Abstract

Digital transformation has reshaped the foundations of law, not only technologically but also normatively and methodologically. Legal paradigms in the digital era must be examined through systematic interpretation, doctrinal reasoning, and normative critique. This study, based on normative legal research with a conceptual approach, utilizes legal materials from books and scholarly journals. Findings reveal three major challenges: first, a legal vacuum and regulatory lag, as technological innovation outpaces regulation, leaving many digital activities ungoverned. Second, a jurisdictional crisis arises because territorially bound national legal systems cannot effectively regulate global digital interactions. Third, regulatory fragmentation occurs due to overlapping digital regulations, creating legal uncertainty. Consequently, the effectiveness of law in the digital age is not measured by the number of regulations but by its adaptability, integrative capacity, and progressive interpretation in response to technological dynamics. Without such transformation, law risks irrelevance in governing digital society

Abstract

Abstrak Pekerja Perjanjian Kerja Waktu Tertentu (PKWT) merupakan kelompok pekerja yang rentan mengalami ketidakpastian kerja akibat fleksibilitas hubungan kerja dalam sistem ketenagakerjaan di Indonesia. Perubahan regulasi melalui Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja menimbulkan persoalan mengenai perlindungan hak pekerja kontrak, khususnya terkait kepastian kerja sebagai hak konstitusional warga negara. Penelitian ini bertujuan menganalisis pengaturan hukum PKWT di Indonesia serta jaminan konstitusional terhadap kepastian kerja bagi pekerja kontrak berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum dianalisis secara kualitatif terhadap peraturan perundang-undangan dan konsep perlindungan hak pekerja. Hasil penelitian menunjukkan bahwa pengaturan PKWT pasca Undang-Undang Cipta Kerja lebih menekankan fleksibilitas hubungan kerja dibandingkan perlindungan kepastian kerja pekerja. Kondisi tersebut berpotensi melemahkan hak atas pekerjaan dan penghidupan yang layak sebagaimana dijamin dalam Pasal 27 ayat (2) dan Pasal 28D ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Oleh karena itu, negara berkewajiban menghadirkan regulasi ketenagakerjaan yang berorientasi pada perlindungan hak konstitusional pekerja. Kata Kunci: hak konstitusional, PKWT, kepastian kerja, perlindungan pekerja.   Abstract Fixed-Term Employment Agreement (PKWT) workers are a vulnerable group of employees who often experience job insecurity due to the flexibility of employment relations in Indonesia’s labor system. Regulatory changes through Law Number 6 of 2023 concerning Job Creation have raised issues regarding the protection of contract workers’ rights, particularly job security as a constitutional right of citizens. This study aims to analyze the legal regulation of PKWT workers in Indonesia and the constitutional guarantee of job security for contract workers based on the 1945 Constitution of the Republic of Indonesia. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials were analyzed qualitatively through legislation and concepts of labor rights protection. The results indicate that the regulation of PKWT after the Job Creation Law emphasizes labor flexibility more than the protection of workers’ job security. This condition potentially weakens the right to work and to earn a decent living as guaranteed under Article 27 paragraph (2) and Article 28D paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Therefore, the state is obligated to establish labor regulations oriented toward protecting the constitutional rights of workers.
