Abstract

The aim of this study is to investigate the authority of the Land Deed Making Officer (PPAT) in issuing Sale and Purchase Deeds Number 134/2016 and 135/2016. All actions, including legal and other acts, performed within the territory of Indonesia must adhere to the prevailing regulations and laws in the country. This requirement applies to all individuals, whether Indonesian citizens or foreign nationals currently in Indonesia. Every landowner in Indonesia is obligated to register their land in accordance with the provisions of the Basic Agrarian Law and its associated regulations, ensuring that land ownership status is clear and legally recognized, which serves as a preventive measure against disputes over land rights. This study employs a descriptive qualitative approach to examine the authority of PPAT Roy Pudyo Hermawan in executing Sale and Purchase Deeds Number 134/2016 and 135/2016. The findings indicate that the deeds were declared legally defective by the Supreme Court, as they did not satisfy the substantive legal requirements and failed to adhere to the procedural standards prescribed for deed execution by a PPAT.

Abstract

Unregistered marriages (perkawinan siri) remain a common practice within Indonesian society. Although such marriages are considered religiously valid, they hold no legal standing under state law due to the absence of official registration with civil authorities. This lack of legal documentation leads to significant legal issues, particularly regarding the legal status of children born from such unions, including civil rights such as recognition, financial support, and inheritance. This study aims to examine the protection of the rights of children born from perkawinan siri from the perspectives of Islamic law, Christian doctrine, and Indonesian positive law, with the goal of identifying a common ground that ensures justice and child welfare. This research adopts a normative legal method (juridical-normative approach), incorporating statutory, conceptual, and comparative legal approaches. The data used in this study are secondary data, consisting of primary legal materials (laws and court decisions), secondary legal materials (legal literature and scholarly journals), and tertiary legal materials. Data were collected through library research. The data analysis technique employed is qualitative analysis, which involves examining the content and interpretation of relevant legal norms and religious teachings, as well as comparing them to identify alignments or discrepancies in the protection of children’s rights born out of unregistered marriages. In Islamic law, children born from biological relationships are entitled to protection, even if they are born outside of legally registered marriages. Within Christian teachings, perspectives vary across denominations; however, there is a general emphasis on the legitimacy of civil law. Under Indonesian national law, the legal status of such children may be acknowledged as long as the evidentiary requirements prescribed by law such as recognition by the father or a court ruling are fulfilled. This study highlights the critical importance of marriage registration as a form of preventive legal protection, ensuring the clarity of a child's legal status and the fulfillment of their rights. Furthermore, empirical findings reveal a persistent gap in legal awareness among the public and a disconnect between legal norms and their implementation, underscoring the need for active roles by the state and religious institutions in promoting legal education and policy reform.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam memutuskan hak asuh anak dalam putusan Nomor 38/Pdt.G/2019/PN Ckr, dengan fokus pada pemenuhan prinsip kepentingan terbaik bagi anak, serta implikasi putusan terhadap pelaksanaan kewajiban orang tua pasca perceraian. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus dan analisis dokumen. Penelitian ini menganalisis bukti-bukti persidangan dan pertimbangan hukum yang digunakan oleh hakim dalam memutuskan hak asuh anak. Hasil penelitian menunjukkan bahwa putusan hakim telah memenuhi prinsip kepentingan terbaik bagi anak, dengan mempertimbangkan faktor-faktor seperti kedekatan emosional anak dengan penggugat, kemampuan penggugat dalam memberikan kebutuhan dasar anak, serta ketidakhadiran tergugat dalam persidangan. Implikasi dari putusan ini tidak hanya memberikan jaminan terhadap kesejahteraan anak, tetapi juga memberikan preseden penting dalam penegakan hukum hak asuh anak di Indonesia. Penelitian ini memberikan kontribusi terhadap pemahaman dan pengembangan kebijakan terkait hak asuh anak pasca perceraian, yang berfokus pada kepentingan terbaik anak dan kesetaraan hak orang tua.

Abstract

Marriage registration plays a central role in the legal system and government administration to record and protect individual rights while managing marital status within a society. This research delves into the significance and impact of marriage registration in the context of civil law and public administration. Through the analysis of marriage regulations, registration procedures, and their legal implications, this study identifies the role of marriage registration in acknowledging the rights and obligations of spouses, as well as protecting the interests of children. The research also explores the evolution of marriage registration in response to social and technological changes, along with its implications for accessibility and data security. The research findings highlight the importance of efficiency and transparency in the marriage registration process to ensure the protection of individual rights and provide a strong foundation for law enforcement. Further understanding of the role of marriage registration can serve as a basis for improving marriage administration systems and supporting policy reforms that promote justice and legal security.

Abstract

Humans are basically created in pairs to carry out daily life activities, therefore humans are referred to as social beings who need the help of others in carrying out an action. For the sake of the realization of forming a harmonious and happy family, it must go through a marriage bond. Indonesia adheres to written law, in which a marriage can take place must meet the requirements for a valid marriage contained in the Marriage Law, namely Law Number 1 of 1974. If marriage has been carried out, it will have legal consequences between husband and wife, namely one of them regarding the existence of a mixture of assets obtained during the marriage. The problems that arise at the time of marriage are not least about the mixing of these assets, in this case to avoid problems that arise later on, husband and wife couples can make a marriage agreement, especially for those who are married to foreign nationals. The form of the marriage agreement in ordinary society is still unclear whether it has to be with a notary deed or just underhanded, where this becomes an uncertainty about the form of the marriage agreement and its legal consequences. The purpose of this research is to provide an insight for the community so that they are no longer wrong in making a marriage agreement and to find out how the position of the marriage agreement itself is. This research method uses normative juridical by analyzing legislation, then a conclusion can be drawn: marriage agreements should still be carried out using a notarial deed where to prove it when a dispute occurs it can be perfectly proven and the authenticity of the identity of the parties who made it is clear.

Abstract

Penelitian ini dilatar belakangi oleh banyaknya permohonan dispensasi perkawinan setelah penerapan undang-undang terbaru terkait batasan usia perkawinan. Penelitian ini mengkaji pertimbangan hakim baik dari aspek normatif maupun sosial agar permohonan dispensasi ini dapat diterima. Penelitian ini fokus pada bagaimana hakim meninjau permohonan dispensasi perkawinan pasca diundangkannya Undang-Undang Nomor 16 Tahun 2019. Penelitian ini menggunakan pendekatan undang-undang. Hasil penelitian ini menunjukkan bahwa hakim dalam memutus perkara dispensasi perkawinan tidak hanya melihat pada kelengkapan administrasi hukumnya saja. Namun juga dari sudut pandang sosiologi, pemberian permohonan dispensasi melihat aspek manfaat yang harus diperoleh untuk menghindari kerugian yang lebih besar. Implikasinya, perubahan undang-undang terkait dispensasi perkawinan semakin meningkat karena menjadi tata cara penyelesaian administrasi perkawinan bagi pasangan di bawah umur dalam ketentuan undang-undang.

Abstract

The marital dispensation provision in the latest Marriage Law adopted the ultimum remedium principle, indicating that marital dispensation is granted to parties who have not met the marriageable age limit if there are pressing conditions and no other alternatives. There are three primary factors to be considered in granting marriage dispensation, namely the protection of the child's mental state, intellectual state and parentage. This study intends to analyze the reasons for the urgency in the judge's consideration in the Cilegon District Court Decision No. 32/Pdt.P/2019/PA.CLG and understand the legal consequences of underage marriage in Indonesia. This normative research is descriptive analytical and the type of data analyzed is primary and secondary data collected through literature studies and all research data will be analyzed using qualitative methods. The results of this study indicate that the conditions that occur in the case of decision no. 32/Pdt.P/2019/PA.CLG are actually not compelling or urgent. The Cilegon District Religion Court should have considered other foundations in shar'i, juridical, sociological and health sciences of the candidates before approving the marriage dispensation of the candidates.

Abstract

This research aims to analyze cases of cancellation of polygamous marriages due to false statements, with a focus on Case Study Decision Number 2530/Pdt. G/2019/PA.Mdn. The research background involved a lawsuit filed by a man regarding the marriage of Defendant I and Defendant II which was carried out without the knowledge of the Plaintiff as the legal guardian. The research method used is normative qualitative by collecting secondary data from relevant laws and judicial decisions. The results of the research show that the marriage of Defendant I and Defendant II was declared null and void because they did not meet the requirements for a legal guardian, which was linked to the Plaintiff's disagreement as the biological father of Defendant I. This analysis is based on Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law , and supported by documentary evidence such as a marriage certificate. The research conclusion confirms that court decisions reflect the judge's thoroughness in implementing applicable legal provisions, protecting individual rights, and upholding the validity of marriage. These results contribute to the development of legal precedent regarding the annulment of polygamous marriages due to false statements in the future.
