Abstract

Gender-based violence (GBV) remains a serious challenge in Indonesian society, including within the family. Religious Courts, as legal institutions that handle family disputes, have an important role in providing justice to victims, especially women. This article analyses the pattern of judges' decisions in cases of gender-based violence in the Religious Courts with a focus on the factors that influence decisions and the relevance of these decisions to the principles of gender justice. Using normative and empirical juridical approaches, it is found that despite efforts to protect victims of GBV, there are still challenges in proof and application of substantive justice principles. This article recommends training for judges, improving access to legal aid for victims, and improving regulations to strengthen legal protection for victims of gender-based violence.

Abstract

Background. The Office of Religious Affairs is the foremost agency of the Ministry of Religion in carrying out the duties of Islamic religious affairs in district level. As a community guidance and service institution, of course, the KUA plays a major role in the creation of a social order under its auspices, both in the field of religion or marriage. So things that can show benefit or benefit must be pursued.Aim. (1) To describe the marriage procedure at KUA Jogoroto Jombang Subdistrict, and (2) Urituk to find out in depth the review of maslahah on additional requirements for marriage at KUA Tembelang District, Jombang.Methods. To answer these two questions, the approach used in writing this thesis is descriptive qualitative, namely research methods that aim to accurately describe the characteristics of an individual, situation, symptom or particular group. This qualitative descriptive method researchers use to systematically describe how the procedures used by KUA Jogoroto sub-district in organizing marriages will then be analyzed with Islamic law.Results. Analysis of the data obtained from the research findings can be revealed that: (1) As with the marriage procedure in KUA in general, KUA Jogoroto also applies the same rules based on the applicable law. The only difference is that there are special rules for prospective brides who are already widows, which must attach a pregnancy-free certificate from the sub-district health center as a mandatory requirement for marriage at the KUA Jogoroto District (2) The policy of the Head of the Jogoroto District KUA is to apply special rules for widows who are getting married at KUA Jogoroto District with the aim of preventing violations of the iddah period / waiting time and reducing the number of marriages of pregnant women as well as providing an understanding to the Jogoroto community about the iddah period does not conflict with Islamic law and is a policy that has benefit values ​​and can be established as a rule.

Abstract

In the mind of Imam Shafi'i there are those who argue that if the husband or wife who mafqud must wait for four years. and according to the Law and Compilation of Islamic Law is to wait with a period of 2 years. The period between these two opinions is very long if compared. This is because the sophisticated transportation and information systems present in the modern era provide a quick opportunity to find out the existence of the mafqud. Unlike the past who still do not know the transportation and information system. So here see which is more relevant to follow between the thoughts of Imam Shafi'i or the Law and Compilation of Islamic Law. In this thesis examines the Relevance of Imam Shafi'i's Thoughts on Mafqud Against Divorce Ghaib Case Study in Jombang Religious Court. This research aims to find out the opinion of Imam Shafi'i about mafqud and the ruling of the Jombang Religious Court regarding mafqud divorce. In this study, the authors used descriptive research methods that seek to describe and analyze problems in as much detail as possible. The type of research used is library research by tracing theories contained in libraries and fields. The results showed that there is no one proposition of the Qur'an and hadith that mentions the deadline for the determination of the time of missing persons, which there is only the opinion of a friend, Umar bin Al-Khatab. But Umar's opinion was only for wives who lost husbands. In addition, it can also be known the consequences of mafqud that can occur to people around or his heirs and he becomes a demand to solve it. Based on the study of the authors conducted, in this study it can be concluded that the Author hopes that ijtihad is carried out by mujtahids at any time such as judges. Because the law is dynamic will change over time following the changing era of times.

Abstract

This study intends to analyze the background of determining the substitute inheritance as well as to map the philosophical meaning and maslahah contained in the law of replacement inheritance as regulated in the Islamic Law Compilation. This is a research study and types of literature data that revolve around the basics of a law to collect data, to analyze the author using deductive and descriptive methods. The results of this study indicate that the background for determining replacement inheritance law in the Islamic Law Compilation is based on justice and mutual benefit and in accordance with the needs of the Indonesian people. The stipulation of the law also does not violate Islamic law (Maslahah Mursalah), which is good deeds according to society but is not regulated in the text nor is there any prohibition from the texts. Meanwhile, the philosophical meaning of the determination of the substitute inheritance law in the Islamic Law Compilation is the achievement of family welfare, especially the successor heirs, who have been left by their parents. Thus, no party will be harmed and persecuted. And Maslahah contained in the law of substitute inheritance is the benefit that can be obtained from a substitute heir, so as to avoid the dangers that will befall in the form of poverty and poverty due to his parents having died first.

Abstract

A marriage dispensation is an exception to the rules or law that is given to an applicant to enter into a marriage. In this research the author examines the decision on requests for marriage dispensation in the Jombang religious court. The focus of the research problem formulation is: 1. What is the level of requests for marriage dispensation in the Jombang religious court. 2. What is the background for submitting the application for marriage dispensation? 3. What are the judge’s considerations in determining the application for marriage dispensation in the Jombang religious court? The type of research is descriptive analysis research. This descriptive characteristic is to get a good, clear picture, and can provide as thorough an analysis of the data as possible about the object under study. The results of this research show that the factors behind the request for marriage dispensation are internal and external factors. The judge’s legal consideration in granting marriage dispensation is that there is Article 7 paragraph 2 of Law No. 1 of 1974 concerning deviations from the age limit for marriage. Court or other official appointed by both parents of the man and woman.

Abstract

Pemanfaatan limbah kayu bangunan secara optimal sebagai souvenir di Pondok Pesantren Al-Ghozaliyah telah diupayakan dalam sebuah program pemberdayaan santri. Pendekatan yang digunakan dalam pelaksanaan adalah Pendekatan edukatif), di mana tim pelaksana pengabdian dan mitra pengabdian (pengurus bidang kesenian dan pengelola limbah kayu) menggunakan aset yang sudah ada setelah itu dikembangkan dan didayagunakan. Pemberdayaan pengurus pondok bidang kesenian ini menunjukkan upaya peningkatan kapasitas kader. Pengurus bidang kesenian dan tutor dari pengelola /pertukangan terbukti dapat mengakui potensi peserta pelatihan sekecil apapun. Hal ini sejalan dengan prinsip bahwa setiap manusia terlahir dengan kelebihan masing-masing. Tidak ada yang tidak memiliki potensi, walau hanya sekedar kemampuan untuk tersenyum. Semua berpotensi dan semua bisa berkontribusi. Keberhasilan desiminasi keterampilan dalam bidang pertukangan untuk pemanfaatan limbah kayu bangunan untuk souvenir bernilai jual membuktikan telah terjadi difusi inovasi pendidikan. Praktik service learning melalui pelatihan yang dilaksanakan menunjukkan upaya pengurus dan santri memupuk soft skill nya. Keberhasilan tim pelaksana pengabdian dalam dinilai dari dampak-dampak perubahan, antara lain: Kemunculan kader baru yang memiliki bekal ketrampilan pembuatan souvenir yang nantinya akan dipasarkan pengurus bidang kesenian di kalangan santri serta Pengalaman para pengurus membangun kemitraan sehingga dapat mengoptimalkan potensi dan asset yang mereka miliki untuk mengembangkan kreativitas santri di bidang pertukangan.

Abstract

Pembelajaran bahasa Arab di SDI baik keterampilan mendengarkan (Istima’), keterampilan berbicara (Kalam), keterampilan Qiroah dan keterampilan menulis (Kitabah) saat ini masih banyak berbasis struktural. Pengajaran masih terfokus pada Nahwu. Implikasinya, pembelajaran menjadi abstrak, monoton, kurang kontekstual, kurang menarik, kurang interaktif, dan kurang komunikatif. Langkah yang dapat diambil adalah pengajar harus dapat menampilkan pelajaran bahasa Arab dengan metode mutakhir yang efektif dan teknik pembelajaran yang menarik. Siswa dilibatkan dalam proses belajar mengajar di kelas sehingga mereka merasa senang dan nyaman dalam pembelajaran bahasa Arab. Hal ini dapat ditempuh dengan menerapkan model pembelajaran kooperatif Jigsaw. Tujuan penelitian adalah menghasilkan model perencanaan pembelajaran bahasa Arab pada aspek KITABAH dengan pendekatan kooperatif Jigsaw di SDI ULUL ALBAB model langkah-langkah pembelajaran, dan dokumentasi pembelajaran bahasa Arab pada aspek Kitabah dengan pendekatan kooperatif Jigsaw di SDI ULUL ALBAB dalam bentuk CD interaktif. Metode penelitian yang digunakan adalah model pengembangan (research and development) Borg dan Gall. Dari keseluruhan aspek dan kriteria penilaian terhadap produk pengembangan berupa model perencanaan pembelajaran menurut ahli pembelajaran bahasa Arab, didapat hasil persentase sebesar 90%. Hal ini dapat diartikan bahwa keseluruhan aspek dan kriteria yang dinilai oleh ahli pembelajaran bahasa Arab berada pada kriteria valid karena berada pada skala 76% - 100%. Berdasarkan kriteria kelayakan produk dapat disimpulkan bahwa produk hasil pengembangan tersebut layak/tidak revisi dan tidak dilakukan uji coba ulang.

Abstract

The worship practice orientation program was carried out by the Human Development Cadre Team in Sidorawas Hamlet, Sumbermulyo Village by inviting fostered partners and congregations for the Maghrib prayer at the Baitus Sholihin mosque, Sidorawas hamlet, Sumbermulyo Village, Jogoroto District, Jombang Regency using the lecture and question and answer method. The approach in this service uses the Asset Based Community Development (ABCD) approach. The results of this mentoring research are able to add knowledge to congregations, realize mosque prosperity, create new enthusiasm in carrying out daily worship and create cooperation between parties in building society.

Abstract

This community service aims to empower Micro, Small, and Medium Enterprises (MSMEs) in Brodot Village to increase sales turnover through optimizing the Ramadhan Market activities. MSMEs are an important sector in the local economy that has great potential but often faces various challenges, such as limited market access, minimal product innovation, and lack of effective marketing strategies. This activity was carried out by a team from STAI At-Tahdzib in collaboration with the Brodot Village government. The activity methods include field observation, training, direct assistance, and ongoing evaluation. Initial observations showed that the majority of MSMEs did not have adequate understanding of digital marketing and attractive product packaging. In the training, participants were given materials about promotional techniques, the use of social media, simple financial management, and product branding. The Ramadhan Market was used as a direct practice medium to sell their products openly to the public. MSMEs were facilitated with tents, promotional banners, and social media as promotional tools. The results of the activity showed a significant increase in sales turnover, especially for snack and pastry products. In addition to financial improvements, this activity also increased the knowledge and confidence of business actors in developing their products. Participants began to actively utilize online platforms such as WhatsApp, Instagram, and Facebook for promotion. Several MSMEs began to package products with more attractive labels and designs. This activity also encouraged collaboration between business actors and created a stronger local business network. During the activity, community enthusiasm was very high. The Ramadan Market became a seasonal economic center that had a positive impact on the village economy. Students involved also gained practical experience in the community empowerment process based on devotion.

Abstract

Pelaksanaan pengabdian kepada masyarakat diharapkan dapat memberikan hasil yang terbaik untuk masyarakat, santri Pondok Pesantren Al-Ghozaliyah, sasaran yang dikenai program. Permasalahan yang muncul adalah penerjemahan santri kelas III Ula Madrasah Diniyah Al-Ghozaliyah yang tekadang tidak sesuai kaidah bahasa Arab karena kurangnya ketlatenan para santri dalam penerjemahan kitab. Metode pendekatan yang dipakai dalam pelaksanaan pengabdian ini meliputi membaca naskah atau kitab materi, belajar menerjemah sesuai kaidah bahasa Arab. Kedua proses ini dalam pembelajaran menerjemah dilaksanakan pada awal kegiatan pembelajaran. Materi yang digunakan pada kegiatan ini adalah kitab fikih klasik yang masyhur dengan sebutan kitab Safinatun Naja melalui bentuk teks dan pendampingan secara efektif sampai pelajar dapat menerjemah kitab Safinatun Naja denagn benar dan sesuai kaidah bahasa Arab. Melalui kegiatan pembelajaran ini diharapkan dapat menyelesaikan permasalahan yang dihadapi oleh santri kelas III Ula Madrasah Diniyah Al-Ghozaliyah. Kegiatan ini bertujuan untuk melihat kemampuan santri dalam menerjemah kitab. Kegiatan ini dilakukan dengan mendampingi santri dalam menerjemah kitab fikih secara mandiri. Melalui kegiatan observasi, para santri sangat antusias. Selain itu pembelajaran juga sesuai dengan target yang diharapkan. Penerapan pembelajaran ini menunjukkan bahwa para santri tekun dalam belajar menerjemah. Selain itu, pembelajaran tersebut dapat meningkatkah hasil menerjemah kitab klasik.
