Abstract

Abstract General Principles Good governance can be a claim in the State Administrative Court even though the existence of AAUPB can be said to be juridical and not formal as described in Article 53 Paragraph 2 of Act Number 51 of 2009 concerning State Administrative Courts. In the life of the AAUPB community can be used as a basis for seeking justice, where if the community feels aggrieved by a State Administrative Decree that does not at all refer to the AAUPB and burdensome the community in making decisions or regulations applied in community life. The problems studied are: Application and how the functions that should be played by AAUPB in the decision and form of legal logic from the side of PTUN judges. If you look at the concept of a Dutch country that implements good governance, in Indonesia the entry into force of AAUPB by looking at the theoretical basis applied in the AAUPB, State Administrative Courts, and Article 53 Paragraph 2 of Law Number 51 of 2009. Results of the study: 1) In the research 06 / G / 2017 / PTUN.DPS the role of AAUPB can be seen in the principle of accuracy, the principle of legal certainty and the principle of professionalism in which officials who are authorized to make decisions regardless of the prevailing historical value. Because in terms of the principle of legal certainty, the principle of professionalism, and the principle of accuracy the decisions issued are burdensome, in this case the community is given the decision issued by the competent authority, 2) in the implementation of the AAUPB to decide a case or dispute that occurs in the Administrative Court The AAUPB country acts as a test tool used by PTUN judges to decide on a case. Conclusions from this study: 1) In the decision No. 06 / G / 2017 / PTUN.DPS implementation or AAUPB function has been running to see from the logic of the panel of judges in implementing AAUPB to decide on a dispute, 2) The judge has acted actively in searching for causes and what which becomes a case by applying AAUPB in a consideration to decide on disputes that occur, without forgetting Emersonfraise that can be used by the government in making a decision that applies to the community. Suggestions from researchers: 1) AAUPB that is used or as a basis for testing instruments for PTUN judges in deciding a case should always be accompanied by regulations that apply in accordance with legislation, 2) the panel of judges must clearly use the legal logic by applying AAUPB as Test equipment decides on a dispute that occurs in the realm of the State Administrative Court. Keywords: Article 53 paragraph (2) law number 51 of 2009; disputes; general principles of good governance; PTUN Abstrak Asas-Asas Umum Pemerintahan yang baik dapat menjadi suatu gugatan dalam Pengadilan Tata Usaha Negara meskipun keberadaan AAUPB dapat dikatakan masih secara yuridis dan belum bersifat formal seperti apa yang dijelaskan dalam Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009 tentang Peradilan Tata Usaha Negara. Dalam kehidupan masyarakat AAUPB dapat dijadikan dasar untuk mencari keadilan, dimana jika masyarakat merasa dirugikan dengan Keputusan Tata Usaha Negara yang tidak Sama sekali mengacu pada AAUPB dan memberatkan masyarakat dalam membuat keputusan atau peraturan yang diterapkan dalam kehidupan bermasyarakat. Permasalahan yang dikaji yaitu: Penerapan dan bagaimana fungsi yang seharusnya diperankan AAUPB dalam putusan dan bentuk logika hukum dari sisi hakim PTUN. Jika melihat dari konsep negara belanda yang menerapkan good governance, di Indonesia berlakunya AAUPB dengan melihat landasan teori yang diterapkan dalam AAUPB, Peradilan Tata Usaha Negara, Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009. Hasil penelitian: 1) Dalam penelitian Putusan Nomor 06/G/2017/PTUN.DPS peran AAUPB dapat terlihat di dalam asas kecermatan, asas kepastian hukum dan asas profesionalitas yang dimana pejabat yang berwenang membuat keputusan tanpa melihat nilai historis yang berlaku. Karena ditinjau dari asas kepastian hukum, asas profesionalitas, dan asas kecermatan putusan yang dikeluarkan memberatkan, dalam hal ini masyarakatlah yang diberatkan oleh putusan yang dikeluarkan oleh pejabat yang berwenang, 2) dalam penerapan AAUPB untuk memutus suatu perkara atau sengketa yang terjadi di Peradilan Tata Usaha Negara AAUPB berperan sebagai alat uji yang digunakan oleh hakim PTUN untuk memutus seuatu perkara. Simpulan dari penelitian ini: 1) Dalam putusan No 06/G/2017/PTUN.DPS penerpan atau fungsi AAUPB sudah berjalan melihat dari sisi logika majelis hakim dalam menerapkan AAUPB untuk memutus suatu sengketa, 2) Hakim sudah bertindak aktif dalam mencari sebab dan apa yang menjadi perkara dengan menerapkan AAUPB dalam suatu pertimbangan untuk memutus sengketa yang terjadi, tanpa melupakan freies emerssen yang dapat digunakan oleh pemerintah dalam membuat suatu keputusan yang berlaku bagi masyarakat. Saran dari peneliti: 1) AAUPB yang dijadikan atau sebagai dasar alat uji bagi majelis hakim PTUN dalam memutus suatu perkara harusnya selalu didampingi dengan peraturan yang berlaku sesuai dengan perundang-undangan, 2) majelis hakim harus secara jelas dalam menggunakan logika hukum dengan menerapkan AAUPB sebagai alat uji memutus suatu sengketa yang terjadi di ranah Peradilan Tata Usaha Negara. Abstract

Abstract Examination of preparations is the first step in resolving State Administrative disputes. Preparatory examination has a very important role, as the gateway to a state administrative dispute to be examined at the State Administrative Court. Before entering into an examination of the subject matter at an ordinary session that is open to the public, the Plaintiff is given the opportunity to perfect his lawsuit that is not perfect and to the Defendant can be asked for information or explanation regarding the State Administrative Decision that has been sued. Preparatory checks are held because remembering the Plaintiff in the State Administrative Court is generally a citizen who has a weak position, when compared to the Defendant as a State Administration Officer. The results of this study are seen in the case of decision no. 4 / G / 2017 / PTUN.DPS according to the rules contained in Article 63 of Act No. 5 of 1986 the plaintiff's claim must be declared not accepted by the Panel of Judges. So from that it can be concluded (1) Existence of preparatory checks in resolving disputes in the State Administrative Court? (2) The legal consequences of preparatory examinations in resolving disputes in decision no. 4 / G / 2017 / PTUN.DPS in the State Administrative Court? The problems that will be discussed will be reviewed based on the normative point of view; the approach used in this study is the legislative approach and the case approach, namely the approach used by reading the applicable literature and legislation. Keywords: Disputes; examination; preparation; state administrative court Abstrak Pemeriksaan persiapan adalah langkah awal dalam penyelesaian sengketa Tata Usaha Negara. Pemeriksaan persiapan memiliki peranan yang sangat penting, sebagai pintu gerbang suatu sengketa tata usaha negara untuk diperiksa pada Pengadilan Tata Usaha Negara. Sebelum memasuki pemeriksaan terhadap pokok perkara pada sidang acara biasa yang terbuka untuk umum, Penggugat diberikan kesempatan untuk menyempurnakan gugatannya yang belum sempurna dan kepada Tergugat dapat dimintai keterangan atau penjelasan yang berkenaan tentang Keputusan Tata Usaha Negara yang telah di gugat. Diadakannya pemeriksaan persiapan dikarenakan mengingat Penggugat pada Pengadilan Tata Usaha Negara pada umumnya adalah warga masyarakat yang mempunyai kedudukan yang lemah, apabila dibandingkan dengan Tergugat sebagai Pejabat Tata Usaha Negara. Hasil penelitian ini dilihat dalam perkara putusan no 4/G/2017/PTUN.DPS sesuai aturannya yang terdapat dalam Pasal 63 Undang-Undang No 5 Tahun 1986 gugatan penggugat harus dinyatakan tidak diterima oleh Majelis Hakim.Maka dari itu dapat disimpulkan (1) Eksistensi pemeriksaan persiapan dalam penyelesaian sengketa di Pengadilan Tata Usaha Negara? (2) Akibat hukum dari pemeriksaan persiapan dalam penyelesaian sengketa putusan no 4/G/2017/PTUN.DPS di Pengadilan Tata Usaha Negara? Permasalahan yang akan dibahas nantinya akan dikaji berdasarkan sudut pandang normatif, Pendekatan yang digunakan dalam penelitian ini yaitu pendekatan perundang-undangan dan pendekatan kasus yaitu pendekatan yang digunakan dengan membaca literatur dan peraturan perundang-undangan yang berlaku. Abstract

The level of discipline and understanding of the rules and low courtesy of road users are things that need special attention in their efforts to solve problems in the field of traffic. Various efforts have been carried out by the government to improve traffic conditions in Indonesia but still have not been able to keep up with the rapid development of traffic. Based on the background of the problem above, the problem can be formulated as follows: how are the legal consequences for the perpetrator in a traffic accident whose victims died and how are the legal considerations for the perpetrators in criminal liability for traffic accidents. The type of research used is juridical empirical legal research because in this study, besides based on existing theories, it is also compared with research based on interviews and data in the field. The results of the discussion in this study: The legal consequences for the perpetrators in traffic accidents whose victims died were punished with a minimum prison sentence of 5 years. In accordance with Article 359 of the Criminal Code. Legal considerations for perpetrators in criminal liability against traffic accidents include elements of accident (negligence), never been punished, there is peace between the parties, giving information is not complicated, there are witnesses who lighten, then the threat of punishment can be lighter.

Abstract

Change to habit of people to live clean and healty is difficult, the problem of dumping garbage into rivers is indeed not an easy problem to overcome, besides cultural factors there are also religious factors for the people in Bali. The community must continue to remind them how to treat waste properly and corectly, it requires direct education from the goverment, the provision of facilities and infrastructure, and law enforcement in an effort to overcome the dumping garbage into the river. Based on this background, the formulation of the problem was found in the form of 1. How is the enactment of Denpasar city regulation number 1 of 2015 concerning the prohibition of garbage disposal into rivers? 2. What factors influence the Regional Regulation No. 1 of 2015 concerning the prohibition of garbage disposal into rivers? The reseach method used is an Empirical research type by conducting research directly into the field with a legal sociology approach which is analyzed using qualitative analysis techniques supported by primary and secondary data sources and used interview techniques, observation, inventory and location determination. Formed regulations must consider various aspects, one which is not in conflict with Pancasila as the philosophy and fondation of the state of Indonesia which reflect the value system both as a means of protecting values and as a means of a realizing public behavior and monitoring and dissemination of goverment overlap in terms of implementation. Recommendations from this paper require special goverment regulations from thr both the central and regional levels to better regulate the community in waste disposal.

Abstract

Joint assets are assets that a husband and wife can obtain during marriage. Dispute resolution means that the resolution of a conflict between two or more parties originating from different perceptions about an interest or property rights that can have legal consequences for both. The Peace Deed is after the parties mediate, a case agreement is reached on the subject matter of the dispute formulated in the peace agreement. At the appointed hearing, the case filed the peace agreement so that it could be used as a peace deed to resolve their dispute. Based on the explanation above, the following issues will be discussed: 1. Can the joint property of the marriage which is used as a debt security to a third party be the object of a peace agreement by the Plaintiff and Defendant? and 2. How is the process of resolving disputes over joint assets that are used as collateral for debts to third parties? This research uses normative legal research methods, using the statutory approach and conceptual approach, assessing primary and secondary legal materials. The results of this study indicate : That, joint property of a marriage that is in the second place as a debt collateral, cannot be used as an object of ownership disputes, or objects in the peace deed between the plaintiff and the defendant without involving the right holder's collateral, Husband or wife husband and wife disputing shared assets that are used as collateral for debt, must place the collateral holder as one of the cases.

Abstract

Penelitian dalam jurnal ini dilatar belakangi adanya kasus yang terjadi di masyarakat, akhir-akhir ini banyak terjadi perceraian di kalangan masyarakat, putusan verstek dalam perkara cerai talak dapat kita jumpai dalam perkara di pengadilan dimana salah satu pihak tidak hadir dalam persidangan dengan alasan maupun tanpa alasan yang sah. Pada pasal 125 ayat (1) HIR. Putusan verstek sebagai putusan hakim pengadilan agama dalam perkara perdata adalah salah satu putusan masuk dalam tahap putusan akhir. Rumusan masalahnya 1) bagaimana kekuatan hukum verstek dalam pemeriksaan cerai talak, 2) bagaimana keputusan hakim tentang penjatuhan putusan verstek terhadap perkara cerai talak. Metode yang digunakan dalam pembuatan jurnal ini adalah metode normative. Dalam hukum acara perdata Indonesia mengenai putusan verstek ini diatur dalam pasal 125 HIR/149 RBg. Ketidakhadiran salah satu pihak atau ketidakhadiran pihak tergugat pada hari sidang yang telah ditentukan adalah salah satu syarat untuk bisa dijatuhkannya putusan verstek oleh majelis hakim pengadilan agama badung yang memimpin persidangan dalam perkara perdata. Metode yang digunakan peneliti adalah metode normative yang merupakan penelitian yang berdasarkan bahan hukum sekunder dari perpustakaan. Dengan putusan verstek ini yang berkekuatan hukum tetap majelis hakim mengabulkan permintaan pihak pemohon dalam persidangan seperti halnya perkara yang masuk di Pengadilan Agama Badung dengan nomoister 0009/Pdt.G/2018/PA.Bdg.

Abstract

Land ownership is the highest land rights in any country. Property Right apart from being transferred can also be borne by mortgages or used as collateral for debt repayment.Land ownership has economic value for human needs. Apart from being transferred, Land ownership can also be borne by mortgages or pledged as collateral for repayment of debt. Land ownership can be transferred because inheritance of acquired land and inheritance is important to be registered to obtain legal certainty. The formulation of the problem raised in this study is; (1) What is the process of inheritance of land rights imposed with Mortgage Rights? and (2) What are the consequences faced by creditors for the inheritance of rights to land that are charged with Mortgage rights? This study aims to determine the process of inheritance of land rights that are charged with Mortgage Rights. This normative study with a method of approaching the problem of legislation with a conceptual approach. Based on the results of this study can be concluded that the process of transferring land rights due to inheritance occurs because of law. Heirs have to pay all debts left by the heir. The consequences faced by creditors are to wait for the process of returning the name of the object to the mortgage. A certificate issued by a land office has the same legal force as a court decision.

Abstract

Indonesian Workers, hereinafter referred to as TKI, are every Indonesian citizen who meets the requirements to work abroad in employment relations for a certain period of time by receiving wages. In the case of the placement of overseas Indonesian Workers held by Indonesian Manpower Services Companies must be in accordance with the terms and procedures specified in the legislation. After the terms and procedures are fulfilled, a work agreement is made concerning legal protection for the rights of Indonesian Workers. With the employment agreement, Indonesian Workers who work abroad will receive legal protection at pre-placement, placement and after-placement. The problem in this study is regarding the regulation of employment agreements and placement of Indonesian workers abroad and forms of legal protection for Indonesian workers abroad. The research method used in the discussion of this paper, the authors use the main approach, namely the Statute Approach and the Conceptual Approach as supporting the legislative approach, the source of the legal material for writing is obtained from the literature with the type of legal material in the form of material primary law and secondary legal material. The results of this study found that the weak protection of Indonesian workers is due to two main factors, namely the implementation factor of the protection law issued by the government does not work as it should, and a weak coordination factor between related stakeholders.

Abstract

Indonesia sebagai negara berkembang dewasa ini sedang melaksanakan pembangunan baik fisik maupun non fisik. Tanah mempunyai peranan yang penting karena tanah merupakan sumber kesejahteraan, kemakmuran, dan kehidupan. Hal ini memberikan pengertian bahwa merupakan tanggung jawab nasional untuk mewujudkan kesejahteraan dan kemakmuran rakyat. Rumusan masalah dalam tulisan ini sebagai berikut : Bagaimana tata cara pendaftaran dan peralihan hak atas tanah karena pewarisan? Faktor-faktor apa saja yang menjadi kendala dalam pendaftaran dan peralihan hak atas tanah karena pewarisan? Tipe penelitian ini dengan menggunakan tipe penelitian hukum normatif. Tata cara pendaftaran peralihan hak atas tanah karena pewarisan ke Kantor Pertanahan Kabupaten/Kota, adalah sebagai berikut: 1) Permohonan Pendaftaran Peralihan hak, 2) Pencatatan Peralihan hak dan 3) Penyerahan Sertifikat Hak. Faktor-faktor yang menjadi kendala dalam pendaftaran peralihan hak atas tanah karena pewarisan yaitu: 1) Kendala yang berasal dari masyarakat yaitu pemohon pendaftaran hak masih kurang melengkapi persyaratan yang dibutuhkan dalam melaksanakan pendaftaran peralihan hak atas tanah karena pewarisan, 2) Kendala yang dihadapi Kantor Pertanahan adalah pada saat proses pendaftaran peralihan hak atas tanah karena pewarisan yaitu mengenai persyaratan yang harus dilengkapi dalam pengajuan pendaftaran peralihan hak atas tanah karena pewarisan sehingga sering menghambat dalam penyelesaiannya.

Abstract

Tanah absentee merupakan tanah yang letaknya jauh dari tempat tinggal pemiliknya. Masyarakat yang tinggal di kota memiliki tanah di desa yang diusahakan oleh petani penggarap dengan sistem bagi hasil mengakibatkan pengelolaan tanah yang tidak efisien dan mengakibatkan sistem eksploitasi. Permasalahannya adalah (1) Bagaimana pola penggarapan tanah pertanian secara absentee di Desa Kintamani Kecamatan Kintamani Kabupaten Bangli?, (2) Bagaimana sistem perjanjian bagi hasil antara penggarap dengan pemilik tanah absentee?. Metode yang digunakan adalah metode empiris. Terdapat 2 (dua) pola penggarapan tanah absentee di desa kintamani yaitu pola penggarapan dengan biaya produksi dalam pengolahan tanah pertanian ditanggung semua oleh si penggarap dan biaya produksi dalam pengolahan tanah pertanian ditanggung sebagian dari pemilik tanah dan sebagian lagi ditanggung oleh penggarap lahan tersebut. Sistem perjanjian bagi hasil antara penggarap dengan pemilik tanah absentee di Desa Kintamani yaitu tidak tertulis/lisan dengan berdasarkan rasa kepercayaan. Penting bagi pemilik yang berjauhan dari letak tanahnya untuk dapat mengolah tanah mereka sendiri dan untuk mencegah terjadinya sengketa di masa depan antara pemilik tanah dan petani penggarap sebaiknya membuat perjanjian secara tertulis.
