Abstract

Penelitian ini bertujuan untuk Untuk mengetahui Pengaturan Hukum tentang penyelenggaraan pelabuhan berdasarkan sistem hukum di Indonesia dan untuk mengetetahui kewenangan Pemerintah Daerah dalam penyelenggaraan pelabuhan Berdasarkan sistem Hukum di Indonesia. Metode yang digunakan dalam penelitian ini adalah hukum normatif yang merupakan prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya yang berkaitan dengan implikasi pemberlakuan asas Cabotage dalam pelayaran Indonesia terhadap eksistensi perusahaan angkutan laut nasional dalam kegiatan perdagangan bebas. Hasil penelitian menunjukan bahwa pengaturan hukum penyelenggaraan pelabuhan secara diatur dalam Peraturan Pemerintah No. 61 Tahun 2009 tentang Kepelabuhanan. Peraturan tersebut dibentuk untuk melaksanakan ketentuan Pasal 78, Pasal 89, Pasal 95, Pasal 99, Pasal 108, Pasal 112 ayat (2), Pasal 113, dan Pasal 210 ayat (2) Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, yang mengatur mengenai Tatanan Kepelabuhanan Nasional, Rencana Induk Pelabuhan serta Daerah Lingkungan Kerja dan Daerah Lingkungan Kepentingan pelabuhan, penyelenggaraan kegiatan di pelabuhan, pembangunan dan pengoperasian pelabuhan, terminal khusus dan terminal untuk kepentingan sendiri, penarifan, pelabuhan dan terminal khusus yang terbuka bagi perdagangan luar negeri, dan sistem informasi pelabuhan Penerapan UU No. 23 Tahun 2014, pada dasarnya bahwa pemerintah daerah menjalankan aturannya yaitu untuk mengatur dan mengurus rumah tangganya sendiri.

Abstract

This study is to determine how the implementation of the use of forms of freedom in the high seas according to the 1982 Convention on the Law of the Sea (UNCLOS 1982) and how the exceptions to freedom in the high seas according to the 1982 Convention on the Law of the Sea (UNCLOS 1982) The research method used in this research is to use normative legal research methods and it can be concluded that: 1. Regulations regarding the high seas are contained in Part VII Article 86 to Article 120 of the 1982 Convention on the Law of the Sea. Each country is granted both a coastal country and a non-coastal state given the right and freedom to utilize the high seas. The freedom of the state on the high seas is freedom in accordance with Article 87, namely freedom of navigation, flight, installing submarine cables and pipes, freedom to build artificial islands and other installations, freedom to catch fish, and freedom to carry out scientific research. Every country can take advantage of every given freedom, but every country is obliged to protect and utilize the high seas for peaceful purposes for the survival of humans. 2. In addition to providing freedom to use the high seas, the 1982 Law of the Sea Convention provides exceptions to these freedoms. Where every country is free to take advantage of the high seas but is not allowed to commit illegal acts or violate laws, both national and international laws, which in its application are often violated by countries in the world. There are several exceptions to the freedom of the high seas, such as the prohibition on slavery, piracy, trafficking of narcotic drugs and psychotropic substances, instant chase, illegal broadcasting, and pollution of the marine environment. Therefore, every country, both coastal and non-coastal countries, is obliged to cooperate in eradicating all forms of abuse of freedom on the high seas.

Abstract

Tigaras Port is managed by the North Sumatra Region II Land Transportation Management Center. Vessels operating at this port consist of 2 motorized crossing ships, namely KMP. North Sumatra I and KMP. North Sumatra II, as well as 17 traditional motor boats. Tigaras Port is one of the ports that has a busy trip schedule and is crowded with visitors every day. The world is currently being hit by a disease epidemic due to Corona Virus Disease (Covid-19) and the epidemic has had a major impact, including to the transportation sector. However, there is no maximum control effort and the level of compliance with the application of health protocols at Tigaras port, both from the passenger sector, transportation facilities operators, and transportation infrastructure operators is still very minimal.

Abstract

Jepara Ferry Port is a port that connects Java to Karimunjawa islands. This port is busy being used to transport vehicles, passengers, and basic food items for crossings, one of the ships used is KMP. Siginjai. The purpose of this study was to determine the operational load factor of KMP. Siginjai in the Jepara - Karimunjawa crossing and to arrange ship schedules based on the required frequency. The method used in this study is a survey method which is divided into two data collection methods, those are primary data and secondary data, primary data in the form of observation and secondary data in the form of institutional methods. In analyzing the data, several types of analysis were used, those are load factor analysis, passenger growth analysis, ship scheduling analysis and ship operational time analysis. Based on data analysis, it is known that the number of ships serving the Jepara – Karimunjawa route is not in accordance with the needs of service users. Based on the analysis of ship needs and facilities to serve the number of existing ships. The number of trips and the frequency of ship departures are currently not in accordance with the needs of service users. this is because the trip on the Jepara - Karimunjawa route is only 1 (one) trip / day which causes service users not to be transported to the ship and have to wait for the next departure. because the ship has excess load capacity.

Abstract

The Padangbai Ferry Port is located in Padangbai Village, Karangasem Regency. This port serves crossings between districts/cities, namely the Padangbai-Nusa Penida cross and between provinces, namely the Padangbai-Lembar cross. As a port that operates 24 hours with 13 trips/day, the current schedule arrangement is very important. Based on the results of a survey conducted by the author, there is a mismatch of the schedule compiled by the Land Transportation Management Center (BPTD) with its implementation, namely the ship's departure time with the existing schedule is not appropriate because the ship is waiting for a full load to depart. To be able to maximize the ship's load, it needs to be supported by a ship schedule that is in accordance with the implementation of the current health protocol in order to create a balance between the number of ships and the existing shipload. Data collection was carried out using the observation method. The data that must be collected are passenger and vehicle productivity, ship characteristics and ship operational time. Institutional methods and library data are taken from the Regional BPTD. XII Province of Bali & NTB. The analysis is carried out by evaluating schedules that are not in accordance with field conditions, and making an appropriate schedule so that no ships still have to wait for passenger and vehicle loads.

Abstract

Marampa Ferry Port is a port located in Manokwari Regency, West Papua Province. This port serves as an access crossing between provinces and within provinces in West Papua. At the moment, it is still at the Marampa Ferry Terminal there are basic mainland facilities that are lacking or even non-existent, which can hinder port operations. To analyze this, an analysis is used based on the Decree of the Minister of Transportation Number KM.52 of 2004 concerning the Implementation of a Ferry Port for waiting room analysis, Regulation of the Minister of Transportation Number 103 of 2017 concerning the Regulation of Vehicles Using Crossing Transportation Services and Decree of the Director General of Land Transportation Number: SK.242 / HK.104 / DRJD / 2010 Regarding Traffic Pattern Management for weighbridge analysis and gangway analysis which is based on the Regulation of the Director General of Land Transportation Number: SK.2681 / AP.005 / DRJD / 2006 Regarding Operation of Crossing Ports. Therefore, it is necessary to have a review and additions to some facilities that are lacking or even non-existent at the Marampa Port, this is done to improve the existing services at the Marampa Ferry Port. Improvement of main land facilities such as repairing waiting rooms and additional supporting facilities such as air conditioning, television, charger boxing and wifi access, providing weigh bridges, and gangways that go directly to the ship deck are carried out to facilitate port operational activities so that passengers can experience the excellent service provided by the port.

Abstract

The Bakauheni Ferry Port is managed by PT. ASDP Indonesia Ferry as port operator , province BPTD Wilayah VI Provinsce Bengkulu and Lampung as a government representative in the port. Crossing the harbor Ba kauheni Located in South Lampung regency province of Lampung . Bakauheni Ferry Port is one of the largest ferry ports in Indonesia with a total of 71 ships and has 7 dock units which are divided into 1 (one) executive dock and 6 (six) regular docks, in the implementation of its operations there are several obstacles that are quite important to overcome such as the problem of implementing sterilization at the Executive Terminal which is not good enough, causing many service users to have activities in the Port area such as trading in the parking area ready to load vehicles, this can occur due to a lack of signs and support for sterilization at the Port, besides that there is still crossing between vehicles in area B3 which is an area ready to load vehicles onto ships. To analyze this, the author refers to PM Number 29 of 2016 concerning the sterilization of ferry ports, PM Number 13 of 2014 Traffic Signs and Decree of the Director General of Land Transportation Number SK, 242 / HK.104 / DRJD / 2010 regarding Technical Guidelines for Traffic Management cross crossing. The analysis used is the analysis of sterilization at the Executive Terminal, Analysis of Needs for Signs at the Executive Terminal and Analysis of Traffic Management at the Executive Terminal. In order to overcome the existing problems, it will be adjusted to the Regulation of the Minister of Transportation Number 29 of 2016 concerning the Sterilization of Ferry Ports such as implementing zone arrangements in accordance with the Regulation of the Minister of Transportation Number 29 of 2016 concerning Sterilization of Ferry Ports so that service users will know which zones they are allowed to use. carry out activities and add equipment that supports sterilization such as land signs, road markings to make it easier for service users to reach their destination at the Executive Terminal, besides that, traffic management arrangements for delivery / pick-up vehicles will also be implemented so as not to enter prohibited areas so as to avoid crossing between vehicles in accordance with the Regulation of the Director General of Land Transportation Number: SK.242 / HK.104 / DRJD / 2010 concerning Technical Guidelines for Traffic Management at Crossings.

Abstract

Belum terpenuhinya syarat dalam penerapan sistem zonasi di Pelabuhan Penyeberangan Bakauheni menyebabkan terjadinya crossing pada arus lalu lintas khususnya pada dermaga eksekutif pada lintasan pengantar jemput penumpang dan kendaraan yang siap muat ke kapal serta pedagang yang masuk ke zona yang dilarang untuk berjualan menyebabkan kurangnya keselamatan dan keamanan di lingkungan pelabuhan. Penelitian ini bertujuan untuk mengevaluasi sistem zonasi di Pelabuhan Penyeberangan Bakauheni berdasarkan Peraturan Menteri Perhubungan Nomor 29 Tahun 2016 tentang Sterilisasi Pelabuhan Penyeberangan serta mengevaluasi penempatan rambu pendukung sistem zonasi yang tepat di Pelabuhan Penyeberangan Bakauheni.

Abstract

Mengingat betapa pentingnya bernavigasi pada alur pelayaran yang memiliki karakteristik yang sempit, berkelak-kelok dan cukup dangkal yang dikategorikan mendapat perhatian khusus saat melewatinya, maka diperlukan pelaut-pelaut yang handal dan cakap, yang memenuhi standar dan sebagai cermin kecakapan pelaut yang baik. Kecakapan pelaut yang baik disini yaitu pelaut-pelaut yang dapat mengambil suatu tindakan yang dianggap perlu guna menghindari bahaya-bahaya navigasi ataupun bahaya-bahaya tubrukan yang senantiasa mengancam dalam setiap pelayaran. tujuan penelitian ini yaitu Untuk mengetahui peran alat navigasi radar saat melewati alur pelayaran sempit dan untuk mengetahui upaya untuk mengoptimalkan penggunaan radar pada saat melewati alur pelayaran sempit. Teknik analisis data dalam penelitian ini adalah analisis desktriptif kualitatif, yaitu dengan cara menggambarkan data-data yang diperoleh dari study kepustakaan dan lapangan. Atas dasar data yang berhasil dikumpulkan, kemudian dianalisis untuk menemukan optimalisasi alat radar dalam navigasi di alur pelayaran sempit. Hasil dari penelitian ini yaitu: (1) Peran alat navigasi radar saat melewati alur pelayaran sempit sangat penting keberadaannya sehingga perlu mendapat perhatian bila terdapat masalah, sebagaimana kegunaan radar pada saat pelayaran sempit yaitu: Penentuan posisi dan ploting; Mengidentifikasi target; dan mendeteksi resiko tubrukan; (1) Upaya untuk mengoptimalkan penggunaan radar pada saat melewati alur pelayaran sempit perwira di atas kapal yaitu berupa; Nakhoda: bimbingan pada saat familiarisasi, perwira yang lain: saling kerja sama belajar dan berbagi ilmu serta berbagi pengalaman, Perusahaan: Melaksanakan test/seleksi kemampuan dan keterampilan terhadap crew baru dan memberikan training dan refreshing pengoperasian radar

Abstract

Kariangau Ferry Port is a port in Balikpapan City which serves the Kariangau-Penajam route with a total of 12 ships per day. Ship operations on this route are not balanced with minimum service standards for ship operations and the ideal number of trips so that when the ship sails it does not carry maximum passengers or vehicles. This research aims to increase the efficiency of ship use based on the current ideal number of ships and trips and minimum service standards for ship operations. The method used in this research is analysis load factor, analysis of minimum service standards for ship operations, analysis of ship needs, and scheduling analysis. Based on the results of the calculation analysis load factorobtained on averageload factorfor passengers it is currently 1% and for vehicles it is currently 57%. The change in ship operating patterns on the Kariangau-Penajam route now from existing conditions, which was obtained through the results of analysis of the calculation of the need for the number of ships and analysis of optimal ship schedules, has caused differences between the current ship operating patterns and the planned operation patterns resulting from the calculations. The operating pattern of this plan is calculated based on the number of trips and the number of ships according to the needs of service users so that ships on this route can carry maximum passengers and vehicles.load factorideal 65%.
