Abstract

Beragam istilah yang digunakan dalam al-Quran dalam memaknai kepemimpinan diantaranya: khalifah, imam, sulthan, malik, ulil amri, dan waly. Pengistilahan tersebut digunakan dalam konteks dimana kepemimpinan berlaku. Pemimpin harus adil, amanah, bermusyawarah dan menegakkan amr al-ma`ruf wa nahy mungkar.Hukum memilih pemimpin non muslim diisyaratkan dalam al-Qur`an salah satunya dalam QS.al-Maidah/5: 51. Sedangkan beberapa ulama berpendapat haram memilih pemimpin Non-Muslim. Ada beberapa ulama yang memberikan kelonggaran/moderat dengan memberikan syarat ketika dalam keadaan darurat maka dibolehkan. MUI, memberikan fatwanya bahwa memilih pemimpin Non-Muslim adalah hukumnya haram, kecuali dalam keadaan daraurat.

Abstract

Syariat poligami seperti halnya syariat Islam lainnya mengandung nilai keadilan untuk mendatangkan kemaslahatan bagi umat Islam itu sendiri. Allah swt menjadikan keadilan sebagai dasar dalam konstruksi hukum, baik yang bersifat privat maupun publik. Poligami sebagai syariat yang secara khusus berkaitan dengan subsistem hukum kekeluargaan dimaksudkan untuk memenuhi kebutuhan daruriyat manusia, menjaga agama (hifsh ad-diin), jiwa (hifzh annafs) dan keturunan (hifzh an-nasl). Kehadiran syariat poligami dalam konteks demikian merupakan manifestasi (dari) keadilan syariat Islam untuk memberikan dan mewujudkan kemaslahatan bagi umat Islam

Abstract

The calendar systems of the ethnic groups in Sulawesi highlight a gap in understanding regarding the extent to which these traditional systems align with, differ from, or complement contemporary astronomical and Islamic time-keeping practices. Despite these communities’ rich, culturally embedded knowledge of time-division based on celestial movements, there has been minimal research on how these indigenous systems engage with scientific astronomy or are shaped by religious influences. Furthermore, there is a lack of comparative studies examining how each community’s calendar system reflects their unique cultural identities, cosmologies, and adaptations to environmental changes. This study examines the calendar systems of popular Sulawesi ethnic groups which are the Bugis, Mandar, and Toraja through the lens of falak science. This study employs a qualitative approach, utilizing document analysis, interviews, and observations as its primary methods. The findings indicate that these Sulawesi ethnic groups hold a rich repository of traditional knowledge on calendar systems, which aligns closely with foundational astronomical principles. Addressing these gaps could deepen insights into the preservation of cultural heritage and the potential integration of traditional knowledge with contemporary scientific and religious calendar practices.

Abstract

This article discusses the traditional Nipa'bajikang wedding ritual practiced by the Je'ne Madingin Muslim community in Gowa Regency, Indonesia, within the framework of Islamic law reasoning based on the concept of 'urf. The main problem of this research is how the position of the Nipa'bajikang tradition in Islamic law and the extent to which the practice of the ritual can be classified as 'urf sahih or 'urf fasid. This research aims to analyze the form and meaning of the implementation of the Nipa'bajikang ritual, examine the views of religious leaders on the tradition, and assess its conformity with the principles of Islamic sharia through the 'urf approach. The research method used is qualitative with a descriptive-analytical approach. Data was obtained through field observations, in-depth interviews with traditional leaders, religious leaders, and communities, and documentation studies. The analysis was carried out by examining ritual practices against the principles of monotheism, prayer orientation, and benefit as the main parameters in the theory of 'urf. The results of the study show that the Nipa'bajikang ritual is understood and carried out as a medium of prayer and plea for blessings to Allah SWT., without belief in the supernatural power in the symbolic elements used. In addition, this ritual serves to strengthen ukhuwah, ta'awun, and social solidarity in the local Muslim community. Based on the criteria of 'urf, the tradition of Nipa'bajikang is categorized as 'urf sahih because it fulfills the elements of social enforcement, utility, and conformity with the principles of Islamic law. The implications of this study confirm the relevance of the concept of 'urf as a socio-legal framework in assessing local cultural practices and supporting the development of contextual Islamic legal reasoning in Indonesian Muslim society.
