Abstract

The judiciary is very important thing to be paid attention, due to its effects on the integrity of the nation as well as state, even in the pre-Islam era up to current days. This study aims to expose the existence of the judicial institution`s authority in administering a judicial power. This research applied library method. The data collected form literature, and the analysis technique used the descriptive analysis based on the evidence of judicial institutions. The court is authority institutions which conduct a justice, trough examining and deciding cases of legal disputes or violations of laws. Wilayatul Hisbah whose main authority is to settle minor criminal acts which are do not require a judicial process in their settlement. In supporting this authority, there is such fatwa council, tahkim or arbitration institution that was held as an institution for implementing judicial power in Islam

Abstract

This study focuses on al-bai’ on clove seeds in the system mappalla perspective of Islamic law. This type of research is qualitative. The research was conducted descriptively-qualitatively. The research location was conducted in Bukkere, Sidrap Regency. The results show that al-bai’ on clove seeds in the system m appalla performed by the people of Bukkere is a hereditary tradition that has become al-urf ; al-bai’ on clove seeds in the mappalla system found there is an element of gharar in Islamic law; al-bai’ on clove seeds in the system mappalla, can not guarantee a good growth that can harm one party.

Abstract

This study aims to investigate the philosophical underpinnings of the law regarding the issue of religious court judges' decisions regarding the right to control and care for children. Various Religious Court decisions cannot be obeyed voluntarily by the party controlling the child (the Defendant) because the mother provides the finest care for children under 12. Based on the decision of the party entitled to care for the child (Plaintiff), and according to the survey, several respondents found the decision to be hollow (illusion). It is a normative study with a conceptual approach that is then descriptively and qualitatively analyzed. Initially, the application of Dwangsom in child support cases was psychological pressure on the Defendant to voluntarily carry out the provisions of the decision and psychological protection for the child, according to the results. Despite this, Dwangsom must be provided upon request. Second, a court decision grants a Dwangsom petition, effectively legalizing the practice in cases of religious child-rearing. Thirdly, the Judge's approval of the Plaintiff's request to establish Dwangsom positively affects the renewal of Islamic family law in Indonesia because numerous decisions regarding child support are not made voluntarily.

Abstract

This study aims to evaluate the effectiveness of premarital courses in promoting family harmony at the Office of Religious Affairs in Tubo Sendana Subdistrict, focusing on underage couples during the period of 2020-2022. The research addresses two primary issues: the implementation of the premarital courses and the factors that support or hinder their execution. A qualitative research method with a field study approach was employed, where primary data were gathered through interviews with the local community and secondary data were collected from various literature sources. The findings indicate that the premarital courses were conducted in accordance with existing regulations; however, several obstacles were identified, including inadequate facilities and negative public perceptions regarding the importance of these courses. Supporting factors included the strategic location of the Office of Religious Affairs and the availability of competent instructors. Based on these findings, the study recommends improving the supporting facilities and intensifying public outreach to enhance understanding of the significance of premarital courses in fostering family harmony.

Abstract

Penelitian ini membahas penerapan kaidah fiqih "darurat tidak membatalkan hak orang lain" dalam konteks akad jual beli dan akad pinjam-meminjam. Kaidah ini menegaskan bahwa keadaan darurat yang dialami seseorang tidak boleh merugikan atau menghilangkan hak pihak lain yang terlibat dalam suatu akad. Kajian ini menggunakan pendekatan normatif dengan analisis terhadap teks-teks hukum Islam klasik dan modern. Dalam akad jual beli, keadaan darurat, seperti kebutuhan mendesak untuk menjual barang di bawah harga pasar, harus tetap memperhatikan prinsip keadilan bagi kedua belah pihak. Sementara itu, dalam akad pinjam-meminjam, situasi darurat seperti ketidakmampuan pengembalian utang tepat waktu harus diselesaikan tanpa merugikan hak kreditur. Hasil penelitian menunjukkan bahwa kaidah ini memiliki relevansi signifikan dalam menjaga keseimbangan antara kemaslahatan individu dan kepentingan masyarakat, sesuai dengan prinsip keadilan dalam hukum Islam.

Abstract

The enforcement of women's rights concerning the restriction of polygamy during the iddah period following divorce is a significant problem in Islamic family law, especially within minority Muslim groups such as Tana Toraja. This paper examines a particular research gap: the inadequate comprehension of how local cultural practices affect the application of Islamic family law in minority settings. This study utilizes a legal methodology, integrating interviews with stakeholders from the local Religious Affairs Office and conducting document analysis of legal rulings, policies, and pertinent literature. The findings identify certain impediments, such as the impact of local cultural norms that frequently contradict Islamic legal principles and a lack of legal understanding within the community. The study proposes two principal recommendations to tackle these challenges: (1) improving legal education customized for the cultural context of minority Muslim communities, and (2) fortifying oversight mechanisms and law enforcement procedures via collaboration among local authorities, religious leaders, and community organizations.

Abstract

This article discusses the issue of legal inheritance for illegitimate children in inheritance law, where there are differences in the national legal system in Indonesia. According to customary law, it is permissible to give equal rights to adopted children, Islamic law allows obligatory wills, and civil law allows inheritance through gifts. The concept of legitime portie, or forced inheritance, exists to protect heirs from losing their inheritance rights. However, in its implementation there were several obstacles, for example in the case when the court confirmed a will to bequeath all assets to one of the sons, even though there were other legal heirs, based on considerations of Article 832 of the Civil Code and local customary law. Civil Code, the inheritance rights of children outside of marriage to their biological father are very dependent on legal recognition. Without this recognition, the legal inheritance relationship between the two does not exist. In contrast, in the Compilation of Islamic Law (KHI), the lineage of illegitimate children only follows the mother's line.

Abstract

This study seeks to examine the modalities of disimplementation of the Islamic family law in addressing the rights of ex-wives post-divorce. The study is crucial as the disimplementation of the law can lead to injustice, legal confusion, and dissatisfaction for the people that the law is intended to protect. This case study examines the disimplementation of ex-wives' rights post-divorce within the religious courts of Pinrang, Sidrap, Tangerang, and Pariaman in Indonesia. Data were collected through interviews and document analysis. The data analysis employed a three-stage interpretative method: restatement, description, and interpretation. The findings reveal that the disimplementation of the Islamic family law regarding the rights of ex-wives post-divorce arises from three factors: firstly, the ex-husband's failure to fulfill his obligations towards his ex-wife's rights. Secondly, the presence of a complex execution process for realizing the wife's rights necessitates substantial financial resources (bureaucracy). Third, deficiencies in law enforcement include the complexities of the legal process for victims (ex-wives), inadequate penalties, and limited legal literacy among ex-wives concerning their rights. The inability to uphold these rights has resulted in economic, social, and psychological damages for ex-wives. This disimplementation is theoretically attributed to inadequate law enforcement, alongside the influences of law enforcement agents, culture, and societal dysfunction.

Abstract

Rapo-rapoang merupakan dasar kata dari rapuh, rapuh itu sendiri dapat diartikan sebagai masa dimana calon pengantin mudah terkena musibah yang dapat mencederai fisik ataupun dapat merenggut nyawa calon pengantin maka dari itu calon pengantin tidak dianjurkan keluar rumah untuk hal yang sia-sia karena tujuan dari rapo-rapoang itu sendiri merupakan larangan agar pengantin terhindar dari bala’. Penelitian ini bertujuan mengetahui budaya adat Rapo-rapoang dan menghindarkan calon mempelai dari bahaya dan memberikan edukasi kepada calon mempelai. Jenis penelitian ini adalah kualitatif deskriptif. Adapun teknik pengumpulan data yang digunakan adalah Teknik Library Reserarch dan Teknik Field Research (Observasi, Wawancara, Dokumentasi). Penelitian ini menggunakan sumber data primer dan data sekunder. Hasil penelitian menujukkan bahwa Pemahaman masyarakat bugis khususnya di kecamatan Watang Sawitto kabupatan Pinrang meyakini bahwa rapo-rapoang merupakan sebuah adat yang dilaksanakan masyarakat setelah terjadinya mapettuada (putus perkataan) dalam adat bugis rapo-rapoang yaitu sebuah larangan yang ditujukan kepada calon mempelai laki-laki dan wanita untuk tidak beraktivitas diluar rumah adapun nilai-nilai rapo-rapoang adalah untuk menghindari bala’, mempersiapkan diri, dan merawat diri.

Abstract

This research examines social facts related to marriage dispensation before and after the enactment of Law No. 16/2019 at the Sidenreng Rappang Religious Court. The focus of the research is on the factors causing the increase in marriage dispensation applications and the response of law enforcers in the religious courts. The method used is field research with a qualitative descriptive approach and case study method. The results showed that after the enactment of Law No. 16/2019, which raised the minimum age of marriage to 19 years, there was a significant increase in marriage dispensation applications at the Sidenreng Rappang Religious Court. The main factors influencing the high number of applications include family economic conditions, low levels of education, strong local social and cultural norms, pregnancy outside marriage, and lack of supervision and education from parents. In addition, fear of violating religious norms and a desire to maintain the family's reputation are also important reasons for marriage dispensation applications. Despite various education and socialization efforts by the Sidenreng Rappang Religious Court, the effective implementation of the minimum age of marriage still faces challenges due to deep-rooted social and cultural factors in the community. This study recommends the need for increased legal education, strengthening the role of parents, and synergy between agencies to reduce marriage dispensation.
