Abstract

The problematic reality of national roads in rural and urban areas is that they are often damaged and unfit for use. This is due to nationwide road repairs that rely only on the central government's responsibility, resulting in development delays that could endanger the safety of road users. The method used in this research is social legal research to observe law in the dynamics of social life in the context of the role of district and city governments in dealing with damage to national roads. The role of the government in dealing with damage to national roads is to carry out supervision to prevent workers from committing irregularities, misappropriation, and wastage of funds, as well as to overcome obstacles that may occur during the repair process. In addition, the government has a role in carrying out road construction and accommodating policies regarding road construction. Thus, even though national roads are the responsibility of the central government, district and city governments also need to take responsibility for national roads.

Abstract

Basically, every nurse who will provide nursing services must be responsible and obliged to document the information made, so that the information can be useful for other health workers. The incompleteness of documentation in integrated patient progress records is due to the high workload of nurses. The purpose of the study was to determine the relationship between nurse workload and the completeness of documenting integrated patient progress records in the inpatient of Banjarmasin Islamic Hospital. Research design quantitative correlation of analytical with cross sectional approach. The population of this study was 84 nurses. Sampling is done by probability sampling, which is using simple random sampling. The sample of this study was nurses at Banjarmasin Islamic Hospital Inpatient as many as 69 nurses. Data collection using nurse workload questionnaires and observation of patient progress records were integrated using spearman rank tests. The results of the research test in this study obtained p value (0.001) < α (0.05) so that it can be concluded that there is a significant relationship between the workload of nurses and the completeness of documenting integrated patient progress records in Islamic Hospital Inpatients. Therefore, it is important to carry out teamwork both between nurses or with other health teams in carrying out work in order to maintain the quality of documentation on integrated patient development records.

Abstract

This study aimed to analyze the juridical implications of enforcing the Regional Regulation of the Province of Bali Number 4 of 2019 and the reconstruction of the renewal of regional regulations regarding traditional villages in Bali. This study used normative legal methods with statutory and conceptual approaches. The study results showed that the juridical implications of enforcing the Bali Province Regional Regulation Number 4 of 2019 were contrary to Government Regulation Number 38 of 2007 because it explicitly contained provisions regarding religion which should be the central government's authority. Bali Provincial Regulation Number 4 of 2019 created discrimination because it prioritized certain religious groups. Reconstruction of the renewal of regional regulations regarding traditional villages in Bali could be carried out by internalizing the tri hita karana concept, including palemahan, pawongan, dan parahyangan in the substance of regional regulations regarding traditional villages in Bali.

Abstract

Hasil penelitian didapatkan sebagai berikut pertama tipologi tanak pecatu di Kecamatan Jerowaru di klasifikasikan menjadi tiga macam yaitu, tanak pecatu yang diberikan kepada Kepala Desa, namun pada realitasnya tanak pecatu ini banyak digugat oleh masyarakat. Kedua, tanak pecatu yang diberikan kepada Sekretaris Desa pada saat sebelum pengalihan status Sekretaris Desa menjadi PNS, namun realitas lapangannya banyak Sekretaris Desa masih mengelola bahkan menjual dan menggadai tanak pecatu yang dibeli melalui APBD. Ketiga, tanak pecatu yang diberikan kepada Kepala Dusun yang sampai saat ini belum terdata dengan jelas karena alasan dijual, digugat dan dijadikan rumah pribadi. Kedua, peningkatan kualitas maupun kuantitas sengketa tanak pecatu disebabkan kebutuhan akan tanah yang semakin meningkat dan peningkatan pengadaan tanah untuk pembangunan kepentingan umum yang juga mengalami peningkatan. Selain alasan tersebut sengketa tanak pecatu disebabkan, karena tanak pecatu yang di alokasikan kepada Desa tidak pernah diurus dan dikelola oleh Desa. Tanak Pecatu yang diberikan kepada Kepala Desa dan Sekretaris Desa sebagai hak gajinya terkadang disalahgunakan penggunaannya seperti gadai atas tanah pecatu tersebut lebih lama dari masa jabatannya. Dan Desa mengakui tanah masyarakat yang di samping Kantor Kepala Desa sebagai tanah pecatu. Ketiga, pengaturan dan Perlindungan Tanak Pecatu dalam Hukum Pertanahan Indonesia semakin beragam tetapi tidak memberikan kepastian hukum.

Abstract

The writing of this article is motivated by the implementation of marriage agreements in Article 147 of the KUHPerdata and Article 29 of Law Number 1 of 1974 about Marriage, which states that marriage agreements are made before the marriage happened. This rule restricts the freedom of two individuals to perform the agreement, so that it is contrary to Article 28 points e paragraph 2 of the 1945 Constitution. In 2015, the Constitutional Court (MK) issued Decision Number: 69 / PUU-XIII / 2015 which concerning about the issue of the marriage agreement. This article discusses the settlement of marital property disputes after the Constitutional Court's decision in terms of normative legal studies. The study focused on legal principles, legal systematics, legal synchronization, and legal history. The result: (1) based on the Constitutional Court's decision, the marriage agreement can be made as long as the marriage bond takes place with mutual agreement witnessed by a notary without having to be preceded by a court ruling; (2) the Constitutional Court's decision results in joint and third party assets that made and witnessed by a notary begins to take effect from the time the marriage takes place, unless otherwise specified in the marriage agreement. That is, if the parties do not determine when the marriage agreement will take effect, the marriage agreement will take effect from the time the marriage takes place. [Penulisan artikel ini dilatarbelakangi oleh pelaksanaan perjanjian perkawinan dalam Pasal 147 Kitab Undang-undang Hukum Perdata (KUHPerdata) dan Pasal 29 Undang-Undang Nomor 1 tahun 1974 tentang Perkawinan, yang menyebutkan bahwa perjanjian perkawinan dibuat sebelum perkawinan dilangsungkan. Peraturan ini membatasi kebebasan dua orang individu untuk melakukan perjanjian, sehingga bertentangan dengan Pasal 28 Poin e Ayat 2 Undang-Undang Dasar 1945. Tahun 2015, Mahkamah Konstitusi (MK) mengeluarkan Putusan Nomor: 69/PUU-XIII/2015 yang di antara ketentuannya menyangkut persoalan perjanjian perkawinan. Artikel ini membahas penyelesaian sengketa harta perkawinan pasca putusan MK tersebut dari sisi kajian hukum normatif. Kajian difokuskan pada asas-asas hukum, sistematika hukum, sinkronisasi hukum, dan sejarah hukum. Hasilnya: (1) berdasarkan pada putusan MK tersebut, perjanjian perkawinan dapat dibuat selama ikatan perkawinan berlangsung atas persetujuan bersama di depan notaris tanpa harus didahului oleh penetapan pengadilan; (2) putusan MK tersebut berakibat pada harta bersama dan pihak ketiga yang dibuat di hadapan notaris mulai berlakunya sejak perkawinan dilangsungkan, kecuali ditentukan lain dalam perjanjian perkawinan. Artinya, apabila para pihak tidak menentukan kapan perjanjian perkawinan tersebut mulai berlaku, maka perjanjian perkawinan tersebut berlaku sejak perkawinan dilangsungkan.]

Abstract

Latar Belakang: Semua tindakan yang dilakukan masyarakat dalam menghadapi bencana sangatlah penting. Kesuksesan dalam penanganan, evakuasi atau pengungsian ketika banjir sangat bergantung dari kesiapsiagaan masyarakat dan perseorangan itu sendiri. Kesiapsiagaan dalam penanganan bencana banjir perlu dibangun dan ditingkatkan melalui langkah yang tepat guna dan berdaya guna. Tujuan: Penelitian ini bertujuan untuk mengetahui hubungan karakteristik dengan kesiapsiagaan masyarakat dalam menghadapi bencana banjir di Desa Lok Buntar Kecamatan Sungai Tabuk Kabupaten Banjar.Metode: Penelitian ini menggunakan metode penelitian kuantitatif dengan jenis penelitian deskriptif analitik dan menggunakan pendekatan cross-sectional.Hasil: Hasil uji statistik spearman rho didapatkan karakteristik yang berhubungan dengan kesiapsiagaan masyarakat dalam menghadapi bencana banjir dengan nilai signifikan 0,1 adalah jenis kelamin (p value 0,030) dan sikap (p value 0,001). Sedangkan karakteristik yang tidak berhubungan dengan kesiapsiagaan masyarakat dalam menghadapi bencana banjir adalah pengetahuan (p value 0,108).Simpulan: Oleh karena itu, masyarakat disarankan untuk dapat lebih meningkatkan pengetahuan, sikap dan kesiapsiagaannya dalam menghadapi bencana banjir.

Abstract

Investigating criminal acts of corruption in certain circumstances is ineffective because the investigation and prosecution process carried out by law enforcement officials in Indonesia is discontinuous. This is normative legal research that uses a statutory approach to determine material and formal suitability for investigating criminal acts of corruption in certain circumstances. The legal materials used are primary and secondary. The data collection technique was carried out by literature study and then analyzed using the syllogism method. The research results show, first, that the lack of optimal investigation is influenced by three factors: substance, structure, and legal culture. Second, formulating ideals for investigating criminal acts of corruption in specific circumstances is necessary. This includes revising the provisions on criminal threats in court decisions, reformulating the role and function of the police, prosecutors, and corruption eradication commissions related to investigations, and recognizing the community's role in preventing corruption in Indonesia. Therefore, the government must consider reformulating the investigation of criminal acts of corruption, especially in certain circumstances, to make it more effective.

Abstract

Agrarian Reform and Land Redistribution have been pursued by the government in various ways. Still, the key question is whether establishing a Land Bank will result in a fair redistribution of land. The purpose of this study is to examine the impact of land banks on agrarian reform and equitable land redistribution following the passage of the Job Creation Act. The findings revealed that the land bank only has a few abandoned lands that are not held by the state, which will be used by the form based on public interest and subsequently handed to the community. The existence of a land bank is a government endeavor to offer land for the public good and for persons who require it.
