Abstract

The issue of apostasy, especially the annulment of marriage on the grounds of apostasy, is a highly intricate and contentious issue at the intersection of Islamic law and human rights. This article seeks to undertake a critical comparative analysis of the legal frameworks, jurisprudence, and practical applications surrounding this issue within Indonesia and Malaysia—two prominent Muslim-majority countries. Through in-depth insight into the relevant laws and court cases with scholarly literature reviews, this paper examines the different approaches taken by these countries and the deeply entrenched challenges in resolving the principles of Islamic legal doctrine with the main tenets of international human rights. This examination requires treading the line carefully, as religious traditions and individual freedoms clash. An inclusive and balanced dialogue can be done to further the protection of human rights and respect the rich tapestry of religious and cultural perspectives. Indeed, the proper application of Islamic law can be viewed as a fundamental human right since the freedom to practice one’s faith is part and parcel of the core tenets of international human rights standards. It is in a holistic approach—one that respects both Islamic legal principles and universal human rights—that apparent tensions can be resolved and fair treatment can be ensured for everyone. Moreover, the Islamic jurisprudents take the invalidation of marriage by way of apostasy as unanimous since it is a permissible action in case of a defect or some damage in the marriage. However, clear and specific regulations are urgently needed with a view to legal certainty and unity within the community.

Abstract

Article 7 of the 1945 Constitution of the Republic of Indonesia still has weaknesses. Its formulation can still be interpreted differently from the original intent , which emphasized the term limits of the president and vice president. The formulation of Article 7 of the 1945 Constitution of the Republic of Indonesia reads "The President and Vice President hold a term of office for five years, and can be re-elected to the same office, only for one term". In the future, so that it is not interpreted differently, the formulation of Article 7 of the 1945 Constitution of the Republic of Indonesia should read "The President and Vice President hold a term of office for five years, and can be re-elected for only one term".

Abstract

The complexity of social issues is growing in line with the growing modern technology these days, which is disproportionate to its interrupted regulation in the law concerned. Using a comparative and conceptual approach, this article seeks to discuss under what circumstances this fast-track legislation can be implemented and how fast-track legislation should be correctly and democratically implemented. The results show that, fast-track legislation must apply under certain circumstances and be selected, thereby not applying to all bills, and the law-making stages should not be reduced. Second, fast-track legislation must take into account democratic principles in the legislation, or it must comply with procedures, participation, public access, or transparency. Such particular circumstances require simplification of particular stages, while the essence of the democratically-formed legislation must remain.

Abstract

Kajian ini merupakan paparan dari hasil penelitian tentang kepercayaan masyarakat desa Padenganploso kecamatan Pucuk kabupaten Lamongan dengan istilah hamil Tumos yang berupa pantangan yang harus dijauhi suami ketika istri sedang hamil. Pantangan tersebut berupa tidak boleh memancing karena kalau dilanggar masyarakat percaya ketika lahir bibir anaknya akan tidak normal, tidak duduk di tengah pintu karena akan susah lahirannya dan tidak boleh menyampirkan handuk di leher karena masyarakat percaya nanti ketika lahir anaknya terlilit tali pusarnya. Penelitian ini bertujuan untuk membahas hal-hal yang berkaitan dengan bagaimana ‘Urf menjadi metode dan sumber hukum islam dalam kepercayaan masyarakat terhadap pantangan yang harus dijauhi ketika istri sedang hamil. Penelitian ini menggunakan metode penelitian empiris dengan menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa ‘Urf merupakan sesuatu yang dikenal dan sudah menjadi kebiasaan masyarakat, baik berupa ucapan ataupun perbuatan. Masyarakat menganal kepercayaan hamil Tumos sudah dari nenek moyang yang diturunkan secara turun temurun. Masyarakat menilai bahwa tradisi ini merupakan tradisi yang baik, dalam penelitian ini tidak ditemukan pertentangan dalam nash maupun al-hadits. Dari sini sudah dapat dikatakan bahwa kepercayaan masyarakat terhadap hamil Tumos bisa disebut dengan tradisi yang baik dan dalam metode yang digunakan telah masuk dalam konteks ‘Urf Sohih yaitu kebiasaan yang telah berlaku di masyarakat serta tidak bertentangan dengan dalil syara maupun Hadits.
