The government in collaboration with the tourism business world, including travel agents and the public, has an obligation to provide support for tourism activities to run safely and must always refer to the legal aspects as a form of protection in the field of tourism for tourists. This is because in Article 26 letter (d) of Law No. 10 of 2009 concerning Tourism is expressly stated that tourism entrepreneurs have an obligation in providing comfort, hospitality, and providing a sense of security to tourists. However, the Act does not explain in detail the responsibilities of the travel agency to tourists. This study discusses two problems, namely 1). What is the form of legal protection for tourists in travel in Badung Regency and 2). What is the responsibility of the travel agency for tourists in Badung Regency. The type of research used in this journal is empirical legal research is legal research that starts from the gap between das solen and das sein, where there is a gap between the theoretical situation and the legal facts that occur in society. The approach used is the sociology of law which also studies the interrelationship between law and other social phenomena. Regarding the form of legal protection for tourists in tourist trips in Badung Regency, namely by providing legal protection, comfort and security to tourists, including providing facilities for elderly and disabled tourists, and getting a safety guarantee in the form of insurance for activities that have high risk. The form of responsibility of a travel bureau if there is a problem with the comfort of tourists, the travel usually always anticipates by improving services and racing on business standards certification for the travel bureau.

Often the community ignores making mining permits so that they have a serious impact on the environmental damage around the place that is turned into mining, so the people who conduct mining without a permit are illegal mining. This research, there is the problem of how the application of criminal sanctions against the suspect of the mining of sand without a licence and how the analysis of consideration of judges in meting out the verdict against suspect of sand mining without permission. This type of research used in writing this research is normative legal research . The results of this research concluded bring sanctions against the suspect of the application of sanction/mining without permission Number 120/Pid.Sus/2017PN. Gin criminal punishment with imprisonment for 6 months and a fine of Rp. 1.000.000,-(one million rupiah) but the punishment does not need to be traveled was superseded by a criminal trial for 9 months. Analysis of the judge's consideration in dropping the verdict against suspect of sand mining without permission with the study's verdict number 120/Pid. Sus/2017/PN. Gin that Tribunal judges have been sentencing trial mejatuhkan for 9 months against the defendant the Tribunal Justices see no damning thing and just see things easing, the defendant first time doing criminal, be polite in the trial, and judge argued the law not only retaliation but aims to improve and educate the defendant in order to become better human beings again.

Paper entitled Legal Aid in Criminal Justice Process in Indonesia comes from Research sourced from the UDHR, a document that is morally binding. Some of the provisions regulate the general principles of law or those that describe the protection of human rights, and the frequent occurrence of the rights of suspects not informed by investigators. The problem (1) what is the process of granting Legal Aid in the criminal justice process? (2) What are the consequences for violating the right to Legal Aid in the criminal justice process? The approaches are legislative approach, factual approach, legal concept analysis approach, and approach through formulas or phrases. The sources of primary legal material in the form of binding and secondary legal materials include the opinions of scholarly scientific works in the collection of legal materials, such as the citation of books and legal journals collected and then processed and analyze. In order to provide signs for law enforcers in implementing material criminal law, legal assistance is regulated in article 54 of the Criminal Procedure Code and article 56 paragraph (1) The Criminal Procedure Code explicitly regulates the obligation of suspects to be accompanied by legal counsel 15 years and above, but if contrary to article 56 paragraph (1) of the Criminal Procedure Code, the judge examining the case must reject the prosecutor's charges, because it is contrary to article 56 paragraph (1). In accordance with the Supreme Court jur number 155/pid/1991, September 16, 1993.

Protection and respect for human rights is a main pillar in any State of law, to provide legal protection against a suspect, then the law number 8 of year 1981 on the law of criminal procedure should be realized, in particular, in the investigation of criminal cases, special interrogation frequently occurs in the arbitrary actions of the investigator against the suspects, who allegedly committing a criminal offence. Violence, intimidation and other forms of coercion against suspects in the process of investigation proved very difficult, legal protection for suspects in the process of investigation, the right to give information freely without pressure from any party the right to obtain legal assistance at every level 1 inspection.) How is the implementation of rights protection-human rights (human rights) in the process of examination of the suspect at the level of investigation? And 2) Rights-rights of anything owned by a suspect in the Investigation Process. This study uses empirical research methods. The position of the suspect and the accused in the CRIMINAL PROCEDURE CODE is as a subject, which in any examination must be treated in a position of human being has the dignity, dignity and self-suspect it doesn't look as rights object and dignity human dignity with arbitrary. Laws and regulations in Indonesia have set the existence of some of the rights of a person who is declared as suspects that must be respected and in respect by every law enforcement in Indonesia's judicial process.

The enactment of Law Number 5 of 2014 concerning State Civil Apparatuses influences the position of temporary employees or honorary staff. The problem in this paper is how to regulate the legal status of non-permanent employees after the enactment of Law Number 5 of 2014 concerning State Civil Apparatuses, as well as concerning legal protection of Temporary Employees (honorary workers) after the enactment of Law Number 5 of 2014 concerning Apparatus State Civil. To solve this problem, research is conducted using normative methods, sources of primary and secondary legal materials, methods of gathering legal materials using the recording of laws and other literature, and analyzing legal materials using legal arguments. The results of this study that the legal protection of Non-permanent Employees (honorary workers) after the enactment of Law Number 5 of 2014 concerning State Civil Apparatus is in Law Number 5 of 2014 concerning State Civil Apparatuses no longer found the term Permanent Employees or honorary employee. But when viewed from the classification of Civil Servants (PNS) and Government Employes with Work Agreements (PPPK). Based on Law Number 5 of 2014 concerning State Civil Apparatus Article 8 Government Employees with Work Agreements (PPPK) are located as one of the elements of the state apparatus. Legal protection for Non-permanent Employees (temporary workers) after the enactment of Law Number 5 of 2014 concerning State Civil Apparatus is protection in the form of old age insurance; health insurance; accident insurance; life insurance; and legal assistance. Protection in the form of old age insurance, health insurance, work accident insurance, and death insurance is carried out in accordance with the national social security system.

HAM dalam setiap insan masyarakat yang terdapat ataupun terselubung dalam daerah pertambangan, seiring berjalannya proyek tersebut menyebabkan adanya permasalahan-permasalahan yang cukup signifikan akibatnya kurang memaksimalkan SDA di daerah tersebut dan perlu adanya pemenuhan ataupun perlindungan. Dampak-dampak yang membuat risih masyarakat sehingga terjadinya konflik dengan operasi tambang dan perlu adanya penyempurnaan keselarasan didalamnya. Adapun rumusan masalah dalam jurnal ini adalah bagaimana pengaturan perizinan pertambangan di indonesia? dan Bagaimana perlindungan hukum terhadap masyarakat di daerah pertambangan?. Penelitian ini menggunakan tipe hukum normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Pengaturan Perizinan Pertambangan di Indonesia yakni suatu konteks kesepakatan yang harus dilakukan dalam sebelum berjalannya proyek tambang tersebut, seperti halnya izin dalam pertambangan yang terutama meliputi segala bentuk, sistematis, cara/ pemikiran, pengolahan serta program proyek tersebut. Bentuk perlindungan hukum yang bersifat preventif yaitu pemerintah memberikan hak terhadap masyarakat di sekitar tambang dalam upayanya menyelaraskan pengelolaan ataupun pemanfaatan konten-konten SDA yakni mineral dan juga batubara, dengan demikian masyarakat dan perusahan pertambangan dapat bekerjasama dan saling mengawasi. Sedangkan bentuk perlindungan hukum bersifat represif adalah pemberi izin usaha pertambangan mewajibkan bila pertambangan terjadi pada tanah ulayat masyarakat hukum adat.

Sanksi pidana terhadap tindak pidana mengedarkan sediaan farmasi kosmetika tanpa izin edar, penelitian ini bertujuan karena semakin maraknya peredaran kosmetika yang tidak mempunyai izin edar namun tetap banyak diminati dan digunakan oleh masyarakat. Penelitian ini memiliki dua rumusan masalah yang akan dibahas yaitu, pertama bagaimanakah pengaturan mengedarkan kosmetika di pasaran yang tidak memiliki izin edar? Dan yang kedua bagaimanakah sanksi pidana terhadap para pelaku yang mengedarkan kosmetika yang tidak memiliki izin edar? Penelitian ini menggunakan metode hukum normatif. Berdasarkan dari hasil penelitian ini bahwa penulis mengkaji melalui analisis kasus menggunakan Putusan Pengadilan Negeri Gianyar Nomor Perkara 132/Pid.Sus/2018/PN Gin. Penelitian ini menggunakan pendekatan Perundang-undangan dengan menelaah semua undang-undang yang berhubungan dengan kasus ini, Konseptual yaitu dengan menggabungkan pendapat para ahli sehingga menjadi argumentasi hukum penulis, dan pendekatan kasus yaitu dengan menggunakan putusan pengadilan. Hasil penelitian ini menunjukan bahwa peran dinas kesehatan Republik Indonesia lebih tegas dalam memberikan standard kesehatan dan kemanfaatan bagi produsen-produsen kosmetik agar tidak lagi ada produsen kosmetik yang curang dan tidak bertanggung jawab dengan menggunakan bahan berbahaya dalam pembuatan kosmetiknya. Pengenaan sanksi pidana terhadap tindak pidana mengedarkan sediaan farmasi kosmetika yang tidak memiliki izin edar sebagaimana diatur dalam UU 36 Tahun 2009 Tentang Kesehatan diatur dalam Pasal 197-201. Dalam kasus penelitian ini Majelis Hakim mempertimbangkan dengan Pasal 197 dengan hukuman penjara maksimal 15 (lima belas) tahun dan denda maksimal 1.500.000.000 (satu milyar lima ratus juta rupiah). Tetapi terdakwa disini hanya dijatuhkan pidana penjara selama 8 (delapan) bulan dan denda sejumlah Rp 2.000.000,- (dua juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar maka akan diganti dengan pidana kurungan selama 2 (dua) bulan. Peran dinas kesehatan republik Indonesia lebih tegas dalam memberikan standar kesehatan dan kemanfaatan agar tidak lagi ada produsen kosmetik curang dan tidak bertanggung jawab.

Abstract—This is a consumer protection guarantee which should be by the consumer over any food products purchased from manufacturers or businessmen. For businessmen who just always worried about how to gain that much without thinking of the interests of consumers. It can be posed some problems that would constitute the subject of this research, the problem namely: 1) how form of liability in case of loss on consumers due to consume products in parcels. 2) how does the dispute resolution mechanism that creates consumer losses resulting from consuming products in parcels. This presentation method using empirical legal research, sociological issues in IE approach using an approach based on the provisions of the law and legal developments on a periodic basis. Liability in the event of the occurrence of harm on consumers due to consume products in parcel is a party – the party that made a mistake and led to losses. Parties – parties that are manufacturer, businessmen and parcel delivery service. Sanctions according to the civil code, namely compensation or administrative sanction and according to the criminal law, namely criminal confinement 5 years in prison. Consumers are dispute resolution mechanism gives rise to loss due to consume products in gifts can be made in litigation or non litigation. In trade parcels expected all parties to know about their respective responsibilities so that would not be incurred losses against consumers who consume parcels.

Abstract—Rape crime is the most common case in Indonesia. Rape is a crime that is very cruel, immoral, despicable and violates the norm where the victims are women both adults and minors. Rape violates Human Rights especially for women. The formulation of the problem raised is how to protect the law of women who are victims of rape in the perspective of human rights and how criminal sanctions are applied to perpetrators of rape crimes. This type of research is a research with a legal and conceptual problem approach. The results of this study indicate that legal protection that can be given to women who are victims of acts of sexual violence / harassment is stipulated in Article 285 of the Criminal Code and Law No. 13 of 2006 specifically in Article 5, Article 8, and Article 9 which are generally in the form of protection and rights of witnesses and victims. Victims of sexual violence have rights that must be enforced, hurt, suffering, fear, and various kinds of adverse effects that befall him after rape and need serious attention. While criminal sanctions against perpetrators of criminal acts of rape have been regulated in general in Article 285 of the Criminal Code which faces a sentence of twelve years in prison.

Abstract—Narcotics is a substance that can make anyone who consumes it lose consciousness and various adverse effects can be caused from this drug because it contains both centric and semi-sentimental plants that affect brain performance until the disappearance of the pain that is felt but makes severe dependence, as for types and various types and this class of drugs has been attached to this Act. The formulation of the problem in this paper is how the duties and authority of the National Narcotics Agency in the act of criminal narcotics and what are the efforts of the National Narcotics Agency in the prevention of narcotics crimes. The research method used in this research is normative legal research; the author uses the main approach, namely the legislative approach to narcotics crime. By the National Narcotics Agency and enforcement practices and constraints that occur in eradicating narcotics crime faced by the National Narcotics Agency, the source of the author's legal material is obtained from a literature study of primary legal material and secondary legal material. The National Narcotics Agency is a non-ministerial government institution domiciled under the President and responsible to the President. The National Narcotics Agency has the duty and authority in the field of prevention and eradication and abuse of narcotics. The National Narcotics Agency encountered several obstacles in carrying out its duties, which were not sufficient operational costs, inadequate facilities and infrastructure, and a lack of community participation in helping the National Narcotics Agency to prevent narcotics crime .
