Abstract

This study aims to find out the legal status of trading transaction agreement through facebook. Myang data source used consists of primary, secondary, and tertiary data sources. The method used to collect data by using literature study and field study. The results of this study indicate that the pattern of contract and form of expression (shigat) on the transaction on facebook is with the order from the consumer (muslam / aqid) which then the seller (muslam alaih / aqid) undertakes buyer's desire then there is a contract process with the agreed agreement together, ie each bound to exercise the rights and obligations (akad), then shigat form is when the seller undertakes the buyer's wish is called a statement (ijab) followed by a buyer's attitude statement to the goods to be purchased by paying the purchased item is called the answer (qobul). The position of the contract on this transaction is divided into two namely Shahih and Ghairu Shahih. This model transaction pattern is actually a processed creative innovation that developed from conventional traditional patterns to be more modern and practical.

Abstract

This research is intended to reveal that traditional knowledge as part of human rights, is the result of innovation and creation of indigenous peoples in terms of knowledge, art, and literature. Traditional knowledge as intellectual property of indigenous peoples is therefore an economic resource that can be utilised for the progress and welfare of indigenous peoples. The research method used is normative juridical with conceptual and statutory approaches. Government efforts in protecting traditional knowledge as intellectual property of indigenous peoples through legislation. Other efforts that can be made are through inventory or documentation of traditional knowledge in an area and can be done by publishing the traditional knowledge as widely as possible. The factor behind the traditional knowledge of indigenous peoples has not provided optimal economic benefits for the welfare of the indigenous peoples concerned is the perspective of the indigenous peoples themselves, namely prioritising the public interest, as well as the lack of knowledge to make traditional knowledge into commodities that provide economic benefits.

Abstract

The crime of corruption is an extra ordinary crime that damages the joints of the economy in a country. Therefore, the crime must be given a sanction that creates a deterrent effect so that the act can be minimized. However, in reality the sanctions against corruption crimes that have been drafted at this time in Indonesia need to be reformulated through the reform of criminal law in Indonesia. This study examines the granting of criminal sanctions for perpetrators of corruption according to Islamic Criminal Law in relation to Criminal Law Reform. The research method used is normative legal research, with data sources in the form of secondary data and primary, secondary and tertiary legal materials. The analysis is in the form of descriptive qualitative. The criminal sanctions for perpetrators of corruption in Indonesia as stipulated in the corruption crime law are only in the form of imprisonment and fines. Thus, there is a need for reform of criminal law, specifically criminal law for corruption. These legal reform efforts sometimes originate from living laws besides Islamic law, including customary law as law that was applicable in Indonesian society before the entry of the Dutch criminal law. Therefore, the renewal of criminal sanctions for perpetrators of corruption crimes is currently a matter that needs to be reformulated considering the current sanctions have not provided a deterrent effect for perpetrators of corruption by reforming the law and incorporating Islamic values into the formulation of these sanctions, especially the values of justice in Islamic criminal law.

Abstract

Indonesia should optimize the criminal law policy about witness protection especially in eradication of corruption as criminal cases. Giving witness of corruption cases a maximum protection could be an alternative instrument in corruption eradication in Indonesia. It because the witness testimony is an important evidence to unveil the clarity of the case and to prove the criminal act that was done by subject. While the officers (of law enforcement) hard to reveal the well planned criminal act. Witnesses mostly are unwilling to denounce a criminal corruption act because of threats, intimidation, and criminalization that they receive from the subjects and their companions. It will be a good chance to protect the witnesses, as Whistleblower or Justice collaborator, as an effort to disclose the criminal corruption case in Indonesia while giving maximum protection only for subjects like what occur till today. Optimalisasi kebijakan hukum pidana tentang perlindungan saksi di Indonesia khusus dalam hal pemberantasan tindak pidana korupsi adalah sebuah gagasan yang harus segera diwujudkan, karena memaksimalkan perlindungan saksi pelapor tindak pidana korupsi dapat dijadikan sebagai instrument alternatif dalam upaya pemberantasan korupsi di Indonesia. Mengingat pentingnya keterangan saksi sebagai salah satu alat bukti dalam upaya mencari dan menemukan kejelasan tentang tindak pidana yang dilakukan oleh pelaku tindak pidana, sementara itu penegak hukum kesulitan untuk mengungkap sebuah kasus korupsi yang biasanya sangat terencana secara sistemik. Biasanya saksi dan/atau pelapor enggan untuk melaporkan sebuah kasus korupsi, karena adanya ancaman, intimidasi dan kriminalisasi terhadap terhadap dirinya dari pihak-pihak tertentu. Ada peluang dengan mengoptimalkan perlindungan saksi baik itu sebagai pelapor (Whistleblower) maupun saksi pelaku yang berkerjasama (Justice collaborator), akan dapat pula mengoptimalkan pengungkapan kasus tindak pidana korupsi di Indonesia yang selama ini kebijakan hukum pidana dalam pemberantasan tindak pidana korupsi lebih mengarah terhadap pelaku semata.

Abstract

Development Law Theory refers to the life view (way of life) of Indonesian society based on the principle of Pancasila which encourages kinship then to norms, principles, institutions and rules. Updating laws is part of and at the same time implements punishment. Islamic Judicial Law, specifically concerning Role Law, stoning law for adulterers, as well as qishash, often gets a sharp spotlight from Non-Islamic societies such as Orientalists, as well as research, principles, legal laws and others required in the substance of the Criminal Code, actually regulated and applied in Islamic Law. On the other hand Islamic law in transition is not as rigid as imagined by Orientalists, but is instead flexible and can be used as a source of renewal of the National Criminal Law.

Abstract

This research examines Indonesia's criminal law policy's readiness to address fisheries and maritime crimes within the Indonesian Exclusive Economic Zone (ZEEI) and its implications for achieving the Sustainable Development Goals (SDGs). However, in the UNCLOS 1982, Indonesia is prohibited from imposing imprisonment as a sanction for violations of the ZEEI, allowing only fines as penalties. In addition to normative issues, structural issues also pose challenges to effective law enforcement and threaten the success of Indonesia's SDGs in the fisheries sector. Using a normative legal research method with statutory, conceptual, and historical approaches. The study finds that Indonesia, as a signatory to UNCLOS 1982, must carefully adapt international rules into national laws without compromising its sovereignty. To achieve legal certainty, imprisonment as an alternative to fines should be considered. Fisheries crimes in ZEEI negatively impact SDGs by depleting fishery resources, destabilizing the economy, violating human rights, and causing environmental damage. Judges play a critical role as enforcers of legal certainty and protectors of Indonesia's national interests through the Judicial Power Law. This research underscores the need for legal reform to strengthen Indonesia’s sovereignty and sustainability in maritime law enforcement.

Abstract

The criminal act of human trafficking (TPPO) is a serious crime that occurs on both national and international scales. It is a crime that is not easily detected because it is carried out in an organized and professional manner. Cases of human trafficking continue to increase every year, both globally and in Indonesia. This clearly proves that various international and national regulations have not been able to eliminate this crime. Therefore, it can be concluded that the high rate of human trafficking is not caused by a lack of regulations established by the government, but rather by the fact that the criminal penalties imposed on the perpetrators have not been effective in deterring them. Additionally, the existing regulations have not been fully effective in preventing the crime. Thus, it is necessary to compare the legal provisions on human trafficking with those found in Islamic criminal law. This research falls under normative legal research, using secondary data and analyzed deductively. Indonesia has regulated human trafficking in the Criminal Code (KUHP), specifically in Article 296, which prohibits human trafficking in the form of sexual exploitation. Similarly, Islamic criminal law prohibits human trafficking. This is based on the primary objectives of Islamic law (Maqāṣid al-Sharī ‘ah), which emphasize the importance of preserving five essential values: religion (dīn), life (nafs), intellect (‘aql), lineage (nasl), and property (māl), as stated in the Qur'an, Surah Al-Isra (17:70). Islamic law strictly forbids all forms of coercion, slavery, and sexual exploitation, as these actions violate the sanctity of human dignity.

Abstract

The current punishment for sexual crimes against children, limited to imprisonment, is deemed ineffective in deterring perpetrators. This article delves into this issue through the lens of positive and customary criminal law. Employing a doctrinal method and drawing from various legal sources, the article reveals that the existing punishment under the Indonesian Criminal Code and Child Protection Laws fails to significantly reduce the incidence of such crimes. As a potential solution, traditional law could serve as supplementary punishment, involving corporal punishment or fines payable to the state treasury. This suggests that customary law could complement judicial sanctions. However, the implementation of such additional measures warrants evaluation to address other environmental factors that may contribute to these crimes.

Abstract

Sexual crimes against children are serious violations that threaten human rights and children's psychological development. In Indragiri Hilir Regency, the rate of sexual violence against children has increased, highlighting the need for effective preventive measures. This study aims to analyze the role of the Tahfidz Al-Qur'an program in enhancing legal awareness among child victims of sexual crimes. The research method used is normative legal research with a descriptive-analytical approach. The findings indicate that the Tahfidz Al-Qur'an program not only teaches memorization skills but also instills moral values and legal understanding in children. Through the learning of the Qur'an, children are equipped with principles of truth and justice as well as awareness of prohibitions against wrongful acts, including sexual violence. Furthermore, this program contributes to building legal awareness in society through a religious approach. In conclusion, the Tahfidz Al-Qur'an program in Indragiri Hilir Regency plays a significant role in enhancing legal awareness among child victims of sexual violence and supports preventive efforts against sexual crimes. Kejahatan seksual terhadap anak merupakan pelanggaran serius yang mengancam hak asasi dan perkembangan psikologis anak. Di Kabupaten Indragiri Hilir, angka kekerasan seksual pada anak meningkat, sehingga diperlukan langkah preventif yang efektif. Penelitian ini bertujuan untuk menganalisis peran program Tahfidz Al-Qur’an dalam meningkatkan kesadaran hukum pada anak korban kejahatan seksual. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan deskriptif-analitis. Hasil penelitian menunjukkan bahwa program Tahfidz Al-Qur’an tidak hanya mengajarkan kemampuan menghafal, tetapi juga menanamkan nilai-nilai moral dan pemahaman hukum pada anak. Melalui pembelajaran Al-Qur’an, anak-anak dibekali prinsip kebenaran dan keadilan serta pemahaman terhadap larangan tindakan tercela, termasuk kekerasan seksual. Selain itu, program ini berkontribusi dalam membangun kesadaran hukum di masyarakat melalui pendekatan religius. Kesimpulannya, program Tahfidz Al-Qur’an di Kabupaten Indragiri Hilir memiliki peran penting dalam meningkatkan kesadaran hukum pada anak korban kekerasan seksual serta mendukung upaya preventif terhadap kejahatan seksual

Abstract

This study analyzes the application of justice values to children in narcotics crime cases based on Decision Number 9/Pid.Sus-Anak/2022/PN.Tar. The research background lies in the increasing involvement of children in narcotics offenses, as in the case where a child was instructed by his biological father to sell narcotics. This research employs a normative legal method with statutory and case approaches, drawing upon Law No. 35 of 2009 on Narcotics, Law No. 11 of 2012 on the Juvenile Criminal Justice System, and relevant court rulings. The findings show that the judge imposed a one-year imprisonment and two months of job training at the Probation Office (BAPAS) as a substitute for fines, considering both the juridical aspect under Article 114 paragraph (1) of the Narcotics Law and the sociological factor of parental influence. The study concludes that while the ruling complies with legal provisions, sociologically the child remains a victim whose rights are not fully protected. Therefore, strengthening the principles of diversion and restorative justice is essential to ensure that sentencing not only creates a deterrent effect but also safeguards the child’s future.
