Abstract

Abstract: The building should be able to provide a comfortable space for users to avoid outside unfavorable climate, so that the activities in it can run optimally. The comfort aspect is one of the important factors in special worship in it. Al-Ahdhar Mosque is a mosque designed by architect Nataneka. This mosque has large openings so that natural lighting and natural ventilation can enter the building. However, it needs to be investigated whether this large opening is enough to influence the lighting conditions and conditions of the Al-Ahdhar mosque. This research was also conducted to find out the relationship between natural lighting and natural ventilation produced and to find out the opinions of respondents to the thermal comfort of the Al-Ahdhar mosque. The method used in this study is field measurements and observations which are then processed quantitatively. The results showed that natural lighting at Al-Ahdhar mosque was 180 lux on the 1st and 128th floors of lux on the 2nd floor, which meant that natural lighting in this mosque still did not meet the standards of 200 lux. Thermal conditions at Al-Ahdhar mosque, the lowest temperature of 240C is found in areas that have openings of 34%. While 80% openings produce temperatures that tend to be higher at 29.20C to 29.60C. Larger openings do not necessarily produce good natural lighting and air conditioning conditions. But keep in mind the location of openings, orientation of openings, and types of openings. The bigger the openings will also include large solar radiation as well.Keywords: natural lighting; natural ventilation; thermal conditions; mosqueAbstrak: Bangunan sebaiknya dapat memberi ruang beraktivitas yang nyaman kepada pengguna agar terhindar dari iklim luar yang tidak menguntungkan, sehingga aktivitas di dalamnya dapat berjalan dengan optimal. Aspek kenyamanan merupakan salah satu faktor penting dalam kekhusukan beribadah di dalamnya. Masjid Al-Ahdhar merupakan masjid yang didesain oleh arsitek Nataneka. Masjid ini memiliki bukaan yang cukup besar sehingga pencahayaan alami dan penghawaan alami dapat masuk ke dalam bangunan. Namun, perlu diteliti apakah bukaan yang besar ini cukup berpengaruh terhadap kondisi pencahayaan dan kondisi penghawaan pada masjid Al-Ahdhar. Penelitian ini juga dilakukan untuk mengetahui hubungan antara pencahayaan alami dan penghawaan alami yang dihasilkan serta mengetahui pendapat responden terhadap kenyamanan termal masjid Al-Ahdhar. Metode yang dilakukan dalam penelitian ini adalah pengukuran lapangan dan observasi yang kemudian diolah secara kuantitatif. Hasil penelitian menunjukkan bahwa pencahayaan alami pada masjid Al-Ahdhar adalah sebesar 180 lux pada lantai 1 dan 128 lux pada lantai 2 yang berarti pencahayaan alami pada masjid ini masih belum memenuhi standar yaitu sebesar 200 lux. Kondisi thermal pada masjid Al-Ahdhar, suhu terendah yaitu sebesar 240C didapatkan pada area yang memiliki bukaan 34%. Sedangkan bukaan 80% menghasilkan suhu udara yang cenderung lebih tinggi yaitu sebesar 29,20C sampai 29,60C. Bukaan yang semakin besar belum tentu menghasilkan kondisi pencahayaan alami dan penghawaan alami yang baik. Namun perlu diperhatikan letak bukaan, orientasi bukaan, dan jenis bukaan. Semakin besar bukaan juga akan memasukkan radiasi matahari yang besar pula.Kata Kunci: pencahayaan alami; penghawaan alami; kondisi termal; masjid

Abstract

This paper examines the Constitutional Court Decision 46 / PUU-XIV / 2016 through the approach of the flow of legal philosophy, specifically legal positivism which resides behind decisions that reject the petition of the applicant. Tensions between the philosophical schools of law always occur, until the judges give their decisions. This decision was classified as a hard case, which was very full of paradigm disputes. The focus of the study in this study is to look at the judges' consideration with the logical positivism approach to law. This is done because the foothold that is the basis of legal arguments places several statutory regulations at the constitutional level and the law becomes the main analysis stone looking at the problems/premise of the major, where the authority adds norms not the authority of the Constitutional Court. Therefore, the formulation of the problem in this study is the identification and analysis of arguments with nuances of legal positivism in the Constitutional Court Decision 46 / PUU-XIV / 2016. The research method used is the Doctrinal / Normative Research, which is the main legal material to be examined in this study, which is the Constitutional Court Decision 46 / PUU-XIV / 2016. The type of approach, using the analytical approach (analytical approach) and philosophical approach (philosophical approach). Conclusions from this study: The flow of legal positivism with its arguments based on axiology, ontology, and epistemology dominates the judges so that the presence of the decision rejects the petition of the applicant. The flow of legal positivism comes with reasoning/logic that is very tight and closed, which makes the legislation as the main basis, thus limiting judges to conduct self-restraint, and submit it to the legislators to execute what is expected of the applicant. In addition, the issue of the principle of legality that upholds legal certainty is also the main reason for the judges who reject the decision. The tension between the flow of legal philosophy in this decision occurs, where legal positivism which originally had a theoretical tension with the flow of natural law and historical schools, also occurred where judges who had dissenting opinions based their arguments on the flow of natural law and historical schools.

Abstract

This paper will discuss how the post-judicial decision of the Constitutional Court has a minimum age of marriage for woman and consideration in the values of human rights. This paper aims to provide an understanding to the public that the importance of paying attention to the age of marriage is a form of protection of children’s rights, and as an effort to prevent discrimination against woman. The research method used is a combination of normative legal research and empirical legal research. The research material that will be used in this research includes secondary data and primary data. Primary data were obtained directly from samples / research subjects. While the legal materials for secondary data in this study were obtained from library materials related to the problem. After the verdict of the Constitutional Court at a minimum age is married to a 19-year-old woman in terms of the values of human rights, and this is one form of public awareness and responsibility of the state for the protection and fulfillment of human rights (children’s rights and principles of nondiscrimination) and constitutional rights. This issue further looks at the future impact of child marriage for woman can lead to discriminatory actions against woman related to the issue of legal position between men and women who will directly violate children’s rights. Tulisan ini akan membahas bagaimana pasca-putusan Mahkamah Konstitusi usia minimal menikah bagi perempuan dan pertimbangan dalam nilai-nilai hak asasi manusia. Tulisan ini bertujuan: memberikan pemahaman kepada masyarakat bahwa pentingnya memperhatikan usia menikah sebagai salah satu bentuk perlindungan terhadap hak-hak anak dan sebagai salah satu upaya pencegahan tindakan diskriminasi terhadap perempuan. Metode penelitian yang digunakan yakni perpaduan antara penelitian hukum normatif dan penelitian hukum empiris. Bahan penelitian yang akan digunakan dalam penelitian ini meliputi data sekunder maupun data primer. Data primer diperoleh secara langsung dari sampel/subjek penelitian. Sedangkan bahan hukum data sekunder dalam penelitian ini diperoleh dari bahan-bahan pustaka yang berhubungan dengan permasalahan. Hasil penelitian menunjukan bahwa pasca-putusan Mahkamah Konstitusi usia minimal menikah bagi perempuan 19 (sembilan belas) tahun menunjukan sangat sarat dengan pertimbangan nilai-nilai hak asasi manusia, dan ini merupakan salah satu bentuk kesadaran masyarakat dan tanggung jawab negara atas perlindungan dan pemenuhan terhadap hak asasi (hak-hak anak, dan prinsip non diskriminasi) dan hak konstitusi. Persoalan ini lebih jauh melihat kedepan dampak dari perkawinan usia anak bagi perempuan dapat menimbulkan tindakan diskriminasi terhadap perempuan terkait dengan persoalan kedudukan hukum antara laki-laki dan perempuan yang secara langsung akan terjadinya pelanggaran terhadap hak-hak anak.

Abstract

The interim president anticipates the vacancy of the office of president and vice president; Indonesia calls it ‘pelaksana tugas kepresidenan’, which is filled by the minister of home affairs, foreign affairs, and minister of defense. This article explores the two actors (bureaucrats and legitimacy) who become interim presidents in the constitutions of the world's countries. Next, the Indonesian arrangement and accompanying problems in the 1945 Constitution will be reviewed. This article is aided by a doctrinal research method with historical, legislative, and comparative constitutional approaches. Indonesia has its peculiarities compared to the constitutions of world countries because it applies a compound position as interim President adopted from the New Order legal products (Tap MPR VII/1973) without going through a decontextualisation process, so it still applies the old features (bureaucratic actors) with compound/collegial executive positions in the new constitutional structure that seeks to purify the presidential system. In addition, there are conditions that the 1945 Constitution still cannot resolve and that cause paralysis of governance. This article offers one solution—which could alleviate two specific problems simultaneously—and that is to make the Speaker of the House of Representatives (DPR) the acting President of the future.

Abstract

The Article 22 of the 1945 Constitution of the Republic of Indonesia grants an exclusive authority to the president enacted as "legal dictatorial power", meaning that the President holds a sovereign authority to create and form regulations or laws independently without needing to discuss with the House of Representatives (DPR). The authority is to stipulate Government Regulation in Lieu of Law (Perppu). It refers to the president’s authority basis to run the regulation over the running government whose primary aims are to guarantee and to protect the citizen’s welfare. On the other hand, in respect of Indonesian constitutional system that adheres to the concept of decentralization, local governments also have the right to determine a situation/condition in response to the global pandemic situation. As a matter of the fact, so many overlaps are found in the exercise of policies and regulations under the authority of central and regional governments. Thus, the current research is aimed to strengthen the role of President as the head of state in dealing with the global pandemic issue and in applying lockdown with its all mechanisms. Practically, the research was carried out by means of normative legal research method associated with statutory, conceptual, historical, and comparative approaches. Furthermore, the research had found that the President appeared to be the supreme power holder over central governments, equipped with strong legitimacy in running the lockdown in accordance with juridical and empirical perspectives on the effectiveness of pandemic handling

Abstract

Dalam upaya meningkatkan kualitas perusahaan, penting untuk mengelola data kepegawaian secara akurat dan selalu diperbarui, mengingat karyawan merupakan aset berharga yang memerlukan manajemen yang efektif. Saat ini, PT Angkasa Pura II (Persero) telah menerapkan sistem informasi kepegawaian yang terkomputerisasi; meskipun demikian, terdapat beberapa kelemahan di dalamnya, seperti belum terintegrasi dengan baik dalam hal absensi, penggajian, dan penilaian karyawan. Oleh karena itu, dilakukan pengembangan Sistem Kepegawaian berbasis Website sebagai solusi atas tantangan tersebut. Website menjadi antarmuka pengguna untuk mengakses aplikasi basis data dan merupakan sistem informasi yang tersebar, sehingga pengguna tidak perlu lagi mengunduh perangkat lunak khusus. Saat ini, hampir semua orang dapat mengakses informasi melalui web, termasuk PT. Angkasa Pura II (Persero), yang hampir seluruhnya telah menggunakan komputerisasi berbasis web dengan menggunakan pemrograman seperti ASP dan PHP. Dalam pengembangan Sistem Data Riwayat Karyawan, peneliti menggunakan metode analisis PIECES untuk memetakan isu dan permasalahan pengolahan data karyawan berdasarkan kriteria performance, information, economic, control, efficiency, dan service.

Abstract

This article discusses the problems encountered in the preliminary court proceeding of gross human right violation cases in Indonesia.  Identified are two state institutions, i.e. the National Human Right Commission and the Attorney General, who possess the authority to initiate investigation and subsequent successful prosecution of gross human right violation cases. Good cooperation and relation between these two agencies is therefore a must.  This article looks into the problems encountered by these two institutions in doing the preliminary process and discusses possible redistribution of these two state agency authorities. To do this a doctrinal approach will be used.

Abstract

This study aims to determine the effectiveness of communication strategy used by the Ministry of Health of The Republic of Indonesia, especially the COVID-19 Task Force in overcoming the spread of the virus by conducting a vaccination program for the community. The spreading of COVID-19 still requires special treatment in various countries, including Indonesia. Besides implementing health protocols, the government must take concrete preventive steps in overcoming this pandemic, namely by providing vaccines for the community. Even though the vaccination program is an effort to prevent the spread of COVID-19, there are still people who refuse to vaccinate or do not know the importance of this vaccination. The use of public relations programs using information technology in the form of the internet is urgently needed during this pandemic. One of the media used by the government is a website which is also supported through social media. Using qualitative reasearch approach case study method, this research analyzed information content related to the government's vaccination program on the covid19.go.id website. Based on the results of information categorization and analysis of information content published on the covid19.go.id website, it can be concluded that the communication strategy by the COVID-19 Task Force public relations is quite effective because information about the implementation of COVID-19 vaccination and the availability of vaccines in Indonesia is continuously updated.

Abstract

The administration of regional property via usage programs constitutes a source of regional financial Revenue. The administration of regional property is governed by Government Regulation Number 1 of 2014 about the Management of State/Regional Property, subsequently supplemented by Regulation of the Minister of Home Affairs Number 19 of 2016 on the Management of Regional Property. Nonetheless, the regulation of the regional property (Barang Milik Daerah/BMD) sector encounters numerous challenges, particularly regarding the coordination required between the Minister of Home Affairs and the Minister of Finance in developing general and technical policies on regional property, which remains suboptimal. Consequently, the Minister of Home Affairs Regulation Number 19/2016 remains inadequate as a regional reference for formulating Regional Regulations/Regulations of Regional Heads, leading many to directly consult the Minister of Finance, which governs State Property. According to the description above, the subsequent challenges are articulated: Issues in regulating the regional property sector at both central and regional levels. Format for the Reorganization of the Central Regulation of the Regional Public Property Sector. Normative (legal) research methodologies, including statutory, conceptual, and case approaches, are employed to analyze the problem formulation. Findings from this research: Regulatory issues arise from a lack of alignment among ministries in coordinating efforts. The Minister of Home Affairs reports to the Coordinating Minister for Political, Legal, and Security Affairs, whereas the Coordinating Minister for the Economy oversees the Minister of Finance. The organization of rules involves distinguishing between Government rules for state property and regional property, necessitating cross-sectoral harmonization throughout their formulation. This must be accomplished due to the control of regional property under many laws, necessitating harmonization in formulating technical regulations at the governmental level, along with heightened care. Recent legislation must be modified to align overarching policies and their technical execution.

Abstract

Presidential succession law is a crucial constitutional instrument designed to ensure the continuity of government in the event of an unexpected vacancy in executive leadership (concurrent vacancy of the President and Vice President). Although such events are rare, their impact on political stability can be profound if not adequately anticipated within a constitutional framework. This article examines how South Korea and the Philippines have constructed their presidential succession laws. South Korea has experienced repeated executive vacancies, while the Philippines, despite sharing substantial similarities in governmental structure with Indonesia—both drawing significant inspiration from the United States Constitution—adopts a notably different succession framework. Using a doctrinal research method with a statutory and comparative constitutional approach, this study finds that both countries have established clear and multi-layered succession structures capable of preventing systemic disruptions even in crises such as presidential impeachments. By contrast, Indonesia’s succession design under Article 8(3) of the 1945 Constitution (UUD NRI 1945) reveals fundamental weaknesses, particularly in assigning collective authority to three ministers without a clear substitution mechanism, thereby exposing the state to the risk of a power vacuum. Nevertheless, the mechanism for electing a new President and Vice President through the People's Consultative Assembly (MPR) provides a pragmatic solution tailored to Indonesia’s complex geographical and political conditions. Based on these findings, the article advocates for a comprehensive reform of Indonesia’s executive succession framework through a concrete, operational, and adaptive institutional architecture to ensure that the machinery of government continues to function even under the most severe crises.
