Abstract

A traffic accident in which the perpetrator is not responsible, leaving the victim alone without stopping the vehicle, and not providing assistance is called a hit-and-run. The crime of hit and run is a problem that needs to be addressed because it is an immoral act and harms others. This thesis will be discussed Police Efforts in protecting hit-and-run victims in the Serang City Region and the Police's efforts to deal with obstacles in protecting hit-and-run victims in the Serang City Region. The research method used is empirical juridical, namely examining applicable legal provisions with data obtained in the field, namely the Serang City Police Resort, in the form of processing data on hit-and-run cases by the police and interviews to obtain information about the factors causing the hit-and-run crime, as well as the handling process. by the police in this case. The handling of the hit-and-run by the police is after receiving a report of a traffic accident, going directly to the crime scene (TKP), collecting evidence, and making an official report at the crime scene. After finding the culprit, an investigation is carried out, if an investigation into the hit-and-run case has been carried out and not found sufficient evidence, then the investigation is terminated (SP3). However, if the perpetrator has not been found, the investigation will continue until the perpetrator is found. In handling hit-and-run criminal cases, the police often experience obstacles, including the lack of evidence and witness statements, and the lack of infrastructure and human resources in the traffic unit which results in delays in handling hit-and-run accidents in the Serang City Police District.

Abstract

The conception of a democratic rule of law in Indonesia has implications for the social and law order as a protection for the citizens. The protections guarantee the rights and responsibilities of every person regulated or protected by a democratic state. Either of the rights protected by the constitutions of Indonesia is guaranteed in obtaining and conveying information. As a profession, it is a part of journalistic activities, both professional and citizen journalism, as a constitutionally inherent right. The problem encountered is protection for citizen journalism, which is not regulated as protection for journalists in the legal system of the press. This research employed a qualitative model with a normative juridical approach to conceptualise the laws with facts and phenomena of journalistic activities. The analysis aims to assert that every person has a constitutional right to obtain and convey information like a professional journalist. A law is responsible for citizen journalism based on the law system of the press and code of ethics, which places citizen journalism products as a part of the news on press channels or press companies as the objects of the media that publish information. The concept of the principles of citizen journalism is related by maqashid shariah in Islam, which includes al-ahkam al-khamsah, namely religious protection (hifz al-din), protection of the soul (hifz al-nafs), protection of offspring (hifz al-nasl), protection of ideas/thoughts (hifz al-'aql), and protection of property (hifz al-mal).

Abstract

Kegiatan Pengabdian ke pesantren untuk mensosialisasikan UU ITE merupakan bentuk pelaksanaan Tri Dharma Perguruan Tinggi, Pesantren sebagai miniatur kehidupan masyarakat dengan beragam karakter dan perilaku santri cukup menarik untuk diteliti dari berbagai aspek dan sudut pandang. Pesantren Modern Assaadah yang beralamat di Pasirmanggu Desa Dahu Kec Cikeusal Serang Banten dipilih menjadi tempat pengabdian tim dosen dari Fakultas Ilmu Sosial Ilmu Politik dan Hukum Universitas Serang Raya. Berdasarkan pratest santri Assaadah 28% belum tahu dan pasca penyuluhan santri Assaadah 100% paham dan mengerti tentang UU ITE.

Abstract

Dinamika kehidupan sosial masyarakat di Indonesia semakin berkembang seiring perkembangan tatanan kehidupan yang berdampak langsung terhadap hubungan antar masyarakat maupun hubungan masyarakat dengan pemerintahan. Indonesia merupakan negara hukum yang termanifestasikan kedalam konstitusi negara yang memberikan jaminan bagi masyarakat untuk turut serta menyelenggarakan tujuan-tujuan negara. Pasca runtuhnya rezim pemerintahan orde lama yang melahirkan reformasi birokrasi dan tatanan hukum pemerintahan. Momentum tersebut menjadi landasan terbentuknya berbagai gerakan sosial masyarakat dalam rangka menunjukan aspirasi dan kehendak masyarakat yang ditujukan baik antar masyarakat maupun terhadap pemerintahan. Perkembangan teknologi informasi serta adanya aras globalisasi yang tidak dapat dihindari, semakin mempercepat laju perubahan gerakan sosial yang sebelumnya hanya gerakan biasa, menjadi gerakan sosial yang terorganisir baik dibidang ekonomi, politik, sosial hingga agama. Lahirnya gerakan sosial merupakan dampak dari prinsip demokrasi yang memberikan ruang dan kesempatan bagi masyarakat untuk memperjuangkan hak-hak secara konstitusional. Perkembangan teknologi informasi terhadap gerakan sosial masyarakat perlu mendapatkan perhatian pemerintah, terlepas bahwa gerakan sosial merupakan bagian bagian prinsip demokrasi konstitusional. Gerakan sosial yang tidak diperhatikan oleh pemerintah di era globalisasi saat ini dikhawatirkan terpengaruh paham-paham radikalisme yang mengancam stabilitas pemerintahan. Gerakan sosial adalah hak setiap orang, dan mempertahankan serta menciptakan stabilitas negara adalah tanggungjawab pemerintah.

Abstract

This study examines the formation of New Autonomous Regions (DOB) within Indonesia’s constitutional framework and analyzes the principles and impacts of the moratorium policy on DOB creation from legal and political perspectives. Grounded in the decentralization principle of the Unitary State of the Republic of Indonesia (NKRI), DOB formation aims to promote equitable development and enhance public services. However, the moratorium policy, in place since 2014, reflects concerns over fiscal burdens and regional readiness, creating tensions with local aspirations. Using a juridical-normative approach, the study reviews key legal frameworks, including the 1945 Constitution and Law Number 23 of 2014, alongside case studies of Papua, West Papua, and Sorong. Findings reveal that while the legal basis for DOB formation is clear, implementation faces administrative and political challenges. The moratorium, lacking a robust legal foundation, prioritizes national fiscal and political considerations over local needs, particularly in regions like Papua with strong demands for autonomy. The study underscores the need for a balanced, transparent approach to reconcile decentralization goals with effective governance

Abstract

Abstract: In managing a local government or municipality, regulation is a must. Forms of regulatory framework in this context is bylaw. In today’s democratic Indonesia, local government has authority to form and implement bylaw according to local needs and values. Including bylaw on sharia. Among the purpose of bylaw is maintaining order. From the perspective of constitutional democracy, sharia bylaws is the right of each local government and community as long as not contradictory to the Constitution. Liberty to enact certain bylaw shows a working democracy. Therefore, sharia bylaw is an indication of ideal democracy, not threat to democracy. Key Words: bylaws, sharia, constitutional democracy
