Abstract

Pendidikan merupakan upaya terstruktur untuk membekali peserta didik agar dapat menjalani kehidupan yang lebih berkualitas. Salah satu dasar dalam proses pendidikan itu adalah pembentukan karakter atau character building. Karakter yang dimaksud adalah sifat, tabiat, watak, dan kebiasaan yang melekat pada diri seseorang. Secara umum, karakter dapat juga disebut sebagai akhlak, moral, dan etika. Hal itu sama-sama mengacu kepada seluruh perilaku seseorang di dalam kehidupan sehari-hari yang meliputi ucapan dan tindakan nyata. Lembaga yang sangat efektif di dalam pembentukan dan pengembangan pendidikan karakter adalah Pesantren. Santri sebagai peserta didik di Pesantren akan dibentuk dan dikembangkan karakternya melalui suatu proses yang terus-menerus selama berada di Pesantren. Pendidikan Karakter diperoleh melalui tiga hal utama, yaitu bahan ajar, proses pengasuhan dan pengajaran, serta keteladanan Kyai dan para dewan pendidik. Bahan ajar meliputi bahan yang meliputi bidang akidah atau dasar-dasar keagamaan; fiqh sebagai panduan untuk ibadah; serta akhlak yang menanamkan perilaku yang prima dalam hidup. Proses Pendidikan, pengajaran, dan berbagai kegiatan secara ketat merupakan pengasuhan dan penanaman kemandirian, semangat menuntut ilmu, serta kepribadian yang tangguh. Keteladan Kyai  dalam seluruh aspek kehidupannya di dalam keilmuan, ibadah, dan keikhlasan dalam memimpin dan mengasuh para santri. Upaya penguatan pendidikan karakter sangat diperlukan untuk memberikan keyakinan bahwa pendidikan pesantren tradisional memiliki keunggulan komparatif di tengah arus modernisasi yang tidak terbendung perkembangannya.

Abstract

Kegiatan PPM yang dilakukan berjudul “Edukasi Pelestarian Warisan Budaya bagi Masyarakat Kampung Dukuh Desa Ciroyom Kecamatan Cikelet Kabupaten Garut”. Kegiatan PPM yang dilaksanakan merupakan bagian integral dari riset berjudul Kehidupan Religi (Agama) Masyarakat Sunda di Jawa Barat. Kegiatan PPM ini memiliki tujuan untuk memberikan pemahaman kepada masyarakat Adat Kampung Dukuh. Salah satu hal yang melatarbelakangi kegiatan PPM ini ialah generasi muda di sekitar Kampung Dukuh belum memahami dengan baik berbagai regulasi yang terkait dengan pelestarian budaya. Di samping itu, selama ini tidak ada upaya terstruktur yang mengisi kekosongan nilai-nilai di dalam pengembangan masyarakat ini karena tampaknya tidak terjangkau oleh pihak otoritas yang memiliki kewenangan pengembangan dan pemberdayaan masyarakat tradisi. Setelah kegiatan ini dilakukan diharapkan generasi muda di Kampung Adat Dukuh mengetahui dan memahami regulasi yang berkaitan dengan pelestarian budaya. Selain itu diharapkan pihak otoritas yang memiliki kewenangan pengembangan dan pemberdayaan masyarakat tradisi dapat menjangkau Masyarakat Adat Kampung Dukuh sebagai bagian dari pelestari warisan budaya di Jawa Barat khususnya dan Indonesia umumnya.

Abstract

This research will explain about the text of Sulwān al-Nā’i Fī al-Fi‘l al-Wāwī wa-al-Yā’ī. The text of Sulwān al-Nā’i Fī al-Fi‘l al-Wāwī wa-al-Yā’ī was being found from the King Saud University online collection. The text was written by Muḥammad al-Hajrusī in 1300 H. While the research itself uses the analytic descriptive method, which the steps are related to its step on philology research, by then we can get the certain data from the object that being describe clearly. This Sulwān al-Nā’i Fī al-Fi‘l al-Wāwī wa-al-Yā’ī text is containing fi‘il (Arabic verbs) wāw and yā’ vocabularies which are well arrangement by their Hijā’īyah alphabet. The research shows that the text of Sulwān al-Nā’i Fī al-Fi‘l al-Wāwī wa-al-Yā’ī giving the information about 133 vocabularies of fi‘l and yā’. On its handwriting, Muhammad al-Hajrusī gave the example on the form of a sentence (kalimah mufidah). The writer hopes that the research will give many benefits to all communities and also can be a reference for a philology and linguistics discussion.

Abstract

This study discusses the application of translation methods and strategies in the subtitles of the film Ar Risalah from Arabic to Indonesian. The film Ar Risalah is a religious film that tells the story of the life of the Prophet Muhammad SAW, which has strong historical and cultural values. This study aims to identify the methods and strategies used in translating dialogue sentences in the film's subtitles. Using a qualitative descriptive research method, data were collected through direct observation of the film's dialogue. The researcher classified the translation methods based on Newmark's theory and translation strategies from Pamungkas and Akmaliyah. The results of the study showed that there were seven translation methods used, namely word-for-word, literal, faithful, semantic, adaptation, free, and idiomatic translation. In addition, there were four translation strategies, namely prioritizing and ending, reducing, adding, and replacing. These findings indicate that translators must consider lexical, contextual, and cultural aspects in producing translations that are communicative and in accordance with the target language. This study provides in-depth insight into the complexity of the film translation process, which is expected to be a reference for subtitle translators in the future.

Abstract

Health services in Bengkulu Province are still very limited due to the lack of transportation and infrastructure conditions, the number of FKTP (First Level Health Facilities) is still in the category of insufficient, the number of specialist doctors is still very limited, one of which is the case in Rejang Lebong Regency. This is certainly the main problem as well as the root of the problem of the National Health Insurance (JKN) programme services in Rejang Lebong Regency. As an initial finding, there is a legal vacuum in the absence of an umbrella of main laws and regulations at the level of Regional Regulations (Perda). The second is related to legal disharmony, as the existing Regent Regulations have not comprehensively followed the mandate of the regulations above them. This research is an empirical juridical research, aimed at examining and knowing what efforts can be made to strengthen the regional laws and regulations of Rejang Lebong Regency to optimise the achievements of the National Health Insurance (JKN) program based on a review of maqasid sharia and legal justice theory. This research is descriptive analysis, focusing on the analysis of regulations within the scope of the problem theme, trying to harmonise the conditions of JKN service policy regulations that should be established in Rejang Lebong based on the conditions and needs of the Rejang Lebong community. The results of the research found, with a study from 2014 to 2020, found 3 obstacles that inhibit the optimal achievement of the JKN KIS program, the first is the apathy of the community, especially PBI APBN and PBI APBD, the second is the lack of encouragement from stakeholders and interests in socialisation efforts and continuous introduction to the community, the third is that the existing regulations are still experiencing lacunae and disharmony, this is a cause that plays a central role in the failure to optimise the JKN KIS program in Rejang Lebong Regency. Efforts that can be made are to form new local regulations, revise existing Regent Regulations and add Regent Regulations to strengthen local regulations which are the main legal umbrella which certainly prioritises the value of the benefit of the soul (hifz al-nafs) and the benefit of the mind (hifz al-aql).

Abstract

The Purpose of this research is to find a formula for harmonizing, consolidating, and refining the concept of draft laws. Harmonization activities are based on policy formulation (regulation system) and material harmonization (substance), with the aim of adjusting the existing national legal system to the new legal system, creating a harmonious law as a positive law (harmony of law). The plural nature of the places where harmonization, consolidation, and refinement of the concept of draft laws occur are the Indonesian House of Representatives (DPR) - Committee on Legislation (Baleg), the Government - Ministry of Law and Human Rights (Depkumham), and the Regional Representative Council (DPD) - Committee on Legislation and PPUU. This makes the practice of harmonization have different interpretations from each institution, which highlights the need for agreement among these institutions in determining standardization in harmonization, consolidation, and refinement of the concept of draft laws. Furthermore, an analysis is needed to determine the appropriate time for harmonization, consolidation, and refinement of the concept of draft laws, whether it should be done before submitting the bill as is currently done, or after discussions are completed, or both before and after. Therefore, it is necessary to investigate the effectiveness of the implementation of the activities of harmonizing, consolidating, and refining the concept of draft laws to minimize the filing of judicial reviews at the Constitutional Court.

Abstract

  Amnesti dan abolisi merupakan hak prerogatif Presiden sebagaimana diatur dalam Pasal 14 ayat (2) UUD NRI Tahun 1945. Kewenangan ini menjadi instrumen politik hukum yang dapat menghapus sifat pidana (amnesti) maupun menghentikan penuntutan (abolisi) dengan pertimbangan Dewan Perwakilan Rakyat (DPR). Namun, dasar hukum yang berlaku hingga kini masih bersandar pada Undang-Undang Darurat Nomor 11 Tahun 1954, yang secara historis lahir dari konteks politik darurat dan sudah tidak relevan dengan sistem hukum modern. Penelitian ini menggunakan pendekatan yuridis-normatif dengan menelaah ketentuan konstitusi, peraturan perundang-undangan, serta praktik pemberian amnesti dan abolisi dalam kasus Hasto Kristiyanto dan Tom Lembong. Hasil kajian menunjukkan bahwa meskipun pemberian amnesti dan abolisi sah secara konstitusional, penerapannya pada kasus tindak pidana korupsi berpotensi melanggar prinsip equality before the law sebagaimana dijamin dalam Pasal 27 ayat (1) UUD 1945, serta melemahkan integritas sistem peradilan. Oleh karena itu, diperlukan rekonstruksi pengaturan melalui pembatasan agar amnesti dan abolisi tidak berlaku bagi tindak pidana luar biasa, kewajiban menunggu putusan inkracht, serta penguatan mekanisme checks and balances melalui DPR, Mahkamah Agung, dan partisipasi publik. Dengan demikian, hak prerogatif Presiden tetap berada dalam koridor hukum, mencegah kesewenang-wenangan, dan menjaga komitmen pemberantasan korupsi.

Abstract

Abstract: An understanding of the rights and efforts that civil servants can take in facing employment disputes arising from the imposition of disciplinary punishment of civil servants, needs to be improved in order to avoid the act of arbitrariness (or willekeur) or action beyond the authority (ultra vires) conducted by the organ of state administrative office. The mechanisms and stages of dispute resolution in the field of personnel, has a variety of channels based on disciplinary violations committed, types of sentences handed down, and the level of position of officials who are authorized to punish. These channels, some through the Administrative Objections and Administrative Appeals. If only through Administrative Objection, then the next stage is the filing of a lawsuit to the State Administrative Court, whereas if the stages are through Administrative Appeals, the first level lawsuit shall be submitted to the Administrative High Court as a first instance court.

Abstract

The presence of concept positive fictitious decision in the Laws Of Administration of Government is an attempt to fight maladministration in the field of public service. In order to decision of positive fictitious get the laws power, Based on Laws Adpem should be applied for the determination to PTUN through lawsuit voluntair. Lawsuit voluntair is lawsuit petition affirmation of a right in the absence of other parties that made opponents (ex parte). If Lawsuit voluntair was granted by PTUN without the presence of the defendant, it could have voluntair lawsuit that originally expected to provide protection to the public, even cause new problems, For example court decision was contrary to the laws and regulations or prejudice the others. To avoid erroneous determination, then the judge in the lawsuit voluntair examination should be careful and cautious. The judge should instruct the defendant to attend and asked for information, although only as a witness and not as opponent. Furthermore, voluntair lawsuit could not be filed due to the passive attitude of the agency or government officials on a request for cancellation of the concrete decisions.

Abstract

Through the amandement of UUD 1945, it was estabilished a Regional Refresentataives Council or Senate (DPD) beside the Legislative Council or House of Refresentative (DPR). However, the establishing of DPD less to lead the significant changes, it is caused by the limitation of its authority. The limitation of DPD authority has been regulated be fore in UUD 1945. The limitation of DPD authority in legislative side, DPD is not involved to approve the constitution design (RUU) which is inline with the regional authority eventhough the constitution design proposed by DPD, in funding side DPD only has right to consider, mean while on controlling side, all of it controls must be reforted to DPR to be followed up. The asimetric relationship does not reflect the check and balances system in parliament. It is contradicted with the principle of democracy that recuires the functioning of parliament as the refresentatives institution. If it is happen, can caese arrogant, dominant, and the authority monopoliezed by majority groups in DPR. The regulation of DPD authority in the future can be done through the amandemen of UUD 1945. DPD should be gevin the veto right in legislation, and interppelation right, questionnaire and the state the opinion in controlling side. With these right, it is hoped that DPD can become the counterpart for DPR dan President in the paradigm of check and balances, so DPD can its function as regional refresentative productively for strengthening the principle of regional autonomy.
