Abstract

This study aims to examine the historical development of the sociology of law and its role in the legal system. The sociology of law is a branch of science that studies the relationship between law and society, including how law is formed, implemented, and influenced by social conditions. The method used in this study is descriptive qualitative, by collecting and analyzing various library sources such as books, journals, and related documents. The results of the study indicate that the sociology of law develops in line with social changes in society, ranging from classical to modern thought that emphasizes the importance of social aspects in law enforcement. In the legal system, the sociology of law plays a role in helping to understand the effectiveness of law, public legal awareness, and social factors that influence compliance with the law. Thus, the historical study of the sociology of law provides a broader understanding of the importance of integrating legal and social aspects in creating a legal system that is just and responsive to the needs of society

Abstract

This study analyzes the dynamics of legal compliance in society through a theoretical approach in sociology of law. Legal compliance is influenced not only by normative rules but also by social structures, cultural values, and individual perceptions. This research employs a qualitative descriptive method using a literature review of recent academic publications. The findings indicate that legal compliance is a multidimensional phenomenon shaped by legal awareness, legitimacy, social structures, and the compatibility between formal law and living law. Classical theories from Durkheim, Weber, and Ehrlich are integrated with modern perspectives to explain the complexity of legal behavior in society. The study reveals that compliance based on internalization is more sustainable than compliance based on coercion. Furthermore, the effectiveness of law depends on public trust and legitimacy. Therefore, sociological approaches are essential in legal development to create responsive and socially accepted laws.

Abstract

Pendekatan teoritis dalam sosiologi hukum melalui analisis teori fungsionalisme, multikulturalisme, dan perspektif konflik dalam proses sosialisasi hukum di masyarakat. Penelitian ini bertujuan untuk menjelaskan bagaimana ketiga pendekatan tersebut memandang fungsi hukum, proses internalisasi norma, serta relasi antara hukum dan dinamika sosial. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan konseptual dan studi kepustakaan melalui analisis berbagai literatur, jurnal ilmiah, serta karya para ahli sosiologi hukum. Hasil penelitian menunjukkan bahwa pendekatan fungsionalisme menempatkan hukum sebagai alat menjaga stabilitas sosial, pendekatan multikulturalisme menekankan pentingnya pengakuan keberagaman budaya dalam sosialisasi hukum, sedangkan perspektif konflik memandang hukum sebagai arena pertarungan kepentingan dan relasi kekuasaan. Ketiga pendekatan tersebut saling melengkapi dalam memberikan pemahaman yang komprehensif mengenai efektivitas hukum dalam kehidupan masyarakat.
