Abstract

This study utilizes a qualitative framework, integrating empirical research and interpretive thematic analysis to examine productive maintenance within polygamous marriages in Aceh Rayeuk. Grounded in Qur’anic principles of financial maintenance, the analysis evaluates data gathered through field observations of household economic practices and in-depth interviews with polygamous couples, village officials, and community leaders. The findings indicate that financial maintenance within these households extends beyond merely fulfilling consumptive needs; it is actively directed toward productive endeavours, including business capital, agricultural land management, property investment, fisheries assets, and children’s education. Interpretive thematic analysis demonstrates that these practices serve as strategies for long-term economic sustainability and function as tangible manifestations of the principle of justice (‘adl) in polygamous marriages. From an Islamic legal perspective, these practices align with the Qur’anic concept of bil-ma‘rūf, which mandates providing financial maintenance in a proper, proportional, and contextually appropriate manner that reflects prevailing socio-economic realities. Furthermore, this study highlights that the efficacy of productive maintenance is contingent upon proactive financial management, the active participation of wives, and local economic conditions. Ultimately, these factors serve as crucial indicators for maintaining the economic stability and overall welfare of polygamous families within the Aceh Rayeuk community.

Abstract

This study aims to explain the roles of the muḥtasib and pageu gampong in enforcing sharia law in Banda Aceh, as well as their respective effectiveness. The study is important because the extensive area covered by sharia law enforcement creates gaps in supervision and enforcement that formal authorities have not yet fully addressed. The research questions focus on the similarities and differences in the authority of these two institutions, and the factors that influence their effectiveness. The study employs a qualitative legal-sociological approach by analyzing institutional practices at the gampong level. The results suggest that muḥtasib and pageu gampong have similar roles involving monitoring, admonishing, and reporting violations of sharia law. However, muḥtasib is limited to these three functions, whereas the pageu gampong also has the authority to resolve customary disputes, particularly minor criminal and civil cases. Pageu gampong is more effective in terms of performance because it stems from the community's collective consciousness, is self-reliant and voluntary, and has a broader membership. Nevertheless, it is not yet widespread, with only twelve villages in Banda Aceh currently having an active pageu gampong.

Abstract

Penyelesaian kasus kekeraan terhadap anak melalui mekanisme adat di Aceh mencerminkan adanya kearifan lokal yang hidup berdampingan dengan sistem hukum nasional dan hukum Islam. Penelitian ini berangkat dari kasus pemukulan terhadap anak di Gampong Deah Raya, Syiah Kuala, Kota Banda Aceh, yang diselesaikan melalui peradilan adat, dan bertujuan untuk mengkaji mekanisme penyelesaiannya serta meninjaunya dari perspektif hukum pidana Islam. Masalah yang diteliti adalah bagaimana mekanisme penyelesaian kasus pemukulan terhadap anak secara adat di Gampong Deah Raya, dan bagaimana pandangan hukum pidana Islam terhadap mekanisme tersebut. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan perundang-undangan. Hasil penelitian menemukan mekanisme penyelesaian kasus kekerasan di Gampong Deah Banda Aceh dilakukan melalui beberapa tahapan; pelaporan ke kepala dusun, musyawarah oleh keuchik bersama tokoh adat, pengambilan keputusan berdasarkan mufakat. Mekanisme ini bertujuan untuk menciptakan perdamaian dan menjaga hubungan sosial. Dari perspektif hukum pidana Islam, pendekatan ini sejalan dengan prinsip iṣlāḥ (perdamaian) dan diyat (kompensasi), selama tidak melanggar prinsip keadilan dan perlindungan terhadap anak.

Abstract

The Board for Peace (BoP), established by President Trump, is integral to the execution of the America-First and transactional strategy. This board indicates a transition in international collaboration from multilateralism under the UN mandate to a multi-corporate framework for handling the post-conflict transition in Gaza. This article analyses the legitimacy of the BoP under international law and the ramifications of Indonesia's permanent membership and its allocation of one billion US dollars to the BoP, while also evaluating its implications for Palestinian sovereignty and the international legal system. This research utilizes an interdisciplinary approach that combines international law, political economy, and international relations. The research indicates that the creation of the BoP was prompted by UN Security Council Resolution 2803, although it has diverged from the resolution's aims. Moreover, the BoP has invalidated the 2024 Advisory Opinion of the International Court of Justice (ICJ) about the Palestinian people's right to self-determination. Moreover, the BoP, which possesses a comprehensive strategy for Gaza's reconstruction post-Israel's devastation, represents an infringement on the rights of the Palestinian populace in Gaza, undermines Palestinian sovereignty, overlooks the Palestinian Authority, and imposes a fiscal obligation on nations, especially permanent members like Indonesia. This paper asserts that the BoP framework is designed exclusively to sustain informal imperialism that advantages Israel, hinders the two-state solution, and constrains Indonesia’s foreign policy—ideally independent and proactive—under the influence of U.S. interests during the Trump administration.
