Abstract

This article examines the prevalence of child marriage in South-Sulawesi Indonesia including people’s perceptions and its factors contributing to child marriage and the use religion to justify their actions. They perceive child marriage as the marriage conducted prior to the age of 16 for woman and of 19 for man as stipulated in the Marriage Law No.1 of 1974, as well as the marriage before ‘akil balig’. Various determinants for child marriage are cultural norms or values of ‘siri’ (shame) for family honour; family prestige and kinship; uneducated parents; economic burden for family and inconsistency in legislation. No religious teachings or Islamic Law clearly support the prevalence of child marriage because the purpose of marriage in Islam is to perform a happy and harmonious relationship among the couple. The use of the Prophet Muhammad’s marriage to Aisha in the age of six as the fundamental basis for child marriage is unjustified.[Tulisan ini membahas kasus-kasus pernikahan anak di Sulawesi Selatan, termasuk persepsi masyarakat dan faktor-faktor pendukungnya diantaranya penggunaan dalil agama (Islam) untuk membenarkan tindakan tersebut. Masyarakat memahami pernikahan anak sebagaimana tercantum dalam UU Pernikahan No. 1 Tahun 1974 bahwa pernikahan anak terjadi pada usia dibawah 19 tahun bagi laki-laki dan 16 tahun bagi perempuan dan atau mereka yang belum akil balig’. Beberapa factor dominan dalam pernikahan anak antara lain; norma adat lokal (‘siri), kehormatan keluarga dan kerabat, orangtua yang kurang terpelajar, beban ekonomi keluarga dan ketidakkonsisten penegakan peraturan. Pada dasarnya tidak ada ajaran Islam atau fiqih yang secara tegas mendukung pernikahan anak karena tujuan dari pernikahan dalam Islam adalah kebahagiaan dan keharmonisan hubungan antar suami istri. Menggunakan rujukan pernikahan Nabi Muhammad dengan Aisyah saat usia enam tahun merupakan perkara yang tidak bisa dibenarkan.]

Abstract

This research aimed to analyze the relevance of dismissal of friday prayers in circular letter of south sulawesi governor number: 451.11 / 2057/2020 during covid-19 pandemic from the perspective of maqāṣid al-syarī’ah. This research is library research using a qualitative approach and content analysis techniques. The results of the research conclude that the substance of the circular letter is relevant to the principle of maqāṣid al-syarī’ah which is the core philosophy of the formation of Islamic law in presenting the benefit of mankind in the world and the hereafter, both from the aspect of maqāṣid al-kulliyyah (universal) and maqāṣid al-juz'iyyah (partial) especially maqāṣid in obeying a leader. Therefore, the emergence of the phenomenon of counter attitudes from some people and even preachers towards the policy should not occur.

Abstract

This paper analyzes the distinction of Islamic law in Indonesia as a role model of Indonesian Islam (Islam Nusantara). The underlying question is that what are the disticntions of Indonesian Islamic law which can be a role model for Indonesian Islam. The purpose of this paper is to identify the characteristics of Islamic law in Indonesia as well as to elaborate the distinctiveness of Indonesian Islam as a role model. It is showed that Islamic law in Indonesia has been well integrated into Indonesian culture and Indonesian legislations. Indonesian Islam (Islam Nusantara) initiated by Nahdatul Ulama shows its capacities to accommodate local wisdom (culture) and Islamic law, so that there is no conflict among them. It is peaceful, pluralistic and egalitarian approach, and there will be ‘role model’ for Islamic civilization.

Abstract

Among the narrative based exegesis books is Jami 'al-Ayy Bayan'an ta'wil al-Qur'an, better known as the exegesis of Ibn Jarir al-Thabariy, which identified with his name: Abu Ja'far Muhammad ibn Jarir ibn Yazid ibn Kathir ibn Ghalib al-Thabariy (224-310 H). This book is the first monumental work in early development of the Qur’anic interpretation and has been a main reference for commentators up to the present time. In fact, it is regarded as an unmatched encyclopedia in its field. How this book explores the chapter al-Fatihah makes the subject matter discussed in this article. The article analyzes the methods of interpretation used by al-Thabary in interpreting the chapter al-Fatihah through an exegesis approach, and comes up, through a critical content analysis, with results indicating that the structure of interpretation applied by al-Thabary in interpreting the chapter al-Fatihah is narrative (bi al-ma'tsur), while the method used is analytical (tahlily), and the style of analysis is socio-civic (adab-ijtima'iyi). Al-Thabary’s interpretation looks different from other commentators’ tradition not only for its being moderate in interpreting every phrase from the chapter al-Fatihah, but also for its relatively thorough exploration of different reading methods (qira'ah) have ever been applied for the chapter al-Fatihah.

Abstract

There are many factors which are quite influence to the consumers in deciding whether or not to buy at a certain retail store, among others are: internal factors of the consumers such as culture, social class, individual characteristics, and psychological factors.  In addition to those factors, decision to buy is also influenced by marketing mix which are carried out by a company, such as:  products, prices, distribution channels, promotion, people, process, and physical facilities. The objective of this study is to reveal the influence of internal factors of the consumers and marketing mix on the decisions made by the consumers to buy at “JM Group” of Palembang. This study was conducted by surveying 120 respondents. The technical analysis used is multiple regression analysis.The result of the study shows that: (1) Internal factors of the consumers are significantly influence on the decisions made by the consumers to buy at “JM Group”. The magnitude of the influence of those internal factors is determined by the dimensions of cultural factor, social class, individual factors and psychological factors; (2) Marketing mix are significantly influence on the decisions made by the consumers to buy at “JM Group”. The magnitude of the influence of combined performances of marketing is determined by the dimensions of product, prices, places, promotion, people, process and physical facilities;  and (3) The internal factors of the consumers and  marketing mix are significantly influence on the decisions made by the consumers to buy at “JM Group”.  This means that if the internal factors of the consumers change and marketing mix can be effectively implemented, the decision to buy is going to improve.Keywords: Consumer Internal Factors, Marketing Mix, Decision to buy

Abstract

The focus of this research is to reveal the method of istinbath jamaah al nadzir law in determining the beginning of the month. The method research is used descriptive with a qualitative approach. Data was collected by interview to the leadership of jamaah al-nadzir and jamaah al-nadzir society. Prophet bequeathed early determination method can be determined by methods rukyah (saw) and hizab (counting) months. The results showed that jamaah al-nadzir determine the beginning of the month with rukyah method (see) and hizab (counting) in contrast to a predetermined previous scholars. Leaders of jamaah al-nadzir is an absolute determinant beginning and end of the month to see some of them looking directly lunar and see the sea level at high tide and low tide.

Abstract

Terminologically, the term of terrorism is not found in Islamic knowledge treasures. However, terrorism as an action has occurred along the Muslim history. This writing tries to trace concepts that contain meanings of terrorism in Islamic law. Examples of the concepts are al-irhâb (irhâbiyyah), al-hirâbah (robbery), al-baghy (rebellion), qâthi‘ al-tharîq or quththâ‘ al-tharîq (hijacking), and al-‘unf (an antonym of gentleness). Actions meant in such concepts are categorized as terrorism because they bear violence, cause people’s panic, material and physical damage, and have political aims. Such terror actions, even if they are committed based on Jihad order, such as murder, hijacking, bombing, robbery and intimidation are forbidden and can not be legitimized because they are contradictory to Islamic teachings which forbid acts of damaging in the earth, to the principles of al-dlarûriyyât al-khams (preserving five human basic needs), humanity, justice and deliberation in Islam.

Abstract

Pertimbangan hukum hakim dalam menjatuhkan putusan terhadap tindak pidana illegal logging di kawasan konservasi hutan didasarkan pada beberapa unsur untuk menetapkan putusan akhir yang akan diambil. Menurut Pasal 88 ayat 1 huruf b Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan, telah dijelaskan secara rinci beserta dengan keterangan saksi merujuk kepada fakta-fakta bahwa terdakwa tidak bersalah. Namun pertimbangan hakim memiliki kekeliruan disebabkan hakim dalam mempertimbangkan kasus tersebut tidak sesuai dengan ketentuan dan fakta-fakta di persidangan yang berlaku ditambah dalam fakta yang terjadi dilapangan yang menunjukkan seharusnya terdakwa tidak diputus bersalah karena terdakwa tidak mengetahui keabsahan surat atau dokumen kayu yang terdakwa beli dari orang lain yang mengakibatkan penipuan yang dialami oleh terdakwa.

Abstract

Visum et repertum peranan penting alat bukti visum et repertum adalah sebagai alat bukti surat, dan sebagai alat bukti surat mempunyai kekuatan sama dengan alat bukti yang lain, dan visum et repertum dianggap penting tapi tidak mutlak ada visum et repertum dalam kasus penganiayaan, kecuali dalam kasus tertentu dan Pertimbangan Hakim dalam menjatuhkan putusan dalam perkara No.1612/Pid.B2018/PN.Mks, telah sesuai dengan peraturan perundang-undangan yang berlaku. Dimana putusan yang dijatuhkan berdasarkan alat bukti berupa keterangan saksi, visum et repertum, keterangan terdakwa, sehingga membuat terdakwa patut dijatuhi hukuman/pidana. Selain itu fakta-fakta yang diperoleh selama persidangan dalam perkara ini. Majelis Hakim mengemukakan hal-hal pada diri terdakwa dan atau pada perbuatan terdakwa yang dapat dipertanggungjawabkan dan dinyatakan bersalah menurut hukum dan harus dijatuhi pidana yang setimpal dengan perbuatan terdakwa sehingga tidak ada hal-hal yang dapat melepas terdakwa dari pertanggungjawaban pidana,baik sebagai alasan pembenar atau alasan pemaaf, oleh karenanya Majelis Hakim berkesimpulan bahwa perbuatan yang dilakukan oleh terdakwa harus dipertanggungjawabkan kepadanya, agar biasa memberikan efek jera dan dikemudian hari tidak melakukan hal yang sama.Kata Kunci: Penganiayaan, Visum et Repertum
