Abstract

The legal relationship between doctors and patients in medical practice is not merely ethical in nature but also establishes a contractual bond known as a therapeutic contract. Within the framework of civil law, this contract fulfills the elements of an agreement as regulated in Articles 1313 and 1320 of the Indonesian Civil Code. Patients, as recipients of medical services, can be classified as consumers as defined under Law Number 8 of 1999 on Consumer Protection (UUPK). This study aims to analyze the construction of therapeutic contracts as service agreements in civil law, examine the legal status of patients as consumers, and formulate a model for strengthening legal protection for patients in healthcare services. The research employs a normative juridical method with statutory, conceptual, and case study approaches. The findings indicate that although therapeutic contracts are valid under civil law, in practice they still generate imbalances in the doctor–patient relationship, particularly in terms of information and medical decision-making. This research proposes an integrative model of legal protection through written medical contracts, harmonization of regulations between the Health Law and UUPK, expansion of the authority of the Consumer Dispute Settlement Body (BPSK), and enhancement of patients’ legal literacy. This model is expected to foster a more balanced and just legal relationship in healthcare services.

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

Abstract

Edukasi KIK di Desa Kutai Lama dilakukan karena adanya potensi adanya Kekayaan Intelektual Komunal yang belum terlindungi. Upaya inventarisasi KIK sebagai langkah defensive, dalam pelaksanaannya masih terdapat beberapa kendala, diantaranya belum optimalnya peranan dari masyarakat dan sinergi institusi. Tujuan edukasi ini untuk memberikan pemahaman kepada masyarakat tentang pentingnya upaya identifikasi dan inventarisasi KIK sebagai upaya melindungi warisan budaya di Desa Kutai lama, dengan harapan dapat mencegah terjadinya penyalahgunaan melawan hukum terhadap warisan budaya dan masyarakat juga dapat memanfaatkan KIK sebagai sarana peningkatan nilai ekonomis di Desa Kutai Lama. Edukasi dilaksanakan di Kantor Desa Kutai Lama pada tanggal, 20 Mei 2024 dihadiri 27 peserta. Tahapan edukasi yang dilaksanakan: 1) Kunjungan awal memperkenalkan kepada jajaran Kelurahan tentang KIK; 2) menyampaikan materi terkait KIK kepada masyarakat; 3) melakukan identifikasi dengan memberikan formulir tentang kegiatan usaha masyarakat. Kegiatan secara keseluruhan berjalan sesuai target. Kegiatan awal dalam pengenalan edukasi ini, diperlukan tindaklanjut pendampingan identifikasi KIK pada kegiatan abdimas berikutnya.

Abstract

Badan Penyelesaian Sengketa Konsumen (BPSK) Kota Samarinda telah terbentuk sejak tahun 2010, yang bertugas menyelesaikan sengketa konsumen yang berada di wilayah Kota Samarinda. Sebagai lembaga penyelesaian sengketa di luar pengadilan, BPSK memiliki kelebihan yaitu konsumen tidak dipungut biaya dan dalam menyelesaikan sengketa konsumen mengedepankan win-win solution. Meskipun telah tersedia BPSK, namun belum semua konsumen di Kota Samarinda belum memanfaatkan lembaga tersebut untuk mengadu dan menyelesaikan sengketa konsumen. Beberapa permasalahan yang menyebabkan konsumen belum memanfaatkan lembaga tersebut, karena tingkat keberdayaan konsumen masih rendah juga dikarenakan belum tersosialisasikannya BPSK kepada konsumen dengan maksimal. Karenanya sangat penting untuk dilakukan edukasi kepada konsumen tentang BPSK tersebut. Adapun metode yang digunakan yaitu melakukan edukasi melalui media online. Sasaran edukasi secara khusus adalah konsumen Kota Samarinda dan secara umum konsumen di Kalimnatan timur. Tujuannya konsumen akan mengetahui dan memahami terkait kewenangan BPSK dan selanjutnya konsumen yang memiliki permasalahan konsumen dapat memanfaatkan BPSK tersebut. Hasil kegiatan, yaitu telah terselenggara webinar secara online melalui zoom meeting. Jumlah peserta webinar sebanyak 85 orang dengan komposisi masyarakat di Kota samarinda dan mahasiswa di Kalimantan Timur.

Abstract

Principal leadership plays a crucial role in creating conducive learning environments, yet significant variations in learning quality across elementary schools suggest inadequate understanding of leadership mechanisms in specific contexts. This quantitative study employed correlational survey design to examine principal leadership effects on learning quality in 26 public elementary schools in Tanggungharjo District, Indonesia. Data were collected from 137 teachers using validated questionnaires measuring five leadership dimensions (personality, managerial competence, academic supervision, social communication, and entrepreneurship/innovation) and learning quality indicators. Principal Component Analysis assessed dimensional structure, while Pearson correlation and simple linear regression analyzed variable relationships. Principal leadership demonstrated very strong positive correlation with learning quality (r = 0.893, p < 0.01), explaining 79.7% of learning quality variance. Dimensional analysis revealed academic supervision and entrepreneurship/innovation as strongest contributors (extraction values = 0.996), while managerial and social-communication dimensions showed relatively lower contributions. The regression equation (Y = 29.588 + 0.596X) confirmed significant positive influence (t = 22.994, p < 0.001).  Findings validate integrated transformational-instructional leadership frameworks, demonstrating that contemporary principal effectiveness requires simultaneously excelling as pedagogical supervisors and entrepreneurial innovators. Results emphasize urgent need for targeted leadership development interventions, particularly in schools where 45.99% of respondents perceived inadequate leadership quality, to strengthen academic supervision competencies and entrepreneurial mindsets for sustainable educational improvement.

Abstract

The 21st century demands high-quality human resources in the education sector to face global challenges. This literature review aims to analyze school principal leadership strategies in developing human resources based on several recent studies. The method used is a literature review of several national and international journals. The results show that transformational and instructional leadership styles significantly influence teacher performance, job satisfaction, and the quality of education. Strategies such as providing motivation, creating a collaborative culture, and developing digital literacy are keys to successful HR development in schools. In conclusion, effective principal leadership is a primary catalyst in improving the quality of human resources in the 21st-century education era.
