Abstract

Community organizations (Ormas) in a country are evidence of the existence of democracy in a country. Indonesia is a constitutional state as well as a democratic state according to Article 1 Paragraphs 2 and 3 of the 1945 Constitution. The existence of mass organizations is recognized and protected in Indonesia as part of the state's recognition of the rights of every citizen to freedom of association and assembly. The dissolution of CSOs carried out without court procedures, according to the author, is a violation of the concept of the rule of law adopted by Indonesia as well as the castration of the rights of association, assembly, and expression of opinion in a democratic country. This study uses a socio-legal approach, with analytical descriptive research methods. Sources of data used are primary data in the form of interviews. The primary legal materials used in this research are the Law on Ormas; and SKB concerning the Prohibition of Activities Using Symbols and Attributes and Termination of FPI Activities. The results of the study stated that the disbandment of mass organizations was politically and ideologically motivated, namely differences in political attitudes and aspirations between Islamic organizations and the government. The dissolution of mass organizations is the impact of the applied procedural democracy. Democracy is not practiced substantially, in a democratic climate, differences in aspirations are a necessity. The disbandment of mass organizations has an impact on disharmony relations between religion and the state, between religious adherents and the government, and has the potential to cause polarization in society. The direct impact of the disbandment of Islamic organizations is the difficulty of building a synergistic relationship between religion and the state, between religious adherents and the government.[]Organisasi kemasyarakatan (Ormas) di suatu negara adalah bukti hidupnya demokrasi di sebuah negara. Indonesia adalah negara hukum sekaligus negara demokrasi sesuai Pasal 1 Ayat 2 dan 3 UUD 1945. Keberadaan Ormas diakui dan dilindungi di Indonesia sebagai bagian bentuk pengakuan negara atas hak setiap warga negara atas kebebasan berserikat dan berkumpul. Pembubaran Ormas yang dilakukan tanpa prosedur pengadilan menurut penulis adalah menyalahi konsep negara hukum yang dianut oleh Indonesia sekaligus pengkebirian hak-hak berserikat, berkumpul, dan menyatakan pendapat di negara demokrasi. Penelitian ini menggunakan pendekatan socio-legal, dengan metode penelitian deskriptif analitis. Sumber data yang digunakan adalah data primer yang berupa hasil wawancara. Bahan hukum primer yang digunakan dalam penelitian ini adalah UU tentang Ormas; dan SKB tentang Larangan Kegiatan Penggunaan Simbol dan Atribut Serta Penghentian Kegiatan FPI. Hasil penelitian menyatakan, pembubaran ormas dilatarbelakangi politis dan ideologis, yakni perbedaan pandangan sikap politik dan aspirasi antara ormas Islam dengan pemerintah. Pembubaran ormas merupakan imbas dari demokrasi prosedural yang diterapkan. Demokrasi tidak dipraktikkan secara substansial, dalam iklim demokrasi perbedaan aspirasi adalah keniscayaan. Pembubaran ormas berdampak pada hubungan yang disharmoni antara agama dengan negara, antara pemeluk agama dengan pemerintah, dan berpotensi menimbulkan polarisasi di tengah masyarakat. Dampak langsung dari pembubaran ormas Islam adalah kesulitan membangun relasi sinergi antara agama dengan negara, antara pemeluk agama dengan pemerintah.

Abstract

Indonesian bankruptcy law, regulated under Act Number 37 of 2004, has yet to fully realize its principles, resulting in legal uncertainty and gaps in implementation. A notable example is the Intidana Cooperative bankruptcy case, where a cassation ruling was later overturned through a Review Court decision. This study analyzes the revocation of Intidana Cooperative’s bankruptcy through the lens of the Principle of Justice in Act Number 37 of 2004, reinforced by John Rawls’ Theory of Justice. Using descriptive analysis of legal documents, government policies, and prior studies, the research finds that the Judicial Review decision upheld the Principle of Justice by recognizing cooperative members as the least advantaged party. Petitioners for bankruptcy were themselves cooperative members, while other members lacked the power to influence cooperative actions without a resolution from the Cooperative Members’ Meeting, placing them in a vulnerable position requiring judicial protection. The study concludes that while justice was realized in this case, existing provisions safeguarding the interests of cooperative members in bankruptcy require further review to ensure equitable outcomes for all parties.

Abstract

This study aims to analyze the state of society that began without a system, or what is called the condition of disorder, which is unstable (social melee) so that the state of law, when it comes to people's lives, must also follow the unstable pattern (legal melee). The method used is normative philosophical, which leads to the basis of discourse (Conceptual). This study also explains some of the gaps in previous similar studies by presenting some novelty of analysis, such as (1) an explanation of how legal wisdom is an important concept for progressive law enforcement, (2) the national legal system (conventional) with legalistic positivistic substance remains an open formulation towards legal progressiveness in Indonesia. The exposure of the construction of a legal system continuously undergoing development is an issue that must always get a balance for new legal discoveries so that the developing law always follows the development of society. The results of this study revealed that the existing legal products also naturally show how the law plays a role. Then, with the existence of legal products, one area that gets regulation against it must be more organized than areas that legal arrangements have not been regulated by law. It can be concluded that today's Indonesian legislation is a portrait that shows the problem of existing regulations. It has become natural to revive and develop with a more structured of legal enforcement.

Abstract

Inkonsisten kebijakan mudik semakain memperdalam dan meruncing pad a tataran masyarakat, sehingga terjadinya polarisasi cara pandang masyarakat terhadap urgensi mudik yang sudah lama tertanam dalam sebagai realitas sosiokultural masyarakat Indonesia namun harus dilakukan meskipun bahaya pandemi Covid-19 mengancam. Penelitian ini bertujuan untuk mengkaji dan menganalisis bagaimana pandangan hukum progresif terhadap kebiajakan larangan mudik. Penelitian ini merupakan jenis penelitian yuridis empiris untuk mengetahui dan menentukan bagaimana hukum itu berlaku sebagai norma atau das sollen. Hasil penelitian dijelaskan bahwa dalam perspektif Hukum Progresif, pemberlakuan Peraturan Menteri Perhubungan Nomor PM 13 Tahun 2021 untuk menghentikan kontroversi larangan mudik lebaran sekaligus menghadirkan kepastian hukum dalam perspektif Hukum Progresif adalah menegaskan cara pandang Pemerintah yang masih mendasarkan diri kepada ajaran ilmu hukum positif (analytical jurisprudence). Permenhub telah dengan sengaja “melokalisir” kebenaran hanya yang nampak secara tekstual dalam pasal-pasal Peraturan Menteri Perhubungan Nomor PM 13 Tahun 2021, yang oleh Hukum Progresif justru hal itu dikritik karena sama sekali tidak bisa menjelaskan kebenaran yang kompleks (keadilan substantive). Dalam perspektif Hukum Proresif, maka hukum selalu dikaitkan pada tujuan-tujuan di luar narasi tekstual hukum itu sendiri. Sehingga hukum harus memihak kepada kepentingan masyarakat (publik) dan demi kepentingan keadilan itu sendiri.

Abstract

Weak law enforcement and equitable development as well as other discriminatory treatments still occur in the implementation of minority rights in Indonesia. The purpose of this research is to examine law enforcement "sharp down, blunt up" from a sociological legal perspective. This study uses a descriptive research method with a qualitative approach. Data collection was carried out by studying literature from previous studies, then used to analyze the phenomenon of legal decisions in Indonesia. The phenomenon of law sharp downwards and blunt upwards is the reality of law enforcement caused by legal practices that are oriented towards justice. Efforts to realize material (substantive) justice in law enforcement (criminal) in court, can be provided through a legal pluralism approach and the ability of judges to evaluate laws. Law enforcement must be carried out appropriately and effectively to measure the success of the state. The running Indonesian state of law must also pay attention to aspects of divinity, humanity, deliberation, and justice.
