Abstract

AbstrakPenelitian ini difokuskan pada model penyelesaian konflik kewenangan terhadap timbulnya dampak dumping limbah batu bara studi kasus pada Pemerintah Kota (Pemkot) Bengkulu dengan Pemerintah Kabupaten (Pemkab) Bengkulu Tengah: pertama, bagaimana dampak kerusakan yang terjadi akibat dari pencemaran di daerah hilir aliran Sungai Bengkulu; kedua, bagaimana tindakan pencegahan yang dilakukan terhadap perluasan dampak pencemaran bagi perusahaan di daerah hulu sungai Bengkulu; dan ketiga, bagaimana konsep ideal pencegahan perluasan dampak pencemaran yang seharusnya dilakukan oleh Pemerintah Provinsi Bengkulu. Penelitian ini menggunakan pendekatan normatif-sosiologis, menggunakan data hasil studi lapangan, dan melakukan studi kepustakaan. Studi ini menyimpulkan bahwa: pertama, ada beberapa dampak yang diakibatkan dari pencemaran limbah batu bara, diantaranya dampak terhadap kerusakan ekosistem sungai, dampak terhadap kondisi air (PDAM Kota Bengkulu), efek domino yang terjadi di hilir sungai, dan dampak terhadap estetika lingkungan; kedua, tindakan pencegahan yang dilakukan terhadap perluasan dampak pencemaran bagi perusahaan di daerah hulu Sungai Bengkulu masih terbatas pada instrumen perizinan saja, tidak menitikberatkan pada pengawasan yang lebih ketat; ketiga, konsep ideal pencegahan perluasan dampak pencemaran yang seharusnya dilakukan adalah dengan melibatkan berbagai pihak terkait, seperti pemerintah, masyarakat, dan stakeholder yang dimotori oleh pemerintah provinsi karena konflik kewenangan ini menyangkut dua wilayah administratif yang berbeda.Kata Kunci: konflik kewenangan, dampak dumping, pencemaran lingkungan, kerusakan ekosistem sungai, limbah batu bara. Conflict of Authority Resolution Model in Case of Emergence of Coal Dumping Effect: Case Study on Bengkulu Municipality Government and Bengkulu Regency GovernmentAbstractThis study focuses on authority conflict resolution model concerning the impact of coal waste dumping—case study on the Bengkulu Municipality Government and Bengkulu Regency Government: first, what is the damage caused by pollution in the river downstream of Bengkulu; second, what are the precautions against the impact of the expansion of the companys pollution in the headwaters area of Bengkulu; and third, what is the ideal concept of prevention of the expansion of pollution impact that should have been conducted by the Government of Bengkulu Province. This research utilizes sociological-normative approach, using data from field and literature. Studies conclude that, first, there are several impacts of coal waste pollution - including impact on river ecosystem, impact on water conditions (PDAM Bengkulu), a domino effect which occurs in the lower river, as well as aesthetic impact on the environment; second, the precautions taken against the expansion of the environmental impact by companies in the upstream areas of Bengkulu are still limited only to the licensing instrument, while disregarding not stricter supervision; third, the most ideal concept to prevent the expansion of pollution should be one that involves various parties such as governments, communities, and stakeholders led by the provincial government; since authority conflict involves two different administrative regions.Keywords: conflict of authority, impact of dumping, environmental pollution, the damage of river ecosystem, coal waste.DOI: https://doi.org/10.22304/pjih.v1n2.a6

Abstract

Mining activity permit system would be the most urgent and most of its functions in maintaining the implementation of processing and protection of the environmental in Indonesia. For that purpose, it is expected the strengthening of the role of government, especially the local government as the owner of the mine producing areas. The ultimate goal of this course is for the benefit of mankind itself, society, state and nation of Indonesia. The permit system is desired able to preserve the rights of society as residents who has a wealth of space mining jurisdictions in general and the affected local communities in particular. After that the legality of permit system must have a strong substance of legal material used to be able to accommodate the interests and rights owned by the public. It is necessary to strengthen the quality of permits issued by the Regional Government in terms of safeguarding the rights of society-rich regions.

Abstract

Political Law is one of the discourses that control the existence of law.One of the realm of law that has recently received the spotlight and serious attention. Particularly related to the legal political option is the environment law that increasingly strong day include criminal law enforcement in law enforcement. There are some weak things that then have negative implications, against the enforcement of environmental laws related to the lack of cautious political choice. Since 1982 in Law No. 4 of 1982 on the Principles of Environmental Management which was changed in 1997 into Law No. 27 of 1997 on Environmental Management, the legal politics of criminal law policy has been conducted, that the criminal law policy in the realm of the environment is already a choice of legal politics in the realm of environmental law. Law Number 32 Year 2009 About PPLH as the latest generation, adds Chapter XV of the Criminal Code in its charge of 23 Articles. Law Number 32 Year 2009 contains a much more complete criminal provision than Law Number 23 Year 1997. Although there is still much to be fixed on the provisions of Law Number 32 Year 2009. Base on research shows that there are special procedural laws that regulate formal law enforcement. It is based on the principle of ultimum remedium which means that the implementation of the criminal law must wait until the effectiveness of administrative law is upheld. To minimize obstacles in enforcing environmental laws which are sometimes used by political elites to seek profit, formal laws against environmental crimes should be set up specifically with the Act.

Abstract

This study examines the Code of Hammurabi, an ancient legal code that dates to early human history, to investigate its old legal ideas and evaluate their ongoing significance in contemporary legal systems. This study seeks to clarify the fundamental concepts that underlie Hammurabi's rules and their lasting influence on modern legal thinking by conducting a thorough investigation of the Code's provisions and historical background. This research aims to provide significant insights into the development of legal norms and their application in addressing current legal difficulties by analyzing important elements such as justice, equity, and societal order as outlined in the Code. This study examines the degree to which Hammurabi's legal ideas align with contemporary legal frameworks. It provides insightful analysis on the lasting significance and flexibility of ancient legal precedents in creating modern legal jurisprudence. This research enhances our comprehension of the historical origins of law and its enduring importance in contemporary legal discussions.

Abstract

Negara Indonesia menganut sistem demokrasi, wujud kongkrit berjalannya sistem demokrasi salah satunya ialah pelaksanaan pemilihan pemimpin dengan secara langsung untuk mengisi jabatan publik. Praktik mahar partai politik merupaka salah satu fenomena permasalahan hukum yang sangat menarik untuk diteliti. Karena politik dianggap menjadi pintu awal karut marutnya pemerintahan di Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana praktik mahar partai politik dalam pemilihan kepala daerah yang terjadi dan bagaimana tinjauan fiqih siyasah mengenai praktik mahar partai politik tersebut. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach) data yang digunakan berfokus pada data sekunder dan dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukan pengaturan dan sanksi terhadap mahar politik diatur dalam Undang-undang Nomor 6 Tahun 2020 tentang Pemilihan Gubernur, Bupati dan Walikota, akan tetapi kata mahar politik dan pembatasan pemberiannya tidak secara rinci dijelaskan. Di dalam perundang-undangan istilah mahar politik dipersamakan dengan kata imbalan. Sementara mahar politik dalam tinjauan fiqh siyasah termasuk ke dalam risywah. Pemberian mahar politik jelas di haramkan dan dilarang dalam hukum Islam. Kegiatan politik bekerjasama dalam hal keburukan atau kejahatan bertentangan dengan norma agama. The Indonesian state adheres to a democratic system, one of the concrete manifestations of the running of the democratic system is the implementation of direct elections of leaders to fill public positions. The practice of political party dowry is one of the phenomena of legal issues that are very interesting to study. Because politics is considered to be the starting point for the chaotic government in Indonesia. This research aims to find out how the practice of political party dowries in regional head elections occurs and how fiqih siyasah reviews the practice of political party dowries. This research is a normative juridical research using a statute approach and conceptual approach. The data used focuses on secondary data and is analysed descriptively qualitatively. The results of this study show that the regulation and sanctions against political dowries are regulated in Law Number 6 of 2020 concerning the Election of Governors, Regents and Mayors, but the word political dowry and restrictions on its provision are not explained in detail. In the legislation, the term political dowry is equated with the word reward. Meanwhile, political dowry in the review of fiqh siyasah is included in risywah. The provision of political dowries is clearly forbidden and prohibited in Islamic law. Political activities cooperate in terms of badness or evil contrary to religious norms.

Abstract

Health services in Bengkulu Province are still very limited due to the lack of transportation and infrastructure conditions, the number of FKTP (First Level Health Facilities) is still in the category of insufficient, the number of specialist doctors is still very limited, one of which is the case in Rejang Lebong Regency. This is certainly the main problem as well as the root of the problem of the National Health Insurance (JKN) programme services in Rejang Lebong Regency. As an initial finding, there is a legal vacuum in the absence of an umbrella of main laws and regulations at the level of Regional Regulations (Perda). The second is related to legal disharmony, as the existing Regent Regulations have not comprehensively followed the mandate of the regulations above them. This research is an empirical juridical research, aimed at examining and knowing what efforts can be made to strengthen the regional laws and regulations of Rejang Lebong Regency to optimise the achievements of the National Health Insurance (JKN) program based on a review of maqasid sharia and legal justice theory. This research is descriptive analysis, focusing on the analysis of regulations within the scope of the problem theme, trying to harmonise the conditions of JKN service policy regulations that should be established in Rejang Lebong based on the conditions and needs of the Rejang Lebong community. The results of the research found, with a study from 2014 to 2020, found 3 obstacles that inhibit the optimal achievement of the JKN KIS program, the first is the apathy of the community, especially PBI APBN and PBI APBD, the second is the lack of encouragement from stakeholders and interests in socialisation efforts and continuous introduction to the community, the third is that the existing regulations are still experiencing lacunae and disharmony, this is a cause that plays a central role in the failure to optimise the JKN KIS program in Rejang Lebong Regency. Efforts that can be made are to form new local regulations, revise existing Regent Regulations and add Regent Regulations to strengthen local regulations which are the main legal umbrella which certainly prioritises the value of the benefit of the soul (hifz al-nafs) and the benefit of the mind (hifz al-aql).

Abstract

Authority is the power of govermment agencies and/or officials or others state administrators to act in the realm of public law. 1)what is the authority of the governor of bengkulu in revoking the mayor of bengkulu regulation no 43 of 2019 regarding the classification of the basic value of land and buildings as the imposition of a free for acquiring land and building rights. 2)The basic value of land and buildings as the basis for the imposition of fees for acquisition of land and building rughts. This type of research using a qualitative approach method. Data collection was carried out by means of interviews and documents from the regional govermment of bengkulu province. The results of the research are 1) the authority to repeal the mayor’s regulated in law no 23 of 2014, government regulation number 33 of 2018 and technically is authority is regulated in minister of home affairs regulations no 120 of 2018. 2) The Decree of the Governor of Bengkulu Number T.516.B.2 of 2021 concerning the Cancellation of the Mayor of Bengkulu Regulation Number 43 of 2019 concerning the Classification of the Basic Value of Land and Buildings as the Imposition of Fees for the Acquisition of Land and Building Rights is valid or invalid as regulated in Article 52 of the Law Number 30 of 2014 concerning Government Administration As amended by Law Number 11 of 2020 concerning Job Creation. Which in the law regulates the legal requirements of a decision which states the legal requirements for a decision are determined by an authorized official, made according to procedures, and the substance is in accordance with the object of the decision.

Abstract

This research examines the urgency and challenges of eradicating foreign bribery in Indonesia, utilizing the perspective of Islamic law as an ethical and moral framework. Although Indonesia has committed to the eradication of corruption through ratification of the United Nations Convention against Corruption (UNCAC) and participation in the G20 Anti-Corruption Working Group, the persistence of a stagnant Corruption Perception Index (CPI) score and the absence of specific regulations on foreign bribery indicate a gap between international commitments and domestic implementation. Through a normative legal method, this research analyzes the legal framework and corruption eradication practices in comparison to the principles of fairness, transparency, and accountability in Islamic law. The results show that there are significant gaps in the regulation and practice of combating corruption, especially in relation to combating foreign bribery. This research recommends reforming regulations that not only meet international standards but also accommodate ethical and moral values from Islamic law, as well as emphasizing the importance of international cooperation based on the principle of solidarity in goodness. Efforts to eradicate foreign bribery in Indonesia require a comprehensive approach, combining legal reform, integration of Islamic values, and strengthening international cooperation, to increase the effectiveness of the fight against corruption and strengthen integrity and public trust.

Abstract

This research seeks to explore the divine values in the development of legal science through the lens of the philosophy of science. In the context of humans as social beings created by the Almighty God, law functions as a normative guide to achieve justice and regulate social interactions. This research focuses on two main issues: the influence of divine values on the formation and development of legal science, and the integration of these values to create a balance between legal certainty, utility, and justice. This study employs a qualitative approach using historical and analytical methods. The type of research is a literature study. This research utilizes primary legal materials such as books, scholarly articles, previous academic studies, and other documents discussing divine values, the philosophy of science, and their relationship with legal principles such as justice, utility, and legal certainty. Subsequently, all obtained data is analyzed through qualitative analysis. The findings indicate that divine values play a crucial role in shaping a divinely-oriented legal paradigm that not only prioritises the formal aspects of law but also the moral and spiritual values derived from religious teachings. From this perspective, law is understood as a manifestation of universal divine values, with Pancasila serving as the epistemological framework that ensures the integration of moral principles within Indonesian law. Furthermore, divine values can create harmony between legal certainty, utility, and justice, where the concept of justice is emphasised to be not merely formal but also substantive, reflecting social justice and human dignity as creations of God. This research underscores the importance of divine values as a foundation in the development of legal science that is adaptive to the social dynamics of society.

Abstract

This study examines the relationship between customary law communities and the ideology of Pancasila within Indonesia’s legal philosophy. Article 18B Paragraph (2) of the 1945 Constitution affirms state recognition of customary law communities and their long-standing social, legal, and cultural systems. However, challenges persist in integrating customary law into the national legal framework, including normative disparities and conflicts of interest. Using a normative juridical method with philosophical, statutory, and case approaches, and drawing on secondary data through literature review, this research finds that the intersection between legal philosophy and Pancasila reflects the value of social justice. Pancasila provides a philosophical and constitutional foundation for recognising and protecting customary law communities while promoting national unity and sustainable development, thereby affirming its role in upholding diversity, justice, and humanity.
