Unwise management of the environment contributes to the deterioration in the quality of the environment because it is necessary to increase environmental protection and management. Environmental protection and sustainable management is the responsibility of the government and the community. The responsibility of the government in carrying out environmental protection and management is a function of public services, to ensure that all residents have a good and healthy environment. Then the government can be held accountable, whether administratively, civil or criminal, when the government fails to carry out its obligations that are not in accordance with the aspirations of the community. This study is qualified as a normative legal research by applying several types of approaches, namely, the legislative approach, conceptual approach, philosophical approach, historical approach, comparative approach, case approach including cultural approaches based on the wisdom of the local community.The results showed that the protection and management of the environment is an effort to assume responsibility is very difficult so that it results in a decrease in the quality of the environment is increasingly apparent. Likewise in the event of environmental pollution and damage, the perpetrators can be held responsible both in civil law and criminal law. However, participatory environmental enforcement by integrating values that develop in the community in protecting and preserving the environment is an ideal form of protecting and prudent environmental management to realize sustainable regional development.

Abstract

The objective of tourism development is not only to increase economic growth but also to preserve nature and surrounding environment. In the context as in the Regency of Badung, the problem arising is that there are still many tourism supporting facilities that are not in accordance with the zoning or designated area so they can have a negative impact towards the environment. This study examines the meaning of the concept of developing an environmentally-based sustainable tourism and strategies for developing the environmentally-based sustainable tourism in the area of tourism supporting facilities in Badung Regency. This study is of great importance in order to discover solutions in the form of appropriate strategies or policies for a sustainable tourism development. This study belongs to a empirical legal research that uses primary data and secondary data. The results of the study show that the concept of sustainable tourism development focuses on long-term tourism development minimizing negative impacts on the environment. The government has a strategic role in formulating relevant tourism development policies, especially in the process of planning as stated in the tourism development master plan in both the Province and Regency/City. The value of the philosophy of Tri Hita Karana is very appropriate to be applied in formulating policies for sustainable tourism development. In addition to formulating policies, a strategy for developing environmentally-based sustainable tourism in tourism supporting facilities in Badung Regency can be implemented by ensuring that all development is in accordance with its designation so as to reduce negative impacts on the environment. Empowerment of local communities in tourism development is also very important to be applied by holding the principles of religious and cultural values that live in the community as well as environmental sustainability.

Abstract

Traffic problems faced by the Indonesian state are increasing. The problems that are often encountered are worse because of the rampant traffic accidents caused by minors. In this study the author will discuss the implementation of Diversion of children in committing criminal acts of traffic accidents in the Bangli Police District and what factors are an obstacle in the implementation of Diversion of children in committing criminal acts of traffic accidents in the Bangli Police District. The writing of this thesis uses empirical methods as well as statutory, conceptual, and case approaches. The results of this study indicate that the implementation of Diversion against children in the crime of traffic offenses in the jurisdiction of Bangli Police Station during the settlement of cases directed by Diversion has been carried out properly and obstacles in the implementation of Diversion against minors in the crime of traffic offenses in Bangli Police Station, including internal and external factors.

Abstract

The principle of openness refers to the principle that the law-making process must be conducted in an open and transparent manner to the public. This means that the process must be accessible to the general public and interested parties, and provide opportunities for them to participate and provide input. In a democratic society, the government should prioritize the welfare of its citizens and listen to their wishes. However, there may be differences of opinion among citizens when it comes to making laws and regulations. The problem formulations raised are 1) How is the regulation of the process of forming laws and regulations in Indonesia? and 2) How is the form of the principle of openness in the formation of laws and regulations? The research method used in this research is normative legal research. The results show that the process of forming laws and regulations in Indonesia goes through several stages, such as initiation, preparation, discussion, ratification, enactment, and implementation. The principle of openness is very important in making laws and regulations because this principle encourages public involvement in the process because it includes providing access to information and seeking input from individuals and groups affected or interested in the issue.

Abstract

Village Regulations are the result of a legal process at the village level that is authorized by the Village Head together with the Village Consultative Body. The Village Consultative Body acts as a liaison between the Village Head and the Village community. This research aims to explore the implementation of the functions of the Village Consultative Body in the formation of Village Regulations in Peguyangan Kangin Village and identify obstacles or barriers faced by the Village Consultative Body in the process. The research method used is an empirical legal method. The results showed that although the Village Consultative Body has a function to take and propose ideas from the community, its implementation has not been optimal because there are still obstacles, such as community disapproval of the Village Regulations made. Efforts made include socializing the formation of Village Regulations to the community. Therefore, the Village Consultative Body should become more proactive in carrying out their roles and functions.

Abstract

Local Government has the rights to enfore each local provisions and other acts to exercise autonomy and co-administration duty. In each phases of the drafting of legislation, it involves the drafter of such legislation. The problem in this article is regarding the position and the duty of a drafter during the drafting of a local legislation as well as the implementation of the participation of a drafter in drafting of local legislation in the province of Bali. This research uses empirical legal research method. The result of this research shows that the position and duty of a drafter of a legislation in the drafting of local legislation is very important, namely to prepare, process, and formulate the draft of legislation and other legal instruments. Moreover, the implementation of the participation of the legislative drafters in the drafting of local legislation in the province of Bali, there are still 3 Districts or Cities which have not involve a drafter in the drafting of local legislation. The comparison of revoked legislation from the year 2013-2018 between Districts or Cities which do involve drafters and the Districts or Cities which do not involve a drafter shows a significant gap of numbers. However in the year 2018, the implementation of the drafters' involvement in the drafting of local legislation in the provincr of Bali is starting to be involved from the beginning to the final phase. Therefore the implementation of the drafters' involvement is starting to proceed effectively. The legal effect of not involving drafters explicitly, no legislation has clearly sanctioned such situasion, hence, there is an empty norm in this case. Pemerintah Daerah berhak menetapkan peraturan daerah dan peraturan perundang-undangan lain untuk melaksanakan otonomi dan tugas pembantuan. Dalam setiap tahapan pembentukan peraturan perundang-undangan mengikutsertakan perancang peraturan perundang-undangan. Permasalahan dalam penelitian ini adalah mengenai kedudukan dan tugas perancang dalam pembentukan perda serta pelaksanaan keikutsertaan perancang dalam pembentukan perda di Provinsi Bali. Penelitian hukum ini menggunakan metode empiris. Hasil penelitian menunjukkan bahwa Kedudukan dan Tugas Perancang Peraturan Perundang-undangan dalam Pembentukan Peraturan Daerah sangat penting yaitu menyiapkan, mengolah, dan merumuskan rancangan peraturan perundang-undangan dan instrumen hukum lainnya. Sedangkan Pelaksanaan Keikutsertaan Perancang Peraturan Perundang-undangan Dalam Pembentukan Peraturan Daerah Di Provinsi Bali, masih terdapat 3 Kabupaten atau Kota yang belum melibatkan perancang dalam pembentukan perda. Perbandingan jumlah perda yang dicabut dari tahun 2013-2018 antara Provinsi atau Kabupaten yang melibatkan perancang dengan Kabupaten atau Kota yang belum melibatkan perancang tidak menunjukkan perbandingan jumlah angka yang signifikan. Akibat hukum apabila tidak mengikutsertakan perancang secara ekplisit, peraturan perundang-undang tidak mencantumkan secara tegas mengenai sanksi sehingga terdapat norma kosong dalam hal ini.

Abstract

The allegations of human rights violation in the Province of Bali whether done vertically by the government or horizontally by the fellow society, were noted through the high number of the people’s report, which were flowing to the team of the Public Communication Service in the Regional Office of The Legal and Human Rights Ministries of Bali. The issues to be elaborated in this research are as set forth how is the mechanism in resolving the allegations of Human Rights violations through the Public Communication Service in the Regional Office of The Legal and Human Rights Ministries of Bali, and what are the factors which affect the resolution of the allegations of Human Rights violations through the Public Communication Service in the Regional Office of The Legal and Human Rights Ministries of Bali. The research method used is empirical legal research. The results have shown that the Regional Office of the Legal and Human Rights Ministries of Bali in handling the allegations of human rights violations through the Public Communication Service has done such by using a mediation method and is acting as the mediator. Dugaan pelanggaran Hak Asasi Manusia di Provinsi Bali baik yang dilakukan secara vertikal oleh pemerintah maupun yang dilakukan secara horizontal oleh sesama masyarakat, ditandai dengan tingginya pengaduan masyarakat yang masuk ke tim Pelayanan Komunikasi Masyarakat pada Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Bali. Permasalahan yang diangkat dalam penelitian ini yaitu bagaimana mekanisme penyelesaian dugaan pelanggaran hak asasi manusia melalui pelayanan komunikasi masyarakat pada Kantor Kementerian Hukum dan Hak Asasi Manusia Bali dan faktor-faktor apa yang dapat mempengaruhi penyelesaian dugaan pelanggaran hak asasi manusia melalui pelayanan komunikasi masyarakat pada Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Bali. Metode penelitian yang digunakan adalah penelitian hukum empiris. Hasil penelitian menunjukkan bahwa Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Bali dalam menangani dugaan pelanggaran hak asasi manusia melalui pelayanan komunikasi masyarakat dilakukan dengan cara mediasi dan bertindak sebagai mediator.

Abstract

The economic growth of a nation depends greatly on the quality of transportation. Online taxi is an innovation in public transport. Using communication technology in the form of applications that can connect between users with transport driver. The existence of a taxi online growing rapidly due to public transport users got options other than conventional taxis. But the presence of a taxi online got rejection in the society especially by society as the transport trade, because the rated breaking traffic laws and road transport as well as going on unhealthy business competition. There are two (2) problems of research: (1) legal online taxi arrangements according to the law No. 22 of 2009, (2) the existence of a taxi online at Bali's tourism regions. The purpose of this research is to know the law setting the online presence and existence of taxi online on the area of tourism in Bali.This research uses the normative legal research methods with the application of laws or regulations, the study of librarianship as primary and secondary legal materials and supported by empirical data with interviews directly. Based on the results of the research note that: (1) online Taxi is not mentioned explicitly in the Act No. 22 of year 2009, but the taxi online is set in the regulation of the Minister of transportation Number 108 Years 2017, as the rental of special transport. (2) A taxi online still got rejections due to its perceived would happen competition and do not respect the role of the community in the area of tourism. The role of local governments in regulating taxi online presence is very important, so as not to give rise to polemics which can interfere with the image of Bali tourism.

Abstract

In state administrative disputes has ditermined who can sue and who can be sued. But aside from the plaintiff and the defendan, in a state administrative dispute lawsuit it is possible for everyone with an interest in the dispute to participate or be include in the vetting process. The formulation of the problems are 1) How the mechanism of the inclusion of the third party in the process of dispute resolution in the state administrative court. 2) How the legal consequences of the inclusion of the third party in the case number 23/G/2015/PTUN.DPS. This research is a normative legal research with the problems approach are statute approach and case approach. Everyone who has an interest can be include in a state administrative dispute. The inclusion of the intervention can be due to their self, the wishes of either party or the initiative of the judge. The entry of the intervention gave the intervention the same obligations and rights with the parties. In case number. 23/G/2015/PTUN.Dps the intervention is placed as a defendant II intervention because of the interest that it has the same as the defendant. And that make the third party has the same obligation and the rights as those of the defendant.

Abstract

In Indonesia there are interesting phenomena that occur in the community, in the general public consider that drivers of transportation online are one of the employees of the application service company so that between them there is a working relationship, because with the requirements that must be met when registering as a drivers of transportation online. As for the formulation of the problem to be discussed: 1. what is the working relationship between drivers of transportation online and companies as a form of civil relations? 2. What is the legal protection for drivers of transportation online and if the drivers makes interpretations at work? The research aims to find out and understand the relationship between drivers of transportation online and companies as a form of civil relations and legal protection for drivers of transportation online and if the drivers makes interpretations at work. This type of research uses normative legal research or library research methods is the method or method used in legal research carried out by examining existing library materials. In partnership relationships emphasize the principle of mutualism between the two parties, meaning that this relationship as mutually beneficial and where the position of the parties is equal. The principle in legal protection related to government actions rests and comes from the concept of recognition and protection of human right.
