Abstract

The aim of this research, (1) To explain about the relation between investment and economic law (2) To know about the relation between foreign investment and the growth of Indonesia Economic. (3) To know about the shape of redirects of foreign investment in Indonesia. This research is normatif research. And the type of this research is library research. The result of this research, noticing that investment is closely related to economic law,investment consideration in a country decided by the regulation of economic law. The result of this research also noticing that there are not spesific regulation about technology transfer, In Undang-Undang nomor 25 Tahun 2007 About direct investment, there are not single article talking about technology transfer. Technology transfer in this case not only about machine but also about knowledge that can help to build Knowledge in Indonesia.

Abstract

This research aims to analyze the form of legal protection for customers who suffer losses due to fraudulent funds in the capital market, the role and efforts of the Financial Services Authority in protecting customers in the capital market, and how Sharia economic law reviews in resolving disputes in the capital market.This type of research is normative legal research through a juridical approach which is carried out by examining various legal rules such as in Laws and Regulations No. 8 of 1995 concerning Capital Markets in Chapter X  I concerning fraud, market manipulation and insider trading, as well as cases related to the capital market, namely the case of PT Sarijaya Permana Sekuritas. Related to dispute resolution in Islamic law explained in the Al-Quran surah Saad verse 26 Data collection techniques using Library Research techniques (literature study), namely a data collection technique that collects legal materials obtained from various sources such as books, journals, and online written media related to the object of discussion. The data analysis technique used is qualitative data analysis technique, namely analyzing data by collecting data, presenting data and drawing conclusions, then the data is arranged in descriptive form by describing the data that has been obtained in the form of logical sentence descriptions, then interpreted and given conclusions.The results of this study indicate that: First, legal protection of customers who suffer losses due to violations committed by securities companies can apply the return of unauthorized profits by the OJK to the Securities Company to provide loss compensation funds to customers. Second, based on Law Number 21 of 2011 OJK has a role in forming regulations for improvements in the field of capital markets including protecting customers as consumers. Third, dispute resolution in Islam can be through peace mechanisms (such), arbitration (tahkim), and courts (Al- qada).

Abstract

People with disabilities often face challenges in fulfilling their rights, including the right to worship in mosques. This research aims to investigate the worship accessibility for people with disabilities in the Tana Luwu area and the role of religious mosque authorities in supporting the fulfillment of the religious rights of people with disabilities in Tana Luwu. This is qualitative research with case study approach, where the researcher interviewed five individuals with disabilities and three mosque authorities. Additionally, the researcher observed several mosques and collected relevant documentation. The research results show that people with disabilities in Tana Luwu face difficulties in accessing mosques in the area due to the lack of disability-friendly facilities. However, the absence of disability-friendly mosque facilities can be overcome with positive attention from mosque authorities and Jemaah or congregants. In general, physical barriers do not pose a significant obstacle for people with disabilities to worship because of the social support they receive from the surrounding community. Discussions about the religious rights of people with disabilities should be expanded, and real improvements in mosques are needed to make them inclusive places of worship.

Abstract

Penelitian ini bertujuan untuk mengetahui tentang diskresi dari sudut pandang hukum administrasi negara dan hukum pidana serta menganalisa apa penyebab kriminalisasi kebijakan atau diskresi yang dikeluarkan oleh penyelenggara negara. Penelitian ini adalah penelitian normatif dalam penelitian ini yang menjadi alat utama pengumpulan data, berupa studi dokumen atau studi kepustakaan. di dalam penelitian ini pengumpulan data dilakukan dengan metode studi kepustakaan. Hasil penelitian ditemukan bahwa ada perbedaan sudut pandang antara hukum administrasi negara dan hukum pidana mengenai diskresi. Di dalam hukum administrasi negara, diskresi merupakan kebebasan bertindak atau kebebasan mengambil keputusan dari Badan atau Pejabat administrasi pemerintahan menurut pendapatnya sendiri, sedangkan dari sudut pandang hukum pidana, diskresi dianggap sebagai sebuah sudut yang menggoda atau disebut sebagai power seduction, bagi para penguasa dalam menjalankan kekuasaaannya. Kekuasaan yang dimaksud adalah kekuasaan untuk menggunakan kewenangan berdasarkan kreatifitas pejabat tersebut. Kemudian Diskresi dapat menjadi sebuah perbuatan melawan hukum dalam hukum pidana. Hal tersebut dapat terjadi Ketika diskresi tersebut mengakibatkan kerugian negara, sekalipun sebenarnya niat awal dari dilakukannya diskresi tersebut bertujuan untuk mengisi kekosongan aturan dan menyelesaikan permasalahan yang ada Ketika menjabat, bukan untuk keuntungan diri sendiri atau orang lain. Kemudian dari penelitan diketahui bahwa kriminalisasi kebijakan, atau diskresi yang gagal kemudian menjadi tindak pidana korupsi, disebabkan oleh adanya kekeliruan pemahaman dalam memaknai unsur melawan hukum sebagai genuus delict dan menyalahgunakan kewenangan sebagai species delict, Kurang cermatnya para penegak hukum dalam memahami dan membedakan antara ruang lingkup hukum administratif dan hukum pidana inilah yang menurut penulis menyebabkan hal ini terjadi.

Abstract

Abstract[English]:This study aims to determine the marriage process carried out during the pandemic and to find out the public's view of the wedding tradition carried out during the pandemic. This research is qualitative research located in Baebunta Village, Baebunta District, North Luwu Regency. Data was collected through interviews, observation and documentation. Data analysis is carried out by giving meaning to the data that has been collected, and from that meaning conclusions are drawn. The results showed that the marriage process during the pandemic underwent a change where there were several traditions that were no longer carried out due to a health protocol policy that must be implemented in the ongoing marriage process. This change in the wedding process makes people have a positive view because it makes wedding costs cheaper, the event is simpler, and the use of time is shorter.Abstrak[Indonesia]:Penelitian ini bertujuan untuk mengetahui proses pernikahan yang dilaksanakan pada masa pandemi dan untuk mengetahui pandangan masyarakat terhadap tradisi pernikahan yang dilaksanakan pada masa pandemi. Penelitian ini merupakan penelitian kualitatif yang berlokasi di Desa Baebunta, Kecamatan Baebunta, Kabupaten Luwu Utara. Pengumpulan data dilakukan melalui wawancara, observasi dan dokumentasi. Analisis data dilakukan dengan memberikan makna terhadap data yang berhasil dikumpulkan, dan dari makna itulah ditarik kesimpulan. Hasil penelitian menunjukkan bahwa proses pernikahan di masa pandemi mengalami perubahan dimana ada beberapa tradisi yang tidak lagi dilaksanakan dikarenakan adanya kebijakan protokol kesehatan yang wajib dilaksanakan dalam proses pernikahan yang berlangsung. Perubahan pada proses pernikahan ini membuat masyarakat berpandangan positif dikarenakan membuat biaya pernikahan lebih murah, acara yang lebih sederhana, dan penggunaan waktu yang lebih singkat.

Abstract

This study aims to determine the condition of the Baha'i community in Palopo during the COVID-19 pandemic and the strategies practiced by the Baha'i community in Palopo to overcome the impact they felt during the COVID-19 pandemic. This research is qualitative research with an ethnographic approach. The research informants are the Baha'i community in Palopo City, the Ministry of Religion of Palopo City, the Population and Civil Registration Office of Palopo City, and the Palopo City Religious Communication Forum. Research data shows that the Baha'i community feels the impact of the pandemic in two aspects, namely (1) a decrease in income and employment and (2and ) psychological aspects in the form of stress due to physical distancing policies that limit interaction and congregational worship. For this impact, the Baha'i community uses several strategies, namely (1) family intimacy, (2) Social networks and trust relationships (3) technological adaptation and spiritual piety.

Abstract

The status of being a widow, especially for young women, often brings negative impacts on their daily lives. Therefore, this research aims to understand the obstacles faced by young widows and the strategies they employ to cope with these challenges. The study was conducted in Pontap Subdistrict, Palopo City, focusing on informants who have experienced divorce or the loss of their husbands within the age range of 19-40 years. The research employed a qualitative approach with the goal of providing an in-depth description of the cases under investigation. The findings of the research reveal that young widows in Pontap Subdistrict face primary challenges in the form of negative social stigma from the surrounding community and economic constraints. This stigma manifests as negative labels attached to the widow status, creating additional barriers in their daily lives. Meanwhile, economic constraints emerge as a crucial factor affecting their ability to meet the basic needs of their households. To address these challenges, young widows employ various strategies that can be categorized into active, passive, and networking strategies. Active strategies involve additional efforts, such as increasing working hours during leisure time. Passive strategies include measures like cutting down on expenses. Networking strategies involve more intensive involvement in community life, building close relationships with family members, neighbors, and relatives as a form of social support and fostering a sense of communal cooperation.

Abstract

The legal binding of a country to an internationally agreed treaty to be implemented in the national law of that country is through ratification. The implementation of ratification should be carried out consistently, based on national interests, legal certainty, constitutional mandates, and the welfare of the general public. This research is a normative legal study with an approach through analysis of primary law and the use of secondary law. The results of this study show that in practice, Indonesia demonstrates an inconsistent attitude towards ratifying international agreements, where the Indonesian government can ratify an international agreement quickly if it supports the government's economic or political interests, but delays or even avoids it if it is considered sensitive or puts pressure on its power, even though the agreement concerns public interests such as human rights, the environment, or the livelihood of many people. Thus, there is a need for national legal political reform through regulatory revisions, setting deadlines for ratification, establishing annual priority agendas, mandatory public reporting on delays, and involving civil society and academics. This reform also needs to be supported by the formation of a cross-sector team tasked with overseeing the ratification process in an inclusive and strategic manner

Abstract

Kehidupan masyarakat pesisir yang identik dengan lingkaran kemiskinan mendorong para perempuan pesisir di Palopo untuk terlibat menjadi penjemur rumput laut. Pendapatan mereka sebagai penjemur rumput laut tergolong masih rendah dikarenakan tidak adanya pengetahuan mengenai olahan rumput laut. Kegiatan pengabdian ini bertujuan untuk memberikan pengetahuan untuk mengolah rumput laut menjadi produk makanan, sehingga nilai jual dari rumput laut bisa meningkat dan berkontribusi positif bagi kehidupan mereka. Kegiatan ini dilakukan melalui kerjasama dengan penyuluh dari Dinas Kelautan dan Perikanan Kota Palopo, Dinas Koperasi dan UKM Kota Palopo, BAZNAS Kota Palopo, dan KUA Wara Selatan.  Perempuan penjemur rumput laut yang tergabung dalam Kelompok Cahaya Katonik diajarkan tentang budidaya rumput laut yang baik dan benar, mulai dari cara memilih bibit, cara mengikat rumput laut yang efektif, cara menebar rumput laut yang telah diikat, hingga cara menjemur rumput laut yang bersih sehingga mampu menghasilkan rumput laut yang berkualitas tinggi. Selanjutnya, perempuan penjemur rumput laut juga diajarkan cara mengolah rumput laut yang sudah kering menjadi produk olahan makanan menjadi cendol rumput laut. Melalui pengolahan produk cendol rumput laut, perempuan penjemur rumput laut dapat mengurangi anggaran rumah tangga untuk cemilan anak, dan membuka usaha baru bagi mereka untuk meningkatkan pendapatan rumah tangganya.

Abstract

Purpose  –  This research aims to determine the practice of children as corn shelling workers in Balutan Village, Bupon District, Luwu Regency; to find out the protection for children as corn shelling workers in Balutan Village, Bupon District, Luwu Regency. Method –  The type of research used is empirical research, using a sociological approach. The source of data in this study is primary data obtained from the results of interviews with child laborers, corn sheller entrepreneurs and parents/guardians of children who work. The data collection techniques used in this study are observation, interviews, and documentation. Result –The results of this research indicate that corn shelling work involving child labor has violated the provisions stipulated by the applicable laws and regulations. Such as working hours that exceed the maximum working time limit for children, working in places with extreme temperatures for children, and no work boundaries between adult and child laborers, as well as no guaranteed work safety for child laborers. Thus, entrepreneurs who employ children as corn shelling workers in Balutan Village, Bupon District, Luwu Regency, have violated the law. Implication – As a practical implication, Child Labor Violation: The engagement of minors in corn shelling operations contravenes national labor statutes, namely those pertaining to child labor protections. Possible Legal Consequences: Entrepreneurs may incur criminal or administrative effects, such as fines or imprisonment for breaching child labor regulations. The findings underline the imperative for labor inspectors and law enforcement regulators to adopt proactive strategies in monitoring and enforcing compliance
