Abstract

This study aims to provide solutions and knowledge to legal protection, especially in ownership of land rights in performing housing benefit sharing agreements in Pekanbaru City, in addition, this study also aims to find out the application of such legal protection to land ownership rights by sharing the proceeds of such housing. It is expected that there will be no more intersections of legal certainty about housing sharing agreements among communitiesThe type of research used by the authors is the Normative Law method, As for the result of this study, the legal protection related to ownership of land rights in the housing sharing agreement specifically in the city of Pekanbaru can refer to Article 1338 paragraph (3) of the Civil Code, which says that the agreement must be executed in good faith, Where the deed of construction agreement containing the rights and obligations of the parties is a deed made in front of a notary that is authentic so that in the presence of such an agreement it becomes a law among them, whereas in its specific application in Kota Pekanbaru Land division cooperation is carried out according to the principle for units, the share of land owners in the form of ownership of house units with a certain percentage, as well as the developer also gets a share of the number of units according to the agreement. The size of each party's share depends on the price of the house unit. Where the higher the price of the house, the greater the share of the owner of the land, so that the parameters of its division correspond to the agreement promised in advance.

Abstract

Sosialisasi dan pelatihan kewirausahaan merupakan langkah strategis dalam menumbuhkan jiwa kewirausahaan serta menggali ide usaha baru di kalangan masyarakat. Penelitian ini bertujuan untuk mengevaluasi efektivitas program sosialisasi dan pelatihan kewirausahaan dalam meningkatkan pemahaman dan keterampilan peserta dalam memulai serta mengembangkan usaha. Metode yang digunakan meliputi sosialisasi konsep dasar kewirausahaan, pelatihan berbasis praktik, serta monitoring dan evaluasi perkembangan peserta. Hasil penelitian menunjukkan bahwa program ini mampu meningkatkan kesadaran dan kepercayaan diri peserta dalam merintis usaha baru. Selain itu, peserta juga berhasil mengembangkan berbagai ide bisnis yang inovatif dan aplikatif. Faktor utama yang mendukung keberhasilan program ini adalah metode pelatihan yang interaktif dan berbasis studi kasus nyata. Meskipun demikian, beberapa tantangan seperti keterbatasan modal dan kebutuhan akan pendampingan lanjutan masih menjadi kendala yang perlu diatasi. Kesimpulan dari penelitian ini adalah bahwa sosialisasi dan pelatihan kewirausahaan memiliki dampak positif dalam membangun ekosistem kewirausahaan yang lebih kuat dan berkelanjutan. Diperlukan pengembangan model pelatihan yang lebih komprehensif serta kolaborasi dengan berbagai pihak terkait untuk memastikan keberlanjutan program ini.

Abstract

This research aims to determine the implementation of the principles of justice and supervision of consumer protection in protecting consumers who use whitening cream cosmetic products (from the perspective of legal justice theory). The urgency of this research was initiated because many whitening cream products are circulating that contain dangerous ingredients and are sold at low prices. The research involved takes a juridical-normative approach. Techniques for data collection include literature studies and observations at BPOM Pekanbaru City. The principle of justice in consumer legal protection has not been effectively implemented by Article 2 paragraph (2) of the UUPK. One of the factors is a lack of effective compensation. The government merely issues administrative and criminal sanctions without being obliged to compensate for damages or restore the health of the skin affected by products. Then, according to UUPK rules, the BPOM does not have the authority to supervise the execution of consumer protection (Article 30 (1) UUPK). As a result, the Pekanbaru City BPOM's supervisory function on this research issue is ineffective, leaving consumers with insufficient facilities and infrastructure, free legal aid, and quick access to settle consumer disputes with business actors.
