Abstract

ABSTRACT This paper raises and explains whether one of the non-bank financial institutions, namely Baitul Maal Wa Tamwil (BMT) Sidogiri Sangkapura Bawean Branch, has contributed to improving the economy of creditor customers or not. And if there is indeed a contribution, the researchers will re-measure how much the Baitul Maal Wa Tamwil (BMT) Sidogiri Sangkapura Bawean Branch contributes to improving the economy of creditor customers.In this study, the researcher chose Baitul Maal Wa Tamwil (BMT) Sidogiri Sangkapura Bawean Branch because BMT is a non-bank and sharia-based financial institution located on the island of Bawean. In addition, BMT Sidogiri Sangkapura also makes it easier for researchers to obtain the data needed for the purposes of this research.The research method that the researchers used in this study was a survey method with the Chi Square analysis technique. Survey research is research that takes samples from the population and uses a questionnaire as a primary data collection tool.In this study the technique was used to find out about the contribution of Baitul Maal Wa Tamwil (BMT) to the economy of creditor customers at BMT Sidogiri Sangkapura. Abstract

The purpose of this study is to answer how the application of mashlahah mursalah in marriage registration in Indonesia. The method in this study is a library method by reading books or magazines with other data sources in the library. In an axiological review, marriage registration is carried out to establish marriage order in society. It attempts to protect the dignity and sanctity of marriage, and more specifically women in domestic life. Through marriage registration as evidenced by a marriage certificate, each husband and wife get a copy. If in the future there are disputes and disputes between them, or one is not responsible, then the other can take legal remedies to defend or obtain their respective rights. This marriage registration brings great benefits to Muslims in Indonesia, especially women, especially wives. Jumhur fuqaha agreed that maslahat is acceptable in Islamic jurisprudence. All benefits must be taken as a source of law as long as they are not motivated by the impulse of lust not and do not contradict the nash and maqasid as-shari'. The mashalih mursalah is among the things discussed. One of the legal provisions based on maslahat mursalah is the necessity of marriage registration in KUA for Muslims in Indonesia

Abstract

This study aims to reinterpret and redefine the community's understanding of leadership and nusyûz to prevent acts of domestic violence in Bengkulu. Considering the changing pattern of people's life values, efforts to reinterpret the meaning of surah al-Nisâ’ verse 34 on leadership and nusyûz are necessary to prevent acts of violence in the household. This study is a descriptive field study. Data collection techniques were interviews and literature search, while the analysis technique used is Miles and Hubermen's analytical procedure. The findings from this study are in the form of interpretation or meaning of a centralized understanding of the verse on leadership in the family, where leadership in the family should focus on the strengths and weaknesses between husband and wife by emphasizing deliberation, the husband's broad chest relieves some of the wife's obligations, and treating the wife commendably. Furthermore, leadership is closely connected with the adequacy of providing for the family. Penelitian ini bertujuan untuk memaknai dan meredefinisi pemahaman masyarakat tentang kepemimpinan dan nusyûz untuk mencegah tindak kekerasan dalam rumah tangga di Bengkulu. Perubahan pola nilai kehidupan masyarakat, diperlukan upaya pemaknaan kembali makna surah al-Nisâ’ verse 34 tentang kepemimpinan dan nusyûz untuk mencegah terjadinya tindak kekerasan dalam rumah tangga. Penelitian ini merupakan penelitian lapangan yang bersifat deskriptif. Teknik pengumpulan data yang digunakan adalah wawancara dan pencarian literatur yang relevan, sedangkan teknik analisis datanya adalah teknik analisis ala Miles dan Hubermen. Temuan dari penelitian ini berupa interpretasi atau pemaknaan pemahaman yang terpusat pada ayat tentang kepemimpinan dalam keluarga, dimana kepemimpinan dalam keluarga harus fokus pada kelebihan dan kekurangan antara suami dan istri dengan menekankan musyawarah, kelapangan dada suami meringankan sebagian kewajiban istri, dan memperlakukan istri secara terpuji. Lebih jauh lagi, kepemimpinan berkaitan erat dengan kecukupan menafkahi keluarga.

Abstract

Mengenai denda yang dibebankan kepada penerima pinjaman oleh penyelenggara pinjaman uang online tidak diatur dalam peraturan otoritas jasa keuangan nomor 77/POJK.01/2016 tentang layanan pinjam meminjam uang berbasis teknologi informasi yang mengakibatkan kerugian dan masalah baru dalam hidup penerima pinjaman. Banyak kasus dimana penerima pinjaman di intimidasi, diteror dalam proses penagihan oleh penyelenggara dan tidak ada toleransi waktu bagi penerima pinjaman yang belum bisa membayar tepat waktu saat jatuh tempo. Dapat dirumuskan permasalahan apa bentuk perlindungan hukum bagi penerima pinjaman online yang dirugikan oleh penyelenggara pinjaman online ? dengan metode penelitian yuridis normatif. Pendekatan masalah yang dipergunakan adalah pendekatan peraturan Perundang-Undangan (statute approach), dan pendekatan konseptual (conceptual approach). Selain di Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen Bentuk Perlindungan hukum terhadap penerima pinjaman uang online juga diatur dalam Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik Pasal 9 menyebutkan bahwa Pelaku usaha yang menawarkan produk melalui Sistem Elektronik harus menyediakan informasi yang lengkap dan benar berkaitan dengan syarat kontrak, produsen, dan produk yang ditawarkan.

Abstract

The use of cadar for women in Indonesia has always been a polemic lately, often causing negative stigma. This study describes the critical analysis of hadith on the legal status of cadar for women through the approach of the concept of religious moderation in Indonesia. The research used is library research using a qualitative approach, collecting data from research sources in the form of books (hadith books), journals and other relevant readings, then analyzed using descriptive methods. The result of this study is that the cadar is a continuation of the jilbab as a covering for the awrah of believers in the Quran al-Ahzab verse 59. According to the hadith of the Prophet narrated by Abu Daud that the aurah of a believer woman is other than the face and palm and the ability to see this part of the woman before proposing. According to the principles and indicators of religious moderation, the wearing of the cadar for women believers in Indonesia does not reflect the concept of balance in religious practices and attitudes because it does not include fashion or culture of the archipelago. The conclusion of this study is that women believers do not wear a cadar in Indonesia does not mean that they do not cover their aurat, because the cadar is also related to the local culture.
