Abstract

Constitutional right is basic right for all Indonesian people, not least for indigenous people which still uphold the values of their customary law. Customary law is often  different  from  the  positive  law  in  Indonesia,  but it’s not a reason to deny the customary law on  indigenous  people  in  a region. One of the Indigenous people is in Yahukimo where the community uses their customary law in various patterns of life. Therefore, even in the election they use their own customary law and are not  guided  by  the  Election Law. Noken is the way they cast a vote. Constitutionality of Noken is accepted as a cultural value by the Constitutional Court.

Abstract

This study analyzes the internal sovereignty of the Indonesian government in the implementation of cooperation in Islamic boarding school funding programs as regulated in Article 46 of Law Number 18 of 2019 concerning Islamic Boarding Schools. to find out what challenges and obstacles the government faces in maintaining internal sovereignty in the Islamic boarding school funding program, to find out how to implement Article 46 of the Islamic boarding school law from the perspective of state sovereignty. This study uses a normative juridical method with a statutory and conceptual approach. The results of the study indicate that the implementation of the Islamic boarding school funding program based on Article 46 of the Islamic Boarding School Law requires a balance between openness to external funding sources and protection of the government's internal sovereignty in determining the direction of Islamic boarding school education policy. The main challenges identified include the potential for foreign interest intervention, financial dependence, and harmonization of funding policies with the characteristics and independence of Islamic boarding schools. This study recommends strengthening the supervisory mechanism, preparing comprehensive derivative regulations, and a funding cooperation model that focuses on strengthening the autonomy and independence of Islamic boarding schools.

Abstract

Law Number 33 of 2014 concerning Halal Product Assurance requires halal certification for products circulating in Indonesia. However, in Bandar Lampung City, many micro and small business actors have not been halal certified. This study aims to analyze the implementation of halal certification by these business actors as well as its supporting and inhibiting factors. This type of research is an empirical normative law with a descriptive approach, using interviews, literature studies, and questionnaires for data collection. The results show that halal certification in Bandar Lampung City is not optimal, with the main obstacles in the form of lack of understanding, high costs, lack of socialization, and weak law enforcement. Instead, the success of certification is supported by clear regulations, awareness of the Islamic community, product testing laboratories, and a free consulting and certification program (SEHATI).

Abstract

Penelitian ini bertujuan untuk menganalisis hubungan antara otonomi daerah dan strategi intervensi harga komoditas pertanian dalam rangka meningkatkan kesejahteraan petani dan ketahanan pangan nasional di Indonesia. Menggunakan pendekatan Systematic Literature Review (SLR) yang dikombinasikan dengan analisis bibliometrik melalui perangkat lunak VOSviewer, studi ini mengevaluasi 107 artikel dari database Scopus. Hasil penelitian menunjukkan bahwa otonomi daerah memberikan ruang bagi pemerintah lokal untuk merancang kebijakan harga yang lebih adaptif terhadap kondisi pasar dan sosial-ekonomi setempat. Strategi intervensi harga yang terdesentralisasi terbukti efektif dalam meningkatkan pendapatan petani, mengurangi dampak fluktuasi pasar, serta memperkuat stabilitas pangan daerah. Visualisasi jaringan kata kunci juga menyoroti bahwa tema governance, decision-making, dan community menjadi fokus utama dalam literatur yang dianalisis. Studi ini menekankan perlunya penguatan koordinasi antar pemerintah dan partisipasi masyarakat dalam perumusan kebijakan harga di sektor pertanian

Abstract

Gadai tanah perkebunan merupakan praktik agraria yang kompleks dan menyentuh aspek hukum, sosial, serta kedaulatan negara. Dalam konteks hukum Indonesia, praktik ini kerap menimbulkan ketidakpastian hukum, terutama akibat disharmoni antara hukum adat dan hukum positif yang berlaku. Penelitian ini bertujuan untuk menganalisis keterkaitan antara kedaulatan internal negara dengan urgensi reformasi hukum gadai tanah perkebunan, serta merumuskan arah kebijakan hukum yang berkeadilan dan berkelanjutan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Data diperoleh dari studi pustaka dan dianalisis secara kualitatif melalui metode deskriptif analitis. Hasil penelitian menunjukkan bahwa kelemahan sistem hukum gadai tanah saat ini berdampak negatif terhadap perlindungan hak masyarakat, khususnya petani kecil dan masyarakat adat, serta berpotensi melemahkan kontrol negara atas sumber daya strategis. Reformasi hukum yang mencakup aspek filosofis, yuridis, dan sosiologis diperlukan untuk memperkuat kedaulatan internal dan menciptakan sistem hukum agraria yang adil, adaptif, dan berorientasi pada perlindungan rakyat.

Abstract

Stunting is a condition of growth failure caused by chronic malnutrition and recurrent infections during the first 1,000 days of life, which has a serious impact on the quality of Indonesia's human resources. Stunting is not only a health issue, but also a violation of children's rights guaranteed by the constitution and national legal instruments. In this context, the state has a legal responsibility to ensure every child's right to nutrition and health in a comprehensive manner. An analysis of Presidential Regulation No. 72 of 2021 shows that national regulations have established strategies to accelerate the reduction of stunting, but they lack mechanisms for sanctions, oversight, and clear delineation of authority. Weak cross-sectoral coordination, low legal literacy among the public, and minimal public participation undermine the effectiveness of policies. To enrich the analysis, this study highlights best practices from Malaysia, Myanmar, and Thailand. These countries have successfully reduced stunting rates through a multisectoral, community-based, and rights-oriented approach. Their strategies include nutrition education, food security, women's empowerment, and interventions based on educational and social institutions. Without a strong and implementable legal framework, and without learning from successful global practices, Indonesia will struggle to achieve significant reductions in stunting. Therefore, strengthening legal policies and adopting international best practices are crucial to realizing the vision of Indonesia's Golden Generation 2045

Abstract

Premarital HIV testing has emerged as a crucial preventive strategy in reducing the transmission of HIV/AIDS, particularly within the context of marital relationships in Indonesia. Despite rising HIV cases and the potential for intra-marital transmission, implementation of mandatory HIV testing for prospective spouses remains inconsistent across regions. This study aims to analyze the urgency and implications of premarital HIV testing as a marriage requirement in Indonesia, focusing on regulatory frameworks, practical implementation, and human rights considerations. A normative juridical method is employed, supported by a conceptual approach and literature review, alongside interviews with selected stakeholders including health officials and couples who have undergone testing. The findings reveal that although regional regulations mandate such testing, several challenges persist: limited healthcare infrastructure, insufficient public awareness, and social resistance rooted in stigma and misconceptions. Moreover, while premarital HIV testing serves public health interests, it also raises ethical concerns regarding privacy, consent, and potential discrimination. If supported by clear policies, adequate counseling, and strong confidentiality measures, premarital HIV testing can effectively safeguard public health without infringing on individual rights. This study recommends reinforcing inter-agency coordination, expanding access to voluntary and informed testing, and designing rights-sensitive policies that balance public health priorities with individual autonomy.

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

Abstract

The aim of this research is first, to analyze the legal relationship in the implementation of loan and borrowing agreements at the Madani Mekaar National Capital (Persero) in the Yosomulyo sub-district, Metro City; secondly, to analyze the obstacles that occur in the implementation of lending and borrowing at PNM Mekaar (Persero) in Yosomulyo Metro City. This type of research is normative-empirical legal research with descriptive legal research type. The research problem approach is nonjudicial case study. Research data sources are primary and secondary data. Data collection methods were carried out by means of literature study, document study and interviews. Data processing methods are data inspection, data marking, data reconstruction, data systematization. The data was analyzed qualitatively. The research results show that the legal relationship between PT PNM Mekaar (Persero) and customers in Yosomulyo Village is a reciprocal contractual relationship, where both parties have rights and obligations that are clearly regulated in the business financing agreement. Implementation of financing loans at PT. PNM Mekaar (Persero) goes through four stages, namely fulfilling application requirements, surveying, implementing financing, and implementing rights and obligations. Then there are obstacles in implementing business financing agreements, namely default in implementing financing agreements at PT PNM Mekaar (Persero), in the form of delays in installment payments and customers running away, thus disrupting the smooth running of financing. Factors causing default include unstable financial conditions of customers and use of funds that are not fit for purpose.

Abstract

Online car auctions in Indonesia are increasingly popular, but the application of distributive and retributive justice principles in this system still faces various challenges, such as information imbalance, data manipulation, and weak law enforcement. This study aims to analyze the effectiveness of the application of these two principles in protecting consumers as well as the role of personal data protection in preventing information manipulation in online auction transactions. Based on the analysis, it is found that although there are regulations governing consumer protection and personal data, the implementation of these regulations is still not optimal. Information asymmetry that occurs in online auction transactions, manipulation practices such as shill bidding, and weak supervision of auction algorithms and misuse of personal data are the main obstacles in creating justice for consumers. In addition, strengthening legal sanctions and implementing new technologies such as blockchain are needed to improve transparency and accountability in online auctions. This research also recommends the need for strengthening regulations, collaboration between the government, auction organizers, and supervisory agencies, as well as consumer education to improve legal literacy. With these measures, it is expected that the online auction system in Indonesia can become more fair, safe, and transparent, and can provide maximum protection for consumers.
