Abstract

Dewasa ini, bentuk-bentuk kekerasan seksual semakin berkembang. Aturan hukum yang ada saat ini belum cukup mengatur terkait kekerasan seksual tersebut. Maka dibentuk Rancangan Undang-Undang Penghapusan Kekerasan Seksual untuk mengakomodasi perlindungan hukum terhadap kekerasan seksual di Indonesia. Studi perbandingan antara Kitab Undang-Undang Hukum Pidana dengan Rancangan Undang-Undang Penghapusan Kekerasan Seksual ini bertujuan untuk mereformasi aturan hukum terkait kekerasan seksual yang ada di Indonesia. Metode yang digunakan penulis adalah analytical method, yaitu memulai studi perbandingan dengan menganalisis perbedaan yang ada di antara Kitab Undang-Undang Hukum Pidana terkait kekerasan seksual dengan Rancangan Undang-Undang Penghapusan Kekerasan Seksual. Rancangan Undang-Undang Penghapusan Kekerasan Seksual dipilih sebagai pembanding karena RUU ini dibuat untuk menjangkau kekerasan seksual yang bentuknya terus berkembang di Indonesia. Akan tetapi kehadiran RUU ini menimbulkan polemik di tengah masyarakat. Oleh karena itu, perbedaan kedua aturan ini perlu dianalisis agar dapat diketahui solusi terbaik di antara keduanya. Rancangan Undang-Undang Penghapusan Kekerasan Seksual merupakan aturan yang berperspektif korban. Rancangan Undang-Undang Penghapusan Kekerasan Seksual juga merumuskan upaya pencegahan dalam kekerasan seksual. Karena pencegahan kekerasan seksual merupakan hal yang sangat penting dalam upaya menghapus kekerasan seksual. Dalam rangkaian penanggulangan dan upaya penghapusan kekerasan seksual, seluruh sektor termasuk masyarakat memiliki peran dalam penghapusan kekerasan seksual. Dari hasil studi perbandingan ini dapat disimpulkan bahwa Rancangan Undang-Undang Penghapusan Kekerasan Seksual dapat mengakomodasi penghapusan kekerasan seksual, sehingga sebaiknya dilakukan reformasi hukum untuk menanggulangi kekerasan seksual di Indonesia.

Abstract

This research was conducted to explain and examine the urgency of customary institutions in forming obedient characters in the Malay community of Sungai Abu Kerinci-Jambi. The purpose of this study is to explain the existence of the customary existence of the Kerinci Malay community, legal compliance in the Kerinci Malay customary institution, the application of obedient character in the community, and the role of customary institutions in forming obedient character in the Kerinci-Jambi community. This research is a qualitative research because it formulates generalizations of the analyzed data based on the phenomena found. The descriptive-analytical method is the method used in this study. The results of this study show that the influence of customary law in the Kerinci Malay community provides awareness of compliance with customary law by the community. The implementation of the character of obedience to customary law and customary institutions in the Malay community of Sungai Abu Kerinci concerns all social activities of community life inhabiting the Malay customary territory of Sungai Abu Kerinci. Customary Institutions play an active role in shaping obedient character in the Malay indigenous people of Sungai Abu Kerinci. Indigenous institutions play a role in sheltering and channeling the aspirations of indigenous peoples; Serving the needs of indigenous peoples; Making a work program, namely regulating the work program of customary institutions for the community; Increasing public understanding, awareness and compliance with customary law; Making legal rules for people who violate the rules that have been set by custom and have been agreed upon by mutual agreement. These customary provisions are complied with and have become a form of the obedient character of the indigenous people of Sungai Abu Kerinci. This is an indicator that the cultivation of the character of obedience to customary law can be applied by the Malay customary institution of Sungai Abu Kerinci in the midst of its community.

Abstract

This article explores the institutionalization of Islamic law in Indonesia, focusing on Busthanul Arifin's thoughts regarding the initiation of Religious Courts and the compilation of Islamic law within the Indonesian legal system. The study employs normative juridical methods, analyzing legal principles, concepts, and doctrines. The findings indicate that Busthanul Arifin's ideas have successfully contributed to the institutionalization of Islamic law in Indonesia through three main pillars: First, Islamic legal institutions, particularly Religious Courts, serve as the implementers of judicial authority, encompassing material aspects, authority, and legal apparatus; Second, laws and regulations, both material and formal, embody the spirit of sharia (al-Qur'an and hadith), forming the basis for jurisprudence and guiding judicial decision-making; third, the legal consciousness of Islamic law transforms it from an abstract concept into a tangible, living law, referred to as "positive law" that is rooted in historical, sociological, juridical, and philosophical values. The dynamic nature of these thoughts underscores the importance of judicial interpretation, which depends on the competence of judges and law enforcers. It is essential to evaluate how these ideas have contributed to justice within the Indonesian legal system. This study offers a reflection on the institutionalization of Islamic law in Indonesia, highlighting the shift from a majority awareness of Islamic legal principles to their formal integration within a predominantly Western-based legal framework.

Abstract

Human rights issues have become an interesting debate in the dynamics of the current world political arena. Western countries use human rights issues as a political instrument against other countries, especially Muslim countries. The reality of the concept of universal human rights comes from natural law. Long before the declaration of universal human rights, the Prophet Muhammad (PBUH) had issued the charter of Medina, which was full of human rights values. The formulation of universal human rights and Islamic human rights is hardly different. In fact, it can be said to be complementary. This paper uses a descriptive-analytical method, namely, by explaining the description of the data found and analyzing it so that the results and findings of this paper can be holistic, concise, and philosophical, and can be scientifically proven based on existing reality. This paper finds that in the Islamic world, the concept of human rights aims at the benefit (maqāṣid al-sharī'ah). However, there are differences between Universal and Islamic human rights, such as the concept of women's freedom and heritage. This difference has an impact on the concept of specific human rights or relative human rights, which are limited by the culture and sociology of certain societies, especially religions that cannot be equated. The Islamic world's response to universal human rights conceptually considers that universal human rights are different from Islamic human rights principles, universal human rights are not based on religious (secular) values. Some Muslim countries are against directly rejecting and using Islamic human rights completely, such as in Iran and Saudi Arabia; and some of them accommodate universal human rights. In the Islamic world, the implementation of human rights is influenced by global political factors with the imposition of Western double standards on Muslim countries, accompanied by economic, military and media forces to pressure Muslim countries. This causes the human rights problem in Muslim countries to be not completely resolved and gives rise to a strong resistance movement to Western human rights (Islamic fundamentalism).

Abstract

This research was conducted to determine how interested parents of high school students in Kerinci Regency and Sungai Penuh City are in choosing an Islamic college for their children's further studies. The factors tested in this research are the image of Islamic universities, promotions, and tuition fees. The sample for this research was 227 respondents. Data was collected using a questionnaire. Data analysis uses the Structural Equation Model (SEM) approach with the help of the SmartPLS 2.3.9 application. The results of this research show that promotions and tuition fees have a positive and significant effect on the image of Islamic universities and influence the interest of students' parents in recommending Islamic universities to their children to continue their studies. The image of Islamic higher education mediates the relationship between promotion and tuition fees in the Decision to choose an Islamic higher education institution. The type of mediation effect is partial mediation.

Abstract

This study aimed to assess the impact of promotion and service quality on students' interest in choosing SIPINTAR products at PT. Bank Perkreditan Rakyat Pembangunan Kerinci. The research employed a quantitative approach with a survey design, involving 60 students in Kerinci Regency using the convenience sampling method. Data analysis utilized multiple linear analysis, and hypothesis testing involved the t-test and F-test with IBM SPSS 26. The findings revealed that promotion had a positive and significant impact on students' interest in using SIPINTAR products, while service quality did not significantly influence students' interest at PT. Kerinci Development People's Credit Bank. The F-test indicated that promotion and service quality jointly have a significant impact on using PT. SIPINTAR products at Kerinci Development People's Credit Bank, with a magnitude of influence at 20.6%. Despite the limitation of focusing solely on promotion and service quality in influencing savings intentions, the research provides valuable insights for the development of banking businesses, especially regional banks.

Abstract

Along with the times, the world of technology is growing, so MSMEs in an economic society must keep up with technological developments to maintain their existence in business and business management, as micro, small, and medium enterprises (MSMEs) play a key role in growth. Indonesian economy. MSMEs account for 85% of the employment rate. In a business, it is necessary to study the business's survival. However, in reality, the community only focuses on the status of working as an employee in a company to earn income. Therefore, cultivating a community with a socialization approach imbued with entrepreneurship is done to help motivate people to run independent businesses. Empowerment refers to the ability of individuals, especially disadvantaged groups, to find productive resources that help them increase their income and participate in development and decision-making processes. The results of this study indicate that the people of Muara Inderapura Village have great potential for village economic development through MSME. Factors supporting community development in the economic field include abundant natural and human resources and strong community participation. While the inhibiting factors are capital, facilities.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) in Hiang Village, Setinjau Laut District, face challenges of limited visibility and market access due to the minimal utilization of digital technology. This low technology adoption is caused by a lack of knowledge, skills, and awareness regarding the potential of digital marketing. This community service activity aimed to enhance the capacity of MSME owners in utilizing Google Maps as a tool to increase their business visibility. The method employed was a participatory counseling approach, which included three stages: planning, implementation (consisting of socialization, theoretical presentation, and hands-on practice), and evaluation (through a post-test, feedback, and monitoring). The results showed a significant increase in participants' understanding, with over 90% passing the post-test. Moreover, there was a high rate of technology adoption, with 84% of participants successfully registering their businesses on Google Maps after the training. It is concluded that this outreach activity was effective in empowering MSMEs, providing a practical solution to the visibility problem, and serving as a strategic first step in bridging the digital divide in rural areas.
