Abstract

One of the things that is currently rife is the case of liwath or male to male intercourse with the willingness of both parties carried out by waria (female-male) or with a normal male appearance. In general, waria have no space in the religious and social spheres of society, because it goes back to the definition of waria itself which is in the middle between women and men. The region known as "serambi mekkah" has a special legal authority that is binding, namely Islamic law or called qanun. Qanun itself is still used today, one of which is Aceh Qanun Number. 6 of 2014 which regulates the jinayat law, jinayat is enforced to punish the perpetrators of khalwat, ikhtilath, and other adultery things that violate Islamic law. The purpose of this study is to examine whether there are legal facilities given to Aceh to implement legal actions and how the enforcement to date by the assigned parties. This research is a field research with qualitative method with empirical juridical approach. The result of this research is that the applicable legal position has been implemented as it should be and the winner of the transvestite contest who carries the name of Aceh is not domiciled in Aceh, while Qanun law applies where a person is located, so the Aceh government cannot give a warning or counselling as long as the transvestite is not in the Aceh area. Although there is a regulation of uqubat cambuk that may be applied to transvestites, the punishment can only be carried out if there is something that is violated, but if the transvestite is just living like an ordinary citizen, he cannot be subjected to this punishment because transvestites are a social disorder/disease, not something that violates positive legal rules, even though it is against Islamic law and occupies an area that applies Islamic law, but the right to live as an Indonesian citizen is still protected by Human Rights.

Abstract

The purpose of this essay is to examine the community's opinions about cash waqf, its regulations, and its rules in relation to fiqh. One option available to Muslims in Banda Aceh City for allocating funds for worship is cash waqf. On a practical level, however, society is still unaware that cash waqf exists, and academics continue to hold differing views at the fiqh level. This is why a legislative method and a conceptual approach were used in the writing of this study. According to the study's findings, one type of transportable waqf is cash waqf. Classical and modern academics continue to disagree on the constitutionality of the legislation from a fiqh standpoint. The Waqf Law, Government Regulations Implementing the Waqf Law, Minister of Religious Affairs Regulations, and BWI Regulations are among the legal provisions in Indonesia that have made cash waqf acceptable. When it comes to Aceh, Qanun Baitul Mal is where monetary waqf is managed. In reality, certain Acehnese citizens, particularly those in Banda Aceh City, are aware of the cash waqf regulations, while others are not yet aware of them. Although Banda Aceh City residents are generally lenient and accept financial waqf, socialization initiatives by associated organizations are thought to be underutilized. Therefore, there must be a concerted effort to maximize community socialization and cash waqf product branding. Cash waqf requires a particular rule in the form of a qanun, which is an extension of the current Qanun Baitul Mal.

Abstract

This study aims to assess and elucidate the influence of polygamy on domestic violence as reflected in the Sharia Court rulings in Aceh, as well as the viability of polygamy as a justification for granting divorce petitions. The study of this topic is significant since Islam essentially allows polygamy, provided that men can behave justly. The divorce ruling at the Sharia Court in Aceh revealed that polygamy led to the neglect of women and other forms of domestic violence. Unfortunately, Indonesian laws and regulations do not acknowledge polygamy as a valid ground for women to petition for divorce. The study is normative juridical review in nature. The data source is a judicial ruling. The data is examined under a women's protection framework. The findings indicate that the wife initiated divorce proceedings against her husband for practicing polygamy, which contravened Indonesian marital law and the Compilation of the Islamic Law, namely polygamy conducted without the wife's consent. Furthermore, polygamy often leads to domestic abuse against the wife. Polygamy can be categorized as irresponsible when practiced by a husband lacking steady economic resources, resulting in the neglect of women and their children. This polygamy is likewise deemed a contravention of the rules of marriage in the Islamic jurisprudence. At the present time, polygamy is not recognized as the reason for divorce in the Indonesian law. This study advocates for the inclusion of polygamy without consent as a legal ground for divorce, as the current legislation recognizes only physical domestic violence as a valid justification for divorce.

Abstract

شمل نظام الإسلام التربوي جميع أنشطة الإنسان الفكرية والسلوكية بما يحقق مصلحة الفرد في ذاته، ويضمن للأمة كلها سلامتها وترابطها، بما يعين الجميع في المجتمع المسلم على القيام بواجب الاستخلاق في الأرض ومن ثم التحقق بالعبودية الخلصة لله تعالى. وتأتي قضية اللباس والزينة بإعتبارها جزئية من الجزئيات المكونة لنظام الإسلام، وخاصية من خصوصيات الشخصية المسلمة التي تحمل في طبيعتها قدرا واضحا من التميز والخصوصية التي تظهر بوضوح في ملامبس المسلمات وتتجلى في أساليب تأنقهن وتجملهن. وقد توصل الباحث إلى نتائج كان من أهما شمول منهج الإسلام التربوي لقضية اللباس والزينة عند المرأة وضبطه لهما بإحكام كما وضح الباحث عمق الحاجة في طبيعة المرأة تجاه اللباس والزينة، مما قد يسوقها إلى شيء من الإفراط عند إشباعها لهذه الحاجة الفطرية، كما أن هذا الميل الفطري كثيرا ما يكون وسيلة استغلال للمرأة من دور الأزياء الأجنبية في نوع اللباس والتأنق مما قد يخرج بالمرأة المسلمة عند الاعتدال

Abstract

 This study aims to determine the factors of non-compliance with Islamic principles in Islamic Financial Institutions (IFIs). This article argues that IFIs must comply with Islamic principles based on the DSN-MUI fatwa, even though in the Indonesian legal hierarchy, DSN-MUI fatwas are not binding. IFIs show ambiguity in complying with Islamic principles when carrying out their intermediation function. Several other factors also cause IFIs' lack of compliance with sharia principles. These include the lack of applicability of the DSN-MUI fatwas, the conflict of interest of the Sharia Supervisory Board (SSBs), and competency issues among SSBs members. To address these issues, it is necessary to strengthen the regulations that make DSN-MUI an authoritative institution in establishing the sharia principles and the fatwas methodology. Thus, the fatwas are more applicable and avoid ambiguity. Furthermore, SSBs need re-structurization to be independent internal supervisory agencies. AbstrakPenelitian bertujuan mengetahui faktor-faktor ketidakpatuhan lembaga keuangan syariah (LKS) pada prinsip-prinsip Islam. Artikel ini menyebutkan LKS harus mematuhi prinsip-prinsip Islam sesuai fatwa DSN-MUI, walaupun dalam hierarki hukum Indonesia, DSN-MUI bukanlah sebuah lembaga otoritatif yang menerbitkan hukum mengikat. LKS tampak ambigu dalam mematuhi prinsip-prinsip Islam saat menjalankan fungsi intermediasinya. Ketidakpatuhan LKS kepada prinsip-prinsip syariah juga disebabkan oleh beberapa faktor lain, seperti: tidak aplikatifnya fatwa DSN-MUI; munculnya konflik kepentingan DPS; dan masalah kompetensi anggota DPS. Untuk mengatasi masalah-masalah tersebut, perlu adanya perbaikan regulasi yang menjadikan DSN-MUI sebagai lembaga otoritatif, agar fatwa yang dikeluarkan lebih aplikatif dan tidak menimbulkan multi tafsir. Sementara dari sisi DPS, perlu adanya regulasi merestrukturisasi organisasi DPS dengan menepatkannya sebagai lembaga pengawas internal yang independen.

Abstract

The Baitul Asyi Waqf Foundation is one of the leading waqf institutions in Aceh, known for its active role in collecting and managing cash waqf. This study aims to examine the cash waqf collection strategies and management systems implemented by the Baitul Asyi Waqf Foundation. This study employs a qualitative research method with a normative legal research approach, utilizing secondary data in the form of primary legal materials and a review of Islamic legal literature. The study findings indicate that the foundation adopts a strategy based on community trust, transparency, and professionalism in managing endowment funds. Additionally, the use of information technology and collaboration with banks that entrust their endowment funds to be managed by the Baitul Asyi Endowment Foundation aims to ensure that endowment funds are managed by trustees, with the proceeds utilised for public or social purposes to enhance the effectiveness of fund collection. In terms of management, endowment funds are invested in productive sectors, such as property and Sharia-based businesses, with the proceeds used to assist Aceh Hajj pilgrims, education, and other social services. This study concludes that the management of monetary endowments is permissible under Islamic law, and according to the various schools of thought, monetary endowments are permissible.

Abstract

This paper aims to learn how the Qanun of Aceh, particularly Qanun No. 4 on Mukim and Qanun No. 5 on Gampong Government enforce Gampong as a government body. It further compares the hierarchical relationship between the qanun and the higher regulations in Indonesia such as Village Government Act No. 32 of 2004, Privileges of Aceh Act No. 44 of 1999, Special Autonomy No. 18 of 2001 and Aceh Government Act No. 11 of 2006. The study found that the Qanun integrates Acehnese identity coupled with the Islamic values into the Gampong institution. The Qanun on Gampong Government, in fact, does not negate any higher regulations in the Indonesian constitution. The principle of decentralization implemented post-Orde Baru requires a massive change in the government system in Indonesia from the centralized system of local state government, to local self-government and finally the decentralized system of the local community. The Qanun on Gampong government is in line with the local community spirit due to greater public participation channeled through Reusam Gampong. Reusam Gampong is the public aspiration, and its application shall not conflict with the higher regulation. In its cultural manifest, Resuam Gampong is an instrument that promotes the marriage between culture and religion into a single government body.

Abstract

Kekerasan seksual sesama jenis (Liwāṭ) yang melibatkan anak sebagai pelaku menjadi fenomena mengkhawatirkan di Aceh, memicu dilema yuridis antara penegakan sanksi jinayat yang tegas dan prinsip perlindungan anak. Penelitian ini bertujuan menganalisis dasar pertimbangan hakim dalam menjatuhkan sanksi ‘uqubat ta`zīr berupa pembinaan bukan ḥudūd terhadap anak pelaku Liwāṭ, serta menguji kesesuaiannya dengan tujuan Hukum Pidana Islam. Menggunakan metode yuridis empiris dengan pendekatan studi kasus pada Putusan Mahkamah Syar’iyah Banda Aceh Nomor 1/JN.Anak/2024/MS.Bna, data dikumpulkan melalui studi dokumentasi dan wawancara kemudian dianalisis secara deskriptif-analitis. Temuan menunjukkan bahwa meskipun unsur materil jarimah terpenuhi, hakim melakukan ijtihad adaptif dengan mengalihkan hukuman badan menjadi pembinaan di LPKA karena status pelaku yang ghairu mukallaf dan pertimbangan sosiologis berupa dampak paparan pornografi. Penjatuhan sanksi ini dinilai selaras dengan prinsip maqasid syariah, khususnya aspek hifdz an-nafs (perlindungan jiwa) dan kemaslahatan, yang mengutamakan rehabilitasi mental daripada pembalasan fisik. Disimpulkan bahwa penegakan Syariat Islam di Aceh bersifat dinamis dan humanis, mampu menyeimbangkan ketegasan hukum Tuhan dengan penyelamatan masa depan anak.

Abstract

This study examines the role of Gampong customary institutions in resolving adultery cases in North Aceh and analyzes their conformity with Islamic criminal law as regulated in Aceh Qanun No. 6 of 2014 concerning Islamic Criminal Code. The research employs a qualitative method using normative and empirical legal approaches. Data were collected through in-depth interviews, observation, and focus group discussions conducted in three Gampongs: Meunasah Blang, Paya Leupah, and Keude Krueng. The findings reveal that Gampong institutions function not only as local administrative structures but also as socio-religious mechanisms for maintaining public morality, social harmony, and communal order. The settlement of adultery cases at the village level emphasizes deliberation, mediation, moral guidance, and restorative justice rather than punitive measures. The study further demonstrates that customary settlements are generally applied in cases categorized as khalwat or moral misconduct that do not fulfill the evidentiary requirements of zina under Islamic law. However, cases considered to meet the legal elements of jarimah are referred to the Wilayatul Hisbah and subsequently processed through the Sharia Court. This research concludes that the interaction between customary law and formal Sharia law in North Aceh reflects a dynamic model of legal pluralism that integrates Islamic values, local wisdom, and social restoration in resolving moral offenses.
